Summary: I love to describe alternatives to Bobby and Lindsay getting
together, they are so much fun to entertain. My point is, this is yet
another one of those stories. I am not sure when it will actually get to
the point, but they are about to begin being recreational.

"Under Oath" Part #1
At the offices of Donnell, Young, Dole and Frutt. 11pm on a chilly Friday
night. Bobby is hunched dramatically over his desk working on a murder
trial. His sky-blue tie is loosened and hanging flimsily on the front of
his shirt. His hair is messy, he is having a hard time with this case, and
it's showing physically. From the bags under his eyes, to the shortness of
his temper, the whole office knew how hard this one was for him. Bobby was
so sure that Nikki Chase was innocent, all the evidence was circumstantial,
but it was going to be enough to convict her of first degree. How was he
going to get her off.
Lindsay entered the office at 11:15pm. She knew Bobby would be here. The
glowing lamp in his office confirmed her suspicions. She stood in the
doorway of his office without him noticing her presence. She took in his
fatigued appearance, she was so worried about him. She realised with a
small smile, that even with him looking like this, she was still intensely
attracted to him. She was determined to ease him of his frustration, just
by sitting with him for a little while and having a light- hearted
conversation with him. She knocked softly. He looked up. She was so sure
she saw a slight smile touch the corners of his mouth. He motioned for her
to come in.
When Bobby heard the knock, he was somewhat perturbed, he was trying to
concentrate, he didn't want to be disturbed. However, when he saw her
standing there, he couldn't help but smile. Work was quickly forgotten. She
was so beautiful, he was having trouble keeping their relationship
platonic. "Hey Lindsay, whatcha doing here this late?" She smiled her heart
capturing smile.
"I could ask you the same thing Bobby. How is the Chase trial coming? Can
we get her an acquittal?"
Bobby, sighed, the thought of work depressing him again. "I don't know
Lindsay, it's not looking too great. Do you think she's innocent Lindsay?
What's your gut feeling?"
"I believe the same thing you do Bobby, she's innocent, or she's an actor
who deserves an Oscar, I think she's innocent, I really do."
Bobby sat down on the couch, and motioned for her to sit with him. He
grabbed the file, and they started pouring through the case together. Bobby
was glad she came. She had some excellent ideas and her expertise on
Constitutional law, she was very helpful. At about 12:45am, they put down
the files and went into the main office to make some coffee. They re-seated
themselves on the sofa and just sat in silence for a while. Bobby was the
first to talk. "So, you never answered my question. What are *you* doing
here, you didn't have to help me out." He quickly added "Not that I am not
extremely grateful, as long as you know you don't have to be here this
late, I am the only one who's not allowed a social life!"
She laughed lightly at this comment of his. "I know I don't have to Bobby,
but I really wanted to help. I've been worried...I mean...we've all been
worried about you. You're working even later than usual. I was taking it
upon myself to help you lighten your load."
Touched at her concern, he leaned over and kissed her lightly. He moved
back, but only a little and whispered "Thanks."
Lindsay felt bolts of electricity flow through her veins when he kissed
her. She noticed his intense gaze, and she couldn't bring herself to look
away. She returned this gaze, hoping that the feelings she felt for him
weren't given away by her eyes. Lindsay was sure this was the right time,
and she leant forward and kissed him. He responded by deepening the kiss.
He leaned back and pulled her on top of him. He wasn't sure how far he
could go with her, he knew how far he wanted to go though. She seemed to
know though. She slowly began to unbutton his shirt, and pushed it off his
shoulders. He did the same with her blouse. He pulled back for a second and
said "Lindsay, are you sure you want this?" She nodded, and then moved in
to pick up where they had left off. He couldn't hold back anymore. He took
her, right there on the soft leather sofa in his office.
At 2am, they lay on the couch, breathing deeply. Neither of them knew what
to say. It felt so good to be together, but the fact that they work
together pretty much prevented any relationship (in their minds anyway) but
this was something they didn't want to end. "Bobby, that was great, really
great, but I don't know if it should happen again, I mean, what if someone
found out, it's hard enough for me to keep in peoples good books." Bobby
laughed at this little statement,
it was true, Lindsay found it hard to get along with them at first,
especially Ellenor, but she was just one of the crowd now, they loved her.
"Lindsay, nobody will have to know, I don't want this to end here, I mean,
we're both single...aren't we?" He asked, just to be sure she wasn't seeing
anyone. " Yes we are single Bobby. If we did continue, this little charade,
it could only be until either of us found someone else. Don't you think?"
Bobby smiled in agreement, and then added flirtatiously "Hey Lindsay, wanna
play charades?"

