2 The
tender forms can be obtained from 21.06.2004 from the office of the Chief
Engineer, West Central Railway, Jabalpur upto 16.00 hrs on the date mentioned above on cash
payment. The tender forms are not transferable.
3 The
tender documents duly filled in should be put into the tender box kept in the
Office of the Chief Engineer (HQ), West Central Railway, Jabalpur upto 15.00
hrs on the date of opening mentioned above and the same will be opened at 15.15
hrs on the same date in the office of Chief Engineer (HQ), West Central
Railway, Jabalpur.
4 The
tender must be accompanied with the valid Earnest Money drawn in favour of FA
& CAO, West Central Railway, Jabalpur in an acceptable form without which
tender will be summarily rejected.
5. Tenderer
should submit address proof with telephone / Mobile Number and two recent passport
size photographs of proprietor / proprietors duly attested otherwise tender
form will not be issued.
6 Only
those firms/contractors having individual capacity & who satisfy the
following pre-qualification criteria need to quote for this tender:
Pre-qualification criteria
(i)) Should
have completed at least one work of similar type for a minimum value of 35% of
Advertised Tender Value of the subject work during the last three years (i e,
current year and three previous financial years).
(ii) Total
contract amount received during the last three financial years should be
minimum 150% of the Advertised Tender Value as per attested certificate from
the employer/client, audited balance sheet duly certified by the Chartered
Accountant etc.
NOTE: If the date of opening happens to be a holiday
or a bundh the tender shall be opened on the next working day.

1. MEANING OF TERMS :-
(i) Definition
These Regulations for Tenders and Contracts shall be read in conjunction
with the General conditions of Contract which are referred to herein and shall
be subject to modifications, additions or super session by special conditions
of contract and/or special specifications, if any, annexed to the Tender Forms.
In these Regulations for Tenders and Contracts the
following terms shall have the Definitions meanings assigned hereunder except
where the contest otherwise required: -
(a)
"Railway shall mean the President of
the Republic of India or the Administrative Officers of
the West Central Railway or of the Successor Railway authorized to deal with
any matters which these presents are concerned on his behalf.
(b)
General Manager" shall mean the
officer in administrative charge of the whole of Railway or exercising the
powers of General Manager for the subject contract and shall mean and include
the General Manager of the successor Railway.
(c) "Chief
Engineer" shall mean the Officer in-charge of the Engineering
Department of West Central Railway and shall also include the Chief Engineer /
Chief Engineer (Construction) and shall mean & include their successors of
the Successor Railway.
(d) "Divisional Railway Manager" shall
mean the Officer in-charge of a Division of the Central Railway and shall mean
and include the Divisional Railway Manager of the Successor Railway
(e)
"Engineer"
shall mean the Divisional Engineer or the Executive Engineer, in executive
charge of the works and shall include the superior officers of the Engineering
Department of Railway i.e. the Senior Divisional Engineer/ Deputy Chief
Engineer/Chief Engineer/ Chief Engineer (Construction) shall mean and include
the Engineers of the Successor Railway.
(f) "Engineers
Representative" shall mean the Assistant Divisional Engineer in direct
charge of the work and shall include any Resident Engineer or Section Engineer
or any Inspector of the Civil Engineering Deptt. appointed by the West Central Railway and shall
mean and include the Engineer's
Representative of the successor Railway.
(g) "Contractor shall mean the person, firm or company whether
incorporated or not who enters into the contract with the Railway and shall
include their executors administrators, Successors and permitted assigns.
(h) "Tenderer"
shall mean the persons, the firm or company who tenders for the work with a
view to executes the works on contract with the Railway and shall include their
personal representatives, successors and permitted assigns.
(i)
"Limited Tenders"
shall mean tenders invited from all or some Contractors on the approved list of
Contractors with the Railway.
Any tenderer registered
for higher value of the works will be automatically considered eligible for participating in the tender for
lower value works also.
Special Limited tender will be adopt
in the following situation in consultation with the FA&CAO.
(i) Works of
specialized nature
(ii) Works of urgent
nature
(iii) Consultancy work
The tenderer must have a
specialization in the above work or similar nature work and should be reputed contractor
firms/organizations/agencies. Tenderer need not necessarily be borne on the
approved list.
(j)
"Open Tenders"
shall mean tenders invited in open and public manner and with adequate notice.
(k) "Works"
shall mean the works contemplated in the drawings and schedules set forth in
the tender forms and description of contract and required to be executed
according to specifications.
(l) "Specifications
shall mean the specifications for Materials & Works, West Central Railway and
other Railway issued under the authority of the Chief Engineer or as amplified,
added to or superseded by special specifications, if any, appended to the
Tender Forms.
(m) "Schedule of Rates, Central Railway/West Central Railway/Western Railway shall mean
the Schedule of Rates issued under the authority of the Chief Engineer from
time to time.
(n) "Drawing"
shall mean the drawings, plans and tracings or prints thereof related to the
work.
(o) Quotation General Manager may delegate
powers to dispense with calling of tenders for works upto Rs. 2,00,000/- each
in value in consultation with the Associate Finance at the stage of acceptance
of offer.
(p) Two
Packet System of tendering may be adopted in specifically identified
situation for obtaining consultancy services for highly technical works where
parameters cannot be precisely pre-defined or for execution of work which are
either technically complicated or specialized in nature and / or which are
executed very rarely as per the Pre-qualification criteria approved by the
Railway Administration.
(q) Counter
offer - In cases where the overall value of the lowest tenderer is not
unreasonably high but the rate (s) for certain item (s) in a schedule or the total
value for a schedule happens to be higher than those quoted by the other
tenderers in the same tender or higher than last accepted rates, the method of
counter offering the lowest rate (s) obtained in the same tender or if all
these are higher, any other rate (s) considered reasonable by tender committee may be adopted while
finalizing the tender.
(ii) Singular and Plural
Words imparting the singular number shall
also include the plural and vice versa where the context requires.
2. Contractors Credentials
A
contractor who has not carried out any work so far on this Railway should furnish particular regarding:-
(a) his
position as an independent contractor specifying Engineering organization
available with details or Partners/Staff/Engineers employed with qualifications
and experience.
(b) his capacity to
undertake and carry out works satisfactorily,
as vouched for by a responsible official or firm;
(c) his previous experience on works
similar to that to be contracted for in
proof of which original certificates or
testimonials may be called
for and their
genuineness verified if need be, by reference to the signatories
thereof;
(d) his knowledge, from actual personal investigations of the resources of the Zone or Zones in which he
offers to work;
(e) his ability to supervise the
work personally or by competent and duly
authorised agents;
(f) For revised eligibility criteria :(

(g) his financial position;
3. An applicant
shall clearly state the categories of works and the area/zone/division
(s)/district(s) in which he desires registration in the list of approved
contractors.
4. The
selection of contractors for enlistment In the approved list would be done by a
committee for different value slabs as notified by Railway.
5. An
annual fee as prescribed by the Railway from time to time would be charged from
such approved contractors to cover the cost of sending notices to them and
clerkage for tenders, etc
6. The list of
approved contractors would be treated as confidential office record.
7. Tender
Form:- Tender Forms
shall embody the contents of the contract documents either directly or by
reference and shall be as per specimen form, Annexure I. Tender Forms shall be
issued on payment of the prescribed fees to the appropriate contractors on the
list of approved contractors. Contractors not on the list of approved
contractors, will on payment of .the prescribed fees, be furnished with tender
forms and they shall be required to submit evidence regarding their financial
status, previous experience and ability to execute the works, and an authorised
copy of the current Income Tax Clearance Certificate without which their
tenders will not be considered.
8. Omissions and Discrepancies
Should a tenderer find discrepancies
in, or omissions from the drawings
or any of
the Tender Forms
or should he be in
doubt as
to their meaning he
should at once notify the authority
inviting tenders who may send a
written instruction to all tenderers.
It shall be understood that every endeavor has been made to avoid any
error which can materially affect the basis of the tender and he successful
tender shall take upon himself and provided for the risk of any error which may
subsequently be discovered and shall make no subsequent claim on account
thereof.
9. Earnest
Money
The tenderer shall be
required to deposit earnest money with the Tender for the due performance of
the stipulation to keep the offer open till such date as specified in the
Tender, under the conditions of Tender, Annexure-I. The earnest money will be as
under.

(A) It shall be
understood that the tender documents have been sold/issued to the tenderer and
the tenderer is permitted to tender in consideration of stipulation on his
part, that after submitting his tender he will not resile from his offer or modify
the terms and conditions thereof in a manner not acceptable to the Engineer.
Should the tenderer fail to observe or comply with the said stipulation, the
aforesaid amount shall be liable to be forfeited to the Railway.
(B) If his tender
is accepted this earnest money mentioned in sub clause (a) above will be
retained as part security for the due and faithful fulfillment of the contract
in terms of Clause 16 of the General Conditions of
Contract. The Earnest Money of other tenderers shall, save as here before in
provided, be returned to them, but the Railway shall not be responsible for any
loss or depreciation that may happen thereto while in their possession, nor be
liable to pay interest thereon.
(C) The
Contractors approved for the works in various categories will have the option
to deposit the Earnest Money for each individual works or furnish standing
Earnest Money. The contractors borne on the approved list will have the
facility of Standing Earnest Money. They have to deposit a fixed amount of Rs.
2,00,000/- (Rupees Two Lakh only) towards Standing Earnest Money before they
are allowed to participate in the tenders. The tenderer should submit the valid
registration certificate (valid for three years from the date of issue) duly
attested by the Gazetted officer.
The
standing Earnest Money has to be separately deposited for both i.e. open line
organization & for construction organization, and with the respective
organization.
The
Standing Earnest Money shall be counted as a valid Earnest Money for open
tenders also for the works costing upto Rs. 8 crores. This facility will also
be available to the contractors for open tenders of the other branches such as Electrical,
S&T etc. within the same organization i.e. either open line or construction
organization.
A
contractor registered with the construction, however, will not have this
facility for participating in open tenders with this standing Earnest Money,
for tenders invited by open line and vice-versa.
(D) No part of
this fixed lumpsum deposit as Earnest Money can be accounted against the
Security Deposit a contractor has to make on the acceptance of his tender and
on execution of an agreement. It may however, be noted by the Contractors that
this Earnest Money deposited by them is available for forfeiture to the extent
specified, in cases where they tender but due to any circumstances fail to keep
the offer open for the period specified in the tender documents. The earnest
money should be in cash or in any of the following forms :-
(E) Deposit
receipts, pay orders, demand drafts. These forms of earnest money could be
either of the State Bank of India or of any of the nationalized
banks. No confirmatory advice from the Reserve Bank of India will be necessary.
(a) Deposit
receipt executed by the Scheduled banks (other than the State Bank of India and the Nationalised Banks)
approved by the Reserve Bank of India for this purpose. The 'Railways
will not, however, accept deposit receipt without getting in writing the
concurrence of the Reserve Bank of India.
(b) Standing or permanent earnest money may
be accepted in the following forms:-
(i) A deposit in cash.
(ii)
Government securities at 5% below the market value.
(iii)
Deposit receipts or demand drafts of the Nationalised Bank. :
(iv)
A deposit in the Post Office Saving Bank.
(v) National Savings Certificates.
(vi)
Twelve Year National Defense Certificates.
(vii)
Ten Year Defense Deposits.
(viii)
National Defense Bonds.
(ix)
National Saving Certificates.
(x) Time Deposit Account which came into force on
16-3-1970 and notified under Ministry of Finance, Notification No.
F3(7)NS/70, dated 28-2-70.
(xi) IRFC Bonds.
Note - (vi) to (viii) These certificates/bonds may be
accepted at their surrender value.
(F) The amount of
earnest money required to be deposited with the tenders as initial security
shall be as under: -
(i) For works
costing upto Rs. 5 lakhs - 2½% ad valorem subject to a maximum of Rs. 10,000/-.
(ii) For works
costing more than Rs. 5 lakhs 2% ad valorem subject to maximum of Rs.
20,000/-.
(iii) For works
above Rs. 20 lakhs but below Rs. 50 lakhs 1% ad valorem subject to maximum of
Rs. 35,000/-.
(iv) For works
above Rs. 50 lakhs Ύ% ad valorem subject to a maximum of Rs. 50,000/-.
The
cost of work for computing earnest money will be calculated based on prevalent
rates and not at par with schedule of rates.
10. Tender without Earnest Money
10.1 Tenders
unaccompanied with full earnest money
in requisite form will under no circumstances be entertained and will be
summarily rejected without further reference to the tenderer. No reference to previous deposit of earnest
money and/or security deposit for
adjustment against the
present tender will be
accepted; neither any request for recovery from any outstanding
bills for earnest money against present tender will be entertained.
10.2 The earnest money for the due performance of
the stipulation to keep the offer open till the date specified in the tender
will be refunded to the unsuccessful tenderer/tenderers within a reasonable
time. The earnest money deposited by the successful tenderer/tenderers will be
retained towards the security deposit for the due and faithful fulfillment of
the contract but shall be forfeited if the contractor fails/contractors fail to
execute the Agreement Bond or start work within a reasonable time (to be
determined by the Engineer-in-Charge) after notification of the acceptance of
his/their tender.
11. Care in submission of tenders
(a) Before submitting
a tender, the tenderer will be deemed to
have satisfied himself
by actual inspection of the
site and locality of the works, that all
conditions liable to be encountered during the execution of the works are taken into
account and that the percentage/rates
he enters in the Tender Form is/are adequate
and all inclusive to accord with the provisions in Clause 37 of the General
Conditions of Contract for the completion
of works to the entire satisfaction
of the Engineer.
(b) Time is
the essence of the contract.
Contractor should plan the work in
such a way so as to complete whole work within the time provided for. Contractor should submit the bar - chart
showing planning of all the item of work for proper monitoring of the contract.
(c)
When work is tendered for by a
firm or company of contractors, the tender shall be signed by the individual
legally authorised representative to enter into commitments on their behalf
supported by Power of Attorney & Partnership Deed in case of partnership
firms.
(d) The Railways will not be bound by any
power of attorney granted by the tenderer or by change in the composition of
the firm made subsequent to the execution of the contract. It may, however, recognize such power of
attorney and changes after obtaining proper legal advice, the cost of which
will be chargeable to the Contractor.
12. Opening of Tenders
At
the advertised time and place,
tenders received for contract shall be opened
by a Committee of
officials, and where practicable, the names of tenderers and the rates
tendered by them read out in
the presence of such of the intending contractors or their agents as
may attend.
13. The
Railway reserves the right of
not to invite tenders for any
work or works, or to invite open or limited tenders and when tenders are called to accept a tender in whole or in
part or reject
any tender or all
tenders without assigning reasons for
any such action.
14. Execution
of Contract documents
The
Tenderer whose tender is accepted shall be required to appear in person at the
office of the General Manager/General Manager (Construction), Chief Administrative
Officer (Construction), Divisional Railway Manager or concerned Engineer, as
the case may be or if a firm or corporation, a duly authorised representative
shall so appear and execute the contract documents within 7 days after notice
that the contract has been awarded to him. Failure to do so shall constitute a
breach of the agreement affected by the acceptance of the tender in which case
the full value of the earnest money accompanying the tender shall stand
forfeited without prejudice to any other rights or remedies.
In the event of any tenderer whose
tender is accepted shall refuse to execute the contract document as here in
before provided, the Railway may determine that such tenderer has abandoned the
contract and there upon his tender and acceptance thereof shall be treated as
cancelled and the Railway shall be entitled to forfeit the full amount of the
Earnest Money and to recover the damages for such default.
In case of non signing the contract
agreement, the work will be done at the risk & cost in addition to the
forfeiture of Earnest Money / Security Deposit.
Contractor
should submit address proof with telephone / Mobile Number, specimen signature
of the contractor duly notified by the Notary public on the Stamp paper of Rs.
100/- and two recent passport size photographs of proprietor / proprietors duly
attested before signing the contract Agreement.
15. Form of Contract Documents
Every contract shall be
completed in respect of the documents it shall constitute. Not less than 5 copies
of the contract documents shall be signed by the competent authority and the
contractor and one copy given to the contractor.
(a) For Zone contracts, awarded on the basis of the
percentage above or below the Schedule of Rates (Central Railway/West Central
Railway/Western Railway) for the whole or part of financial year, the contract
agreement required to be executed by the tenderer whose tender is accepted
shall be as per specimen form, Annexure II. During the currency of the
Zone contract, work orders as per specimen form Annexure III or IV, for works not exceeding
Rs. 10, 000/- each, shall be issued by the Divisional Railway Manager/Executive
Engineer under the agreement for Zone Contract.
(b) For contracts for specific works, valued at more than
Rs. 10,000/- the contract document
required to be executed by the tenderer whose tender is accepted shall be
either an Agreement as per specimen form Annexure IV, or a work order as per
specimen form Annexure V as may be prescribed by the
Railway.

conditions attached hereto and hereby agree to abide by the said conditions. I
/We also agree to keep this offer open for acceptance for a period of
..days from the date fixed for opening of the same and in default
thereof. I/We will be liable for forfeiture of my/our Earnest Money I/We
offer to do the work for West Central
Railway, at the rates quoted in the attached schedule and hereby bind
myself/ourselves to complete the work in all respects within
months including / excluding
monsoon from the date of issue of acceptance letter.
2. I / We also hereby agree to abide by the General
and Special Conditions of Contract corrected upto date and to carryout the work
according to the special conditions of contract & specifications of
materials and works as laid down by the Railway in the special conditions,
specifications and standard schedule of rates corrected up-to-date. I / We have quoted my / our rates for
various items in the tender schedule taking into account all the conditions of
the tender and codes & manuals also and I / We have read all the general
& special conditions and its corrections slips upto date including
omission, deletion etc. and agree to abide by them. The contract shall stand
cancelled without prejudice to any other rights or remedies if:-

A sum of Rs. 20,000/- is herewith forwarded as
Earnest money. The total value of the Earnest money shall stand forfeited
without prejudice to any other right or remedies if:-
(a)
I / We do not execute the contract
agreement within seven days after receipt of the notice issued by the Railway
that such documents are ready,
or
(b) I / We do not
commence the work within fifteen days after receipt of orders to that effect.
4. Until a formal agreement is prepared
and executed, acceptance of this bid shall constitute a binding contract
between us subject to modifications as may be mutually agreed to between us as
indicated in the letter of acceptance for this work.
5. I hereby certify that no retired
Engineer/Gazetted Officer of the Railways who has retired within 2 years of
date of submission of tender and has not obtained permission of competent
authority has been engaged by me/our firm.
I also certify that none of my relative is engaged in Engineering
Department in West Central Railway.

time during the office hours. The drawings are only for the guidance of
Tenderer (s). Detailed working drawings, (if required) based generally on the
drawing mentioned above, will be given by the Engineer or his representative
from time to time.
3.
The Tenderer (s) shall quote his/their rates as a percentage above or below the
schedule of Rates of the Central Railway/West Central Railway/Western Railway as
applicable except where he/they are required to quote item rates and must
tender for all the items shown in the schedule of approximate quantities
attached. The quantities shown in the attached schedule are given as a guide
and are approximate only and are subject to variation according to the needs of
the Railway. The Railway does not guarantee work under each item of the
schedule.

