Lennie and Ed
investigate a long string of killings that has spanned over 20 years.
Ultimately, the find the killer who is in his late 50s and has a long sheet of
priors, including manslaughter and assualt.
Branch decides this
person is worthy of being executed, but decides against it since he's not certain
enough and instead wants to see the perp rot in prison. But then a wrinkle
comes up when it turns out the perp has some mental deficiences, a low IQ and
imprisoning him could be considered as cruel and unusual. The ACLU is now
getting involved and even cites Branch is supporting the IL governor's stand on
a morotorium to the DP. Branch is embarrassed and asks Jack and Serena to find
a way out.
Jack decides the man
should be institutionalized for now and have the issue revisted. That way the
perp is locked up and it gives Branch a way out. However, the perp decides to
hire Mellnick to argue that he is competent to stand trial and face the
possibility of the DP.
After a lot of arguing
from experts, including Skoda, and family members of the victims and the perp,
the judge concludes the perp is unfit for trial and be locked up at Bellvue for
the time being.
Ultimately, with Jack
and Serena in Branch's office, Branch gets a call saying the perp hung himself
in the shower despite resistence from guards and other inmates. Everyone has a
long face.
