BYE-LAWS FOR THE CONDUCT OF EXAMINATION
FOR AND GRANT OF SIRDAR’S CERTIFICATE OF COMPETENCY
1.
Type of
practical experience: - (1) The
practical experience and training of a candidate for the grant of Sirdar’s Certificate shall include experience
of the types mentioned in column 1 of the following table for periods not less
than these specified in columns 2, 3 & 4 of the tables.

Note 1. Experience as a miner or timberman in
depillaring area can be accepted towards the aforesaid requirements relating to
training in both timbering and depillaring.
Note 2. Experience as shotfirer in depillaring area is accepted towards depillaring training.
Note 3. Experience as shotfirer in depillaring area
or in such development workings where timbering is essential shall be accepted
towards training in timbering.
(2) Experience/training in Surveying/Engineering or
as a Munsi may be accepted against the remaining period of practical
experience/training for periods not exceeding the following:-
(a)
In case of persons
holding approved qualifications of degree level in mining: 4 months.
(b)
In case of periods
holding approved qualifications of diploma level in mining: 8 months.
(c)
In other cases: 12
months.
(3) Only such practical experience in opencast mines
would be approved as has been obtained in mines having an average monthly
output of not less than 600 tones of coal.
(4) Practical experience extending over a period of
less than three months in case of workers and four weeks in case of officials
and mining apprentices at a time shall not be approved.
(5) Every certificate of practical experience should
contain precise information about the capacity in which the candidate worked,
the nature of work done, and the dates of commencement and termination of
experience at each mine. No certificate of practical experience shall be
considered unless it is granted by the manager of the mine and bears the
official seal of the manager.

Application to be supported by documents: - No application shall be considered unless it is
supported it is supported by original Certificates as to qualifications (i.e.
Mate’s Certificate, Valid Gas-testing Certificate, Valid First Aid Certificate,
Degree or Diploma in Mining approved by the Board in this behalf) and as to
literacy, sound health character and evidence showing that the prescribed fee
has been paid.

Holding of Examination: - Examination shall be held at such times and such
places as may be fixed by the Board
and notified to the candidates. The examination fees of a candidate who fails
to appear for an examination at the appointed place and time without sufficient
cause to the satisfaction of the Chief Inspector shall be forfeited.
4.
Appointment of Examiners: - (1) So far as practicable the examiners appointed
by the Board for each examination shall be two agents or managers holding the
First Class Manager's Certificate and an Inspector of Mines who shall also act
as the Local Secretary for the examination.
(2) Except in an emergency no member of the Board shall act as an examiner.
5.
Type of Examination: - (1) The examination shall be conducted orally in
Hindi or in the language of the district in which the examination is held.
(2) Candidates shall be examined in the following
subjects: -
(i)
Methods of examining
roof and sides of working places and roadways etc.
(ii)
Methods of timbering
and setting support, withdrawal of supports.
(iii)
Shotfiring and
transport and use of explosives in mines;
(iv)
Ventilation and mine
gases – elementary;
(v)
Provisions of the Coal
Mines Regulations, 1957, Rules and Byelaws made under the Mines Act, 1952,
relating to the safety of persons employed in mines in general and to the
duties of Sirdars and Shotfirers in particular.
6.
Conduct of the Examination: - Every candidate shall conduct himself as required
by the Secretary of the examination.
7.
Identity and conduct of candidates: - (1) At the time of examination every candidate
shall hand over the authorisa5tion issued to him for appearing in the
examination and two unmounted photographs of himself (of a size approximately 5
cm x 6.5 cm) to the Secretary for the examination who after satisfying himself
that each photograph is a likeness of the candidate shall endorse each of them
on the back with the name of the candidate.
8.
Successful Candidates: - (1) In order to pass in the examination a candidate
shall have to secure at least 40% marks with each examiner and at least 50%
marks in aggregate.
(2) The Secretary of examination shall record the
left-hand thumb impression of every successful candidate.
9.
Unsuccessful Candidates: - A candidate who has failed in an examination for a
Sirdar’s Certificate shall not be eligible for re-examination for a period of
three months from the date of the examination when he failed.
10.
Re-examination of person whose certificate were
cancelled: - Any person whose
certificate has been cancelled by the Board under Regulations 28(3) of the Coal
Mines Regulations, 1957, may subject to the approval of the Board, appear in
the examination again, but not before the expiry of three years from the date
of the order of cancellation.
11.
Penalty for misconduct: - (1) Any candidate who submits a false certificate
or counterfeits a certificate or makes a false declaration or adopts unfair
means during the examination, may be disqualified by the Board and also
debarred from appearing at any subsequent examination for a specified period
not exceeding three years depending upon the facts of the case.
(2) If a candidate who has been declared successful
in any examination for the grant of a certificate, is found to have submitted a
false certificate or to have counterfeited a certificate or to have made a
false declaration, the Board may cancel his result or withdraw the certificate
issued to him, as the case may be.