The next day 3pm at DYD&F
Bobby, Lindsay and Lucy are the only ones at the office. Everyone else is
in court for the rest of the day. Lindsay is in Bobby's office with him ,
and the are going through the Chase files again. They are seated on the
couch, and as they read, Bobby is absentmindedly stroking Lindsay's thigh.
Lindsay couldn't help but be thrilled about how natural he seemed to be
able to show this affection to her. He looked up at her, smiling, and said
"Wanna have dinner at my place tonight Lindsay?"
"Sure, what time?" She replied, this was going to be so easy for her.
"Hmmmm he said, be there at seven."
"Want me to bring anything?" She asked sincerely. Bobby let his eyes travel
from her shapely legs, to her beautiful face, then back to her legs, before
her turned his attention to her face and said suggestively "I can think of
one thing."
She swatted him gently with the file, and some papers fell out and
fluttered to the ground. They both leaned forward to pick them up and
bumped heads lightly. "Geez you got a hard head Dole!" Bobby said
teasingly. "No wonder you can recite the Constitution backward, I think you
keep a copy of it inside your head!" He laughed at his joke. Her face
remained stern, she was trying to appear insulted, but her laughing eyes
betrayed her, and she joined him, laughing until her sides hurt and tears
rolled down her cheek.
He reached up to her face, tentatively wiping away one of her tears. She
grabbed his hand and held it to her face. They leaned in, and were about to
kiss when the door burst open. The disturbance threw them away from each
other, the file spilling it's entire contents this time. Lucy didn't notice
the embarrassment spreading through both of their cheeks. "Bobby, that
Chase woman's sister called, she has some information, she wants you to
call her. I don't think you should bother, she's obviously guilty."
"Lucy!" Bobby and Lindsay shouted in unison. Lucy rolled her eyes, and
walked out, making sure the door slammed behind her.
Lindsay got up to leave. Bobby looked out the window of his office and made
sure Lucy wasn't looking. She wasn't. He stood up, placed his arms around
Lindsay, she wasn't concerned, she had checked on Lucy too. "Second chair
this case with me Lindsay, I need your help."
"Sure, I'd love to." He pulled her closer and kissed her passionately."
They were glad that now they would have more time together. "Ok." She said,
breaking the kiss, "Till tonight then." She kissed him softly before she
left, leaving him standing, breathlessly lusting after her.

Bobby's apartment 7:05pm. He was in the kitchen putting the final touches
on the dinner he had prepared for Lindsay when there was a knock at the
door. He smiled, knowing it would be her. He opened the door and took in
her appearance. She was wearing a pair of light blue Lee Cooper jeans, a
white Redsox t-shirt and a black soft leather jacket that reached just
below her back. Even in these simple clothes she was the most desirable
woman on the earth in his eyes. Lindsay stepped inside, the apartment was
masculine, with the faint aroma of dinner in the air. She was more than
pleased with Bobby's reaction to her. He had just stood there staring, so
she had let herself in. He was wearing his work clothes, minus the tie and
the jacket, and the shirt was undone at the top. She followed him into the
kitchen, and he motioned for her to pour herself a glass of the white wine
he had purchased.
They chatted for a few minutes about nothing, the case came up a few times,
but was shut down quickly, neither of them wanted to discuss work. While
they were talking, Bobby stepped closer to Lindsay, he placed his arms
around her, "Hmmm" he said "this feels better. You know Lindsay, you talk
too much." He leaned in and kissed her. She placed her glass of wine on the
counter and threw her arms around his neck, they stood there like that,
kissing, for a few more moments, they both decided it was time for dinner.
After the meal, which consisted of roast lamb with mint sauce and roasted
vegetables, Lindsay got up to clear the table. She leant over to take his
plate. He grabbed her arm, placed the plates in her hand on the table and
pulled her into his lap. "I didn't invite you over here to clean Miss
Dole." She smiled, enjoying the flirtation in his voice. "Well," she said
equally flirtatious, and bordering on seductive, "How about you show me
what I am here for?" Nothing more needed to be said. He scooped her up into
his arms and carried her into his bedroom. He laid her down on the bed, and
placing himself on top of her he asked "Are you sure you want to know?"

Bobby's apartment 4am the next morning.
Lindsay woke up, a little dazed,
before she realised where she was. Seeing the time, she figured it was time
for her to leave. She remorsefully untangled herself from his arms and
slipped silently out of the bed, she got dressed and left the apartment,
the smile on her face stayed with her the whole way home, as she reminisced
about her and Bobby's night together. They had played 'charades' numerous
times that night, and each time was better than the last as their bodies
became more and more familiar with each other. She decided as she unlocked
the door to her own empty apartment, that she didn't really want this to
end. Bobby woke up at the sound of his door closing. He sighed sadly as he
realised Lindsay had left. He was looking forward to waking up with her
next to him. He had watched her sleep for about half an hour that night. He
decided that there was no way she could be anymore beautiful, and realised
then and there that he was falling in love with her. He couldn't let this
end, he would make sure that next time, she wouldn't want to leave.

Offices of DYD&F 9am the next morning. Bobby and Lindsay were getting ready
to leave for the court house, they had a PC hearing at 10:30, and they
wanted to review their notes at the courthouse before they went in. Helen
Gamble was the D.A on this case, and knowing how ruthless she could be,
they wanted to be ready. They bid farewell to the others and then left.
Bobby had been waiting for this opportunity to talk to her. "So, have a good
time last night?"
"Sure did..do you?" She asked uncertainly.
"I had a great night...that is...until I woke up, and you had gone."
She smiled at him, her cheeks going slightly red at his statement.
"I just thought it would be better if I left, I am a horrible morning
person, and I had no clean clothes to wear."
"Well Miss Dole, I happen to think you look just *fine* without clothes. In
fact, I'd say, I like it a lot more, and with time, I believe I could get
quite accustomed to it."
"Why, Mr Donnell, are you propositioning me?
"Yes, I believe I am. Do you object?"
"Not at all, as long as you can live up to the memories I have of last
night, wont be an easy job I assure you." Now it was his turn to blush.
They had entered the courthouse now, and had found the room they had to
prepare their notes. They sat down, side by side, and began preparing for
the hearing. Lindsay had a great idea, on how to get some of the evidence
suppressed, but Judge Earnshaw was not known for his taking to courtroom
stunts. They leaned back in their chairs. Only ten minutes until it was
time to go into court. "I don't know if we have a chance here Lindsay, it's
seems like such a stretch, but we have to get her off, we have to." Lindsay
didn't know what to say. She placed her hand reassuringly on top of his. He
interlocked his fingers with hers, and they sat there like that, hand in
hand, until the door opened and they were called into the courtroom. "Good
luck Bobby." Lindsay said, both of them knowing full-well that he would
need it.

