WITNESS STATEMENT

PART TWO


I,_________________________________,  do hereby voluntarily and of my own free will, make the following statement without having been subjected to any coercion, unlawful influence, or unlawful inducement.

Statement -  September 9, 1998 
   Michael Lynn Mincy  


I was at North Hills Mall, North Richland Hills, Texas, on Sunday, about 4:20pm, November  20, 1994. 
I had just finished eating a Hamburger , and was about to leave the food court area. Then for the second
time that year, I was detained first by a short, white, young male employee from the GADZOOKS clothing 
store, some thirty or more feet away from me, and totally enclosed by glass, as it occupies a partitioned
office space in the mall. After leaving the confines of this store, I was told by this young male employee of GADZOOKS, that I "had to leave the mall immediately!" I told him that I was "not" leaving the mall, and if he didn't leave me alone, I would have him arrested. To this he said, "Go ahead! I've already
called the 'mall security'!" To which I replied, "That's good!" When the mall security did arrive, I let
this young male tell his "story" to them un-interrupted. He claimed that he was "acting" on behalf of the 
female Assistant Manger ( Johanna ROACHELLE) of the store where he worked, and that she was 
"terrified"  to come out of the store into the mall because I was there.  

After he finished, I explained to "all" of the "security personell" there, that they had "no" authority to detain me. And secondly, I had done "nothing" to anyone.  I was simply eating a hamburger there in the 
food court area of North Hills Mall, "not" bothering" anyone, and I was certainly "not" doing anything to 
the assistant manager (Johanna ROACHELLE) og the GADZOOKS store. Especially since I was about
thirty feet away from her, and  "outside" of the store where she worked, so that it was "impossible" for me
to do anything to her, not even so much as looking in "her direction". I cound't even see her at all from
the place I was seated at, at the time I was there in the food court area. 

After I finished talking, Mr. Willy Brown, then head of the North Hills Mall security, told the several
guards there something like, "just forget it!", but they were speaking to each other in so low a voice, it 
was difficult to hear any more than that .

For 45 minutes "before" all the "above" began, I had talking to a friend of mine from the "first grade"

through "high school", Mr. Mark WILLIAMS, then living in Arlington, Texas.  After the "end" of the "above" incident, I again had a conversation with him about the incident. And as I stood there in the mall
talking to him, I had my back to the store where this Johanna worked, and Mark WILLIAMS was facing
towards the store as we talked. Mark told me "not" to turn around, because he was watching what he said was a "constant stream" of security guards going in and out of the GADZOOKS store. He said the female
assistant manager (Johanna ROACHELLE) and the "mall security" were constantly  "talking to each other", and  "looking" and "pointing" to me while my back was turned to them. But they did "nothing"
to me the rest of the time I was there in the mall that day.

I later wrote and mailed a letter to the GADZOOKS main office in Dallas, and mailed copies to their store 
at North Hills Mall, where the incident occured, and a copy went to the North Hills Mall office as well.
In that letter, I recalled this incident to them, and I told them that what they had done was a "gross violation of my civil rights", and that "if" it ever happened "again", I would "take whatever immediate
legal action was necessary" against them. There were no further incidences of this kind from them.

But, on November 17, 1997, Jennifer CASEY, working at another North Hills Mall store, CONTEMPO
CASUALS,  began her "accustions" against me. This is the "same" Jennifer CASEY,  who  I had told all
about  the "first" incident (March 27, 1994) with the "above" Johanna ROAHELLE, and when I asked Jennifer "do you think I was acting in a 'harassing' way to you ?", Jennifer CASEY said "No! " And when I asked her what "she" (Jennifer CASEY) thought about the "above" incident, she said, "...she must be 'crazy'!", reffering to  Johanna ROACHELLE.