Tenders containing erasures and/or alterations of the tender documents are
liable to be rejected. Any correction made by Tenderer (s) on his/their entries
must be attested by him/them
5.
The works are required to be completed within a period of 10 (Ten) months including / excluding monsoon period from
the date of issue of acceptance letter.
6.
Earnest Money :-
(a) The tender must be accompanied by a sum of Rs. 50,000/- as earnest money deposited in cash or in any of
the forms as mentioned in Regulations for tenders and Contracts for the
guidance of the Engineers and Contractors, failing which the tender will not be
considered.
b.
The Tenderer(s) shall keep the offer open for a minimum period of 120 days from the date of
opening of the Tender. It is understood that the tender documents has been sold
/ issued to the Tenderer(s) and the Tenderer(s), is/are permitted to tender in
consideration of the stipulation on his/their part that after submitting
his/their tender subject to the period being extended further if required by
mutual agreement from time to time, he will not resile from his offer or modify
the terms and conditions thereof in a manner not acceptable to the Railway.
If the tenderer fail to observe or comply with the foregoing
stipulation, the amount deposited as Earnest Money for the due performance of
the above stipulation shall be forfeited to the Railway.
c.
If the tender is accepted, the amount of Earnest Money will be retained and
adjust as security Deposit for the due and faithful fulfillment of the
contract. This amount of Security Deposit shall be forfeited if the
tenderer(s)/contractor(s) fail to execute the Agreement Bond within 7 days after
receipt of notice issued by Railway that such documents are ready or to
commence the work within 15 days after receipt of the orders to that effect.
d.
The Earnest Money of the unsuccessful tenderer(s) will, save as here-in-before provided,
be returned to the unsuccessful tenderers(s) within a reasonable time but the
Railway shall not be responsible for any loss or depreciation that may happen
to the Security for the due performance of the stipulation to keep the offer
open for the period specified in the tender documents or to the Earnest Money
while in their possession nor be liable to pay interest thereon.
7.
Rights of the Railway to deal with tender :- The authority for the acceptance of the tender will
rest with the Railway. It shall not be obligatory on the said authority to
accept the lowest tender or any other tender and no tenderer(s) shall demand
any explanation for the cause of rejection of his/their tender nor the Railway
undertake to assign reasons for declining to consider or reject any particular
tender or tenders.
8.
If the tenderer(s) deliberately gives/give wrong information in his/their
tender or creates/ create circumstances for the acceptance of his/their tender,
the Railway reserves the right to reject such tender at any stage.'
9. If
the tenderer(s) expires after the submission of his/their tender or after the
acceptance of his their tender, the Railway shall deem such tender cancelled.
If a partner of a firm expires after the submission of their tender or after
the acceptance of their tender, the Railway shall deem such tender as
cancelled, unless the firm retains its character.
10.
Tenderer's Credentials :- Documents testifying tenderers previous
experience and financial status should be produced alongwith the tender or when
desired by competent authority of the Railway.
Tenderer(s) who has/have hot carried out any work so far on
this Railway and who is/are not borne on the approved list of the Contractors
of Railway should submit alongwith his/their tender credentials to establish.
(i) His
capacity to carry out the works satisfactorily.
(ii) His financial status supported by Bank
reference and other documents.
(iii) Certificates
duly attested and testimonials regarding contracting experience for the type of
job for which tender is invited with list of works carried out in the past

Tender must be enclosed in a sealed cover, superscribed "Tender
No. and must be sent by registered post to the address of concerned office of the Railway so as to
reach the office not later than the date & time mentioned in the Tender
Notice or deposited in the special box allotted for the purpose in the concerned
office of the West central Railway. This
Special box will be sealed at the date
and time mentioned in tender Notice. The tender will be opened at the date and
time mentioned in tender Notice. The tender papers will not be sold after the
date and time mentioned in tender Notice. If the date of opening happens to be
a holiday or a bundh the tender shall be opened on the next working day.
12.
Non-compliance with any of the conditions set forth therein above is liable to
result in the tender being rejected.
13. Execution of Contract Documents: - The
successful tenderer(s) shall be required to execute an agreement With the President
of India acting through West Central Railway for carrying out the work
according to General conditions of Contract, Special conditions/specifications
annexed to the tender and specifications for work and materials as laid down in
Works Hand Book Part III and Sanitary Works Hand Book of Railways as amended/corrected
upto correction slip.
14. Partnership deeds, Power of Attorney etc:-
The tenderer shall clearly specify whether the tender is submitted on his own
or on behalf of a partnership concern. If the tender is submitted on behalf of
a partnership concern, he should submit ^certified copy of partnership deed
alongwith the tender and authorisation to sign the tender documents on behalf
of partnership firm. If these documents are not enclosed alongwith tender documents,
the tender will be treated as having been submitted by individual signing the
tender documents. The Railway will not be bound by any power of attorney
granted by the tenderer or b^ conges in the composition of the firm made
subsequent to the execution of the contract. It may however recognise such
power of attorney and changes after obtaining proper legal advice, the cost of
which will be chargeable to the contractor.
15. The tenderer whether sole proprietor, a limited
company or a partnership firm if they want to act through agent or individual
partner(s) should submit alongwith the tenderer at a later stage, a power of
attorney duly stamped and authenticated by a Notary Public or by Magistrate in
favour of the specific person whether he/they be partner(s) of the firm or any
other person specifically authorising him/them to submit the tender, sign the
agreement, receive money, witness measurements, sign measurement books,
compromise, settle, relinquish any claim(s) preferred by the firm and sign
"No Claim Certificate" and refer all or any disputes to arbitration.
16. Employment/Partnership, etc., of
Retired Railway Employees :- (a) should a tenderer be a retired engineer of
the Gazetted rank or any other Gazetted officer Working before his retirement,
whether in the executive or administrative capacity, or whether holding a
pensionable post or not, in the department of any of the railways owned and administered
by the President of India for the time being or should a tenderer being partnership
firm have as one of its partners a retired engineer or retire|| Gazetted
Officer as aforesaid, or should a tenderer being an incorporated company have
any such retired engineer or retired officer as one of its Directors, or should
a tenderer have in his employment any retired Engineer or retired Gazetted
Officer as aforesaid, the full information as to the date of retirement of such
Engineer or Gazetted Officer from the said service and in case where such
Engineer or Officer had not retired from Government service at least 2 years
prior to the date of submission of the tender as to whether permission for
taking such contract, or if the contractor be a partnership firm or an
incorporated company, to become a partner or Director as the case may be, or to
take the employment under the contractor, has been obtained by the tenderer or
the Engineer or Officer, as the case may be from the President of India or any
officer, duly authorised by him in this behalf, shall be clearly stated in
writing at the time of submitting the tender. Tenders without the information
above referred to or a statement to the effect that no such retired Engineer or
retired Gazetted Officer is so associated with the tenderer, as the case may
be, shall be rejected.
(b) Should a tenderer or contractor
being an individual on the list of approved Contractors, have a relative(s) or
in the case of partnership firm or company of contractors one or more of his
shareholder(s) or a relative(s) of the shareholders) employed in gazetted
capacity in the department of the West Central Railway, the authority inviting
tenders shall be informed of the fact at the time of submission of tender,
failing which the tender may be disqualified/rejected or if such fact
subsequently comes to light, the contract may be rescinded in accordance with
the provision in clause 62 of the General Conditions of
Contract.

3. The conditional tender will not be accepted. If the tenderer desired
to quote their conditions, it should be quoted on the page of Special

SPECIFICATION / SPECIAL CONDITIONS FOR CONCRETE
1. These special conditions /
specifications over Railways specifications and IS: 456/1978, in case of any
conflict, the special conditions will prevail.
2.
A
temporally camp office shall be made by contractor at site.
3.
Contractors
site Engineer who will be a qualified graduate Engineer shall always be
available at the site during execution of works for correctness and proper
quality control of works. His attendance Register shall be maintained by
Engineers Representative.
4. Cube testing of concrete shall be done as per IS : 456 -1978 Additional
cubes in same number as required for 28 days testing, will be taken for 07 days
testing. Payment for concrete work will be made only after its 07 days cube
test report is submitted and the results are found satisfactory.
5.
Acceptance
criteria, inspection and testing of structures shall be as per IS : 456 -1978. Engineer or Engineers
representatives decision shall be final and conclusive.
6.
Concrete
shall be mixed in a mechanical mixer complying with IS: 1791-1968.
7.
Water
to be used for mixing and curing shall be potable and has to be got approved by
Engineers representative.
8.
Coarse Aggregate :-
a)
Coarse
aggregate to be used shall be block trap on hard grants machine crushed
ballast.
b)
Coarse
aggregate to be used shall have to be got tested by contractor at his cost for
:-
1) Aggregate crushing value.
2) Aggregate abrasion value.
3) Presence of deleterious substances
in accordance with IS : 2386 (Part I,
II, IV) 1963. Coarse aggregate
will be approved only if test results comply with standard as given in IS: 383-1970.
4) Coarse aggregate having flacky,
elongated, soft or oversized particles are liable to be rejected by Engineer or
Engineers representative whose decision will be final and conclusive.
9. Fine
aggregate :-
a)
Fine
aggregate shall consist of siliceous material having hard, strong, durable,
uncoated particles.
b)
Fine
aggregate will be used shall be tested at contractors cost for deleterious
substances as per IS : 2386. (Pt. I, II)
1963.
Deleterious substances should be within
the limits as per IS : 383-1970.
c)
Grading
of fine aggregate when determined as per IS:
2386 (Part I) 1963 shall be in grading zone I, II or III as per IS : 383-17 - 1970.
d)
Fine
aggregate not conforming to these standards shall be rejected by Engineer or
Engineers representative whose decision shall be final and conclusive.

SPECIAL CONDITIONS FOR CONTRACTORS CEMENT AND
SETTEL.
1.0
CEMENT
1.1
GENERAL
1.1.1 MASTER SCHEDULE ITEM
The cost of cement for the work is
included in the rates for Master schedule items mentioned in the tender.
NON-SCHEDULE ITEMS
The rates to be quoted by the
tenderers shall be inclusive of the cost of the cement. No extra Payment
towards cost of cement will be payable.
1.1.2
The
Rly. Will not supply any cement for the works. The contractor(s) has/have to
procure the cement required for the work from the Market & transport the
same to the site of work at his/ their own cost including all taxes, octroi,
etc. and including all lead & handling etc.
1.1.3
The
cement should be purchased by the contractor (s) only from the
Authorised/Approved manufactures or their Authorised agent. The contractor (S)
should produce the documental proofs such as bill, challans, etc, from such
authorised Manufacturers/Agents from
whom the cement is purchased for every lot of cement brought at site and to be
verified by the Rlys representative. The cement brought at side without such
documental proof s will not be permitted to be used in the works.
1.1.4
The
cement as approved by the Rlys representative will be properly stacked at site
in the go downs constructed by the contractor at his own cost. The contractors
should keep the cement under their safe custody & will be made accessible
to the Railways representative to physically verify & check at any time.
1.1.5
The
contractors will be fully responsible for the safeguard of the cement along
with other materials & the Railways will not compensate for any damage,
loss or theft of the cement or any other materials at site. Any delay in
procurement of cement will not be considered as cause for granting extension for the
materials at site.
Quality & Testing:
The cement used shall be any of the
following , with the prior approval of the Engineer.

for RCC & PSC work. Portland Pozzolana cement conforming to IS: 1489 can be
used only for foundation concrete & concrete works in bridge substructures where reinforcement is not provided
for structural strength or reinforcement provided is only nominal for
temperature stresses etc. When Portland, Pozzolana cement is used it is to
be ensured that proper damp caring of concrete is done at least for 14 days
& supporting for work is not removed till concrete has attained at least 75%
of the design strength.
In aggressive environment, where SO3
& Cl ions are present in abundance,
preferably ordinary Portland cement with
moderate sulphate resisting properties
conforming to specifications as given in table below may be used.

1.2.2
Random
specimen samples of cement/Steel taken from the lot brought at site should be
tested at any authorised/approved Engineering Institute of Laboratory for its
physical and chemical properties as specified in the IS Specifications (IS
4031) and any other tests as specified by the Engineer or his representative.
Some of the tests which should be carried out are :-
i.
Compressive
strength.
ii.
Initial
& final setting time.
iii.
Consistency.
iv.
Soundness.
These test will be got carried out
by the Railways representative & the arrangements & cost of tests
including cost of cement for testing will be borne by the contractor. Such
tests should be done invariably at every change of batch of cement & at
times when it is found necessary at the discretion of the Site Engineer/his
representative at site.
2.3
To
ensure quality control, test certificate from the manufactures should be
produced by the contractors which should confirm to the relevant
specifications.
2.4
Rejected
lot should be removed from site immediately by contractor.
3.0
CEMENT
CONTENT &WATER CEMENT RATIO: The appropriate value of minimum cement
content & maximum free water cement ratio for different exposure conditions
are given below for RCC & PCC separately.

However, cement content in excess of
500 Kg/M3 should not be used unless special consideration has been given in the
design to the increased risk of cracking due to shrinkage in this sections or
to early thermal cracking or the increased risk of damage due to alkali silica
reactions.
CONSUMPTION USE AND ACCOUNTAL
The consumption or use of cement in
the works will be at the rate of quantities specified for each item requiring
nominal mix & as required for design mix.
In case of designed mixes of
concrete, the contractors should submit the design of mix duly done by any
approved Engineering Institute of Laboratory & the cement required as
specified in the design should be used to achieve the specified strength of the
concrete.
Proper accounts of the cement for
receipt, consumption, balance etc. should be maintained at site duly verified
and signed by the contractors and the Railways representatives.
In cases if the cement consumed in
the work is lesser than specified, the cost of such cement used less, will be
recovered from the contractors bill at twice the market rate increased by 20%
codal charges not with standings the fact that required strength is achieved by
less Qty. of cement used and also provided such works are qualitatively.
Otherwise acceptable to the
Railways. In case of excess consumption no extra cement will be paid to the
contractor(s)
1.4.4
The
cement should be fresh & generally within three months of age. If the
cement is elder than 3 months test should be carried out for its loss of
strength & other properties and addl./extra Qty. of cement will be used, as
decided by the site engineer to achieve the required strength. No extra payment
will be made by the Railway for such addl. Quantity used by the contractor.
1.4.5
Cement
brought at the site by the contractors for a particular work should not be
taken to other works/sites without the written approval/permission of the
Railways Site Engineer.
1.4.6
Any
cement left out on completion of works will be the property of the contractor.
The contractor will be at liberty to dispose of the leftover cement. Railway
will neither takeover the leftover cement nor will compensate the contractor in
any manner what-so-ever.
2.0.0
STEEL
2.1.0
GENERAL
2.1.1
Railway
will not supply any steel for the works included in this tender.
2.1.2
Mild/Ribeed
Torque steel bars of various diameters for reinforcement in RCC works & for
other items of works as required and structural steel for fabrication items of
work will be procured and transported to site by the contractor(s) at his/their
own cost.
2.1.3
The
steel bars/structural steel shall confirm to the relevant IS Specifications M.S
Bars should confirm to IS 432 (Part-II) 1982 & Torque steel should confirm
to IS 1786/1985 in standard lengths.
2.1.4
The
contractor(s) shall purchase good quality and defect free steel only from the
steel plants/stock yards of SAIL, TISCO or TISCO or their authorised rollers,
under proper test certificates.
Steel purchased from any other sources other than the above
will not be permitted to be used in the work.
2.1.5
The
steel brought at site should be properly dia meter wise separately and
protected from contract with earth water etc. Wherever the treatment of the
steel against the corrosion is specified the same should be done as specified
in the Item and specification.
2.1.6
It
is entirely contractor s
responsibility to safe guard the steel
from damage loss & theft etc. & railways will not pay any compensation
for any such loss, damage or theft.
2.1.7
The
rate for the items of RCC works is exclusive of the cost of the steel & is
only for the concrete work with the specified mix but inclusive of cutting,
bending, hooking & placing of steel reinforcement.
2.1.8
The
cost of the steel will be paid under a separate suitable items as provided in
the tender schedule.
2.2.0
QUALITY AND TESTING
2.2.1
The
quality of the steel and source of purchase will be as mentioned in para 2.1.4.
The contractor/s should submit test certificate, from the
manufactures for each lot & diameter of the steel bars brought by the
contractor.
In addition to the
test certificate, Railways will conduct necessary test through any authorised/ recognized Engineering Institute
or Laboratory, taking sample cut pieces from a lot of steel brought by the
contractors. These test will be conducted for each dia of the bars separately
for their physical, chemical, & Engineering properties as specified in the
I.S. Codes. All arrangements & the cost of test including the cost of
the test pieces will be borne by the contractor. No extra
payment will be made by the Railways on this account.
2.2.2
Rejected
material should be removed from the site by the contractor.
2.3.0
CONSUMPTION AND ACCOUNTAL.
2.3.1
The
steel should used in the work as shown in the approved drawing. Over laps, if
necessary, should be provided as required by design and specification, but no
payment shall be made for extra steel used for providing over laps.
2.3.2
Proper
account will be maintained in the registers regarding consumption balance etc.
Duly signed by the contractor and Railways representative.
2.3.3
For
the purpose of payment, linear measurement of bars used for the work will be
converted into mass unit by multiplying the former by the standard unit weight.
No overlaps will be accounted for the payment no rolling margin will be
considered. The cut pieces, wastage and the left over materials will be
disposed off by the contractor. Railways will not pay any compensation for such
cut piece, wastage or balance left out material.
2.3.4
The
steel brought at site by the contractor for a particular work should not be
shifted to other works/site without the written approval/permission of the
Railways.
SPECIAL CONDITION FOR
DESIGN AND DRAWING
1.1.1
The
Drawing & Design shall confirm to relevant statuary position of
( I ) I RS code of
practice for the design of sub structure and foundation of bridges with all
correction slip.
(ii) I R S concrete
bridge code with all contractor slips.
(iii) I R Bridge
Mannul 1998
(iv) Relevant I S
code .
(v) Bridge rules latest with up to date
correction slips and all other necessary I S , I R S ,B S. with up to
date correction slip required for design should be procured by
contractor and as and when required
code should be presented by contractor to railway .Reference to the
slandered adopted shall be given in the relevant document as are not readily
available indigenously shall be supplied as required . Relevant codes to be
followed and in case different situations of codes about some matter the
decision of the railway shall be final . The list of the code / manual etc.
followed must be submitted alongwith drawing.
1.1.2
The
design procedure shall include examination of construction i.e mass Concrete /
RCC for sub- structure and adoption of most economic and cost effective type of
construction consistent with the locally available materials and construction
techniques in consultation with railway (minimum M-25 for mass concrete and
M-30 for reinforcement concrete or higher grade of cement concrete and for PSC
Girder minimum M-40 will be used ) .
1.3 If
any site data in addition to the information furnished to the tenderer is required,
the same shall be obtained by contractor, as considered necessary for
reliable and economic design from his own resources. Railway may assist in
getting information through
recommendory letter.
1.4 The
contractor shall prepare general arrangements and detailed structure drawing
complete in all respect for being used as contract drawing for construction. At
least six copies each of such drawing including revision there to shall be
supplied by contractor. The level of detailing, quality of drafts mon-ship and
the scale adopted for the drawing shall be such as to provide complete
information for execution of work and free from any ambiguities. The decision
of the engineer about the adequacy of the drawing in this regard shall be final
and conclusive. The contractor will have to provide one copy of the approved
drawing in reliable CD/for record purpose for no extra payment will be
made.
Specification
and Condition
1. Contractor
is required to visit the individual site of bridges at his own
Cost to make him conversant with the
work, though founding details for bridges will be given by railway. However for
any bridges if any details required will be collected by the contractor from
site for which no extra payment will be made.
2. Standard
loading will be considered as per MBG loading 1987.
3 Minimum
M-25 design mix concrete for plain concrete and M-30 design mix for
reinforcement concrete work will be used.
Before detail designing of bridges,
a general arrangement drawing will be prepared in consultation with field
officers of the railway and got approved by the railway (two copies of GAD will
be submitted along with a tracing film ) .
5 All the
drawings have to be prepared in the latest version of Auto CAD .
6 Contractor
shall have the responsibility of getting the drawing approved . Contractor shall have to attend the head quarters
office at Jabalpur promptly at his own
cost , whenever called upon him to do in this regard or otherwise . Any
delay on there account shall be treated as delay on contractors account .