The courtroom, honourable Judge Earnshaw presiding. "All Rise"
"Bobby Donnell for the defendant your honour, waive reading."
"Helen Gamble for the prosecution, we'd like to refuse bail you honour."
"Your honour, Miss Chase is a student with no prior record, we don't think
she poses any threat...."
"Oh please!" Helen said sarcastically "First degree charges here, bail
shouldn't be an option!"
The judge thought about this and said "Miss Gamble is right, bail is
denied!" Bobby sighed defeatedly, he knew they wouldn't get bail, so he
wasn't particularly upset about this. He stood up again. "Your Honour,
defense moves to suppress the evidence of correspondence. It was found in a
breach of the fourth amendment search and seizure. The police had no right
to be in her apartment at that stage."
"Fine, oral arguments set for one o'clock, adjourned!"
On the way out of the courthouse, Lindsay suggested they go to a coffee
house, and review oral arguments there. Bobby was pleased with the events
of the morning so far. He smiled as he leaned down and suggested that they
have an oral argument at his place that night. She rolled her eyes
dramatically at his clever play on words. She smiled and said "I wouldn't
miss it, besides, I am a great arguer."
"Yes," He replied suggestively, "You certainly are."

Court house 1pm same day.
Bobby had decided that Lindsay should take over
the motion to suppress, because of her constitution expertise, plus, he
loved to watch her in court, she was the best, they both knew it. Helen
went first. "Look, the police had already decided that Miss Chase was a
suspect, they had grounds to search the apartment, they didn't need a
warrant, the correspondence in question, tells how the defendant hated the
victim, this evidence is vital to the prosecution, it shows how the murder
was premeditated, you can't suppress this evidence."
"Firstly," Lindsay began. "The police had no reason to suspect Miss Chase
before those notes were found. Secondly, they always need a warrant, the
fact that they don't use them is stupid...no matter what the crime, it is
the courts duty to uphold the constitution, here, it was breached, the
correspondence, no matter how detrimental to our case, should not be
allowed into evidence. The prosecution will still have a case, the fact
that it wont be as strong, is due only to the stupidity of the Boston
Police, not the defence, it's your duty as a judge to see that the
constitution is upheld."
"I hate it when you defence attorneys start with all that 'it's your duty
as a judge crap!" The judge started. "However, the defence is right, it was
an illegal search, the contents of the correspondence therefore, is
inadmissible. Trial set for one month from today on June 12th. Until then,
court is adjourned." The judge banged his gavel. Bobby and Lindsay, stood
up and smiled. "Way to go Lindsay, you were great." Bobby handed out praise
rarely, so this was a moment to be thankful for. "Yes" Lindsay said "I
certainly was."
They both smiled as they walked out of the courthouse, happy at the
progress they had made today.

Bobby's apartment 4am the next morning.
Lindsay had woken up after another
unforgettable night. She sighed as she realised that it was time to go. She
made a move to get up, but Bobby, who's arms had encircled her waist,
tightened his grip, turned her around, kissed her passionately, and
whispered softly ear, "Stay." She kissed him back, and let him hold her, as
she fell asleep again, glad that he had asked her to stay, it would have
been unbearable to leave him there. She fell asleep, and watching eyes
smiled happily as he realised she had fallen asleep smiling ecstatically.

Title: "Under Oath" Part three
Summary: One month into Bobby and Lindsay's secret charade. Helen is going
to come in and confuse the situation.
Disclaimer: If you don't know the drill...well...too bad (see part#1)

Lindsay's apartment 7:30am, her and Bobby have just woken up, and she is
trying to persuade him to get ready for work. Bobby is refusing to let her
out of bed, every time she struggles against his grip, he tickles her until
she cries. "Bobby, please!" Lindsay cries through fits of laughter, she is
desperately trying to catch her breath, but she is having a lot of trouble.
"Bobbbyyyy! I need to have a shower, let me go! Ahhhh!" She squeals as he
begins to tickle her again. But she has formulated a plan. She flips him
onto his back and sits on top of him, her legs bent and her feet resting
under his shoulder.
"Now, this is what I'm talking about!" He grins, not prepared to lose this
battle. "Bobby Donnell, you are insatiable! However, me being the expert
negotiator that I am, I have formulated a plan. I have to shower, you have
to shower, you refuse to let me out of your grip, so I propose...."
"What Lindsay, you're proposing already?!" She slapped him lightly on the
arm, and then continued negotiating. "So, why don't you come and have a
shower...with me?" Bobby didn't need to be told twice. He scooped her off
the bed and carried her into the shower, she giggled with delight the whole
way. Once in the bathroom he turned on the taps, adjusted the temperature.
He then turned to her, delicately removing the Harvard T-shirt she had worn
to bed, he removed his own shorts, then they both stepped into the shower.
"Hey Lindsay," he looked at her, smiled his gorgeous smile and said, "Want
me to wash your back?

Macalls pub 12:30pm.
Helen and Lindsay were having lunch together. Lindsay
was in a happy mood, her and Helen hadn't spent much time together,
although she could never tell Helen, what- or who- had put that rosey glow
into her cheeks. "So babe, you're unusually happy today, any reason? Got a
new man? Getting some action?" She said this last part so loud, that about
5 people turned to look at the conversation held by these two women.
"Helen! Do you want to have this conversation louder, I don't think the
people in Australia heard you!"
"Ahhh" Helen said. "You totally are getting action! Who from? Oh my God, is
it Bobby?"
"Helen! Keep it down please, you are way off track. Why won't you get over
this me and Bobby thing? How many times do you want to be told? There's
nothing between us!"
"Well, I kind of had an ulterior motive for asking. Can you set me up with
him babe? Please, he is so sexy, plus, he looks like he needs some action,
he's so wound up."
Lindsay was sure Helen would notice that all the colour had drained from
her face. But she hadn't, she just kept going on about all the things about
Bobby that Lindsay already knew. What could she say? She decided, she would
ask Bobby, and he could make up his mind.
She could only hope that he would say no. She realised Helen was staring at
her expectantly, waiting for her answer. "Sure Helen."
Lindsay smiled sweetly, "I'll ask him for you."
They continued their lunch, talking about little things, the whole time,
they were both dreading Bobby's answer. Helen was sure Lindsay would say
no, she really thought Lindsay loved Bobby, but she had secretly hoped she
didn't, Helen hated to admit it, but she had quite the crush on Bobby
Donnell.

