Dear Sir:

     My name is Michael Lynn Mincy. I am 41 years old, and live at 5425 Mallory Drive, 
Fort Worth (Haltom City). I have lived here all my life.  I have never been arrested 
for any crime in my life.  I graduated from Haltom High School in June 1972, attended 
UTA from September 1972 intermittently untill October 1983. I also attended TCJC intermittently 
from January 1977 to December 1985, when I received my AA degree. I worked at various jobs 
during this time.  I have suffered from minor to severe health problems from October 
1986 to the present, but I seem to be in mostly good health at this time. But at the present 
I am still unemployed.  The purpose of this is to provide you with a summary of a series of 
events as I recalled them, and which were caused by persons employed by several retail stores 
and several local Police Departments. These events I believe were illegal and may justify my 
being able to bring one or more lawsuits against one or more individuals, and the retail stores 
and Police Departments that employ them.  Below are the most important events in which 
I believe  are examples of illegal conduct on their part. These are listed in time order, from 
the present backwards in time, and by where they occured. They are:

1.     At about 11:20 pm on Friday, July 28, 1995, I entered the Winn-Dixie Food Store in 
Haltom City to buy a can of "Coca-Cola" softdrink. After standing in one place in the store 
for a few moments just before I started to leave, my niece Amanda Gail Mincy (12 yrs old) and 
he friend Dana (15 yrs old) approached me and began a conversation with me. All three of us 
continued talking to each other from about 11:30pm to 11:45pm (estimated time), and after about
15 minutes, I said goodbye to them and left the store. After a few moments of driving around 
the area where I live, I went home. nothing unusual had happened to me at the Winn-Dixie Store, 
or while I was driving around.  On sunday July 30, 1995, my brother Randal Mincy (Amanda's 
father) came to visit my parents house, where I also live, in Haltom City. Just before leaving, 
my brother  asked Amanda to tell me what happened at the Winn-Dixie store on the previous Friday 
after I left.  As I understood from what she told me, the following happened. Immediately 
after I left the Winn-Dixie store, some of the store's personell (incuding some managers) 
ran  over to my niece and her friend and demanded to know what we had been talking about, who I 
was, who I was in relation to them, what and how much information did they know about me. They 
told them I was Amanda's niece, but appearantly they didn't believe them.

2.     Very shortly after this (I don't know exactly how long), a Haltom City Policewoman arrived
 and also detained them. She interrogated them about me also, and demanded to know what they knew
 about me, then told them something vague about how they knew I was always driving up and down
streets, and warned them to stay away from me. After some time of this type of questioning, this 
female officer let them go, and they both returned to Amanda's home. She lives at 4108 Doeline, 
in Haltom City. Her phone number is     To my personal knowledge, and from what I was told by 
my niece, no charges were brought against my niece or her friend, and I certainly was not charged
 with anything, or even aware of any of this untill Sunday afternoon of July 30, 1995.     

On Monday, July 31, 1995, at the suggestion of Brenda from your office, I called the Internal 
Affairs Office of the Haltom City Police Department, which consisted of Sgt. Hanson. Sgt. Hanson 
was not there at first, but later in the day called me back, and after I explained twice about
what had happened, and that I was calling to make a complaint, he told me that no, that was not 
a complaint, but that I was only telling him what happened. At that point I told him I WAS making
 a complaint. In any case, he told me he would have the Patrol Officer call me last night 
(Wednesday, August 2, 1995), but she never did.

3.     I was at North Hills Mall in North Richland Hills at about       on Sunday November, 1994. I had just finished eating a hamburger, 
and was about to leave the food court area. Then for the Second time that year, I was detained 
first by a short, white, very young high school age male employee of the Gadzooks novelty store 
and soonafterwards  detained by the North Hills Mall security guards. the empolyee from Gadzooks
 told me to leave the Mall immediately. I told him I was NOT leaving the Mall, and that if he 
didn't leave me alone, I would have him arrested. To this he said "Go ahead...I've already called
 the Mall security....", to which I replied "That's good!" When they arived, I let him tell them 
his story without interruption. He claimed to be acting on behalf of the female store's assistant 
manager (named Johanna), and that she was terrified to come out of the store into the mall because 
I was there.  After he finished, I explained to ALL of the Mall Security members present, 
that first, an attorney had told me that they had NO authority to detain me. And secondly I had 
done NOTHING to no one. I was simply eating a hamburger there in the food court area of North 
Hills Mall, and NOT bothering anyone, and I certainly was NOT doing anything to the assistant 
manager of Gadzooks. I was not anywhere near her at the time, especially since I was about thirty 
feet outside and away from the store, and it was impossible for me to do anythng to her. and not 
even so much as looking in her direction. I couldn't see her at all from the direction I was 
looking at the time.  After I finished talking, a Mr. Brown (security guard) told the ohter 
security guards something (Icouldn't hear what he said), but then he told them something like 
"just forget it", and that was the end of of that incident, so I thought.

