Thank you for taking the time to contact the Brazilian Tourism
Office in Washington, D.C. to express your concern for the oxen of
Santa Catarina,
Brazil. In hopes
of clarifying the situation, and defining the current legal framework and
actions underway to terminate this inhumane practice, we will explain below the
official statements from the Office of Public Security and Citizens Defense in
Santa Catarina.
In
1999, the Brazilian equivalent to the Supreme Court made it illegal all forms
and practices of the 100 year tradition “Farra do Boi” by law 153.531-8/SC; RT
753/101. Since then, any person who demonstrates noncompliance with this law is
immediately imprisoned and prosecuted accordingly, suffering up to one year
imprisonment.
Furthermore, the State has organized educational programs in local
schools, health centers, and community centers to raise awareness of the health
threats caused by “Farra do Boi” for both the animals and the people involved,
as well as the fundamental cruel and immoral nature of this outdated practice.
Although it is believed that education is the ideal option for putting a
permanent end to this problem, the impact of this process will not be felt
overnight. This year, as in the past five years, police will be randomly
searching communities, vehicles and people in the state of Santa Catarina in
search of animals or evidence of involvement with this illegal event in an
effort to demonstrate to the public that this is a law to be taken seriously.
The Brazilian Tourism Office does not support this practice in any
way, however, we do ask that you understand that rumors regarding this practice
have been largely exaggerated. Despite the knowledge that in the past, cruel and
inhumane treatment of animals was conducted in this country, please recognize
the difference between legal and illegal. The proper authorities have addressed
this issue, and will continue to do their best to target all offenders until
they reach a resolution.
We
hope that you will grant yourself the pleasure of traveling to this incredible

No
contexto das ações que envolvem a denominada "farra do boi", o Ministério
Público estadual jamais deixou - e jamais deixará - de, pedagogicamente, e nos
limites de suas atribuições legais, implementar as ações aptas ao equacionamento
racional da questão.
Seu
compromisso com a causa da proteção aos animais e preservação da Natureza
remonta ao início dos anos 80. Foi aqui na cidade de Florianópolis que, em 1º de
outubro de 1982, estimulado pelas iniciativas pioneioras do Ministério Público
catarinense, o Conselho Nacional dos Procuradores-Gerais de Justiça, órgão
máximo de representação das administrações dos Ministérios Públicos de todo o
país, editou a Recomendação n. 1/82, propugnando pela implantação, em todo os
Estados da Federação, de "organismos destinados a proteger, em especial, o meio
ambiente, o consumidor e as pessoas direta ou indiretamente atingidas pelo
crime".
Da mesma maneira, quando da
propositura da ação civil pública que culminou com a proibição da "farra do
boi", chancelada pelo Supremo Tribunal Federal, o Ministério Público sempre
caminhou ao lado das entidades ambientalistas que patrocinaram aquela
medida.
De qualquer modo, ainda que tenha
se empenhado sistematicamente no equacionamento da questão, buscando inclusive
persuadir e envolver outros órgãos, autoridades e instituições, seria pouco
sensato que o Ministério Público assumisse, isoladamente, a responsabilidade
pela prevenção, repressão e investigação dos atos e fatos relacionados com a
censurável manifestação popular. E isto por uma elementar razão: a Polícia
Militar e a Polícia Civil, indiscutivelmente essenciais ao êxito de qualquer
iniciativa com aquele escopo, são supordinadas ao chefe do Poder Executivo
estadual, e não ao Ministério Público.
Também a ele se subordinam os
órgãos responsáveis pela definição das políticas de educação, área onde -
supomos - a questão deveria ser pedagogicamente tratada, com vistas à construção
de freios culturais espontâneos capazes de inibir os impulsos tentendes à
continuidade da manifestação em comento.
Seja
como for, em respeito ao comando da lei e fiel à sua própria proposta
político-institucional, o Ministério Público perseverará na busca da harmonia e
da paz, fins últimos das própria
justiça.

TRADUCIDA DEL INGLES DE LA OFICINA DE TURISMO:
Gracias por tomarse el tiempo de
contactar a la Oficina Brasileña de Turismo en Washington D.C. para expresar su
preocupación por los bueyes en Santa Catarina, Brazil. Con la esperanza de
clarificar la situación, y definiendo el marco legal actual y las acciones en
marcha para terminar esta inhumana práctica, explicaremos a continuación las
declaraciones oficiales de la Oficina de Seguridad Pública y Defensa
Ciudadana en Santa Catarina.
En 1999, el equivalente a la Suprema
Corte en Brazil, hizo ilegales todas las formas y prácticas de la tradición de
100 años "Farra do Boi" por la ley 153.531-8/SC; RT 753/101. Desde entonces,
cualquier persona que demuestre incumplimiento de ésta, será inmediatamente
aprisionado y procesado, cumpliendo con 1 año de
encarcelamiento.
Además, el Estado ha organizado
programas educativos en las escuelas locales, centros de salud y centros de
comunidad para aumentar la conciencia de las amenazas a la salud causadas por
"Farra do Boi" por los animales y personas involucrados, así como la
fundamentalmente cruel e inmoral naturaleza de esta anticuada
práctica.
Aunque creemos que la educación es
la opción ideal para terminar permanentemente con este problema, el impacto de
este proceso no será de la noche a la mañana. Este año, al igual que los pasados
5 años, la policiía estará rondeando buscando comunidades, vehículos y gente en
el estado de Santa Catarina en busca de animales o evidencias de
participación con este evento ilegal en un esfuerzo para demostrar al público ,
que ésta es una ley para ser tomada seriamente.
La Oficina Brasileña de Turismo no
apoya esta práctica en ningun modo, sin embargo, le pedimos que entienda que los
rumores en cuanto a esta práctica han sido enormemente exageradas. A pesar
de el conocimiento de que en el pasado, el trato cruel e inhumano de los
animales era practicado en este país, porfavor reconozca la diferencia entre
legal e ilegal. Las autoridades apropiadas han tomado cartas en el asunto, y
continuarán haciendo su mejor esfuerzo para atrapar a todos los delincuentes
hasta que alcancen una solución.
Esperamos que encuentre el placer de
viajar a este increíble y diverso país. Si tiene alguna pregunta referente al

Thanks for your concern.
The Government of Santa Catarina has been supporting the
Farra do Boi, which is getting worse every year. This year the Governor of Santa
Catarina himself even stated on TV that the policemen "will watch the Farras to
prevent any excesses ". He is being prosecuted by local animal
protection NGOS, WSPA member societies.
I would very much like to know about
these "educational programs in local schools, health centers, and community
centers to raise awareness of the health threats caused by “Farra do Boi” .."
mentioned by the Brazilian Tourism Office as to my knowledge there has been
none!
A few weeks ago one of the Directors the Secretary of
Tourism of Santa Catarina , Mr. Valdir Walendowsky, stated to the media that
Farra do boi is part of tourism attractions of Santa Catarina!
As to this unbelievable statement: ..." rumors
regarding this practice have been largely exaggerated..". I can only suppose the
staff of this Brazilian Tourism Office in Washington has had no chance of
reading any newspapers, listened to radio or watched TV from Brazil for a long
time, or at least during the months of February to May when the Farras are
reported in all the Brazilian media, but of course especially in Santa
Catarina. I recommend them to buy a Brazilian media clipping and they would
be rather schoked but at least well informed! Oxen drowned and/or tortured,
people killed, hotels invaded, tourists injured in broad daylight -
all registered.