5pm at DYD&F. Bobby and Lindsay were the only ones still there. Lindsay
looked into Bobby's office. Finding him there, she knocked lightly on his
door. "Bobby, I'm going home, do you need me to look at anything tonight, I
mean, with the case?"
"Well Lindsay, you don't have to look at the case, but you could come over
tonight, and ah, take a look at me." At this, she closed his door, and sat
down on the sofa. He came over and sat next to her. He placed his hand on
her thigh, and stroked her bare skin with his fingers. She grabbed his
hand, and just held it on her lap. "Look Bobby, you know I went to lunch
with Helen today, right?"
"Yeah, so? Oh, do you have plans with her tonight, that's ok. I will miss
you though." He leaned in to kiss her, but she moved back. "No Bobby. She
wants me to set you two up on a date. I told her I'd ask you, so I am
asking you. Do you want to go out with her?"
"No" He leaned forward again, but as before, she leant back.
"Bobby, if you want to go out with her, you can."
"What Lindsay, do you want me to go?"
"No...I mean..Yes, if that's what you want. I just don't want to hold you
back, what if she's right for you? You'll always wonder, unless you find
out for yourself." Lindsay really hoped he'd say no for real, but she had
to try her best, not just for Helen, but for Bobby as well. His happiness
meant a lot to her, more than her own did that's for sure.
"Fine Lindsay, one date, but I will be thinking of you the whole time, so
when it's finally over, can I come back to your place? I mean, I am doing
this as a favour to your overwhelming curiosity, and as the saying goes,
'no good deed should go unrewarded." She smiled emphatically at him. Those
words were so uplifting. She reached into her purse, took out the spare key
to her apartment and handed it to him. "Fine, but you don't have to come
back, ok, if you do, and I'm asleep, wake me up...really, wake me up, I'll
wanna hear all about it."
She kissed him goodbye, and handed him Helen's cell-phone number.
"Have fun, if all goes well, I'll see you tomorrow." She smiled coyly.
"No Lindsay, you'll see me tonight, I promise." He watched her leave. 'What
was she thinking, Helen Gamble.' Bobby knew she wasn't his type. He picked
up the phone and as he dialled her number he sung a line from a song he
thought fitted this situation 'The things we do for love!'

8:00pm at Francines French Restaurant. Bobby and Helen have just been
seated at their table after an hours wait. "Wow, busy place." Helen
commented, slightly miffed that he hadn't in that whole hour complemented
her on how she looked, regardless of the 3 hours she had spent getting
ready. But she was determined not to let the self- obsessed side of her
show, not on the first date anyway. Helen had already planned for another
date. She wasn't aware that the whole time they were waiting, Bobby was
wishing he was with her best friend. Bobby, was annoyed at how long they
had to wait, he wanted to get this over and done with. Helen was nice, but
remarkably self- absorbed. He had deliberately chosen not to compliment her
on how hot she looked (and he knew how hot she looked) because, he didn't
want her to like him. However, he found himself warming to her as they
progressed through their meal. She was outstandingly confident, and he
concluded that her confidence, may at times, be mistaken for vanity.
Confidence was not something he saw too often with Lindsay, so in a way, he
was glad for the change.
As they left the restaurant, Bobby realised he had gone about 20 minutes of
that night not thinking about Lindsay. That was really an accomplishment for
him. And as Helen grabbed his hand and entwined it with hers, he
felt...well, nice. Lindsay and him had agreed, that they would continue,
only until the other found someone else, and while he still wanted it to be
Lindsay who he spent his life with, she didn't seem to feel the same, and
so it was best to 'move on.' He would still go to her place tonight, but
maybe, and his last thought came with some sorrow, maybe it would be the
last time.

