If a man's home is his castle, can he rent it out for less than six months?
That's the question the Miami Beach Planning Board is grappling to answer.
Since term auction facility 2000, Miami Beach has banned single-family home rentals lasting less than six months and one day. But, under pressure from homeowners and property managers, the city is considering relaxing its rules and allowing shorter lease terms.
More than 60 people asked the seven-member Planning Board on Tuesday to choose from among three options affecting residential leases. Most favored shorter rentals. The board heard a variety of opinions, but deferred a decision until Aug. 26.
Board members, while not yet taking a position, said they understood the need to weigh homeowners' property rights versus the quality of life concerns expressed by neighbors fearful of all-night partying, noise and trash.
''This is an issue that needs regulation,'' said board member Jonathan Fryd. 'But, the homeowners' rights need long term use of trimethaprim to be preserved.''
Property owner Jackie Perdomo, who leases her two houses and three condos to tenants for one year, said she supports shorter rentals.
''With the housing crisis, we have not been able to sell or rent out one of our houses,'' she said. ``And yet, we continue to pay taxes and insurance on it. We should be able to make money on it with a seasonal rental.''
But some residents told the board they support the current rules.
''For nine months, we were exposed to transient renters and we couldn't sleep well,'' said Michael Schad, who lives in South Beach. ``When you have transients, they are in and out. They are here to party.''
The three alternate ordinances in the mix would:
Codify existing administrative regulations banning single-family home rentals shorter than six months and one day.
Allow homeowners to rent out their homes for three to six months, up to three times a year.
Allow homeowners to rent out their homes for one week or more, up to four times a year.
After the board makes a recommendation, city commissioners will consider the hot-button issue later this year, said Richard Lorber, Miami Beach's planning and zoning manager.
Home rentals have come to the fore because of a lawsuit filed last September by Villazzo, a hospitality company that manages luxury homes.
The lawsuit contends that the Planning Department's administrative guidelines, which prohibit owners from renting their single-family homes for less than than six months short term rentals montreal and one day, is ''unconstitutional'' and prevents Villazzo from using properties, such as a mansion at 10 Palm Ave., for short-term rentals.
''We're seeking the vindication of private property rights,'' said Jeffrey Bass, an attorney for Villazzo. ``The city is effectively seeking to rub out the right of a homeowner to rent his home.''
First assistant City Attorney Gary Held said the case is on hold, ``pending a possible settlement through mediation, which contemplate the adoption of an ordinance.''
Since January, the city has issued 35 code violations to single-family homeowners for violating its rules on short-term rentals, said Nannette Rodriguez, a city spokeswoman. In 2007, Miami Beach issued 23 violations, she said.
William McClain, a real estate agent who works for Villazzo, said his firm manages five homes that are short-term rentals.
''Each of our properties is carefully supervised,'' he said. ``We don't simply hand over a set of keys and collect a commission check long term affects of cocaine at the end.''