During the checking of
drawings if necessary corrections as desired by competent authority will be made in the tracing film
.& CD also for which no extra payment
will be made .

The contractor will submit the calculation and
summary of the quantities of the items
involved for executing the work , schedule of reinforcement along the scheme
and specification of working in construction .

measures to be adopted before during and
after construction . Number of test and frequency of various test for different

list of equipment required to set-
up field laboratory.

engineer in charge will be final and
conclusive.
STRUCTURAL CONCRETE
1.1 Cement
i) Ordinary Portland Cement (of approved
grade) conforming to IS: 8112 shall be used for cast-in-situ construction.
ii)
C3A
content of OPC should be between 5 to 8 percent.
iii)
Reputed
manufacturer, viz. Gujarat Ambuja, L&T, ACC, Rajashree, Birla super cement
is only to be used.
1.2 Fine Aggregates (Sand)
i) Creek sand shall not be used in
permanent work.
ii) Sand, if found too coarse, shall be
suitably blended with finer sand obtained from approved resources to obtain the
desired grading. The provision of two types of sand, their stacking separately
and their mixing in the specified proportions shall be at the contractors
cost.
The sand
shall not contain silt more than a total of 3% by weight and shale, clay, and
other structurally week particles a total of 2% by weight. Chloride content in
washed sand shall not be greater than 0.04% by weight.
iii) The grading of the sand shall conform
to IS: 2386.
The sand
shall be screened on a 4.75 mm size screen to eliminate over-size particles.
The sand
shall be washed in screw type mechanical washers in potable water to remove
excess silt, clay and chlorides. The screening and washing of sand shall be
completed at least one day before using it in concrete.
The washed
sand shall be stored on a sloping concrete platform and in such a manner as to
avoid contamination.
1.3 Coarse Aggregates
i) Coarse aggregates for the works shall
be crushed stone conforming to IS:383, obtained from approved sources. Only
quarries having jaw crushers with choke feeding arrangement producing
aggregates of nearly cubical shape shall be approved.
ii) Coarse aggregate containing flat or
flaky pieces or mica shall be rejected.
iii) The aggregates shall be subjected to
tests in accordance with IS:2386 as may be ordered by the Engineer.
iv) Aggregate shall be stored in such a way
as to prevent segregation of sizes and avoid contamination with fines and other
undesirable material.
1.4 Water
i) Creek water shall not be used Potable
water from piped supply of proper quality should be used.
ii) The permissible limits for solids shall
be as follows :

1.5 Storage of Materials
1.5.1 General
All materials may be stored at
proper places so as to prevent their deterioration or intrusion by foreign
matter and to ensure their satisfactory quality and fitness for the work. The
storage space must also permit easy inspection, removal and restorage of the
materials. All such materials even though stored in approved godowns / places,
must be subjected to acceptance test prior to their immediate use.
1.5.2 Aggregates
Aggregate stockpiles may be made on
ground that is denuded of vegetation, is hard and well drained. If necessary,
the ground shall be covered with 50 mm plank.
Coarse aggregates, unless otherwise
agreed by the Engineer in writing, shall be delivered to the site in separate
sizes (2 sizes when nominal size is 25 mm or less and 3 sizes when the nominal
size is 32 mm or more). Aggregates placed directly on the ground shall not be
removed from the stockpile within 30 cm of the ground until the final cleaning
up of the work, and then only the clean aggregate will be permitted to be used.
In the case of fine aggregates,
these shall be deposited at the mixing site not less than 8 hours before use
and shall have been tested and approved by the Engineer.
1.5.3 Cement
Cement shall be transported, handled
and stored on the site in such a manner as to avoid deterioration or
contamination. Cement shall be stored above ground level in perfectly dry and
water-tight sheds and shall be stacked not more than eight bags high. Wherever
bulk storage containers are used their capacity should be sufficient to cater
to the requirement at site and should be cleaned at least once every 3 to 4
months. Cement older than 3 months from the date of manufacture shall not be
used.
Each consignment shall be stored
separately so that it may be readily identified and inspected and cement shall
be used in the sequence in which it is delivered at site. Any consignment or
part of a consignment of cement which had deteriorated in any way, during
storage, shall not be used in the works and shall be removed from the site by
the Contractor without charge to the Employer.
The Contractor shall prepare and
maintain proper records on site in respect of delivery, handling, storage and
use of cement and these records shall be available for inspection by the
Engineer at all times.
The Contractor shall make a monthly
return to the Engineer on the date corresponding to the interim certificate
date, showing the quantities of cement received and issued during the month and
in stock at the end of the month.
Testing
A sample shall be tested from every
batch of cement delivered on site or once for every 1000 bags whichever is more
frequent. Tests shall be carried out for fineness, initial and final setting
time, and compressive strength (IS: 4031) and the results approved by the
Engineer before use of the cement in permanent works. Samples shall be taken
immediately on receipt of cement at site. The methods and procedure of sampling
shall be in accordance with IS: 3535. The Engineer may specify other forms of
sampling and tests including chemical analysis, (IS: 4032) fi in his opinion
the cement is of doubtful quality; the costs of such additional tests shall be
borne by the contractor.
1.5.4 Reinforcement / Untensioned Steel
Supply from primary manufacturers
such as SAIL, TISCO, etc. will be taken. The reinforcement bars, when delivered
on the job, shall be stored above the surface of the ground upon platforms,
skids, or other supports, and shall be protected from mechanical injury and
from deterioration by exposure.
Inspection
Every bar shall be inspected before
assembling on the works and any defective, brittle, excessively rusted or burnt
bars shall be removed. Cracked ends of bars shall be cut out.
1.6 Design Mix
1.6.1 For all items of
concrete only design mix shall be used. Prior to the start of construction, the
Contractor shall design the mix and submit to the Engineer for approval, the
proportions of materials to be used.
1.6.2 Requirements of
Consistency
The mix shall have the consistency which
will allow proper placement and consolidation in the required position. Every
attempt shall be made to obtain uniform consistency.
The slump of concrete shall be
checked as per IS:516.
1.6.3 Requirements for Designed
Mixes
1.6.3.1 Trial mixes : (For
strength)
The contractor is entirely
responsible for the design of the concrete mixes.The design is however to be
approved by the Engineer. At least 5 weeks before commencing any concreting in
the works, the contractor shall make trial mixes using samples of coarse
aggregates, sand, water, super plasticizer and cement, typical of those to be
used in the works, and which have been tested in an approved laboratory. A
clean dry mixer shall be used and the first batch discarded.
The cement content for different grades of
concrete and the required average strength at 28 days for which the mixes shall
be designed as per IS: 10262 and as approved by the Engineer-in-charge.
The concrete mixes shall be designed
on the basis of required strength, desired workability, the maximum size of
aggregate and also the various grades of cement as specified in IS : 10262
1982, clause 3.1.1. Accordingly, the required cement content shall be
ascertained. The contractor may be allowed to use either approved super
plasticizer or increased cement content to achieve the required strengths at
his own request.
For each grade a total of 18 cubes
shall be made. Of these 18 cubes made, not more than 6 may be made on any day
and further, of the 6 cubes made in one day not more than 2 cubes may be made
from any single batch. 9 of these cubes each representing a different batch of
concrete shall be tested at the age of 7 days and the remaining 9 cubes shall
be tested at the age of 28 days. The making of cubes, their curing, storing,
transporting & testing shall be in accordance with Indian Standards IS :
516. The test shall be carried out in a laboratory approved by the Engineer.
If the average strength of the
concrete cubes falls below the required target mean strength (fcm) fresh
preliminary mixes for then grade shall be made as before, until the trial mixes
yield cubes of compressive strength at 28 days greater than the required
average target mean strength (fcm) at that age.
Whenever there is significant change
in the quality of any of the ingredients for concrete, the Engineer may at his
discretion order to carry out of fresh trial mixes. All costs for trial mixes
& tests shall be to the contractors account and held to be included in the
contract rates.
Before commencing the work, the
contractor shall submit to the Engineer for approval full details of the
preliminary trial mixes and tests.
When the proportions of a concrete
mix have been approved by the Engineer, the contractor shall not vary the
quality or source of the materials or the mix without the written approval of
the Engineer.
1.6.4 Size of Coarse Aggregate
The size (maximum nominal) of coarse
aggregates for concrete to be used in various components shall be given as
Table 3.

The proportions of the various
individual size of aggregates shall be so adjusted that the grading produces
densest mix and the grading curve corresponds to the maximum nominal size
adopted for the concrete mix.
1.6.5 Mixing Concrete
Concrete shall be mixed either in a
concrete mixer or in a batching and mixing plant, as per these specifications.
Hand mixing shall not be permitted. The mixer or the plant shall be at an
approved location considering the properties of the mixes and the
transportation arrangements available with the Contractor. The mixer or the
plant shall be approved by the Engineer.
Mixing shall be continued till
materials are uniformly distributed and a uniform color of the entire mass is
obtained, and each individual particle of the coarse aggregate shows complete
coating of mortar containing its proportionate amount of cement.
Mixers which have been out of use
for more than 30 minutes shall be thoroughly cleaned before putting in a new
batch. Unless otherwise agreed to by the Engineer, the first batch of concrete
from the mixer shall contain only two thirds of the normal quantity of coarse
aggregate. Mixing plant shall be thoroughly cleaned before changing from one
type of mix to another.
1.6.6 Transporting, Placing and Compaction of Concrete
The method of transporting and
placing concrete shall be approved by the Engineer. Concrete shall be
transported and placed as near as practicable to its final position, so that no
contamination, segregation or loss of its constituent materials takes place.
Concrete shall not be freely dropped into place from a height exceeding 1.5
metres.
When concrete is conveyed by chute,
the plant shall be of such size and design as to ensure practically continuous
flow. Slope of the chute shall be so adjusted that the concrete flows without
the use of excessive quantity of water and without any segregation of its
ingredients. The delivery end of the chute shall be as close as possible to the
point of deposit. The chute shall be thoroughly flushed with water before and
after each working period and the water used for this purpose shall be
discharged outside the formwork.
All formwork and reinforcement
contained in it shall be cleaned and made free from standing water, dust, snow
or ice immediately before placing of concrete.
No concrete shall be placed in any
part of the structure until the approval of the Engineer has been obtained.
If concreting is not started within
24 hours of the approval being given, it shall have to be obtained again from
the Engineer. Concreting then shall proceed continuously over the area between
the construction joints. Fresh concrete shall not be placed against concrete
which has been in position for more than 30 minutes unless a proper
construction joint is formed.
Except where otherwise agreed to by
the Engineer, concrete shall be deposited in horizontal layers to a compacted
depth of not more than 450 mm.
Concrete when deposited shall have a
temperature of not less than 5 degrees Celsius, and not more than 40 degree
Celsius. It shall be compacted in its final position within 30 minutes of its
discharge from the mixer, unless carried in properly designed agitators,
operating continuously, when this time shall be within 1 hour of the addition
of cement to the mix and within 30 minutes of its discharge from the agitator.
It may be necessary to add retarding admixtures to concrete if trials show that
the periods indicated above are unacceptable. In all such matters, the
Engineers decision shall be final.
Concrete shall be thoroughly
compacted by vibration or other means during placing and worked around the
reinforcement, tendons or duct formers, embedded fixtures and into corners of
the formwork to produce a dense homogeneous void-free mass having the required
surface finish. When vibrators are used, vibration shall be done continuously
during the placing of each batch of concrete until the expulsion of air has
practically ceased and in a manner that does not promote segregation. Over
vibration shall be avoided to minimise the risk of forming a weak surface
layer. When external vibrators are used, the design of formwork and disposition
of vibrator shall be such as to ensure efficient compaction and to avoid
surface blemishes. Vibrations shall not be applied through reinforcement and
where vibrators of immersion type are used, contact with reinforcement and all
inserts like ducts etc., shall be avoided. The internal vibrators shall be
inserted in an orderly manner and the distance between insertions should be
about one and half times the radius of the area visibly affected by vibration.
Additional vibrators in serviceable condition shall be kept at site so that
they can be used in the event of breakdowns.
Mechanical vibrators used shall
comply with IS:2502, IS:2506, IS:2514 and IS:4656.
1.6.7 Construction Joints
Sequencing of concrete placement
should be organised in such a way that cold joints are totally eliminated. The
sequence of concreting shall be submitted for approval of Railway prior to
concreting of the structural element.
All construction joints, if any
provided, shall be treated with epoxy compound after preparing the surface with
V-notch, cleaning etc. complete to the satisfaction of the Engineer.
1.6.8 Concreting Under Water
All concreting shall be done under
dry conditions & no concreting under water conditions shall be done.
1.6.9 Protection and Curing
Concreting operations shall not
commence until adequate arrangements for concrete curing have been made by the
Contractor.
Curing and protection of concrete
shall start immediately after compaction of the concrete to protect it from :
a) Premature
drying out particularly by solar radiation and wind
b) High
internal thermal gradients
c) Leaching
out by rain and flowing water
d) Rapid
cooling during the first few days after placing
e) Low
temperature
f) Vibration
and impact which may disrupt the concrete and interfere with its bond to the
reinforcement
Where members are of considerable
size and length, with high cement content, accelerated curing methods may be
applied, as approved by the Engineer.
1.6.9.1 Water Curing
Water for curing shall be as
specified suitable for concreting.
Sea water shall not be used for
curing. Sea water shall not come into contact with concrete members unless it
has attained adequate strength.
Exposed surface of concrete shall be
kept continuously in a dump or wet condition by ponding or by covering with a
layer of sacks, canvas, Hessian or similar materials and shall be kept
constantly wet for a period of not less than 14 days from the date of placing
of concrete.
1.6.9.2 Curing compound
Curing compounds shall normally not
be used. If proposed to be used, they can be permitted at selected locations,
at the directive of the Engineer.
1.6.10 Finishing
Immediately after removal of forms,
exposed bars or bolts, if any, shall be cut inside the concrete member to a
depth of at least 50 mm below the surface of the concrete and the resulting
holes filled with cement mortar of dry pack consistency.
All construction and expansion
joints in the completed work shall be left carefully tooled and free from any
mortar and concrete. Expansion joint filler shall be left exposed for its full
length with clean and true edges.
The finished surfaces of concrete
after removal of formwork should be such that no touching up is required. All
fins caused by form joints, if any, shall be ground using electric surface
grinder.
Immediately on removal of forms, the
concrete work shall be examined by the Engineer before any defects are made
good.
a)
The work that has sagged
or contains honeycombing to an extent detrimental to structural safety or
architectural appearance shall be rejected.
b)
Surface defect of a minor
nature may be accepted. On acceptance of such work by the Engineer, the same
shall be rectified as directed by Engineer.
1.6.11 Tests
And Standards Of Acceptance
1.6.11.1 Concrete shall conform to the
surface finish and tolerance as prescribed in these specifications for
respective components.
1.6.11.2 Random sampling and lot by lot of
acceptance inspection shall be made for the 28 days cube strength of concrete.
1.6.11.3 Concrete under acceptance shall be
notionally divided into lots for the purpose of sampling, before commencement
of work. The delimitation of lots shall be determined by the following :
i) No
individual lot shall be more than 30 cum. in volume
ii) At least one cube forming an item of
the sample representing the lot shall be taken from concrete of the same grade
and mix proportions cast on any day.
iii) Different grades of mixes of concrete
shall be divided into separate lots
iv) Concrete of a lot shall be used in the
same identifiable component of the bridge.
1.6.11.4 Sampling and
testing
1. Concrete
for making 3 test cubes shall be taken from a batch of concrete at point
of delivery into construction, according to procedure laid down in IS:1199.
2. A random sampling procedure to ensure that
each of the concrete batches forming the lot under acceptance inspection has
equal chance of being chosen for taking cubes shall be adopted.
3.
150
mm cubes shall be made, cured and tested at the age of 28 days for compressive
strength in accordance with IS:516. The 28 day test strength result for each
cube shall form an item of the sample.
1.6.11.5 Test
specimen and sample strength :
Three test specimens shall be made
from each sample for testing at 28 day. Additional cubes may be required for
various purposes such as to determine the strength of concrete at 7 days for
any other purpose.
The test strength of the sample
shall be the average of the strength of 3 cubes. The individual variation
should not be more than + 15 percent of average.
1.6.11.6 Frequency
The minimum frequency of sampling of concrete of each grade
shall be in accordance with Table 4.

