LAWSUITS AGAINST THE LAKEVILLE POLICE DEPARTMENT
This page contains all the details and papers concerning my legal actions against the Lakeville Police Department, Dakota County Drug Task Force, and the Dakota County Attorney’s Office. Some documents and details are censored or not yet included as the County Attorney’s Office has not seen them. Check back often as this page will be updated on a regular basis.

BACKGROUND
In the early morning hours of March 10, 2007 the Lakeville Police Department paid me a visit. It ended with my arrest and the following charges: Assault2, interfering with a 911 call, possession of chemicals with intention to manufacture methamphetamine, and child endangerment related to the so-called meth chemicals. NONE OF IT IS TRUE!!!
I HAVE PROOF
Fortunately for my wife and I we have substantial proof that none of this is true. We have already been to court and obtained a ruling that there was no intent to manufacture methamphetamine. This means that half of their charges are false right there! At that proceeding 2 Lakeville Pigs, and the idiot I mean Agent that conducted the drug investigation, Adam MacDonald testified against me. They also brought in an “expert” from the St. Paul Crime Lab that testified about the police photos of all my chemistry equipment.
AGENT ADAM MACDONALD
Agent MacDonald is with the Dakota County Drug Task Force. He was the agent that handled this case. In Court all MacDonald was able to prove is that he and the Dakota County Drug Task Force are completely incompetent and couldn’t tell a meth lab from an outhouse. Agent MacDonald indicated on the stand that his meth training consisted of two 4 hour seminars. My pool training took 16 hours! Of the 75 plus items that they took from my chemistry set MacDonald only knew what 4 or 5 of them were. He couldn’t even say if Lithium metal was a meth precursor. (Yes MacDonald it is and no I didn’t have any lithium.) I introduced a purchase list from my chemistry supplier that proved that the chemicals they took and the few that could be used to make meth dated between 7-10 years old & I had MacDonald read it to the Court. I also had MacDonald read the test results from Landmark Environmental and a letter from Dakota County Enviromental indicating “No meth detected.” The tests are sensitive down to less than one millionth of a gram and would of detected if meth was even used in the home but came up with nothing! Strange...a meth lab with no meth. Overall with my help MacDonald managed to make a complete fool of himself.

THE DRUG TASK FORCE FUCKED UP
The Dakota County Drug Task Force fucked up on this one bad. For one thing they obtained a warrant which was to take methamphetamine (none found); possible meth precursor chemicals (4 of 75+ items taken); and drug manufacturing equipment. They violated the warrant by taking the other 70 or so items which have nothing to do with meth whatsoever. MacDonald couldn’t identify what any of these chemicals and items were or what they are used for. I went through the list with the St. Paul Crime Lab criminologist who indicated to the Court that nearly every chemical on the list had no use in the manufacture of methamphetamine. As these things obviously had nothing to do with meth it was a violation of the terms of the warrant to take them. Of course no one bothered to question me or do any research whatsoever to determine if this very large chemistry set was used for something other than meth manufacture. In fact there was no investigation into any other possibility whatsoever and I can prove that too. I have a document from another Dakota County Government Office that can prove this. As the County Attorney doesn’t have this yet it’s not included here yet.
THEY ILLEGALLY OBTAINED THE WARRANT IN THE FIRST PLACE
What will really get them is how they obtained the warrant: illegally. This is nothing new for the Lakeville Police Department & the Dakota County Drug Task Force. At least two Lakeville pigs put in their reports that “chemicals commonly used to manufacture methamphetamines were in plain view on top of boxes within easy reach of children.” One Lakeville Pig who shall be referred to only as Sgt. A.B. (to protect his identity due to his unusually small penis size) even testified to this in court. I put a series of 21 photographs taken by the Lakeville Police Department in front of Sgt. A.B. who was unable to point out these “chemicals on top of boxes in plain view” in any of them. These photos were all the photos of the room in question “before” the meth search. The room was completely packed with stuff and was not accessible. No chemicals were visible at all. The Lakeville Police Department along with Adam MacDonald lied in order to obtain the meth warrant and we can easily prove it. Plus the Lakeville Photos which were timestamped show that they were digging in boxes for chemicals well before the signed warrant time. (My chemistry set was in storage in sealed boxes and buried in this storage room.)
THEIR MOTIVE
The motive for pushing this is really simple: MONEY. The Dakota County Drug Task Force is fully funded by seizures of goods from drug busts. They also receive state and Federal Funding based on need. The need is determined by the number of drug busts. There is a federal grant program for detection, seizure, & cleanup of methamphetamine labs that is based on the number found. Business has been slow for Dakota County and the funding for next year will reflect this. Meth lab seizures in Minnesota are down by 78% since a law was enacted placing pseudoephedrine products behind the pharmacy counter. MacDonald and the Drug Task Force have other possible motives too. More meth labs equals promotions, commendations, medals, ect. Plus it gives the impression to the community that they are “doing something” about the meth problem in Dakota County.
CURRENT LEGAL ACTIONS AGAINST THE DRUG TASK FORCE
We currently have two pending legal actions against the Drug Task Force. The first is for return of the firearms valued at around $4800. This will be heard either on July 13 or in August if the whiners at the County Attorney’s office get their delay. Given that I already have a court ruling that there was no intent to make meth along with overwhelming physical evidence they will loose this whenever it is heard.
The second action is a lawsuit against Adam MacDonald & the Drug Task Force seeking $6850 in actual damages. That’s $5500 for the chemistry set they illegally destroyed & $1350 for the testing of our home for the presence of meth. This lawsuit is currently scheduled for August 10. It is just the beginning. We will be going after substantial damages for defamation of character, liable, loss of home, job, emotional and mental suffering and several other things in a separate action to be filed in August.
When everything is said & done we will be helping every single person with a drug conviction in Dakota County get a new trial on the grounds that Dakota County Drug Task Force violates warrants and fabricates evidence. The County Attorney’s Office will be backed up for years with retrials due to this case. If you know someone who may have been wrongly accused please let us know.
UPDATE 07/20/2007
On July 13, 2007 there was a motion hearing in our judicial determination lawsuit against the Drug Task Force. Click here to view our motion and response to the County Attorney’s affidavit. They were successful in delaying the hearing until August 27th. This is a case they know they will loose, this delay is nothing but that. We have 66 exhibits and about an hour of testimony prepared that overwhelmingly proves that there was no meth lab or intent to manufacture meth.

