I don't know if I should post
this or not ive been debating about it I don't want to upset
anyone but in return I need to get it out of my system. it
is sad and scary and horrifying all at once. our dear sweet
family member was murdered yesterday by a rot/pit-bull dog.
the dam dog broke thru our privacy fence actually broke the
fence board just to get in to eat/our dog. our dear dog is a
pure breed
Chihuahua.
and her name is JO JO. our poor dog never had a fighting
chance and to make matters worse our daughter Ashley found
the dam dog in the act of killing our family member. we all
went rushing out side (me and Danny) to see why Ashley was
screaming "Jo Jo's dead Jo Jo's dead" I went running out
side I saw the neighbors dog eating my dogs stomach and I
chased the bitch away. i went running thru my house and went
outside to see my DH talking to the neighbors both male and
female, well they were both yelling and i started yelling
for them to go and see what there fucking dog has done to
our dog. both refused to go and see, about that time Bobby
my brother came around from back with his AK47 in and with a
clip screaming "where the fuck is that fucking dog im going
to kill it" the male neighbor took off running into his
house to hide while my DH went to call the cops. Bobby saw
and was told that the dog is put up and he went back in with
the gun and put it away. well the neighbor lady was asking
if we were crazy for having a gun in the house as we have
kids in the house, well not much she knows but my kids are
raised around guns for a good reason a child never allowed
to touch a gun will play with it out of curiosity rather
than a child who knows what a gun can do. I told them to go
in our back yard and look at what there dog has done but
they refused (the cowards) after i went back in I comforted
Ashley again and went out to see what was going on out back
as i heard yelling i go out back to find the male neighbor
yelling at Danny and Bobby that he wants to kick there ass
and bring it on (hello this is not the city or the 90s were
in the 2000s) I start yelling at the guy and told him to
fucking at his age and do you have no compassion for what
your animal did? how much of a low life are you?' he then
takes his coat off and throws it on the ground and says to
Danny to 'bring it on I'll kick your ass' so I told him to
grow the fuck up and act older' he just kept looking at
Danny though I know Danny said stuff to him but for the life of
me I cant remember what it was. I went in our house and
grabbed my digital camera and took pictures of Jo Jo and then went
and got my camcorder and took video of everything. when the
cops got there, We told them what happened and bobby told
them he was going to kill the dog but since the threat was
over he put his gun away and the cop told him go for it.
when told about shooting the dog. the cops took pictures of
there own of our dog and our fence and then went to talk to
the neighbors who by then were out back again with there
landlord. we buried our dear dog yesterday under her
favorite
tree. and everyone said there goodbye's, it was too long of a
horrible day.
**UPDATE**
I talked to the the Land
owner for on next door, I found out that they (Tina and
Omar) were not even allowed to have that big of a dog.
The landlord also said she is kicking them out and they
are leaving on there own free will so it is a mutual
move on those party's part, the landlord said they will
fix our fence as at first she thought it was her fence
but I showed her our property lines were. also the dog
is locked in there garage barking and yelping for help.
the whole time I was out back talking to the landlord
for next door. I got my papers for filling small claims
and hopefully will get to file it on wed or Thursday as
that is when the police report will be done and then I
hope to have there last names. I DO know there place of
employment so if need be I can have them served at their
work!! I don't know if I should call the pound as the
fucking dog is locked in the garage but I am not looking
in to see if it is ok for as long as I care it can die
but I don't know. The landlady was real nice she said she
will fix our fence as I showed her the property line
survey that I got a copy of today. I personally do not
believe she should pay as I believe her tenets should pay
since it is there dog.
I will add that the house
next door now has a for sale sign up. interesting.
I got my papers filled
out for small claims court. all except there names as I
must wait for the police report to get finished in order
to obtain the peoples names. im asking for the full
amount and even if I loose the case totally then they
will know we mean business. you cant hurt our family. I
do not like the way the Laws are written in Kansas as
apparently it is NOT illegal to own a vicious animal, but
if you own one you are only allowed 1 report of an
attack of a person or property which is totally
Bull Shit. I'm going to call the pound again today and
bug them to see if they are going to do anything and to
report that they are now moving out from next door. I
want the pound and the police on top of this issue.