1.6.12 Acceptance criteria
1.
The
strength requirement of any particular grade of concrete will be considered
satisfactory if the 28 days compressive strengths of individual sets (each set
consists of 3 cubes) and of individual cubes satisfy the following requirements:
i)
For
the first five sets.
a)
The
average strength determined from any group of the three consecutive test cubes
exceeds the specified characteristic strength (f ck) by not less than 0.8
times the current margin.
b)
Only
one individual cube test result in any set may fall below the specified
characteristic strength (f ck) provided that this value is not less than 95%
of the specified characteristic strength (f ck).
ii)
Thereafter,
provided that the average strength of any fifteen consecutive cubes exceeds the
specified characteristic cube strength by at least 0.9 times the current margin
( 9 MPa ) all the subsequent test result may be considered acceptable if.
a)
The
average strength as determined from any group of three consecutive test cubes
exceeds the specified characteristic strength (f ck) by not less than 0.6
times the current margin.
b) Only one individual cube test result in
any set may fall below the specified characteristic strength provided that this
value is not less than 90% of the specified characteristic strength.
2.
Whenever
a mix is redesigned due to a change in the quality of aggregate or cement or
for any other reason, it shall be considered a new mix and initially subject to
the acceptability criteria above.
3.
If
the concrete produced at site does not satisfy the above strength requirements,
the Engineer will reserve the right to require the contractor to improve the
methods of batching, the quality of the ingredients and redesign the mix with
increased cement content, if necessary. The contractor shall not be entitled to
claim any extra cost for the extra cement used for the modifications stipulated
by the Engineer for fulfilling the strength requirements specified.
4.
It
is the complete responsibility of the contractor to design the concrete mixes
by approved standard methods and to produce the reinforced concrete conforming
to the specification and the strength requirements approved by the Engineer. It
is expected that the contractor will have competent staff to carry out this
work.
5. As frequently as the Engineer may
require, testing shall be carried out in the field for:
1.
Moisture content and absorption and density of sand and aggregate.
2.
Silt content of sand.
3. Grading of sand and aggregates.
4. Slump test of concrete.
5. Concrete cube test.
The contractor shall provide and
maintain on site at all times, until the works are completed, equipment and
staff required for carrying out these tests. The contractor shall grant the
Engineer or his representative full access to his laboratory at all times and
shall produce on demand complete records of all tests carried out on site.
Before concreting commences on any
section of the works the contractor shall obtain approval of the Engineer or
his representative as regards the formworks and reinforcements conforming to
the drawings. He shall also indicate to the Engineer in writing and obtain his
approval for positions of construction joints.
1.6.13 Cracks
i) If
cracks develop in concrete construction, which in the opinion of the Engineer
may be detrimental to the strength of the construction. The contractor shall
dismantle the construction, carry away the debris, replace the construction and
carry out all consequential work thereto.
ii) If
any cracks develop in the concrete construction, which in the opinion of the
Engineer, are not detrimental to the stability of the construction, the
Contractor at his own expense shall grout the cracks with polymer cement grout
of approved quality and also at his own expense and risk shall make good to the
satisfaction of the Engineer, which in the opinion of the Engineer has suffered
damage either in appearance or stability owing to such cracks. The Engineers
decision as to the extent of the liability of the Contractor in the above
matter shall be final and binding.
1.6.14 Defective Concrete
Should
any concrete be found honeycombed or in any way defective which may be
suspected to affect the performance of the structure, shall be rejected
outright. However, some surface defects like minor honey combing etc. not
affecting the structural properties shall on the instruction of the Engineer
repaired as per the approved procedure.

1.6.16 Equipment
Unless
specified otherwise, equipment for production, transportation and compaction of

1.6.17 Measurement for Payment
Structural concrete shall be
measured in cubic metres. In reinforced or pre-stressed concrete, the volume
occupied by reinforcement or pre-stressing cables and sheathing shall not be deducted.
Payment shall be made based on the dimensions as per the drawing if the
structure is within prescribed tolerance.

ELIGIBILITY
CRITERIA
OPEN TENDER COSTING
ABOVE RS. 10 LAKH.
Only those firms, which in their individual capacity who satisfy
the following criteria need to quote for this tender: -
(i) Should have completed at least one work of
similar type for a minimum value of 35% of Advertised Tender Value of the
subject work during the last three years (i e, current year and three previous
financial years).
(ii) Should have valid Revenue / Bankers Solvency
Certificate of 40% of Advertised Tender Value of work.
(iii) Total contract amount received during the last
three financial years should be minimum 150% of the Advertised Tender Value as
per attested certificate from the employer/client, audited balance sheet duly
certified by the Chartered Accountant etc.
(iv) In addition to
the above or different eligibility criteria have been provided in the tender
notice shall also be applicable.
NOTE: - The
eligibility criteria regarding Solvency Certificate shall not be required for
the work costing less than Rs. 1 (one) crore.
The list of
documents to be attached is given as below for the system of tendering. The
tender will be opened at the time & date mentioned in the Tender Notice and
is consists of the following:-
i) Earnest money in standard format.
ii) Attested
certificate from the employer/client, Audited balance sheet duly certified by
the Chartered Accountant etc.
iii) List
personnel, organization available on hand and proposed to be engaged for the
subject work.
iv) List of
plant and machinery available on hand (own) and proposed to be inducted (own
and hired to be given separately) for the subject work.
v) List of
works completed in the last three financial year giving description of the
work, organization for whom executed, approximate value of the contract at the
time of ward, date of award and dated of scheduled complete of the work. Date of actual start, actual
completion and final value of the contract should also be given.
vi) List of
work on hand indicating the description of the work, contract value, and
approximate value of balance work yet to be done and date of award.
vii) Bio datas of Engineers and other technical
staff to be engaged for this work.
viii) Partnership deed.
ix) Power of Attorneys.
x) Tender documents duly signed &
completed, (Schedule of items, rates and quantities, mode of payment).
xi) Any other document the tenderers may
like to submit in support of his credentials /scheme.
Note:
1. In case of item No. (v) and (vi)
above, supporting documents/certificate from the organization with whom they
worked / are working should be enclosed.
2.
Certificate from the private individual for whom such works are executed /
being executed may not be accepted.
CONDITIONS OF
TENDER
1.
The
drawings for the works can be seen in the concerned Office, at any time during
office hours.
2.
General
Conditions of Contract and Specifications for materials and works in the concerned
office or obtained on payment at prescribed rate at any time during office
hours.
3.
The
Tenderer/Tenderers shall quote his/their rates with reference to each item as shown
in the attached Schedule. The contractor
must offer a single percentage rate for all M.S. items and for N.S. items
single percentage or individual item wise rate as the case may be (as indicated
in schedule). The quantities
shown in the
attached Schedule are given as a
guide and are approximate only and are subject to variation
according to the needs
of Railway. The Railway accepts no responsibility for their
accuracy. The Railway does not guarantee
work under each item of the Schedule.
All
rates for the each item of works should be written in words as well as in
figures at all the pages wherever applicable.
In case of discrepancies between the rate quoted in figures and words,
the rate quoted in words will prevail. .
If the tenderer failed to quote the rate of any item of the schedule as
mentioned his/their tender will summarily rejected treating the same as
incomplete tender.
4.
Tender containing erasures and alterations of the tender document are
liable to be rejected. Any correction
made by the Tenderer/Tenderers in his/their entries must be attested by
him/them.
5.
The works are required to be completed within a period of completion as mentioned in the tender notice
from the date of issue of acceptance letter.
6.
The tender must be accompanied by a required Earnest
money deposited in cash or in any forms mentioned in the tender notice/tender document failing
which the tender will be summarily
rejected.
The tenderer shall hold the
offer open till such date as may be specified in the tender. It is understood that the
tender documents have been
sold/issued to the tenderer and the
tenderer is being permitted to tender in consideration of the stipulation on his part that after submitting
his tender, he will not resile from his offer or
modify the terms
and conditions thereof
in a manner not
acceptable to the
Chief Engineer / Deputy Chief
Engineer/ Executive Engineer/Divisional Railway Manager/Divisional Engineer of
the West Central Railway. Should the tenderer
fail to observe or comply with the foregoing stipulation, the amount deposited
as security for the due performance of the above stipulation shall be forfeited
by the Railway. If the tender is
accepted, the amount of earnest money will be held as part of security deposit
for the due and faithful fulfillment of the contract. The earnest money of the unsuccessful
tenderer will as therein before provided be returned to the unsuccessful
tenderers but the Railway shall not be responsible for any loss or depreciation
that may happen to the security for the due performance of the stipulation to
keep the offer open for the period specified in the tender documents or to the
earnest money while in their possession, nor be liable to pay interest
thereon.
7.
It
shall not be obligatory on the said authority to accept the lowest tender and
no tenderer/tenderers shall demand any explanation for the cause of rejection
of his/their tender.
8. If the tenderer deliberately gives / tenderers
deliberately give wrong information in his/their tender or creates/create
circumstance for the acceptance of his/their tender, the Railway reserves the
right to reject such tender at any stage.
9. If
a tenderer expires after the submission of his tender or after the acceptance
of his tender, the Railway shall deem such tender as cancelled. If a partner of a firm expires after the
submission of their tender or after the acceptance of their tender, the Railway
shall deem such tender as cancelled unless the firm retains its character.
10. As far as possible the tenderers bid should
not have any condition or specification or assumption contrary to the
provisions in these tender documents on which the tenderers bid is based, shall
be supplemented by the details of exact financial implications if applicable.
Tenderers special conditions, not in conformity with the tender specifications,
are required to be listed separately. It needs to be emphasized that only such
conditions/stipulations which are at variance with the tender conditions
stipulated such special condition taking into account the restrictions
mentioned elsewhere in the tender document. Only such of the special
conditions/specifications stipulated by tenderers which have been specifically
approved by the Railways in writing shall be deemed to have been accepted by
the Railways. Any other tenderers conditions/stipulations are at variance with
the tender conditions provisions shall be withdrawn by the tenderers.
The
special conditions quoted by the tenderers shall liable to be rejected. If any
special conditions are required to be quoted by the tenderer which should be
write on the page No. 19 as Special
conditions to be quoted by the tenderer of this tender document. Special
conditions quoted at other than this page will not be entertained.
11. The tenderers shall inspect the
proposed site of Building, and acquaint himself/themselves with the site
conditions, working hours, layout of lands, and all relevant items connected
with the execution of the work.
12. RIGHTS OF RAILWAY TO DEAL
WITH TENDER :
The
authority for the acceptance of the tender will rest with the Railway which
does not bind itself to accept the lowest or any other tender nor does the
Railway undertake to assign reason for declining to consider or reject any
particular tender or tenders.
13. EXECUTION
OF CONTRACT DOCUMENTS:
13.1 The
successful tenderers shall be required to execute an agreement with the Railway
for carrying out the works according to General Conditions of Contract,
special conditions of this tender.
13.2 The
tenderers whose tender is accepted shall be required to appear at the concerned
office of West Central Railway in person in case of a firm or corporation a
duly authorized representative shall so appear to execute the contract
documents within seven days after issued of acceptance letter to him. Failure
to do so shall constitute a breach of the agreement effected by the acceptance
of the tender in which case the full value of the earnest money accompanying
the tender shall stand forfeited without prejudice to any other right or
remedies.
14. ERRORS, OMISSIONS AND
DISCREPANCIES :
The
tenderers shall not take any advantage of any misinterpretation of the
condition due to typing or any other error & if in doubt shall bring to the
notice of Engineer without delay. In case of any contradiction only the printed
rules and books should be followed and no claim for the misinterpretation shall
be entertained. In addition provision contained in the clause of General
Conditions of Contract shall also be applicable.
15.
NOTICE TO PUBLIC BODIES :
The contractor/s shall give to the Airport Authority, JDA,
municipality, police and other authorities all notices that may be required by
law and obtain all requisite licence, permissions, clearances and pursuance
will be done by the Architect / Consultants / Contractors and statutory charges
will be paid by the Contractor (s) for such work, which may be liveable on
account of his operation in executing the work.
16.
EXCEPTED MATTER :
All
measurements, methods or measurements meaning and intent of specifications and
Interpretation of special conditions of contract, given and also made by the
Railway or by the Engineer on behalf of the Railway shall be final and binding
and shall be considered Excepted matters in terms of condition of the General
Conditions of Contract and will strictly stay outside purview of any
arbitrations limit and will not be arbitrable.
17.
SIGNING OF CONTRACT DOCUMENTS :
17.1 The
tenderer/s whose tender is accepted shall be required to appear at the concerned
office of West Central Railway in person or in a firm or corporation duly
authorized representatives shall so appear and to execute the contract
documents within seven days after notice that the contract has been awarded to
him.
17.2 Failure
to do so shall constitute a breach of the agreement affected by the acceptance
of the tender in which case the full value of the earnest money accompanying
the tender shall stand forfeited without prejudice to any other rights or
remedies.
17.3 In the event of any tenderers whose
tender is accepted shall refuse to execute the contract documents as herein
before provided. The Railway may determine that such tenderer/s has/have
abandoned the contract and there upon his/their tender and the acceptance
thereof shall be treated as cancelled and the Railway shall be entitled to
forfeit the full amount of the earnest money and to recover the liquidated damages
for such default.
18. LIQUIDATED DAMAGES
:
In
case the work is delayed due to reasons attributable to the Railway or the
contractor/s the completion period of the contract shall be extended in
accordance with the provision of General Conditions of Contract.
19. The tenderer is required to produce

20.
Delayed'
& `Late' tenders will be dealt as per rules issued by Railway Board.
21. Accepting
Authority :-
The authority for the acceptance of the tender will rest with the the
Divisional Engineer or the Executive Engineer in executive charge of the works
and shall include the superior officers of the Engineering Department of
Railway i.e., the Senior Divisional Engineer/ Deputy Chief Engineer/Chief
Engineer/ Chief Engineer (Construction), West Central Railway who does not bind
himself to accept the lowest or any other
tender nor does he undertake to
assign reasons for
declining to consider any particular tender or tenders.
22. The
successful Tenderer /
Tenderers shall be
required to execute
an Agreement with the President of India acting through the Divisional Engineer or the
Executive Engineer, in executive charge of the works and shall include the
superior officers of the Engineering Department of Railway i.e., the Senior
Divisional Engineer/ Deputy Chief Engineer/Chief Engineer/ Chief Engineer
(Construction) of the West Central Railway, for carrying out the
work according to the General Conditions of Contract and Specifications
for Works and Materials of Central Railway.
23. The
Tenderer shall keep the offer open for a
minimum period of 90/120/180 days from
the date of opening of the tender within which
period the tenderer cannot withdraw his offer, subject to the period being
extended further if required by mutual agreement from time to time. Any contravention of the above condition will
make the tenderer liable for forfeiture of his earnest money.
24.
Should a tenderer be retired Engineer of the
Gazetted rank or any
other Gazetted Officer working
before his retirement, whether in the executive/or administrative capacity,
or whether holding a pensionable post or
not, in the Engineering Department of any of the Railway owned and administered
by the President of India for the time
being, or should a tenderer being
partnership firm have as one of its partners a retired Engineer or
a retired Gazetted
officer as aforesaid, or should
a tenderer being
as incorporated company have any
such retired Engineer or retired Officer as one of its directors, or
should a tenderer have in his employment
any retired Engineer, or retired gazetted Officer as
aforesaid the full information as
to the date of retirement of
such Engineer or gazetted officer
from the said service and in cases where such Engineer or Officer had
not retired from Government service at
least two years prior to the date of the
submission of the
tender as to whether permission
for taking such
contract, if the contractor be a partnership firm or an incorporated company, to become a partner or
director as the case may be, or to take
employment under the contractor has been
obtained by the tenderer or the Engineer or the Officer as the case may
be from the President of India or any officer duly authorised by him in this
behalf shall be clearly stated in writing at the time of submitting
the tender. Tenders without the information above referred
to or a statement to the effect that no such retired Engineer or retired
Gazetted Officer is so associated with Tenderer, as the case may be, shall be
rejected.
25.
Should a Tenderer or Contractor
being an individual on the list of approved Contractors, have a relative
employed in gazetted capacity in the
Engineering Department of West Central Railway, or in the case of a partnership firm or company
incorporated under the India
Company Law should a partner or
a relative or the
partner or a share holder or a relative of a share
holder be employed in gazetted capacity in the Engineering Department
of the West Central Railway, the authority inviting tenders
shall be informed of the fact at
the time of submission of tenders,
failing which the tender may be rejected, or if such fact
subsequently comes to light, the
contract may be rescinded in accordance with the
provisions in Clause 62 of the General
Conditions of Contract.
26.
Should
the Railway decide to negotiate with a view to bring down the rates, the
original offer will still be binding in case nothing materialises out of the
negotiations. A declaration to this
effect should be submitted by the tenderer/ tenderers along with the negotiated
offer in the prescribed proforma.
27. Deduction of Income Tax at Source :-
The Rly. will deduct the Income-tax
and surcharge thereon, on the gross amount of each bill as prescribed by Govt.
from time to time and such deduction of Income Tax shall be recovered while
making payment to the contractor.
All the other taxes
which are applicable to the work as declared by the Central Govt. and state
Govt. time to time during the currency of the contract shall be deducted from
the contractors bills.
28. The
tenderer(s) quoting against standing Earnest Money
is required to pay the total
Security Deposit either in cash or in
the acceptable form
before signing the
contract documents.
29. Partnership Deeds, Power of Attorney
etc. :-
The tenderer shall clearly specify whether
the tender is submitted on his own behalf or on behalf of a partnership
concern/company. If the tender is
submitted on behalf of partnership concern/company a certified copy of
partnership deed/ articles of association, as the case may be, and a power of
attorney to sign the tender documents, bills etc. should be submitted. If these
documents are not enclosed along with the documents the tender will be treated
as having been submitted by individual, signing the tender documents. The Railway will not be bound by any power of
attorney granted by the tenderer or by changes in the composition of the firm
made subsequent to the execution of the contract. Railway may, however, recognise such power of
attorney/partnership deed/article of association after obtaining proper legal
advice, charges for which will be chargeable to the contractor.