Lindsay's apartment 11:30pm.
She lay in bed, all of her thoughts were
focused on him. She knew their date started at seven, Helen had called her
and squealed her appreciation over the phone. It had been four hours.
Knowing how aggressive Helen was, they were probably back at her apartment,
or even worse, back at his. Helen was so bold when it came to things like
sex, so if that's where they were, Lindsay knew he would never be back. She
sighed sadly and rolled over. She was just about to cry, when she heard the
key turn in the lock. She smiled so big, she was sure the whiteness of her
teeth would light up the whole apartment. She closed her eyes, and her
mouth, and pretended to be asleep.
Bobby wasn't sure what he was going to say to her. Helen had invited him up
to her apartment, be had declined, using tiredness as his excuse. He wasn't
willing to start anything up with Helen without talking to Lindsay first.
He had agreed to a second date, the next night in fact, but if Lindsay
asked him not to, he knew he would cancel. Well, this was her last chance
to tell him, that was even if she had the same feelings, and he didn't
think she did. However, he could only hope.
He entered the bedroom, only to find her asleep. He stripped down to this
shorts and climbed in next to her. She stirred a little, even rolled over
to face him, but she didn't wake up. He stared at her face, God, she was so
beautiful, he had almost decided then and there never to see Helen again,
when she opened her eyes. "Hey." She said sleepily. "Didn't think you'd be
here, otherwise I wouldn't have slept. Sorry." She smiled her captivating
smile, and reached out to him. He pulled her close, waiting for the
barricade of questions he knew were coming.
She kissed him tentatively. "So, how'd it go? Obviously, you didn't go
back to her place, which surprises me."
"Why Lindsay" He says, slightly annoyed "Do you think I sleep with everyone
on the first date!?"
"We didn't date Bobby." She smiled "And no, it's just Helen can be
amazingly persistent, I am surprised at her."
"Well, she did ask. But do you blame her, I mean, look at me, I am
irresistible. But I said no." He smiled now, embarrassed that he had jumped
so quickly to conclusions. "Mmm I bet she's heaps upset now, Helen never
gets refused. So, do you like her? I mean, are you gonna go out again?"
"Actually, we are going to a club tomorrow night." Lindsay pulled back a
little, he felt this and asked "Is that ok?"
"Of course!" She said, a little too quickly, and very defensively.
"Why wouldn't it be? This was just an agreement, you found someone else,
that was the 'rules' wasn't it. So you're off the hook."
"Lindsay, I come here to be with you, because I want to, no other reason.
But you were right, what if she's right for me? I can't miss out on that
because you and I have great sex."
They settled back into each others arms. She buried her head in his arms,
so he couldn't see the tears in her eyes. He lifted her head up. "What's
wrong Lindsay?" He was hoping she'd tell him she wanted a relationship.
"Nothing, I am just gonna miss this...the sex I mean." He was saddened by
her reply.
"Ohh." He looked down at her smiled and said "We still have tonight, don't
we?"
"Sure." she said happily, "But Bobby, this is the last time. Maybe if it
doesn't work out with you two, we could maybe....but for now, this is it."
And there in the night, they ended it, the whole non- relationship they had
built, was left behind, as they left for work the next morning.

Summary: Bobby and Helen have been dating for a month now, and the Chase
trial is about to begin (They are on opposing sides). Lindsay is deeply
depressed..etc etc etc.

DYD&F 10pm. Lindsay and Bobby were in his office going over their defense
for the Chase trial which started in two days. They were ready, Bobby was
even a little more optimistic about their chances at an acquittal. Lindsay
didn't care. She wanted to shoot herself for letting Helen talk her into
setting her up with Bobby. They seemed so happy. It had been a month now,
and Lindsay had taken to avoiding them both as much as possible, she knew
if she had to hear anymore about the happy couple, she would probably
throw-up. Bobby had noticed Lindsay's distance. They hadn't had a real
conversation since he and Helen started dating. Bobby was confused as to
why she would care. He had given her a chance to tell him not to date
Helen, and she had all but driven him to their dates. She obviously didn't
have feelings for him, so why was she acting this way. He decided he was
going to find out.
"You know Lindsay, Helen misses you. She told me you guys haven't been out
for three weeks, and you haven't even called her. Is there something
wrong?" Lindsay felt even sicker. Now Bobby was Helen's messenger, great,
just what she needed. But, she decided, there was no point in lying, she'd
tell him exactly what was wrong...well not exactly. She wasn't about to
confess her love for her best friends boyfriend, but she had a few things
to say.
Not looking up from the file she was reading, Lindsay answered Bobby's
question, the hostility in her voice was very apparent. "My problem Bobby,
is that I don't want to get on the phone to Helen, or go to lunch with
Helen, so I can sit there, listening to her ramble on about you and her!
Please, I would rather walk over hot coals with no shoes, than listen to
that. It's revolting!"
Bobby was shocked, this was a side of Lindsay he hadn't had the pleasure of
seeing. He even thought he detected a little twinge of jealousy in her
voice. He didn't know what to say, he was stunned into silence. The last
thing he wanted was to lose his friendship with Lindsay, but she was being
really horrible. "Lindsay, I'm sure Helen doesn't realise, maybe you should
tell her, she really misses your friendship."
"Yeah," replied Lindsay angrily, she was not giving in on this one, even to
Bobby, "Well here's is a friendship I could do without." With this, she
picked up her bag and stormed out of the office. Just before she opened the
office door, she made a comment to herself that Bobby had 'accidentally'
overheard, he was even more shocked by this than he had ever been in his
life. He fell off the sofa. Her words rang in his ears "Yeah, what kind of
best friend is she, she stole the man I love!"

Helen Gamble's apartment 11:30pm.
She and Bobby were seated on her sofa,
they each had a beer in their hands. Helen noticed that Bobby was not with
her, his mind was far away. She figured he was probably thinking about the
Chase trial. Helen had hoped that this case wouldn't put any strain on this
relationship, it hadn't seemed to, until now. She decided it was time he
paid attention to her. "Bobby?" She said softly. "Mmmm" Bobby replied
absentmindedly, he was thinking about Lindsay, he wasn't listening to
Helen.
She continued, knowing he wasn't listening. "Well, I was sitting in my
office today, cutting the hair off my law journals, when all of a sudden I
decided, I was going to cryogenically freeze my toes, and unfreeze them
later, after a dazzling career in bug catching in the Pacific Ocean." She
sighed exhaustedly, realising he hadn't heard a word she said, his reply
confirmed this.
"Sure honey, I'd love some." Bobby snapped out of his trance, feeling awful
that he had ignored her. He turned to her and said "Helen, you know what,
I'm sorry, I'm just gonna go home tonight ok, I'll call you tomorrow."
Without giving her a chance to argue, he kissed her on the cheek, and left
the apartment. He got into his car, and didn't even realise where he was
going, until he pulled up in front of Lindsay's apartment building. He
realised it was late, but there was a light on in her window, and he knew
he wouldn't sleep until he sorted this out.

