Temeljem Sporazuma od 20. travnja 2004. g., uz suglasnost Trgovačkog suda u Splitu u predmetu stečaja trgovačkog društva Dikokom d.d. u stečaju koji se vodi pod br: broj: X ST 88/2000, Grad Vis za stečajnog dužnika Diokom d.d. u stečaju

O G L A Š A V A

prodaju dijela imovine prikupljanjem pismenih ponuda

Predmet prodaje:

Objekt industrijskog pogona za proizvodnju odjeće u Visu, Ivana Farolfija bb, bruto građevinske površine poslovnog prostora objekta 2.499,61 m2 sa pripadajućim građevinskim zemljištem od ukupno 1.758,00 m2, u zemljišnim je knjigama koje se vode za K.O. Vis, upisan u Zk. Ul. 4796, označen kao čest. zem. 610/1/2/3 i čest. zem. 6476/2/5, prazno od osoba i stvari, sve s početnom cijenom od =1.500.000,00 Eura.

Podnositelji ponuda dužni su dostaviti ponudu odvjetničkom uredu Mihael Acalinović Vis, Poštanski pretinac br: 12, u zatvorenoj kuverti s naznakom "za natječaj Ponuda ne otvaraj" do 25. 07. 2004. g. s time da se ponude mogu predati i neposredno u uredu u Nazora 7.

Pravo sudjelovanja imaju sve pravne i fizičke osobe koje uplate jamčevinu u iznosu od 1% od oglašene cijene. Uplatu jamčevine izvršiti u Hrvatskim kunama na račun odvjetničkog ureda Mihael Acalinović pod brojem: 2330003 - 1000000013 40078355 007, Splitska Banka i to najkasnije dva dana prije otvaranja ponuda, sa naznakom svrhe uplate "jamčevina po natječaju". Dokaz o uplaćenoj jamčevini mora biti priložen uz ponudu.

Prodaja se vrši na način "viđeno - kupljeno". Javno razmatranje ponuda obavit će se osam dana od dana zaključenja natječaja u Gradskoj upravi Grada Visa.

U razmatranje će se uzeti sve ponude uz koje bude dostavljen dokaz o uplati jamčevine.

Ponuditelj čija ponuda bude prihvaćena dužan je u roku od 15 dana od dana prihvata ponude, putem odvjetničkog ureda Mihael Acalinović Vis, zaključiti sa stečajnim dužnikom Diokom d.d. u stečaju, Ugovor o kupnji, te u daljnjem roku od 8 dana uplatiti čitav iznos ugovorene kupovne cijene i troškova ugovaranja (izrada ugovora, ovjera potpisa i dr), na račun koji će se označiti u Ugovoru, sve sa naznakom svrhe uplate, koji uplaćeni iznos će na tom računu biti zadržan do izvršene uknjižbe prava vlasništva na kupca u cijelosti uz istovremeno brisanje svakog takvog prava sa imena prodavaoca u cijelosti (klauzula intabulandi), a u slučaju kakvih zapreka isti iznos kupovine će biti kupcu vraćen bez odlaganja u valuti uplate uz odbitak troškova posebno troškova valutacije i transfera novca.

Kupcu se jamčevina uračunava u cijenu, a ostalim sudionicima se vraća.

Zadržava se pravo ne prihvatiti niti jednu ponudu i to bez obveze da o razlozima neprihvaćanja obavijesti ponuditelja.

Sve informacije u svezi prodaje te pregleda nekretnine, zainteresirani mogu dobiti na tel. 711 161 te 098 593 877 tijekom jutra od 12 do 13 sati, te od 17 do 19 sati.

the sale of a part of assets by written offers,

for bankruptcy debtor Diokom d.d. in bankruptcy

The case of sale:

Industrial facility of the clothes production in Vis, Ivan Farolfi (without number), business premises of gross area 2.499,61 m2 with the belonging building land of a total of 1.758,00 m2 which is registered of cadastral community of Vis, documenter as 4796 in cadastral register, marked as cadastral particle 610/1/2/3 and 6476/2/3/5/7, emptiness of persons and things,for initial price of: 1.500.000,00 Euros.

The offer submitters are obliged to deliver the offer at the lawyer s office Mihael Acalinović Vis, P.O.B. 12, in the closed envelope specifying "for the competition Offer, do not open" until 25. 07. 2004. g., the offers could be brought at first hand in the office in 7 Vladimir Nazor Street, Vis.

All corporation and physical persons who pay 1% of the caution money of the announced price have the right to compete. The caution money should be put up in Croatian Kuna on the account of the lawyer's office Mihael Acalinović, number: 2330003 - 1000000013 40078355 007, Splitska Banka, not later than two days before the closing date of the offer, specifying the purpose of payment "caution money for the competition". The evidence of the paid caution money must be enclosed.

The sale will be carried out according the principle "seen-bought". Public consideration of the offers will be done eight days after the closure of the competition at the city government of Vis.

All the offers with the evidence of the paid caution money enclosed will be taken in consideration.

The Tenderer whose offer was accepted, shall be obliged, by way of lawyer's office of Mihael Acalinović Vis, conclude the contract of purchase with the bankruptcy debtor Diokom d.d. in bankruptcy, within 15 days after the offer acceptance. In the course of the next 8 days tenderer should pay the entire amount of the agreed price, and expense negotiation (construction contract, verification subscription(s) and other.), on the account, which will be specified in the contract, with specified purpose of payment. The paid amount on that account will be held until the final conclusion of "clausula intabulandi" , registration of property rights of buyer, with concurrently erasing of those rights of the vendor.

In case of any obstacle, the same amount of purchase will be giver back to buyer without delay in paid currency, with deduction of the expenses, separately expense of valuation and the transfer of money.

The caution money will be comprised in price for the buyer, to the rest of the competitors will be given back.

The right to not accept, not one offer is retained, without the obligation of informing the reasons of non-acceptance.