(3/9/04 8:30pm)A police
officer came to my house this afternoon looking for Omar
(the male neighbor) as he apparently has a warrant for
his arrest (LOL :) LOL) and if i would please kindly
give the officer a phone call when he returns home
tonight :) so doing my civil duty i just got off the
phone with the answering machine for the officers voice
mail.
I also this afternoon
went to the court house and filed for small claims court
and im asking the full .00, when you break it down with
repair to my fence and replacement of an 'AKC Registered
Tea Cup
Chihuahua' and to have ours cremated as that we
still might do. and with pain and suffering for our Jo
Jo is well over bucks. I set it up for the Sheriff to
serve them both at work (lol ha ha ha), it cost me bucks
to file but I am not after money im after teaching these
people you can't have a vicious dog and let it get away.
I keep thing back to a
little over a week ago to where that dog and another dog
was loose and was barking at Ashley and Jared in our
drive way, we did not call the cops as the neighbor guy
(Omar) put both dogs in his yard but now i think we
should have turned them in but since there was no harm
done to our kids at the time we felt ok with the
decision but now I know we were wrong, we should have
reported it.
3/14/2004 I just wanted
to update a little as I got a letter in the mail
yesterday saying if I want to press charges I must
contact the police dept to sign a paper as it seems they
cant do so with out this signed (sarcasm) I mean after
all it was just a vicious attack on a defenseless animal
who DIED as a result. oh and the owner of the property
next door came over yesterday while it rained and
"FIXED" our fence you got to see pic of this it is so
rigged and pathetic you would not believe we are calling
a fence company tomorrow as the dam thing is going to
fall over due to very poor workman ship. its scary oh
and the dam dog is loose again next door at least in the
yard..

Hi everyone, you are
not going to believe this but you know how our little
dog was killed by the neighbors dog who broke our
fence just to do the deed, I have since gone and set
up for small claims court to sue them for the max
amount, here in my little town. I have taken video
and pictures and I have gotten receipts and papers out
the wing wang to go to court with (im going for an
over kill to prove my side) well today I get a
letter from the producers of none other than JUDGE
JUDY wanting us to go on there show and sue the
neighbors on there show. I swear on a ton of bibles
I never called the show I think our neighbor did.
the show says if we win we are guaranteed to get our
money and all expenses paid to L.A. for the show. I
don't know about this. I cant get a hold of Danny yet
to tell him but I don't want to go on TV and show
what there dog did to my dog. what would you do?

I found out that is
was not our neighbors like I first thought, I called
our court house to ask about if small claims was
public records and to see if the neighbors have been
served by the Sheriff, well come to find out no they
had not been served yet so they could not even know
about the law suit yet and YES since the small
claims is public records and that Judge Judy and Judge Brown
people come to the court house and look over the
claims and pick and choose what they want and that's
how we got picked, they lady at the court house was
not even surprised at my questing her on the subject.
Danny my dh is like me were not sure what to do, MIL
says we should go and let her know what the Air date
would be, lol. If we go I will let everyone know
what we are doing and the outcome and all, LOL. I
think its funny in a way but I have my concerns,
Ashley would have to go no matter which court we
went to and testify, same with me and dh and my
brother, along with the neighbors, who I DO NOT want
to reward with a trip or money! I don't want the
pictures of Jo Jo on TV they are VERY gruesome, I have
pictures of what they did to my fence, what the dog did
to my fence, and how they tried to fix it only to
have it come apart (they rigged it) and then we tore
it ALL the way down, we got the estimate to get it
fixed and what there part would be for replacement (
I
tell you ive been thinking), ive got video, of the
scene and the cops and what they did to the fence by
tearing it down
~as with the neighbors, either her BF (ie.. defendant
#1) left her or is in jail again or she kicked him
out. he has not been around since Sunday night when
the dog was loose again and the cops came and caught
it and removed it to the pound. she (defendant #2)
was Pi$ and cussing at the cops and saying how the
dog was not hers and the cop told her you live with
the dog ITS YOURS!!, well #1 left and we have not
seen him around or at his work site. and to top it
off no sheriff has not served them :( !!!!
Now me just wondering here if she got her letter
from Judge Judy in the mail does that mean she's
been served cause when filling out the papers for
small claims the lady told me I can even serve them
it don't matter who does the serving as long as they
are told about court, so if she gets her letter
from Judge Judy does that mean she's been served?
Whoo im winded lol, anyway. that is it for now, (I
think lol) I will update more later