SPECIAL CONDITIONS
OF CONTRACT
(PART-I)
1. GENERAL
1.1
These "Special Conditions
and Specifications, Instructions to
Tenderers and the stipulations made in the Schedule of quantities and rates" shall govern the works
executed under this contract in
addition to the
"Central Railway Specification
for Materials and Works, General
Conditions of Contract and Central
Railway Standard Schedule of Rates-1990", each, as amended
by correction slips from time to
time.
1.2 Where
there is any conflict between these "Special Conditions and
Specifications" and the "Schedule of
quantities and rates" on one hand and the "Central
Railway Specifications for
Materials and Works,
General Conditions of
Contract and the
Central Railway Standard Schedule
of Rates-1990" on the other, the former shall prevail.
1.3
All references in
this document to the
word "Standard
Specifications" shall mean the
Specifications mentioned in the "Central Railway Specifications for
Materials and Works".
1.4
Any foot note/s appearing below
the item/s of the contract schedule will
take precedence over these Special Conditions.
1.5
Any Specifications / Conditions
stated by the tenderer in the covering
letter submitted along with his tender shall be deemed to be
a part of the contract only to such extent as
have been explicitly accepted by the Railway.
1.6
The special conditions supplement the General
Conditions of Tenders and Additional General Conditions of Tender , the
General Conditions of Contract and the notes appearing under the relevant
chapters and sub-chapters of the Standard Schedule of Rates-1990
and should be considered a part
of the contract papers. Where the
provisions of these conditions are at variance
with the General
Conditions of Contract, these special
conditions shall prevail.
1.7
The General Conditions
of Contract will mean the
General Conditions of Contract as
amended and/or corrected from time
to time and obtaining at the time
of accepting of the tender and at
the time
of execution of the agreement mentioned in Clause 15 under Conditions of Tender. It is the responsibility of the Contractor
before submitting his tender and again before entering into said agreement to
ascertain all amendments and /or corrections made to the said General
Conditions of contract.
2.0
SECURITY DEPOSIT ON ACCEPTANCE OF
TENDERS :
2.1
Unless otherwise
specified in the special
conditions, if any, the rates for deposit of security amount, including
the amount of earnest money deposited with the tender, by
contractor will be as under, on
acceptance of tender :-
i) For contracts
upto Rs. 1.00 lakhs. 10% of the
value of the contract.
ii) For
contracts more than Rs. 1.00 lakhs 10%
of the first Rs.1.00 lakhs and
and upto Rs. 2.00 lakhs 7.½% of the balance.
iii) For contracts more than Rs.2.00 lakhs 10% of the first Rs.1.00 lakhs 7.½% of the
and upto Rs.2.00 Crores. next
Rs.1.00 Lakhs and 5% of the
balance subject
to the maximum of Rs.10.00 lakhs. The amount over and above Rs.3.00 lakhs be
recovered from the running bills of the contractors @ 10% till it reaches to required value
iv) For contracts above Rs.2.00 Crores 5% of the contract value. The
amount over
and above Rs.3.00 lakhs be recovered from the
progressing bills of the contractors @ 10% till it reaches 5% of the contract
value.
The earnest money deposited by the tenderer against this particular
contract will be converted into initial security deposit.
In the case of the contracts which are accepted on the strength of
Standing Earnest Money, the tenderer, immediately on receipt of the acceptance
letter, will have to deposit the total security deposit either in cash or in
the acceptable forms before signing the contract documents. If the contractor requests for 10% deduction
from the bills towards the security deposit, which will be considered on merit
of each case, the amount equivalent to the Earnest Money required against this
particular contract as an initial security deposit has to be deposited by the contractor
in any of the acceptable forms mentioned in para 2.2 below before signing the contract
documents.
The contractor may deposit the balance amount
in any of the forms mentioned in para 2.2 below or the same
can be deducted, if he so desires and depending on merit of the case, from his
On Account Bills at the rate of 10% until
the sum of these deductions plus the amount of
Earnest Money deposited with the tender for this works taken together
equals the requisite amount of Security Deposit required for the
due fulfillment of the
contract. The Security Deposit unless
forfeited in whole or in part, according
to the terms and conditions,
will be refunded on receipt of a
certificate from the Engineer concerned to the
effect that the work has been satisfactorily completed and maintained in
all respects for the period specified in
the Special Conditions and
Specifications of Contract
and provision under Clause 51 (1) to (3) of General Conditions
of Contract have been fulfilled
and no defects have been noticed.
No interest will accrue on the Security Deposit under any
circumstances.
2.2 The Security
Deposit referred to in para 2.1 above can
be deposited in cash with the
Chief Cashier, West Central Railway, Jabalpur or Divisional Cashier, West Central
Railway, Jabalpur and submit receipt thereof or in any of the forms mentioned
below :-
Deposit Receipts, Pay Orders, Demand
Drafts and Guarantee Bonds
(1)
The Deposit Receipt, Pay Orders, Demand Drafts should be either of the State Bank of India
or any of the Nationalised Bank or Scheduled Banks or State Co-operative Banks.
No confirmation advice from the Reserve Bank of India will be necessary. Guarantee Bonds issued by Co-operative Banks (Other than State Co-operative Banks)
would not be accepted towards Security Deposit as these
Co-operative Banks (Other than State
Co-operative Banks) are not
Scheduled State Co-operative Banks as mentioned in the
second schedule of the Reserve Bank of India. These instruments should be in favour of the
authority as mentioned in the Tender Notice/acceptance letter.
(2) Guarantee Bonds in the prescribed proforma should
be furnished in the
name of the President of
India acting through the authority of West Central Railway,
Jabalpur as mentioned in the Tender
notice / acceptance letter.
(3) Units will be accepted as Security Deposit
at 5% below the market price or at the face value whichever is less. The
contractors will have to deposit with the Railway their Units Certificate along
with the transfer deed and a letter in duplicate as per the prescribed
proforma. The Unit Certificates will be
retained by the Railway till the successful fulfillment of the contract.
Tenderer should bring the latest rate of unit certificate as declared by the
Company/firm duly attested by the Gazetted officer.
3.0 SUPPLY OF MATERIAL
BY RAILWAYS
3.1 Railways material such as steel M.S. bars,
coils, plates, tie-bars, angle iron, R.S. Js. Channels, rails etc. roofing
material glazing or any other items as are stipulated in the agreement to be
issued to the contractor for the work either free of charge or on payment as
the case may be will be issued to him at the Railways depot/goods shed at
locations as decided by Engineer-in-charge and will have to be transported by the
contractor to the site of work at his cost.
All such materials will be used by the contractor for the work in such
quantities as are indicated in the schedule or in relevant specifications or
drawings or as approved by the Engineers whose decision thereon shall be
final. Wastage of or damage to such
materials in any manner shall be totally avoided. If surplus material issued, if any, is not
returned in good condition immediately after completion of the work or if any
quantity of material supplied by the Railway is consumed in excess or wasted or
damaged or lost or not satisfactorily accounted for in that case recovery will
be made from the contractor at twice the market rate or twice book rate at the
time of last issue whichever is higher plus 5% freight and 2% incidental
charges plus 12.5% supervision charges on the above cost arrived at for the quantity
of material consumed in excess or wasted or damaged, lost or not satisfactorily
accounted for.
In case it is discovered that the quantity of steel or any other items
issued by the Railway as actually used in the work is less than the quantity/quantities
specified to be used, the cost of steel and for other such items not so used
shall also be recovered from the contractor/s on the basis stipulated in
sub-para above.
Action under this Clause
will be without prejudice to the right of the Railway to take action against
the contractor/s under the conditions of the contract for not doing/completing
the work according to the contract for not doing/completing the work according
the prescribed Specifications and approved drawings.
3.1.1
If there is any delay in supply of material to the contractor/s no claim or
compensation of any kind will be entertained, but only suitable extension of
time will be considered by the Railway depending upon the merits of the
case.
3.2
Mild steel rounds may be supplied in straight
lengths or in coils and in lengths as may be available with the Railway. In
the event of steel materials of diameters as specified in the drawings
not being available the nearest size will be given and no claims shall be
entertained on account of increased
weight of steel materials in handling and transport, cutting, bending, binding,
hooking, fixing, placing etc, reinforcement including additional binding wire.
3.3
Railway
may supply deformed bar/tor steel instead of M.S. rounds or vice-versa for
reinforcement, either of the same diameter or equivalent diameter and no extra
payment will be made for handling and transport etc. of deformed bars/tor steel
if the same is used instead of M.S. rounds or vice-versa.
3.4
Railways
materials will be issued on specific requisitions by the contractor and as per
requirement consistent with the progress of works and or progress of supply of
fabricated materials to the Railway. A
guarantee bond for the amount to cover cost of Railway material will have to be
furnished by the contractor before such materials are issued to him. The guarantee bond will be valid for at least
6 months beyond the completion period of contract. The approximate cost of Railway material to
be issued to contractor shall be intimated in due course.
3.5 All
material left over as Surplus or as Scraps out of materials supplied by the
Railway should be returned to the Railways Stores as per the instruction of
Engineer-in-charge failing which the cost will be recovered, as per the
provision of Clause 3.1 of the Special Conditions of Contract.
4. USE
OF MATERIALS SECURED WITH GOVERNMENT ASSISTANCE
4.1 The
Railway shall not supply from its own quota to the contractors controlled or
imported commodities. Assistance will,
however, be given by recommending to appropriate authorities on contractors
application for issue of import licenses and release of controlled commodities
if the Engineer is satisfied that this material is actually required by the
contractors for carrying out the work and is not available in the country.
4.2 Where any raw
materials for the execution of the contract are procured with the assistance of
Government either by issue from Government, stocks or purchases under
arrangements made or permit(s) or license(s) issued by the Government, the
Contractor shall hold the materials as trustee for the Government and use such
materials economically and solely for the purpose of the contract against which
they are issued and not dispose off them without permission of the Government
and return, if required by the Government, all surplus or unserviceable
materials that may be left by him after completion of the contract or at its
termination for any reason whatsoever on his being paid such price as
Government may fix with due regard to the condition for any reason whatsoever
on his being paid such price as Government may fix with due regard to the
condition of the materials. The freight
charges for the return of the materials according to the direction of the
purchaser shall be borne by the contractor, in the event of contract being
cancelled for any default on his part.
The decision of Government shall be final and conclusive.
4.3
In
the event of a breach of the aforesaid conditions, the contractor shall in
addition to throwing himself open to action for contravention of terms of the
license(s) or the permit(s) and/or for original breach of trust be liable to
account to Government for all moneys, advantages or profits resulting or which
in the usual course would have resulted to him by reason of such breach.
5. HIRE OF PLANT & MACHINERY
AND OTHER FACILITIES
5.1
The contractor shall
make his own arrangements for
all plants and machinery, other facilities, equipments, tools
including spare parts,
fuel and consumable stores, and all
labour required to ensure
efficient methodical execution of the work.
The rates quoted and accepted shall be deemed to be inclusive of all
charges of such items.
5.2
On the contractor's request the Railway may, however, give on hire plant
and machinery/other facilities, equipment
and tools, if available spare
with the Railway, without any commitment
on the part of the Railway to do so, in such case, the hire charges for
plant and machinery per annum
will be calculated to
cover interest, ordinary repairs and maintenance charges at 5%, special
repairs and maintenance charges at 10%,
depreciation charges as
per extant rules of the Railway, and an additional
10% on
the total of these four above, on the cost of the Plants &
Machinery, which will be the present day market value plus freight and other incidental charges increased by 12.5%
supervision charges.
5.3
Hire charges for items other
than plant and machinery, which do
not require any form of repair
and maintenance, shall only take into account interest on capital,
depreciation and an additional 10% on
these two.
5.4 The hire charges per day shall be
arrived at by dividing the annual
hire charges by 250, which shall
be assumed to be the
number of working days in a year for
this purpose only. These hire charges will be payable from the
day the plant is handed over to the day it is returned to the Railway
administration. If, however, during this
period the plant remains out of order for reasons beyond the control of the
contractor, or is withdrawn for periodic overhaul or any repairs, such periods
shall not be counted for levy of hire charges.
The contractor shall enter into a separate agreement in this respect and
the terms and conditions as per the agreement will be final and binding on the
contractor.
5.5
In the event of a plant or
equipment or facility given on
hire to the contractor not being returned to the Railway administration
in a reasonably goods working order/depreciation that it
would have suffered for the period of hire, the Railway
shall treat the plant/facility as
on sale, as per extant orders of the
Railway, from the date it was initially given on hire, withdrawing the hire terms and charges.
5.6
If, however, the
plant and machinery/other facilities, equipments, and
tools requisitioned by the contractor
are not available in Railway's stock or the Railway
decides not to supply the same for reasons whatsoever, neither the
Railway shall be bound
to arrange for the supply thereof nor will the
Railway's inability to supply
them be accepted as an excuse for
delay in the completion of the
works/or for any claims thereof.
6. HANDINGOVER
OF SITE
Contractor should start the
work within 7 days from the date of issue of acceptance letter. The site will be
handed over to the contractor/authorised representative after reporting from
the contractor's side. It will not be
binding on the Railway to hand over full site at a time in the starting to the
contractor, but the site will be handed over to the contractor commensurate
with the progress of the work. A note of
handing over of site to the contractor in addition to entry in the site order
book will be prepared duly signed by the Railway and Contractors representative
and submitted to the Engineer In charge.
7. SETTING OUT OF WORKS :-
7.1 In case of bridges
the Railway will initially set out the centre line of the
bridge and the alignment and fix
the position of the piers and abutments. The contractor shall thereafter set out the work
and every part thereof fully. The
contractor shall be responsible for maintaining the accuracy of
the alignment, positions, levels and
of the work in accordance with the drawings, directions
or instructions given from time to time to him and every
facility shall be given to the engineer for checking of the same.
The contractor at his own cost shall rectify an error in the dimensions,
alignments positions or levels of work set out or constructed by him to the
satisfaction of the Engineer.
7.2 In
the case of building, or other structures the Engineer or his representative
will set out the centre longitudinal
or the face line and at least one main
cross line.
7.3 The work shall be set out by the contractor
to the satisfaction of the engineer but his approval thereto shall
not, nor shall
his joining with the contractor in setting out the
work, relieve the contractor from
his entire and sole responsibility for correctness thereof.
7.4 The
contractor shall also provide, fix and
be responsible for the
maintenance of all stakes, template
profiles, level marks, points
etc. & must take all necessary precautions to prevent these from being removed, altered or
disturbed and will be held responsible
for the consequences of such removal,
alterations or disturbances,
should the same take place, and for their efficient reinstatement.
8. SUPPLY OF WATER AND ELECTRICITY :-
8.1 The
contractor shall make his own arrangements for water supply. Wherever it is convenient to the Railway
Administration, the water from piped supply may be made available to the
contractor, provided the contractor shall arrange at his own expense to effect
the connections and lay additional pipe lines and accessories to the site of
work and that the contractor shall not be entitled to any compensation for
interruption or failure of the water supply.
The contractor will have to pay for such water supply from Railway well
or tube wells at a rate of one per cent (1%) on the amount of all items or work
appearing in the bills payable to the contractor in respect of which work such
water has been used by the contractor and such charges shall be deducted from
sums due or payable by the Railway to the contractor from time to time. Water Connections to labour camps will not
be permitted. Contractor has to make his
own arrangement for water supply to the labour camps.
8.2 The contractor
shall make his own arrangements
for the operation of mechanical
equipments required for the execution of work
and/or for the purpose of lighting
for working during
day/night time. Wherever, it is
convenient to the Railway Administration, the electric supply may be made
available to the contractor provided the contractor shall arrange at his own
expense to effect the connections and lay additional wiring, provide meter and
other accessories on the site. Such work
of laying wiring etc. shall be done under supervision of a qualified staff and
a certificate shall be required to be submitted to the effect that the work of
wiring has been done as per rules or the work shall have to be got done through
Railway Organization and the charges for the same shall have to be borne by the
contractor as per extant rules.
8.3 The contractor shall not be entitled
to any compensation for interruption or failure of the electric supply. The contractor will have to pay for such
electric supply from Railway at a rate agreed to between contractor and Railway
Administration and such charges shall be deducted from the sums due or payable
by the Railway to the contractor from time to time.
8.4.1
Water
available locally in wells, creeks, or nallahs may be brackish water at some
locations. It should be noted that no
sea or brackish water shall be used in all classes of masonry, reinforced, mass
concrete work and curing of work. In
addition, water used for the above works shall be free from earthy, vegetable
or organic matter, oils, acids and alkaline substance in solutions or in
suspension and impurities and shall be fit for drinking.
9. WORKS INVOLVING USE OF CEMENT AND STEEL
Cement and steel for
use in the works should be procured by the contractor from the authorised /approved
manufacturers/their authorised dealers/ authorised stock yards which should
conform to IS Specifications and special conditions of cement and steel.
Cement bags should be
procured preferably in paper / polythene bag packing & should bear the
following information in legible markings:
i) Manufacturer's name.
ii) Registered Trade Mark of manufacturer,
if any.
iii) Type of Cement.
iv) Weight of each bag in kg. or
No. of Bags/Tonne.
v) Date of manufacture,
generally marked as week of the
year/year of manufacture,
e.g. 30/93 which means 30th
week of 1993.
To ensure quality control, test certificates
from the manufacturers should be produced by the contractors which should
conform to the relevant specifications and IS codes (latest specifications may
be incorporated).
Railways may also take
samples during the course of work & get the cement and steel tested to
ascertain their conformity to specifications.
When such sampling is done, it should be as
per specifications laid down in relevant IS Codes.
Tests on
Cement will be as per IS 4031 and any other test as specified by the
Engineer or his representative.
Tests on steel samples will be
carried out as per specifications laid down in relevant IS Codes.
The contractor should
make his own arrangement for proper stacking and storing of cement, reinforcing
bars and structural steel etc. All
material should be protected from any depletion. The reinforcing bars should be
protected from corrosion.
Further
details have been indicated in the Special Conditions (Part-II)
10.
PRESERVATION OF WORK
Contractor should take
all care to preserve the work until taken over by the Railway in good
condition. Contractor is responsible for
handing over of work to the Railway as per scope of contract.
11. EMPLOYMENT OF STAFF
The contract is liable
for cancellation if either the contractor himself or any of his employee is
found to be a person of Gazetted rank of Engineering Department which includes
