WITNESS STATEMENT

PART TWO


I,_________________________________,  do hereby voluntarily and of my own free will, make the following statement without having been subjected to any coercion, unlawful influence, or unlawful inducement.

Statement -  September 9, 1998

At about 4:00pm, Sunday, March 27, 1994, I was standing alone, facing a wall lined with "T-shirts"
at the GADZOOKS clothing storeat North Hills Mall, in North Richland Hills, Texas. There was
nobody within 10 to 20 feet of me at that time. And as I stood there, I began to hear a girl "screaming" at me, to my right, some 20 feet or so. As I turned my head to look at her, I could see Johanna ROACHELLE, the assistant manager at that time, of that GADZOOKS store. Standing to her right was Willy BROWN, of the North Hills Mall security. She seemed to me to be completely hysterical, and at first I could "not" understand anything she was saying to me. After a while, I heard her say, "....I don't like the way you 'look ' at 'me' or  'my' girls, and that's 'sexual harassment'!" The "girls" she was refering to, were her "female" employees, who  actually "begged" me to "come into" this "same" store only several days before. She then told me I had to leave the store. I tried to reason with her, but she continued her "hysterical" behavoir. So, at that point, I turned to Mr. BROWN, and I asked him, "Do you see any 'sexual harassment' ?" To which he said, "No! But, if you don't, she'll just call the police anyway." So, even though I was "not" harassing "anyone", I agreed to leave, and I did so. 

A few minutes later, I was detained by Mr. Willy BROWN as I was walking around the mall, but away from the GADZOOKS store. Willy BROWN asked , "Could I please have your name and address to 'cover' myself ?"  I was still at that time very upset and angry by the "above" incident, and at that time, I
saw "no" reason "not" to give him that infornation. But the next day, Monday March 28, 1994, I told about these events to Mr. Kenneth HALE, then a private attorney. Mr. HALE is now the municipal judge of Haltom City, Texas.  But as a private attorney, Judge HALE told me that "security" personell have "no"
authority (as I understand now) to request such "personal" information, and as far as he could tell from our phone conversation, that was the only "mistake" I made. I must say here now, that at "no" time was the North Richland Hills police present, and they had "not" been called as far as I know, and I was certainly "not" arrested, and "no" charges were ever brought against me. Judge HALE also told me, that

since I was "not" arrested, that it was a "good sign". He told me it sounded to him, that since I was "not"
arrested,  she (Johanna ROACHELLE) was guilty of "criminal slander", and "libel".

Also, before I left the mall that day (March 27, 1994), I called Jennifer CASEY from a "pay" phone
there at North Hills Mall. At the time, she was working at the FRULLATTI  cafe, also in North 
Hills Mall. When she came to the phone, I asked if she would mind calling "me" at home, when "she" 
got to her home later that day. She did call, and in the phone conversation, I asked Jennifer CASEY
about the "above" Johanna ROACHELLE, and when I asked Jennifer "do you think I was acting 
in a 'harassing' way to you ?", meaning "her", Jennifer CASEY,  Jennifer CASEY said "No! " 
And when I asked her what "she" (Jennifer CASEY) thought about the "above" incident, she said, 
"...she must be 'crazy'!", reffering to  Johanna ROACHELLE.