Lindsay was sitting on her bed, drinking a beer when she heard a knock at
the door. Thinking it would be the pizza she ordered, she walked to the
door, only to find Bobby, already inside, holding up the key she had given
him a month ago.
"Still fits." He said casually.
"Great. What do you want?" She wanted to be nice, but their conversation that afternoon was replaying clearly in her mind. "Or should I be asking what Helen wants. You know she
could just as easily have called me..."
Bobby didn't want to fight with
her, he jumped in before the arguing started. "Lindsay, I am not here for
Helen, I am here for me, and for you."
She seemed to calm down a bit, but
not for long "What, did the lovebirds have a fight?! You thought, hey
Lindsay's available, maybe I'll just use her again, until Helen and I make
up, or someone better comes along!"
This made Bobby angry, how dare she
accuse him of that, he wouldn't let her win that easily. "Hey, when we
started sleeping together, you made up the rules, not me...."
"Ohh so you're saying that you're the victim here. You're not the one who
was cast aside for your best friend." She took a deep breath, the next time
she spoke, she was calm and collected. "I knew the arrangement Bobby, I
guess I am upset, that your someone else, was Helen, and I am even more
upset, because I agreed to set you two up."
He sat down on the sofa, and
motioned for her to sit next to him. He realised how badly he had wanted
her to say, 'I'm mad because I love you!' He hadn't realised how much he
still loved her, but he couldn't tell her that, he didn't want to hurt
Helen. "Lindsay, I need your friendship, please, I know it'll be hard, but
you have been great to me, please, can we be friends?"
She nodded, smiling.
She knew she hadn't won the way she had wanted to, but this was a good
start.

Chase trial, day one, Boston Courthouse. The prosecution is headed by
Helen Gamble and second chaired by Richard Beh. The defense is headed by
Bobby Donnell (who is dating Helen) and second chaired by Lindsay Dole (who
was sleeping with Bobby, and they has just repaired their friendship).
Personal relationships were put aside here, in this courtroom, they were on
opposite sides, and neither side would back down, or give up.
Nikki Chase had been charged with killing her neighbour during an
argument. She had entered a plea of not-guilty, claiming it was self-
defence. The only problem was, that none of the other people in her block
had heard the argument. There was also correspondence from Nikki to the
victim, stating that she hated him. Lindsay had successfully gotten this
evidence suppressed, under the 4th amendment search and seizure laws. It
would still be a tough trial. Bobby was more confident than he was at the
beginning.
The prosecution had put two neighbours and a friend of the defendant on
the stand. None of their testimonies were very damaging. Helen put Nikki up
as her last witness. Nikki was ready for Helen, Lindsay had spent 2 hours
filling her in on how hard Helen would go on her. And Helen went hard. She
grilled Nikki on why she hadn't screamed out for help before she resorted
to beating him to death with a telephone. Nikki had wavered a little on
this question, but nothing too damaging.
Lindsay and Bobby had decided that Lindsay would take this cross, and
Bobby would do the close. Lindsay rose dramatically from her chair and
stepped out in front of the witness stand. Before she began speaking, she
paused in front of the jury, and purposely did up the buttons of her navy
blue jacket. "Miss Chase" she began, speaking very deliberately, and
intensely professionally. "You did not, as Miss Gamble says, beat him to
death did you?"
"No, I only hit him once, I just wanted him to get away from me, I didn't
want to kill him."
"I'm sure you didn't Miss Chase. Why was he angry at you?"
"I had made a complaint to the landlord about his noise, and the landlord
had threatened to evict him, if he didn't 'tone it down.' I guess it made
him pretty mad, he was always having parties and stuff, so, now that he
couldn't, I guess...yeah, he was angry."
"So he came to your apartment, and threatened you."
"First he yelled and stuff, saying how he was allowed to have a life. I
argued back a little, then he told me to watch my mouth, or he'd tear my
head off. Then he came at me."
Lindsay continued to question the witness. Bobby stared at her, he had
that dreamy far- off look he always got when he watched her. Whether she
was sleeping, talking, or cross- examining a witness, Bobby could not help
but be awe- struck by the feelings she evoked in him. He wasn't listening
to the defendant. Instead, he was thinking how beautiful she looked today.
She wore a black pinstripe skirt suit. The skirt stopped 2 inches above
her knee, showing off her shapely legs. Under the jacket, she wore a light
blue cotton shirt, which accentuated her porcelain skin, and her dazzling
eyes, which twinkled merrily as she spoke. He didn't even realise that
someone in the room was watching him, and that they were less than
impressed by the dreamy look in his eyes, as he stared at the defense
attorney in front of him.
Helen stared at Bobby. He had a look on his face that confused her. It
looked like one of those looks you give someone you love, the confusing
thing was, he appeared to be looking at the overweight, red-faced, male
judge. She was perplexed. That was, until Lindsay finished her questioning.
Helen eyed the two of them, as Lindsay walked back to her chair Bobby had
smiled at her. It was a happy and bewitchingly secret that smile Helen had
never witnessed before. She sat stunned as Lindsay returned his smile,
before looking over at Helen. Seeing the look on Helen's face, Lindsay
blushed a deep scarlet, and then rushed back to her seat, and fixed her
eyes on the file in front of her, not daring to look at Helen's face. That
was definitely the wisest thing for Lindsay to do, because if looks could
kill, Helen would be the defendant.