DRUG TASK FORCE REPORT
Here is the Drug Task Force Report of Agent Adam MacDonald. There are several interesting things to note about this report: 1) It states that chemicals were in plain view on top of boxes. As mentioned before Sgt. A.B. was unable to identify in court any chemicals in plain view in any of the police evidence photos. They lied! Some of the photos of the storage room are below, can you point out the “chemicals in plain view on top of cardboard boxes?” 2) Most of the items in the report list have no use in meth manufacture or manufacture of any drug for that matter. A Saint Paul Crime Lab Criminologist testified to this FACT in Court. She also testified that most of these items listed as “precursors” are “as common as flour is in the kitchen” in a chem. Set or a laboratory and that she would be surprised if these items were not present. 3) Macdonald noted next to item 58 (Potassium Cyanide) that Benzyl Cyanide is a precursor. I had no benzyl cyanide. Relating benzyl cyanide to potassium cyanide is like relating methyl alcohol to methamphetamine because they both contain the word “meth” in them. MacDonald admitted on the stand that he didn’t even know what benzyl cyanide is or if there is any relation to benzyl cyanide. This is another attempt by the DTF to make things look how they want, not how they are. 4) Methamphetamine does not require 75+ items and chemicals from lab suppliers to manufacture. It can be done from common household items and a few solvents from the hardware store. No lab equipment/chemicals/know-how is necessary. The criminologist testified to this as well.
WHERE ARE THE CHEMICALS?
These are the LPD photos of the storage room where they described “chemicals in plain view, on top of cardboard boxes” and “accessible to children.” For one, the room was packed full of stuff, it was hard to get into. Plus in some of the photos you can see the door that they removed from the room. (And for the record our children were not allowed near this area of the home.)
Click on the thumbnails for larger images. These are the only 4 photos taken by the LPD of the room where my chemistry set was stored. Sgt. A.B. was not able to identify any chemicals in photos of the rest of the home either.
THE WARRANT
Here is a copy of the search warrant. It clearly spells out that only items used in methamphetamine manufacture & general drug manufacture were to be taken. Because of the fact that 90%+ of items taken had no use in manufacture of anything they violated the warrant. And they destroyed everything they took without hearing or Court Order. They also lied to get the warrant. The warrant application/affidavit states how officers observed the chemicals in plain view in the room above. It’s very obvious that these statements by the LPD & the DTF are false. If they lied about this, it isn’t hard to believe that they lied about many more things related to March 10, 2007.
Many more items and exhibits will be posted sometime in late July/early August. I cannot post/discuss certain items until after they have been entered in Court. Stay Tuned….