Civil, Mechanical, Electrical, Signal & Telecommunication Departments of
Railways whether pensionable or non-pensionable who after retirement has sought
engagement as contractor for or in connection with the execution of public
works whether on Railway, P.W.D. or
Defence Forces or as an employee of such contractor
within 2 years of his retirement without obtaining the
permission of the President of India before taking up such
engagement or employment.
12. The Contractor shall
employ the following
technical staff during the
execution of thE work:-
i) Atleast one graduate engineer when the
cost of the work to be executed is Rs.15 Lakhs and above.
ii) Atleast one qualified diploma holder
when the cost of the work to be executed is more than Rs.5 Lakhs, but less than
Rs.15 Lakhs.
Technical staff should be available at site whenever
required by the Engineer-in-charge to take instructions. In case the contractor fails to employ the
technical staff as aforesaid, he shall be liable to pay a reasonable amount to
the Railways not exceeding a sum of Rs.2000/- (Rupees Two Thousand only) for
each month of default in case of graduate engineer and Rs.1000/- (Rupees One
Thousand only) for each month default in case of diploma holder.
The
decision of the Engineer-in-charge as to the period for which required
technical staff was not employed by the contractor and as to the reasonableness
of the amount to be deducted from the contractor, shall be final & binding
on the contractor
13. INSPECTION REGISTERS AND RECORDS
The contractor shall
maintain accurate records, plans and charts showing the dates and progress of
all main operations and the Engineer shall have access to this information at
all times. Records of tests made shall
be handed over to the Engineer's representative after carrying
out the tests. The following registers
will be maintained at site, by the Railways representative.
i) Site Order Register -
The contractor shall
promptly acknowledge orders given therein by the Engineer or his representative
or his superior officers and comply with them.
The compliance shall be reported by the Contractor to the Engineer in
good time so that it can be checked.
ii) Cement Register -
This register will be maintained to
record daily receipt and consumption of the cement duly indicating the balance
quantity. The quantum of the work done for the cement issued on a particular
date will also be maintained.
iii) Steel Register -
This register will record the
receipts of steel items and details of reinforcements and members wherever
steel is used.
iv) Labour Register -
This register will be
maintained to show daily strength of labour in different categories employed by
the contractor.
v) Log Book of events -
All events are required to be
chronologically logged in this book date and shift-wise.
vi) Material Passing & Testing Register -
Register will show material brought
at site, passed, rejected etc. with quantity, specifications & test results
etc.
All registers at item (i) to (vi)
mentioned as above will be maintained by the representative of the Engineer and
signed by the contractor. Any other registers considered necessary by the
Engineer, shall be maintained at site in which the representative of the
Engineer and the contractor will have to sign.
The registers, proforma charts, etc. will be the property of the
Railway.
Registers as mentioned above will
have to be maintained depending on the scope of the work as prescribed by
Engineer at site.
14. SAMPLING AND TESTING
Contractor
shall establish a field laboratory at site of work at his cost providing
necessary facilities for performing routine type tests such as physical
properties of cement, bricks, aggregate, water, concrete including its crushing
strength to the satisfaction of the Engineer-in-charge. He will also arrange
for the testing of physical/ chemical properties of reinforcement steel used by
him from Govt. approved test houses/Engineering Colleges to establish the
quality of steel bars used. He shall
ensure that equipments provided are of latest specification and are in good
working order and got calibrated at the laboratory. The contractor shall get certain percentage
of samples tested at other approved laboratories as may be directed by the
Engineer-in-charge as confirmatory tests at his own cost.
15. VARIATION
IN EXTANT OF CONTRACT:
15.1 MODIFICATIONS TO CONTRACT TO BE IN
WRITING :
In
the event of any of the provisions of the contract requiring to be modified,
after the contract documents have been signed, the modifications shall be made
in writing & signed by the Railway and the contractor, and no work shall
proceed under such modifications unless this has been done. Any verbal or
written arrangement abandoning modifying extending, reducing or supplementing
the contract or any of the terms thereof shall be deemed conditional and shall
not be binding on the Railway unless and until the same is incorporated in
formal agreement and signed by the Railway and the contractor, and till then
the Railway shall have the right to repudiate such arrangement.
15.2 POWER OF MODIFICATIONS TO CONTRACT :
15.2.1 The Engineer on behalf of the Railway shall be
entitled to order in writing to enlarge or extend, diminish or reduce the works
or make any alterations in their design, character, position, site, quantities,
dimensions or in the method of their execution or in the combination and to
order any additional works to done or any works not to be done & the
contractor will not be entitled to any compensation for any increase/reduction
in the quantities of work but will be paid only for the actual amount of work
done.
15.2.2 Unless
otherwise specified in the special conditions of the contract, the accepted
variation in quantity for each individual item of the contract would be upto
25% of the quantity originally contracted. The contractor shall be bound to
carry out the work at the agreed rates and shall not be entitled to any claim
or any compensation whatsoever upto the limit of 25% variation in quantity of
individual items of work.
15.2.3 In
case the value of contract goes beyond 25% of the original agreemental value,
for the first 15% increase in the value beyond 25% of the agreemental value,
the rates will have a reduction of 2% in the incremental value of the agreement
and for the next 10% increase in the value rates will have an additional
reduction of 2% in the further incremental value of the agreement.
15.2.4 Execution
of quantities beyond (+) 50% of the overall agreemental value, if found
necessary, shall be through fresh tenders or by negotiating fresh rates with
existing contractor as per procedure laid down by Railway Board.
15.2.5 For
variation in value beyond (-) 25% (Minus Twenty Five percent) of the
agreemental value, the work shall be done at the same rates, terms and
conditions by the contractor.
15.2.6 In
case of vitiation due to variation in quantities the amount by which vitiation
occurs will not be payable to the tenderer/contractor.
15.3 VALUATION OF VARIATION:
15.3.1 The enlargement, extensions, reductions, alterations or additions
referred to in of this clause shall in no degree, effect the validity of the
contract but shall be performed by the contractor as provided therein and will
be subject to the same conditions, stipulations and obligations as if they had
been originally, and expressly included and provided for in the specifications
and drawings and the amount to be paid therefore shall be calculated in
accordance with the accepted schedule of rates. Any extra item/quantities of
work, falling outside the purview of the provision this clause above shall be
paid for at the rate determined under clause-39 of General Conditions of Contract.
16.
SALES TAX/COMMERCIAL TAX/TURNOVER
TAX IN WORKS CONTRACT
The element of sales tax/commercial
tax/turnover tax in works contract, if any, shall be considered to be included
in the rates quoted by the tenderer/s in the tender schedule. Sales tax /commercial tax/turnover tax on
works contract will be recovered from the contractors bill at the rate as
applicable as per rules framed by State Govt. from time to time and remitted to
the State Govt. by the Railways.
17 TAXES,ROYALTIES AND
PATENT RIGHTS.
17.1
All
rates quoted in the tender shall be deemed to be inclusive of all taxes,
royalties payable by the contractor/s to the Govt. or public body or local authority
and no additional amount will be paid or claim entertained on this account by
the Railway. Contractor shall not have
any claim whatsoever as a result of the increase in the rates for such
royalties, taxes, duties, or any other forms of levies etc. Concessional Sales Tax Form and Octroi
Exemption Certificate will be issued to Contractor on his specific request, if
legally permissible.
17.2
The
contractor shall defray the cost of all royalties, fees and other payments in
respect of patents, Patent rights and licences which may be payable to patented
licensee or other person or corporation and shall obtain all necessary
licences. In case of any breach (whether
willfully or inadvertently) by the contractor of this provision, the contractor
shall indemnify the Railway and its officers, servants, representatives against
all claims, proceedings, damages, cost charges, loss and
liability which they or any
of them may sustain incur or be put to
by reason or
inconsequence of, directly or indirectly, any
such breach and against payment of any royalties, damages or
other moneys which the Railway may have to make to any
person or paid in total
to the patent rights in respect of the
users of any
machine, instructions, process,
articles, matters or thing
constructed, manufactured,
supplied or delivered by the
contractor to his order under
this contract.
17.3
PAYMENT OF ROYALTY CHARGES
All payment of royalty charges etc. to the State
Government in connection with extraction and supply of rubble/stone
ballast/sand and earth, from other than Railway land acquired by Railways under
Land Acquisition Act-1985, have to be borne and paid by the contractor.
The Railways in consultation with the respective State
Governments will confirm percentage of Royalty Charges to be recovered for
supply of minor minerals. The Railway
Administration is entitled to deduct from the contractors and keep in deposit
such amount equal to the proportionate Royalty Charges from each on account
bills and the same will be released as and when the contractor submits a
receipt/documents/clearance certificate certifying that Royalty Charges have
been paid by the Contractors, relating to the contract.
The contractor will be
required to obtain a final Royalty clearance certificate from the concerned
State/Revenue Authorities/Collector and produce the same to concerned office of
West Central Railway after completion of supply but before the release of final
bill. If in any case the contractor
fails to produce the clearance certificate for Royalty Charges, final bills
will be passed after retaining an amount equal to the amount of unpaid Royalty
charges, as intimated by the Revenue Authorities/Collector or as calculated on
the basis of relevant Rates, for payment of Royalty Charges applicable to the
area. No claim regarding interest
charges for delay in payment of the retained amount on Royalty account shall be
entertained.
The retained amount will
be released, at the discretion of the administration, on production of clear
Bank Guarantee covering the amount so with held towards Royalty Charges/State
taxes.
17.4 Form
for availing concessional sales tax for supply to Government Deptt. will be
issued for supply contracts only on request of contractor if legally
permissible.
18. Permit
or Parwana
The contractor will at
his own expense obtain such permits or parwana from whomsoever necessary for
carrying out work or for any other purpose as may be necessary to enable
him to
perform his part of the contract. The Railway Admn. will not
under any circumstances be liable to obtain any permit or parwana whatsoever, for the contractor.
19.
STORAGE OF INFLAMMABLE ARTICLES
No inflammable
materials, such as petroleum oil etc.
within the meaning of the Indian Petroleum Act and Indian Explosives Act shall
be stored at site or adjacent land until the approval
of the Railway and necessary
licence under the Act has been obtained by the Contractor. All due precautions as required under the
Act shall be taken by the contractor.
20. (A) ANTI-LARVAL
WORKS
The contractor/s shall at his/their
cost carry out all anti-larval works as per the Bye/laws of the local
authorities concerned or as may be directed by the Engineer during the
execution of the work/s under this contract. If the contractor/s fails to carry out such
work/s the Railway may carry out the same and recover the cost thereof from the
contractor/s in the same way, as other Railway amounts are recoverable.
(B)
ANTI-MALARIA PRECAUTIONS
Every
precaution shall be taken by the contractor to prevent the breeding of
mosquitoes on the works during construction and all receptacles used for the storage of water must be
suitably protected for this purpose or must be emptied at close of the work
every day.
20.
SERVICE ROADS AND APPROACHES
The rates for all items of
the schedule shall be inclusive of the cost of all arrangements for crossing
all obstructions to be crossed in the course of the work over land or across
water and the cost of providing and maintenance of approach and/or service
roads as may be necessary for bringing and removing the plants, machinery and
material to and from the site of work including rent for use and/or
compensation for damage if any to intervening private land traversed by such
approach/service roads, and including cost of acquisition of land, if required
for the
purpose. The contractor will be
permitted to make use of available service roads of the Railways free of
cost. Railway reserves the right to
make use of the contractors service road without paying any charges to
him.
22. RATES
Tenderer should note that the rates
quoted shall embrace all operations necessary for the satisfactory completion
of the work and shall include all charges for handling, transport, lead, lift,
labour, housing, sanitation, water supply, materials, fuel, tools and plants,
electric power, workshop facilities, machinery, security, lighting etc. and any
other expenses of every kind.
23.
SAFE WORKING METHODS
The contractors shall at all times,
adopt such safe methods of working as will ensure safety of structures,
equipment and labour, Safety Rules that should be adhered to are given as
guidelines in Appendix "A". If
at any time, the Railway finds the safety arrangements inadequate or unsafe,
the contractor shall take immediate corrective action as directed by the Rlys
representative at site. Any directions
in the matter shall in no way absolve the contractor of his sole responsibility
to adopt safe working methods. The
contractor is responsible for providing skilled personnel and adequate expert
supervision so as to ensure complete safety.
24.
WORKING HOURS
24.1
The
contractors attention is drawn to clause 23 of the General Conditions of Contract
which stipulates that he shall not carryout any work between sunset and sunrise
without the previous permission of the Engineer. However, on receipt of request in writing by
the contractor, the Engineer may grant permission for doing works after sunset
if he is satisfied that the contractor arrangements for so doing the work will
ensure quality and workmanship and will also ensure safety of workmen and
structures. The contractor will be
primarily responsible to fulfil these conditions during the execution of works.
It will be his responsibility to
provide adequate lighting at all working places as well as to ensure safety
during working. He will also appoint, if
necessary, men to keep watch of the temporary structures during the progress of
the work at night.
24.2 If the Engineer is
satisfied that the work is not likely
to be completed in time except by resorting to
night work, he may
suo-moto order the contractor to carry out the works
even at night without conferring any rights on
contractor for claiming
any extra payments
for the same.
The contractor will be responsible to comply with all the directions and
instructions given by the Engineer in this regard.
25. NOTICE TO PUBLIC BODIES
The contractor shall
give to the Municipality, Police and other authorities all notices that may be
required by the law and obtain all requisite licenses for temporary
obstructions, enclosures and pay all fees, taxes and charges which may be
livable on account of his own operation in executing the contract. He should make good any damage to adjoining
premises whether public or private and provide and maintain any light etc. required
in night.
26. FIGURES
& DIMENSIONS
Figures and dimensions
on drawings shall supersede measurements by scale and drawings to a large scale
shall take precedence over those to a smaller scale.
27. PLEA
OF CUSTOM
The plea of `Custom' prevailing will
not on any account be permitted as an excuse for infringement or any of the
conditions of contract or specifications.
28.
LEGAL CHARGES
A fee of Rs.200/- per legal document like
partnership deed or power of attorney executed before or after the execution of
the contract will be recovered from the contractor for obtaining legal advice
of the Law Officer.
29.
CARE OF STAFF
The Railway will provide no
quarters for accommodation of the contractor or any of his staff employed on
the work. The contractor may be allowed to erect any labour camps for housing
the labour at or near the site work on available Railway land. The contractor shall at his own cost make
all necessary and adequate arrangements for the importation, feeding and
preservation of the hygiene of his staff.
The contractor shall permit inspection at all times of all sanitary
arrangements made by him, by the Engineer or his assistant or the Medical staff
of the Railway. If the contractor fails
to make adequate medical and sanitary arrangements these will be provided by
the Railway and the cost thereof, will be recovered from the contractor.
30. FIRST-AID
The contractor shall maintain in a
readily accessible place first-aid appliance including adequate supply of
sterilised dressing and sterilised cotton wool.
The appliances shall be placed under the charge of responsible person
who shall be readily available during working hours.
31(A) .
FORCE MAJEURE CLAUSE:-
If at any time during the
continuance of this contract, the performance in whole or in part by either
party of any obligation under this contract shall be prevented or delayed by
reason of any war, hostility, acts of public enemy, civil commotion, sabotage,
serious loss or damage by fire, explosions, epidemics, strikes, lockouts or
acts of God (hereinafter referred to events) provided, notice of the
happening of any such event is given by either party to the other within 21
(Twenty one) days from the date of occurrence thereof, neither party shall by
reason of such event, be entitled to terminate this contract nor shall either
party have any claim for damages against the other in respect of such
non-performance or delay in performance, and works under the contract shall be
resumed as soon as practicable after such event has come to an end or ceased to
exist. The works/completion period shall
be extended by the Railway Administration for this period without any penalty.
31.(B) DAMAGE, ACCIDENTS OR FLOODS OR TIDES
The contractor shall take all precautions against damages from
accidents, floods or tide. No
compensation will be allowed to the contractor for his tools, plants,
materials, machines and other equipment lost or damaged by any cause
whatsoever. The contractor shall be
liable to make good the damages to any structure or part of a structure, plant
or material of every description belonging to the Railway Administration, lost
or damaged by any cause during the course of contractor's work.
The Railway Administration will not
be liable to pay to the contractor any charges for rectification or repairs to
any damage, which may have occurred from any cause whatsoever, to any part of
the new structures during construction.
No claims in this regard will be arbitrable.
32.
TRESPASS
The contractor shall at all times be
responsible for any damages or trespass committed by his agents and workmen in
carrying out the work, unless such trespass is authorised by the Engineer.
33.
Code Nos. description and rates
given in the schedule
are based on the Standard
Schedule of Rates-1990. Any
discrepancies noticed at any time during the execution, currency of the work in
wording, rates, quantity of cement etc. should be rectified by reference to the
printed schedule which shall be treated as authoritative and binding on the
contractor. The notes appearing at the
beginning of each of the relevant chapters of the Central Railways Standard
Schedule of Rates-1990 except as modified by these special conditions will be
applicable to this contract, both for standard schedule and non-schedule items.
34. PROVISION
OF PAYMENT OF WAGES ACT & CONTRACT LABOUR (REGULATION & ABOLITION ACT)
(1)
The
contractor shall comply with the
provisions of the payment of
Wages Act-1923 and the rules made there under in respect of all employees
directly or through petty contractor, sub-contractor employed by him in the
works and the Contract Labour
(Regulation and Abolition) Act, 1970 and
the Contract Labour (Regulation and Abolition)
Central Rules, 1971 as modified
from time to time, wherever applicable and shall also
indemnify the Railway from and against any claim under the aforesaid Acts and the Rules.
(2) The contractor shall obtain valid licence
under the aforesaid Act as modified
from time to time before the commencement of the work and continue to have a
valid licence until the completion of the work. Any failure to fulfill this requirement
shall attract the penal provisions of the contract arising out of the resultant
non-execution of the work.
(3) The contractor shall pay to labour
employed by him
directly or through sub-contractors the wages as
per provisions of the aforesaid Act and
the Rules wherever applicable. The contractors shall not withstanding the
provisions of the contract to the contrary, cause to be paid the wages to
labour indirectly engaged on the work including any engaged by his
sub-contractors in connection with the said work, as if the labour had been
immediately employed by him.
(4) In respect of all labour directly
or indirectly employed