DYD&F 2pm that same afternoon. Bobby and Lindsay were in high spirits
as they walked into the office. The trial was going so well, that both
sides had rested, and closing arguments were set for the next day. The rest
of the firm listened intently as Bobby bragged about Lindsay's questioning,
which he had barely listened to. He and Lindsay then went back to his
office and prepared closing arguments. As soon as they got inside, he
grabbed her arm and said sweetly "You did great Lindsay. Real great. I was
watching...I mean listening to you, and I just kept thinking about how
beautiful...I mean amazing a lawyer you are, I am glad to work with you."
She smiled. She could tell how embarrassed he was, not only had he given
her a fabulous compliment, but he had accidentally let slip that he thought
she was beautiful. She was just as embarrassed though, and she could feel
her cheeks burning, "Thanks Bobby, I am glad we work together too, really,
I am." They stood staring each other, as an uncomfortable silence passed.
She broke it. "Now let's see if you're anywhere near as good as I am!" And
with that they sat down, and began working on his closing arguments.

Helen paced angrily around her apartment. "How dare he! How dare she!
Some friends!" She shouted her frustrations out to no one. She felt so
stupid. "How could I be so blind! It was right there the whole time. Stupid
Helen, stupid." She decided she would break up with Bobby that night, and
then go and speak to Lindsay, although, she figured she was more likely to
yell than speak. She smiled sadly as she imagined the look on both their
faces. "They don't even know how in love they are with each other." She
laughed a soft, sad laugh "Well tonight's the night they find out!"

Offices of DYD&F 9pm. Bobby and Lindsay had been working on his closing
the whole afternoon. The had stopped for an hour to go and have dinner, but
had then come back to the office to continue working. They were both so
tired that they had given up trying to suppress the urge to yawn. Bobby
stretched in his chair, and then moved over onto the sofa where Lindsay was
sitting. "Well, how do you think this is going to go Lindsay? Do you think
we'll win?"
"I hope so Bobby, this," She said waving the file, "This is a good closing,
thanks, in a huge part to me."
"Well aren't we the modest one. Must be the lack of sleep going to your
head."
"Hey! Was I just insulted?"
"Yep. What are you going to do about it?" He asked teasingly.
"Nothing." She yawned. "I am too damn tired. But just you wait until I am
at full- strength, you won't know what hit you."
Lindsay yawned and lay her head lightly on Bobby's shoulder. "Wake me up
when you're done." She smiled sleepily at him, and within 5 minutes, she
was fast asleep. He looked at her, his eyes travelling the full length of
her body. She was easily the most beautiful creature on this earth. Well,
to him anyway. He knew the feelings he had for her were wrong, he was with
Helen, but he knew he'd never love anyone like he loved Lindsay. He gently
kissed the top of her head, then lay his own head on hers, and fell asleep,
breathing in the delicious herbal scent of her hair.

Meanwhile, across town.
Helen banged furiously on Bobby's apartment door. She had been there
for three minutes now, and she realised, he wasn't home. "Just great!" She
muttered to herself. "Well if I can't see him now, I'll speak to Lindsay
first." And off she marched, purposely, to Lindsay's apartment to give her
a piece of her mind.
From the street Helen could see that Lindsay's apartment was dark. She
decided to go up anyway, after all, Lindsay might just be asleep. She
pounded on the door. "Lindsay, if you're awake, get up and let me in now!"
After 2 minutes, Helen took out the key to Lindsay's apartment. She still
had one, even though she moved out long ago. She slid the key in the lock
and turned it. The door opened, and in she went. Not remembering where the
light switch was, Helen stumbled around the apartment, banging in to
numerous objects on the way to what she thought was the bedroom.
Helen stumbled back out of the apartment. There was nobody at home, she
had found Lindsay's bedroom successfully, after walking into the laundry
and the bathroom. Helen was not stupid. "Bobby's not home, Lindsay's not
home, they are both on the same case, they like to beat me, of course they
are still at the office!" So off she went, feeling a little guilty that she
had not been working as hard as they had on the Chase trial. Only a little
guilty though, because Helen discovered with some shock, she just didn't
care at the moment, she knew she could wing-it with closing statements
anyway.

Helen entered the offices of Donnell, Young, Dole and Frutt at around
10:30pm. She noticed that the only light that was on was coming from the
place she knew to be Bobby's office. She opened the door to his office, and
was about to start screaming, when she realised they were both asleep. She
was laying on his shoulder, and he had his head resting on hers. Even while
they were sleeping, Helen could see how in love they were, they just looked
so comfortable with each other, it was a closeness Helen hadn't really
known with Bobby, or even with Lindsay for that matter. "God, if only they
knew."
Helen sighed defeatedly, and was about to leave when a brilliant idea
came to her. She tip-toed over to the desk, and wrote a message on a
notepad. She tore the piece of paper off, and folded it into a neat
little square. She then walked over to Bobby and Lindsay. She grabbed their
hands softly, and interlocked their fingers, she then placed the note in
between their palms. "They're not going to know what to think when they see
that note." She smiled sadly and left the office. As soon as she got out of
the building, the smile faded, and the tears that had been threatening to
fall since court that day, fell silently onto the pavement.

Bobby awoke at 6:15am, about two seconds before Lindsay did. He couldn't
believe how rested he felt, especially since he had slept sitting upright,
with his head tilted sharply to the side. He breathed in the still
beautiful aroma of Lindsay's hair, and knew that she was the reason he had
slept so well. He didn't realise that she was awake and he kissed the top
of her head again. Lindsay smiled when she woke up, Bobby was holding her
hand, and it felt just like old times, she nearly cried with joy when he
had kissed her, but she didn't know what to say. She stirred slightly, and
then sat up, still holding onto his hand. She stared down at the piece of
paper which had been deliberately been placed into their hands. "What's
this?" She asked sleepily.
"Ah, I guess I must have grabbed your hand while we slept...sorry."
"No, Bobby" she smiled "Not that....this." She pulled out the white piece
of paper. Seeing the confusion on his face, she opened the note, he looked
over her shoulder and read the note. When she had finished Lindsay
whispered "Helen." and then got up and left, mumbling something about
having to shower.
Bobby looked down at the note which read:
Guys, I love you both with all my heart. But that doesn't even compare to
how much you two love each other. We will always be friends, no matter what
o.k
Love Always.
Helen
Bobby smiled at the sweet gesture, he guessed that it meant they were
over, he couldn't say he was really upset at this. However, he was upset at
Lindsay's reaction, why had she left like that. He knew that they had to
talk, and today, after the trial was over, he would.