      For the most part, that was the end of the incident on  November   , 1994. but for about 
45 minutes before it all began, I had been talking to a long time friend of mine I've known since
 the first grade, Mr. Mark Williams ( of Arlington). After the end of the above incident, I again
 had a conversation with Mr. Williams, about what had happened. As I stood there in the Mall 
talk ing to him, I had my back to the Gadzooks store, and Mark was facing toward the store, as we
continued to talk. He told me not to turn around, because he was watching what he said was a 
constant stream of security guards going in and out of the Gadzooks store. He said the female 
assistant manager and the Mall security were constantly talking to each other and  looking and 
pointing to me while my back was turned to them. But they did nothing to me the rest of that day,
 and they have not done anything to me since that day.  However, I later wrote and mailed a 
letter to the Gadzook's main office in Dallas, and mailed copies to their store at North Hills 
Mall, and to the North Hills Mall office as well. In this letter I recalled the events that had 
taken place as best as I could recall them. I also told them that what happened was a "gross 
violation of my civil rights" and that if it ever happened again, I would take immediate legal 
action against them. Since I mailed those letters, there have been no further incidences of this 
kind. 


4.     At about 4:  pm, Sunday March 27, 1994, I was standing alone, facing a wall lined 
with T shirts at the Gadzooks novelty store at North Hills Mall in North Richland Hills. there 
was NOBODY within 10 to 20 feet of me at that time. As I stood there, I began hear a girl 
screaming to my right. As I turned my head to look at her, I could see her starring at me and 
screaming. her name is Johanna and the assistant manager of that store. Standing to her right 
was a Mr. Brown, of the North Hills Mall security. She semed to me to be completely hesterical, 
and at first I could not understand what she said. But after a while I was able to understand 
most of what she said. Part of what she said was, "...I don't like the way you look at me or 
'my girls', and that's 'sexual harrasment' !" And she said I had to leave the store. I tried to 
reason with her, but she continued to act hysterically. So at that point, I looked at Mr. Brown 
and I said, "Do You see any 'sexual harassement' ?", to which he replied, "No. But if you don't 
leave, she'll just call the police anyway."  So, even though I was NOT harrassing her in any way,
I agreed to leave, and I did so.  A few minutes later I was detained by Mr. Brown as 
I was walking away from the store, but still in the mall. He said, "Could I please have your name
and address to 'cover' myself ?" I was still very much upset and angry at the same time, and I 
saw no reason then not to give him that informa tion. But the next day, Monday March 28, 1994, 
when I told Mr. Kenneth Hale (now the city judge of Haltom City), I was told that I had made a 
mistake in doing what I did in Mr Brown's request for personal information. Mr. hale told me that
 security guards have no authority to detain anyone, and that only a real police officer can 
request the information that Mr. Brown had requested of me. But I had already given that 
information to Mr. brown, though in hindsight I can see it was a mistake.

I should mention that at NO time was the North Richland Hills Police present. they had never 
been called , to my knowledge, and I certainly was NOT arrested and NO charges were ever brought 
against me. Judge Hale also told me, that since I was NOT arrested, that it was a good sign. 
He also told me it sounded to him, that since I was NOT arrested, she (Johanna), and I assumed 
the Gadzooks store and possibly North Hills Mall, were guilty of "criminal slander" and "libel".

After I had given the personal information the Mr. Brown, I stayed in the the mall, just 
walking around, trying to get my composure back, as I was still in a state of shock over the 
whole matter. Then after a short while, about     pm, I left North Hills Mall, and returned home,
 still pretty much confused about all that had taken place.