in the work for performance of the
contractor's part of the contract, the
contractor shall comply with or
cause to be complied with the provisions
of the aforesaid Act and the
Rules wherever applicable.
(5)
In
every case in which by virtue of the provisions of the aforesaid Act or the
Rules, the Railway is obliged to pay any amount of wages to a workman employed
by the contractor or his sub-contractor in execution of the work or to incur
any expenditure in providing welfare and health amenities required to be
provided under the aforesaid Act and the Rules or to incur any expenditure on
account of the contingency liability of the Railway due to the contractors
failure to fulfil his statutory obligations under the aforesaid
Act or the Rules and Railway
will recover from the contractor the amount of wages so
paid or the amount of expenditure so
incurred and without prejudice to the
rights of the Railway under Section 20 Sub-section (2)
and Section 21 Sub-section (4) of
aforesaid Act.
The
Railway shall be at liberty
to recover such amount or part
thereof by deducting it
from the security deposit and/or
from any sum due by the
Railway to the contractor whether under the contract or otherwise. The Railway shall not
be bound to contest any claim made
against it under sub-section (1) of Section 20 and Sub-section
(4) of Section 21 of the aforesaid Act
except on the written request of the
contractor and upon his giving to the Railway
full security for
all cost for which the Railway
might become liable in contesting
such claim. The decision
of the Railway regarding the amount actually recoverable from the contractor as stated above,
shall be final and binding on the contractor.
( 6) If the
contractor is a
co-operative labour contract,
Society / Vendor Co-operative
Society, there shall be no element of
contractor or ex-contractors in that Society in any capacity nor shall
there be any close relative of the
Contractor or ex-contractor associating with the Society as
an office bearer. The Railway
administration reserve the right to terminate the
con tract of the Society at any time without any reason after giving
notice of calendar month, in case of breach of the above clause.
35.
CLAIMS
35.1
The
contractor shall put up his claim as per clause
43 of the General Conditions of Contract during the progress of work
and not after completion of the
work. All such claims shall be settled promptly during
the progress of the work.
35.2 The contractor shall not be
entitled to make any claim whatsoever against the Railway under or by virtue of
or arising out
of this contract, nor shall the Railway entertain
or consider any such claim, if made by the contractor after he have signed a `No Claim Certificate' in
favour of the Railway,
in such form as shall be required by
the Railway after the
works are finally measured. The Contractor shall be debarred from
disputing the correctness of the items covered by No Claim Certificate or
demanding a reference to arbitration in respect thereof.
35.3 Clause 39 of General
Conditions of Contract is replaced by the revised Clause as under(Boards
letter No.78/WI/CT/34(Rev.Co.)
dt.15-1-1979 :-
Any item of
works carried out by the contractor on
the instructions of the Engineer
which is not included in the accepted
Schedule of Rates shall be
executed at the
rate set forth
in Schedule of
Rates -1990 (Central Railways)
modified by the tender
percentage and where such items are not contained in
the latter work will be done
at the rates agreed upon between the
Engineer and the Contractor before the execution of such items of work and
the contractor shall be bound to
notify the Engineer at least seven
days before the necessity arises for the execution of such items
of work that the accepted
schedule of rates does not include a rate or rates for the extra work
involved. The rates payable for such items shall be decided at the meeting to
be held between the Engineer and the
contractor in as short period as possible
after the need for the special items has come to the notice. In case,
the contractor fails to attend
the meeting after
being notified to do so or in the
event of no settlement being arrived at the Railway shall be entitled to execute the
extra works by
other means and the contractor
shall have no claims or loss or
damage that may result from such procedure.
Provided always that if the contractor shall commence
work or incurs any expenditure in regard there-to-before the
rates shall be determined as lastly here-on-to for-mentioned, then and in such a case the
contractor shall only be entitled to
be paid
in respect of the work carried out or expenditure incurred by him
prior to the date of
determination as aforesaid according to rates as shall be
fixed by the
Engineer. However, if the
contractor is not satisfied with the decision of the Engineer in this respect he may
appeal to the Chief
Engineer within 30 days of
getting the decision of
the Engineer, supported by
analysis of the rates claimed. The Chief
Engineer's decision after hearing both the parties in the matter, would be
final and binding on the contractor and the Railway.
36. SETTLEMENT OF
DISPUTES
36.1 The
disputes will be settled under the Arbitration Act 1996. The successful
tenderers shall put up his/their claim as per clause 43 of the General
Conditions of the Contract during the progress of work and not after completion
of the work. All such claims and dispute shall be settled promptly during the
progress of the work. The final authority for giving the decision on claim and
dispute put up by the tenderers/contractors shall be the Chief Engineer, West
Central Railway, Jabalpur.
36.2 The
provision of the clause 63 & 64 of the General conditions of contract
will be applicable only for settlement of claims of dispute/(s) between the
parties for value less than or equal to 20% of the value of the contract. When
claims or disputes are of the value more than 20% of the value of contract,
provision of clause 63 & 64 and other value and clause of the general
conditions of contract will not be applicable and arbitration will not be
remedy for settlement of such disputes.
36.3 The
contractor/s shall not be entitled to ask for reference to arbitration, before
the completion of the work assigned to him/them contract. The contractor/s
shall seek reference to arbitration to settle the disputes only once within the
ambit of condition above.
36.4 The
contractor/s shall not be entitled to make any claim whatsoever against the
railways under or by virtue of or arising out of this contract, nor shall the
Railway entertain or consider any such claim, if made by the contractor/s after
he/they shall have signed NO CLAIM CERTIFICATE in favour of the
Railway, in such form as shall be required by the Railway after the work are
finally measured up. The contractor/s shall be debarred from disputing the
correctness of the items covered by No Claim Certificate or demanding a
reference to arbitration; in respect thereof after clear no claim as given by
contractor the dispute if any will not be arbitrable.
36.5 These
special conditions shall prevail over existing clause 63 & 64 of the
General conditions of contract other than provision relating Excepted
Matters. For settlement of disputes between one Government Deptt. And another
or between the Government Department and Public Sector undertaking, the
following special conditions shall be applicable.
36.6 In
the event of any dispute of difference between the parties hitherto, such
dispute or condition shall be resolved amicably by empowered agencies of the
Government. If such resolution is not possible, then the unresolved dispute or
difference shall be referred to arbitration of an arbitrator to be nominated by
Secretary, Department of Legal Affairs (Law Secretary) in terms of office
Memorandum No. 55/3/1/75/CF dt. 19-12-75 issued by the Cabinet
Secretariat (Department of Cabinet Affairs) as modified from time to time.
36.7 The arbitration Act, 1996 or the
arbitration clause contained in the General Conditions of Contract shall not be
applicable to the arbitration under this clause. The award of the Arbitrator
shall be binding upon parties in the dispute, provided however, any Party
aggrieved by such award may make further reference for setting aside or
revision of the award to Law Secretary whose decision shall bind the parties
finally and conclusively
CLAUSE 63 &
64 OF G.C.C.
36.8 Clause
Nos. 63 & 64 of General Conditions
of Contract (GCC) have been revised in view
of Promulgation of the Arbitration and Conciliation
Ordinance-1996, as under :- (Rly.Boards
letter No.96/CE-I/CT/29 dt.6-8-1997).
CLAUSE 63
:
Matters finally determined by the Railway - All disputes and differences of
any kind whatsoever arising out of or in connection with the contract, whether
during the progress of the work or after its completion and whether before or
after the determination of the contract shall be referred by the contractor to
the Railway and the Railway shall within 120 days after receipt of the
Contractors representation make and notify decisions on all matters referred
to by the Contractor in writing provided that matters for which provision has
been made in Clause 8, 18, 22(5), 39, 43(2), 45(a), 55, 55-A(5), 57, 57(a),
61(1), 61(2) and 62(i) to (xiii) (B) of General Conditions of Contract or
in any Clause of the Special Conditions of the Contract shall be deemed as excepted matters and decisions of
the Railway authority, thereon shall be final and binding on the contractor
provided further that excepted matters and decisions shall stand specifically
excluded from the purview of the arbitration clause and not be referred to
arbitration.
64 (1) (i) - DEMAND
FOR ARBITRATION
In the event of any
dispute or difference between the parties hereto as to the construction or
operation of this contract, or the respective rights and liabilities of the
parties on any matter in question, dispute or difference on any account or as
to the withholding by the Railway of any certificate to which the contractor
may claim to be entitled to, or if the Railway fails to make a decision within 120
days, then and in any such case, but except in any of the expected matters
referred to in Clause 63 of these conditions, the contractor, after 120 days
but within 180 days of his presenting his final claim on disputed matters shall
demand in writing that the dispute or difference be referred to arbitration.
64 (1) (ii) :
The demand for arbitration shall
specify the matters which are in question or subject of the dispute or
difference as also the amount of claim item wise. Only such dispute(s) or difference(s) in
respect of which the demand has been made together with counter claims or set
off shall be referred to arbitration and other matters shall not be included in
the reference.
(a)
The
Arbitration proceedings shall be assumed to have commenced from the day, a
written and valid demand for arbitration is received by the Railway.
(b)
The
claimant shall submit his claim stating the facts supporting the claims
alongwith all the relevant documents and the relief or remedy sought against
each claim within a period of 30 days from the date of appointment of the
Arbitral Tribunal.
(c)
The
Railway shall submit its defense statement and counter claim(s), if any, within
a period of 60 days of receipt of copy of claims from Tribunal thereafter,
unless otherwise extension has been granted by Tribunal.
64 (i) (iii) :
No new claim shall be
added during proceedings by either party.
However, a party may amend or supplement the original claim or defense
thereof during the course of arbitration proceedings subject to acceptance by
Tribunal having due regard to the delay in making it.
64 (i) (iv) :
If the contractor(s) does/do not prefer his/their specific and final
claims in writing, within a period of 90 days of receiving the intimation from
the Railways that the final bill is ready for payment, he/they will be deemed
to have waived his/their claim(s) and the Railway shall be discharged and
released of all liabilities under the contract in respect of these claims.
64 (2) :
OBLIGATION DURING PENDANCY OF ARBITRATION - Work
under the contract shall, unless otherwise directed by the Engineer, continue
during the arbitration proceedings, and no payment due or payable by the
Railway shall be withheld on account of such proceedings, provided, however, it
shall be open for Arbitral Tribunal to consider and decide whether or not such
work should continue during arbitration proceedings.
64 (3) (a) (i) :
In cases where the total
value of all claims in question added together does not exceed Rs.10,00,000/-
(Rupees Ten Lakhs only), the Arbitral Tribunal consist of a sole
arbitrator who shall be either the
General Manager or a Gazetted Officer of Railway not below the grade of J.A.
Grade nominated by the General Manager in that behalf. The
sole arbitrator shall be appointed within 60 days from the day when a
written and valid demand for arbitration is received by Railway.
64 (3) (a) (ii) :
In cases not covered by
Clause 64 (3) (a) (i), the Arbitral Tribunal shall consist of a panel of three
Gazetted Rly. Officers not below J.A. Grade, as the arbitrators. For this purpose, the Railway will send a
panel of more than 3 names of Gazetted Rly. Officers of one or more
departments, of the Railway to the contractor who will be asked to suggest to
General Manager upto 2 names out of the panel for appointment as contractors
nominee. The General Manager shall
appoint at least one out of them as the contractors nominee and will, also
simultaneously appoint the balance number of arbitrators either from the panel
or from outside the panel, duly indicating the presiding arbitrator from
amongst the 3 arbitrators so appointed.
While nominating the arbitrators it will be necessary to ensure that one
of them is from the Accounts Department.
An officer of Selection Grade of the Accounts Department shall be
considered of equal status to the officers in S.A. Grade of other departments
of the Railways for the purpose of appointment of arbitrators.
64 (3) (a) (iii) :
If one or more of the
arbitrators appointed as above refuses to act as arbitrator, withdraws from his
office as arbitrator, or vacates his/their office/offices or is/are unable or
unwilling to perform his functions as arbitrator for any reason whatsoever or
dies or in the opinion of the General Manager fails to act without undue delay,
the General Manager shall appoint new arbitrator/arbitrators to act in
his/their place in the same manner in which the earlier arbitrator/arbitrators
had been appointed. Such re-constituted
Tribunal may, at its discretion, proceed with the reference from the stage at
which it was left by the previous arbitrator(s).
64 (3) (a) (iv) :
The arbitral Tribunal
shall have power to call for such evidence by way of affidavits or otherwise as
the Arbitral Tribunal shall think proper, and it shall be the duty of the
parties hereto to do or cause to be done all such things as may be necessary to
enable the Arbitral Tribunal to make the award without any delay.
64 (3) (a) (v) :
While appointing
arbitrator(s) under sub-clause (i), (ii) & (iii) above, due care shall be
taken that he/they is/are not the
one/those who had an opportunity to deal with the matters to which the contract
relates or who in the course of his/their duties as Railway servant(s)
expressed views on all or any of the matters under dispute or differences. The proceedings of the Arbitral Tribunal or
the award made by such Tribunal will, however, not be invalid merely for the
reason that one or more arbitrator had, in the course of his service,
opportunity to deal with the matters to which the contract relates or who in
the course of his/their duties expressed views on all or any of the matters
under dispute.
64 (3) (b) (i) :
The arbitral award shall
state item wise, the sum and reasons upon which it is based.
64 (3) (b) (ii) :
A party may apply for
corrections of any computational errors, any typographical or clerical errors
or any other error of similar nature occuring in the award and interpretation
of a specific point of award to tribunal within 30 days of receipt of the
award.
64 (3) (b) (iii) :
A party may apply to
tribunal within 30 days of receipt of award to make an additional award as to
claims presented in the arbitral proceedings but omitted from the arbitrl
award.
64.4 :
In case of the Tribunal, comprising
of three Members, any ruling or award shall be made by a majority of Members of
Tribunal. In the absence of such a
majority, the views of the Presiding
Arbitrator shall prevail.
64.5 :
Where the arbitral award
is for the payment of money, no interest shall be payable on whole or any part
of the money for any period till the date on which the award is made.
64.6 :
The cost of arbitration
shall be borne by the respective parties. The cost shall inter-alia including fee of the
arbitrator(s) as per the rates fixed by the Railway Administration from time to
time.
64.7 :
Subject to the
provisions of the aforesaid Arbitration and Conciliation Act-1996 and the rules
thereunder and any statutory modification thereof shall apply to the
arbitration proceedings under this clause.
If any
dispute arises between the parties with respect to this agreement any
application or suit shall be initiated only in the court with the local limits
of whose jurisdiction the West Central Railway, Divisional Head Quarters Office
is situated and both the parties shall be bound by this clause.
18.0 REFUND OF SECURITY
DEPOSIT
No part refund of
security deposit shall be permitted till completion of consultancy contract.
19. The tender is required
to obtain licence from the Assistant Labour Commissioner (Central), Jabalpur
under contract Labour (Regulation & Abolition), Act,1970 and contract
Labour (Regulation and Abolition) Central Rules, 1971.
20. Non compliance with
any of the conditions set forth herein above is liable to result in the tender
being rejected.
37. SHIFTING OF ELECTRICAL/TELEGRAPH
WIRES/CABLES ETC.
In some stretches, high
tension grid towers/electric / telegraph/ telephone wires or posts etc. may require shifting.
It is
expected that the electric
lines/towers will be
shifted in time, but in case,
there is any delay on
this account suitable extension
in period of completion will be considered and
given to the contractor for only
the affected portion
and no compensation
whatsoever in this respect
or due to the delay thus caused will be payable and contractor has
to adopt such
methods of execution so
as not to cause any
damage to existing
structures, lines etc.
38.
TESTING AND FIELD LABORATORY
38.1 Contractor shall
provide a field laboratory at the site of work for
day-to-day testing at
site during the progress of work.
All the expenditure on this account shall be borne by
the contractor and no extra payment
shall be made by Railway.
38.2
The contractor
shall get a percentage of
samples tested from other approved
laboratories as directed by
Engineer-in-charge for confirmatory test without any extra payment to
the contractor unless otherwise specified in the contract.
38.3
Materials supplied by the
contractor will required to be
tested as required
by the various codes and
specifications at contractors cost.
If additional testing other than
required by specification is ordered by Engineer, the testing charges shall be
borne by the Department, if the results are satisfactory and
will be borne by the contractor,
if the same are found to be
unsatisfactory.
39. FOREIGN
EXCHANGE
Any demand of foreign
exchange for importing of equipments & materials will not be accepted.
40. EMERGENCY WORK
In the event of any accident or failure
occurring in on or
about the work
or arising out of or in connection
with the construction, completion or maintenance of the works, which
in the opinion of the Engineer requires immediate attention,
the Railway may
bring its own workmen or other
agency to execute or partly execute
the necessary work or carryout
repairs if the Engineer considers that the contractor is
not in a position to do so in time and charge the cost thereof to the contractor.
41.
CLEARANCE OF SITE
The contractor after
completion of the work shall clear the site of the work and tidy up the area
and remove leftover materials, debris
etc. In case the contractor fails to do
so, the same will be removed by the Railways and the cost thereof will be
charged to the contractor. Rates of work(s) shall be inclusive of clearing the
site, tidying etc. after completion of the work.
42.
COMPLETION PERIOD
42.1
The
contractor shall have to complete the work in all respects within a period of completion
as mentioned in the tender notice from the date of issue of acceptance of the
tender.
42.2
The
contractor shall strictly adhere to the programme framed by the Engineer or his representative so as to complete the work
within the time allotted to the
Contractor
42.3 The contractor will have to employ labour in
full strength commensurate
with working areas available. He
will also arrange for
materials and equipments to complete
the job most expeditiously within
the stipulated completion period. The Engineer's decision as to what is full
strength will be final and binding on the contractor.
43.
MAINTENANCE OF
WORKS
The contractor shall be
required to maintain the work effectively for a period of 6 (six) months or till the end of first monsoon after the
completion period, which ever is later from the date of completion as
per Clause 47 of the General Conditions
of Contract of Central Railway and no part refund of Security
Deposit shall be permitted during the
maintenance period mentioned above. In
case of construction of building (service / residential), the payment of the
roof slab which directly or indirectly
comes in contact with the rain, these slabs payment should be arranged after
passing of one monsoon period.
44.
PRICE VARIATION.
The rates quoted by tenderers and
accepted by Railway Administration shall hold good till the completion of the
work and no additional
individual claim will be
admissible on account of fluctuation in
market rates, increase in
taxes/any other levies/tolls etc. except that
payment/recovery for overall market situation shall
be made as per price variation clause
in para below.
2. No cognisance will be given for any sort
of fluctuations in taxes and other market conditions etc. for any individual
item for the purpose of making
adjustments in payments. The contract
shall, however be governed by the general price variation clause as under.