Later that day, Boston courthouse, Helen had just finished her
arguments. She had done really well, and if Bobby felt confident about
their friendship, he would have congratulated her with a smile. He didn't
though, and he got up to do his closing, without looking at either of the
two women that were staring intently at his every move.
Helen sighed softly as she watched Bobby. She knew she had done the
right thing last night, so why did she feel so stupid for letting him go.
She told herself that she would only really miss the sex, but deep down,
she was pretty sure that was not true. She turned her attention to Lindsay,
she was also staring at Bobby, she had a smile on her face that revealed
nothing, her expressions today were very controlled. She turned to Helen,
the painted smile faded, as she looked hopefully for some sign that they
were ok. Helen smiled back, losing her relationship with Bobby was bad
enough, she wasn't about to let her friendship with Lindsay end.
Lindsay nearly shouted with joy when Helen smiled back at her. Lindsay
needed to tell Bobby how she felt, but not at the risk of losing the sister
she never had, Helen. She turned her attention back to Bobby, a real smile
lighting up her face for the first time since she had fled the office that
morning. He was perfect, even in the suit he was wearing, she could see how
nice his body was, he had a slight kink in his hair, but it suited him
well. He smiled at the jury, and Lindsay was sure that a few of the female
jurors had blushed. He had this case in the bag, she knew. He was so
charming, such a sweet-talker when he wanted to be. It was one of his
finest qualities.
Later, Lindsay and Bobby sat with their client in a court waiting room,
waiting for the jury to come back. Bobby had confidently told Nikki, that
they had done well, and it looked good, but he had also insisted that she
not get her hopes up, cause you just never know. Lindsay smiled sweetly at
him. He felt his knees go weak, but he managed to smile back. Suddenly the
door burst open, and Helen came in. "Guys, jury's back, lets go." They all
rushed back to the courthouse, all that passed between them was silence.
"Case 2022 State versus Nikki Chase. On the count of murder in the first
degree, we find the defendant, not guilty." A relieved sigh went up at the
defence table, even Helen looked slightly relieved. Nikki hugged them both,
said thank you, then left the courtroom, to celebrate with her College
friends, and her family.
Lindsay and Bobby remained in the room long after everyone had left.
They were in shock, at their win, even though towards the end, they had
thought they would get this result. As shocked as they were, neither of
them were thinking about the case anymore. Lindsay got up and walked over
towards the witness chair. Bobby stood up, "Lindsay, we need to talk, and
it seems fitting that we are here, so..." He nodded playfully to the
witness chair, "Defence calls Lindsay Dole to the stand." Lindsay
reluctantly sat down in the chair, she wasn't sure she liked where this was
going, but she was too curious not to find out.
Bobby started the 'trial.' "Do you swear to tell the truth, the whole
truth and nothing but the truth, so help you God?"
"I do" Lindsay said, dramatically raising her right hand.
"Please state your name for the record." Bobby smiled.
"Bobby, there is no record, and you know my name." She had no plans to make
this easy.
"Please, your honour, permission to treat this witness as hostile?" Bobby
was enjoying this little game, he decided to take it all the way, even
talking to imaginary judges.
"Ok, ok!" Lindsay gave in. "My name is Lindsay Dole."
"And what do you do Miss Dole?"
"I am a lawyer at DYD&F"
"Oh, I've heard about that firm, apparently the boss is a real stud."
"Well, he thinks he is!" Lindsay retorted teasingly.
"And what do you think Miss Dole, is he a handsome man?"
"Oh, yeah, he's not too bad."
"Not too bad?" Bobby asked, pretending to be insulted. Lindsay just
laughed. "Not too bad at all. Actually, I'd say he was quite attractive,
gorgeous even." Lindsay replied, enjoying the colour that had entered his
cheeks, giving away his embarrassment.
He decided he had to get straight to the point. "Miss Dole, a friend has
testified that you are in fact in love with Mr Donnell Is this statement
true?" This time it was Lindsay who blushed, what could she say? Why was he
asking her this, she tried her best to avoid answering the question. "I'd
like to plead the fifth amendment here please." Bobby shook his head.
"You can't, you're the one on trial. Tell me Lindsay, do you love me, even
half as much as I love you, I need to know." Lindsay couldn't hide her
ecstatic smile. "In light of this new evidence" she started sweetly "I'd
like to change my plea, to guilty." Bobby's grin reached from ear to ear.
He stepped up to the witness stand, pulled her out, wrapped his arms
tightly around her waist. "Then, Miss Dole, the court sentences you to a
life sentence, effective immediately, to be served in my arms." He pressed
his lips to hers, and they kissed for what seemed like hours. He pulled
away, and gazed into her eyes, which were alive with joy, "I love you
Lindsay."
"I love you too Bobby." They kissed again, this was what they had both been
waiting for, and they decided, that this was all that ever mattered.

Ok, seriously, what did you's think. I have to say that I love the end,
does the name "Under Oath" make sense to you now? I named it that because I
knew how it ended before I knew how it started. Feedback please!
