Release -- Waiver of Liability -- Indemnity Agreement For valid consideration, including permission to voluntarily participate in any event sponsored, promoted, or directed by the Mitsubishi Four Wheel Drive Club of North America and intending to be legally bound, the undersigned, for himself/herself, his/her personal representatives, heirs, assigns and next of kin: HEREBY RELEASES the Mitsubishi Four Wheel Drive Club of North America, its officers, members, trail guides, sponsors of the Mitsubishi Four Wheel Drive Club of North America, owners, lessors of premises used to conduct the events (hereinafter collectively referred to as "Releasees") of all liability for any harm or damage however caused, including any act or omission, directly or indirectly the result of any event. It is understood and accepted by each of the undersigned that there is inherent risk associated with this event, including but not limited to bodily injury, and vehicle damage, that is assumed by each participant. IN ADDITION, the undersigned, including personal representatives, heirs, assigns and next of kin, AGREES TO INDEMNIFY AND HOLD HARMLESS the Releasees from any loss, liability, damage or cost incurred directly or indirectly due to participation by the undersigned, whether caused by Releasees negligence or otherwise and AGREES TO ASSUME FULL RESPONSIBILITY and RISK for any personal injury, death, or property damage from Releasees negligence or otherwise while the undersigned is participating in thsi event. In signing this Release--Waiver of Liability--Indemnity Agreement, each of the undersigned hereby acknowledges and represents the following: 1. That he/she has read, understood and agrees to the foregoing Release and Waiver of Liability and Indemnity Agreement in its entirety, and has the opportunity to seek legal counsel. 2. That he/she shall at all times, while riding in a vehicle during any Mitsubishi Four Wheel Drive Club of North America event, wear his or her respective seat and shoulder belts. 3. That the owner/driver certifies that he/she has inspected their respective vehicles and the vehicle is in good mechanical condition. 4. That the owner/driver has fully informed himself/herself about the event and/or trail involved in the event, either by prior participation or by investigating into the event and trail. THE UNDERSIGNED HAS READ THE ENTIRE CONTENTS OF THIS RELEASE---WAIVER of LIABILITY---INDEMNITY AGREEMENT DOCUMENT AND UNDERSTANDS THAT EACH HAS RESTRICTED SIGNIFICANT LEGAL RIGHTS BY SIGNING IT, AND EACH SIGNATURE IS VOLUNTARY. ALL EVENT PARTICIPANTS MUST SIGN WAIVER. (For participants under the age of 18 years of age, a parent or the minor's legal guardian must sign this release form and write the word "minor" and age next to the minor's name. A parent or legal guardian must accompany any driver under the age of 18.)