5. The
adjustment for variation in prices if required shall be
made once every quarter in the on account payments. If more than one on-account payment is made
to the contractor in a quarter the
adjustment, if required, shall be made in each bill.
6. If
the amount of variation in prices, either
upward or downward is less than
5% of the amount payable to the contractor
(excluding (a) cost of cement, steel and other items supplied by the
Railway to the contractor at a fixed price, and (b) specific
consultancy charges as per
accepted offer), no adjustment shall

7. Price
variation during extended
period of contract :
The price adjustment as worked out
above i.e. either in
crease or decrease will be applicable upto the stipulated date of

extended period of completion where such extension has been granted
under Clause 17(1), 17(2)
& 17(3) of the General
Conditions of Contract. However,
where extensions of time has been granted due to contractor's failure under Clause 17(4) of the
General Conditions of Contract. Price adjustment will be done as follows. :-

indices applicable to the last month or original completion period or

17(1), 17(2) or 17(3) the price adjustment of

will be adopted for price adjustment for the period
of extension under Clause 17(4) of the General
Conditions of Con tract.
8.
Applicability and ceiling limit for price
variation shall be as follows :
"Price variation
clause will not
apply if the price variation is upto 5%. Reimbursement / Recovery due to variation in prices will be made only for the amount in
excess of 5% of the amount payable to the contractor.

45. It is necessary for the contractor
to utmost care in executing the work as per specifications laid down. To
facilitate the work of quality control the contractor shall arrange for

APPENDIX-`A'
SAFETY RULES
1. Suitable
scaffolds should be provided for workmen for all works that cannot safely be
done from the ground or from solid construction except such short period work
as can be done safely from ladders. When
a ladder is used an extra labourer shall be engaged for holding the ladder and
if the ladder is used for carrying materials as will, suitable foot-holds and
hand holds shall be provided on the ladder and the ladder shall be given an
inclination not steeper than one horizontal to four vertical.
2. Scaffolding
or staging more than 3.5 metres above the ground or floor swung or suspended
from an overhead support or erected with stationary support shall have a guard
rail properly attached bolted, braced and otherwise secured above the floor or
platform of such scaffolding or staging and extending along the entire length
thereof with only such opening as may be necessary for the delivery of materials. Such scaffolding or staging shall be so
fastened as to prevent it from swaying from the building or structure.
3. Working platform gangways and
stairways should be so constructed that they should not sag unduly or
unequally, and where the height of the platform or the gangway or the stairway
is more than 3.5 meters above ground level or floor level, they should be
closely boarded, should have adequate width and should be suitably fastened as
described in the para above.
4.
Safe means of access shall be
provided to all working platforms and other working places. Every ladder shall be securely fixed. No portable single ladder shall be over 10
meters in length while the width between side rails in swung ladder shall in no
case be less than 300 mm for ladder upto and including 3.5 metres in
length. For longer ladders this width
should be increased by at least 20 mm for each additional metre of length. Uniform steps spacing shall not exceed 300
mm. Adequate precautions shall be taken
to prevent danger from electrical equipment.
No materials on any of the sides of work shall be so stacked or placed
as to cause danger for inconvenience to any persons or the public.
The contractor shall provide all
necessary fencing and lights to protect the public from accident, and shall be
bound to bear the expenses of defense of every suit action or other proceedings
at law that may be brought by any persons for injury sustained owing to neglect
of the above precautions and to pay any damages and cost which may be awarded
in any such suit action or proceedings to any such persons or which may with
the consent of the contractor be paid to compromise any claim by any such person.
5. Before any demolition work is
commenced and also during the process of the work: -
(a) All
roads and open areas adjacent to the work site shall either be closed or
suitably protected.
(b) No electric cable
or apparatus which is liable to be a source of danger over a cable or apparatus
used by the operator shall remain electrically charged.
(c)
All practical steps shall be taken to prevent danger to persons employed from
risk of fire or explosion of flooding. No floor, roof, or other part of the
building shall be so overloaded with debris or materials as to render it
unsafe.
6.
All
necessary personal safety equipment as considered adequate by the
Engineer-in-charge should be kept available for the use of the persons employed
on the site and maintained in a condition suitable for immediate use and the
contractor should take adequate steps to ensure proper use of equipment by
these concerned.
(a) Workers employed on mixing asphalt
materials, cement and live mortar shall be provided with protective
goggles.
(b) These engaged in white washing and mixing or attacking of cement
bags or any materials which is injurious to the eyes shall be provided with
protective goggles.
(c) Those engaged in welding works shall be provided with welders
protective eyesight lids.
(d) Stone breakers shall be provided with protective goggle and
protective clothing and seated at sufficiently safe intervals.
6A. In case the contractors have to ply
vehicles for the purpose connected with the contract adjacent to Railway track
the Railway Administration will be at liberty to post an experienced staff as
flag man for guidance of the movements such vehicles so as to prevent accidents
and the contractor will bear wages including all etc. of the staff posted as
flag man for the period of Contract for such periods during which such staff is
posted for the purposes. The Rly. Administration will be sole judge in the
absolute discretion, of the fact that it is necessary to post any staff, that
which of the staff will be suitable for the purpose, that what should be the
wages and other allowance payable by the contractor for staff posted for the
purpose. The Rly. Administration will have a right without
prejudice to other remedies to deduct the wages etc. of such staff from the
bills of the contractor in respect of this contract of from any moneys or the
contractor whatsoever available with the Railway Administration. The contractor will be liable for any over
payments under Workman Compensation Act on account of any injury sustained to
Railway servant during that period.
7. When the work is done near any place where
there is risk of drowning, all necessary equipment should be provided and kept
ready for use and all necessary steps taken for prompt rescue of any persons in
danger and adequate provision should be made for prompt first aid treatment of
all injuries likely to be sustained during the course of the work.
8. Use
of hoisting machines and tackle including their attachment anchorage and
supports shall conform the following standards or conditions:
(a) (i) These shall
be of good mechanical
construction, sound materials and
adequate strength and free from patent defect and shall be kept in good repair and
in good working order.
(ii)
Every
rope used in hoisting or lowering materials or as a means of suspension shall
be of durable quality and adequate strength and free from patent defects.
(b) Every Crane
Driver or hoisting
appliances operator shall
be properly qualified and no
person under the age of 21 years shall be in-charge of any hoisting
machine including any scaffolding.
(c) In
case of every hoisting machine and of
every cabin ring, shackle, swivel and pulley block used in hoisting or as
means of suspension safe working
load shall be ascertained
by adequate means. Every hoisting
machine and all gear referred to above shall be plainly marked within the safe
working load.
In case of a hoisting
machine having a variable safe working load, each safe working load of the
conditions under which it is applicable shall be clearly indicated. No part of any machinery or any gear referred
to above in this paragraph shall be loaded beyond the safe working load except
for the purpose of testing.
(d) In
case of departmental machine the safe working
load shall be notified by the Electrical Engineer-in-charge. As regards contractors machines, the
contractor shall notify safe working load of the machine to the
Engineer-in-charge whenever he brings any machinery to site of work, get it
verified by the Electrical Engineer concerned.
9. Motors, gearing transmission, electric wiring
and the dangerous part of hoisting appliances should be provided with efficient
safe guards, hoisting appliances should be provided with such means will as
reduce to the minimum the risk of accidental descent of the load, adequate
precautions should be taken to reduce to the minimum the risk of any part of a
suspended load becoming accidentally displaced.
When workers are employed on electrical installations, which are already
energised insulating mats, wearing apparel, such as gloves, sleeves and both as
may be necessary should be provided. The
workers should not wear any rings, watches and carry keys or other materials
which are good conductors of electricity.
10. All
scaffolds, ladders and other safety devices mentioned or described herein shall
be maintained in safe condition and no scaffold ladder or equipment shall be
altered or removed while it is use.
Adequate washing facilities should be provided at or near places of
work.
11. USE OF EXPLOSIVE
Explosive shall not be used on the
work or brought to the site by the contractor without the written permission of
the Engineer. After such permission is
given, the explosives will be stored and used as per extant explosive rules of
the Government of India/State Government.
12.
These safety provisions should
be brought to the notice of all concerned, display on a notice board at a
prominent place at the work spot. The
persons responsible for compliance of the safety code shall be named herein by
the contractor.
13. To
ensure effective endorsement of the rules and regulations relating to safety
precautions, the arrangements made by the contractor shall be opened to
inspection by Labour Officer/Engineer-in-charge of the Department or their
representative.
14.
Precautions while working in the
vicinity of track :-
(a) When the work is required to be done
along or near existing Railway track, the contractors shall take steps as are
necessary for the safety of the track, labour working at site. He/They will also be required to programme
his/their working so as not to interfere with movement of trains. No extra payment shall be allowed for these precautions. It should be ensured that the ballast of the
track is not spoiled or mixed with earth.
(b) In
addition to the precautions taken by the contractors for the safety of the
track and labour, it may be necessary to post flagmen in some locations as
additional safety measure. The
contractor(s) shall be fully responsible for any damage to or trespass caused
by his/their men to surrounding structure, Rly. bears no liability whatsoever
on this account.
15.
Notwithstanding the above clause from (1) to (14) there is nothing in
these to exempt the contract or the operation of any other act or Rule in force
in the Republic of India.
WORKING PROCEDURE
1.
After
getting the acceptance letter, contractor will get the testing of all material
and take approval from the Engineer-in-charge. All material i.e. cement, coarse,
aggregate, fine aggregate, moorum, steel bars, bricks etc. are to be tested.
2.
After
getting the approval of material, approved materials are to be collected at the
site in required quantity.
3.
Labourers,
tools, plants and machinery are to be arranged by contractor.
4.
A
field laboratory is to be provided for testing the concretes, brick and other material.

WORKING PROCEDURE
CONTINUED
1. Contractor will arrange the required
approved materials i.e. cement, sand, aggregate, plasticizer & bricks
design mix report for controlled concrete RCC alongwith test report from Govt.
Engineering College/Polytechnic etc., for completion of work to the
satisfactory of Engineer-in-charge before starting of the work
2. Contractor
will arrange the sufficient nos. of required machinery such as mixer, vibrator,
road roller, tools & plants etc. to the satisfaction of Engineer-in-charge
before starting the work. Contractor will arrange sufficient nos. of skilled
staff such as mason, fitter, carpenters, operators, plumbers etc.
3. Contractor
will arrange the sufficient nos. of Zero error theodolite and leveling
instrument for carrying out the work perfectly for which nothing extra will be
paid to the contractor.
4. Contractor
will arrange the testing equipment and laboratory at site for carrying out the
various measured tests during the execution of work at his own cost. The test
which can not be performed at site shall be carried out at Govt. Engineering College / Polytechnic as may be directed by
Engineer-in-charge.
5. Contractor
is solely responsible for safety of the work, his labours and safety of
employees of office.
6. TELEPHONE FACILITIES:
The
contractor will have to make his own arrangement for providing communication
facilities at the site of work at his own cost (Land line, Mobile Phone,
Intercom and walky-talky). The telephone facilities provided by the contractor
shall be allowed to be used by the Railway staff without any charges.
7. CAMP OFFICE:
The
contractor has to provide a Camp Office for Railway officials at site with
water supply and sanitary facilities at his own cost for which no payment will
be made to the contractor. If contractor fails to provide such facilities, this
will be provided by the Railways, the cost thereof being recovered from the
contractor.
8. AUTO LEVEL:
New
Auto Level Instruments with 32 x magnification of Standard firm as approved by
the Engineer-in-charge, will be brought by the contractor at site for taking
Camber etc., at his own cost.
9. COMPUTER:
The
contractor should provide a new Colour PC of adequate configuration alongwith
Colour printer and other related accessories at site at his own cost, for
submitting computerized weekly progress, contract bills etc. The computer and
its attachments will be handed over to Railway in good working condition after
completion of work.
10. SECURITY:
Being
remote area, all the security arrangements for material, machinery, plants,
equipments, labour and supervisors including Railways inspecting/supervising
officials at working site will be arranged by the contractor at his own cost.
The Railway will provide no security arrangement.
11. DIGITAL VIDEOGRAPHIC RECORDING:
The
successful tenderer will be required to prepare digital video recording of
entire activities such as assembly, erection, launching etc. and edit the same
to cover the duration about three hours. This firm shall pictorially report the
entire activity of the work starting from beginning to end with audio
commentary. Two copies of videos C.D.s shall be handed over to Railway
alongwith necessary details, instructions, and literature. The cost of entire
activities will be borne by the Contractor.
12. COMPLETION DRAWINGS:
On
completion of work, the contractor will submit completion drawing on floppy and
thereafter on clearance of Railways on C.D. for record.

CONTRACTOR'S
AGREEMENT
I / we offer to do the work at the rates entered in the
schedule of rates on the reverse which I / we have signed, and I / we
understand that no fixed quantity of work is given to me to do that in starting
work I / we am/are only given a place to work in or to deposit materials on,
and that I / we have no claim to more than one unit of work as entered in the
Scheduled Rates. I / we agree that all works done and materials delivered shall
be subject to the approval of the Engineer in Charge, who may reject and
decline to pay for whatever may be in his opinion inferior or defective or
either and I / we agree that the Standard Specifications contained in the Works
Hand Book Part III, corrected upto date and Sanitary Works Hand Book corrected
upto date of Central Railway / West Central Railway / Western Railway in so far
as they are not over-ruled by items of this agreement, shall be deemed part of
this agreement.
I/we agree that no work under this work order shall be
assigned or sublet without the previous written approval of the tender accepting
authority.
I/we agree that my work may be stopped at any time by the
.Engineer
on his giving me / us or my / our agent on the works seven days notice in
writing and I/we agree that the measurement of my works shall be made by the
Engineer at any time appointed by him in writing subsequent to the expiry of
the said notice and measurement shall be made by him at the said time whether I/
we am/are present or not and that on payment for work done and approved
materials delivered at site of work as ascertained by the said measurement, I
shall have no further claim against the Railway and I/we agree that any dispute
arise on matters connected with this agreement, the same shall be referred to a
person to be nominated in this behalf by the tender accepting authority or
higher authority for the time being of the Railway, whose decision in writing
shall be final and binding on both parties.
I / we agree that any claim I/we have to make shall be made
in writing within seven days of date of measurement taken by the Engineer as
aforesaid and that any claims in respect of such measurement made more than
seven days after taking of such measurement shall be deemed to have waived by
me/us.
I/we agree to indemnify the Railway against any claims which
may be made under Workmen's Compensation Act, 1923.
I/We agree to complete the works herein set forth on or
before the date specified herein and to maintain the same for a period
