Congress violates it's oath of office!!!!!Recently our Constitution came under vile attack by the very congress which has sworn to uphold and defend it, specifically the first amendments right of the people to petition congress for redress of grievances. Here is this amendment as copied from the national archives. Amendment 1 Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances . To bring you up to speed on this, last year (2001) a man by the name of Bob Schulz after numerous ignored petitions of he and his group (Mind you I signed this petition some time ago) decided to fast until death or acceptance of the petition by congress. Well the fast lasted about 20 days or so and the only person to step up to the plate on this was Representative Roscoe Bartlett of Maryland's 6th district http://www.bartlett.house.gov/ (I think Ron Paul also played a part in this though this was all arranged through Congressman Bartlett's office) He accepted it and made arrangements for a public hearing at the capital which would involve both the IRS & DOJ and the testimony given would be recorded and aired live under oath. According to the group http://www.givemeliberty.org/ which petitioned congress they issued this report on Aug 7th of 2001 " The office of Congressman Roscoe Bartlett announced late Friday the specific dates and location for the Citizen's hearing. The proceedings will commence, as expected, on September 25th in room #311 of the Cannon House Office Building on Capitol Hill. " This all went as planned then we all know of the events of September 11th. Then on the 12th the group issued this statement " In the shadow of Tuesday's dark events, Bob Schulz, Chairman of the We The People Foundation , communicated his request to Rep. Roscoe Bartlett Wednesday, that the tax hearing be postponed until sometime in October. " So the hearings were postponed at the groups request. Then on Oct 12 the Congressman sent this letter to the group. http://www.bostonteaparty2.org/bartlett/bartlett.html In this letter he admits the group is exercising their first amendment right he also admits it is congresses duty to give an answer to all petitions. Here I quote from his letter which is also in graphic form (Link above) which will prove it's word for word. (Bold & Color Emphasis added.) " The constitution that I loved and have sworn to uphold and defend grants citizens the right to petition our government for redress of grievances. It is my duty as an elected representative to the United States Congress to ensure that once a petition, such as yours, is properly framed, our government timely and properly responds. To that end , I fully supported you in July to arrange a formal two-day public forum where the Department of Justice and the IRS would respond under oath. However, the events of September 11, 2001 caused the need for a delay. I greatly appreciated your Foundation�s respect for my duties as a member of congress, including my role on the Armed Services Committee and the Special Panel of Terrorism. Yesterday you explained to me that the Foundation�s members and supporters have been understanding and fully supportive during this delay. Please convey my concern for the inconvenience to them caused by the delay and my appreciation for their understanding. Now it is critical for the Congress to resume its business. An important domestic matter to address is the alleged fraudulent and illegal operations of the federal income tax system. " He goes on to give the dates and times and place of these hearing as he has rescheduled them for " February 27 and 28 in the Science and Technology Committee Hearing Room in the Rayburn House Office Building beginning at 9:00 a.m. each day . A letter of support and confirmation signed by myself and other members of Congress has been drafted, circulated, and will be sent to officials at the Department of Justice, Treasury and the IRS, informing them of the dates and times and requiring their attendance. " So he rescheduled the hearings in an effort to uphold his oath of office. Then a mere month prior to the hearings Representative Bartlett's office canceled the hearings. http://www.bartlett.house.gov/newsarticle.asp?RecordID=134 and in the process makes the LAMEST excuse possible. The tax group had been advertising to wait to file until the hearings on the 27 & 28th of Feb. This was not illegal, immoral or unconstitutional since by law folks have until April 15 plenty of time left to file. But Representative Bartlett's office claimed the group was advocating not filing at all yet he acknowledges the words the group was using which in no way advocated not filing but just to wait until after the hearings. In view of comments in Representative Bartlett's letter I view this as a breech of his oath if he as well as the rest of congress can so casually disregard a petition by the people for redress of grievances. No matter whether congress likes the issue or not they have a duty to face the music and confront the people who are their bosses. This can be proven in the words of the Continental Congress of 1774 in which in a letter to Sisten Province of Quebec they make the following statement http://press-pubs.uchicago.edu/founders/documents/v1ch14s12.html The influence of this right extends still farther. If money is wanted by Rulers, who have in any manner oppressed the people, they may retain it, until their grievances are redressed; and thus peaceably procure relief, without trusting to despised petitions, or disturbing the public tranquillity.I urge you to write your congressmen & women on this very important issue and ask them why they failed so misserablly to uphold the very first amendment of the US Constitution! Evidence that has been mounting in the last few years thanks in part to the internets ability to let folks share info and has raised serious questions which congress must answer. I now urge you once again to follow up on this issue with your congressmen & women so that the Constitution which I personally love and cherish does not get so easily trampled by those who have sworn to uphold and defend. Update: June 24rth, 2002 After the hearings (which congress did not attend or send representatives of any government entity at least not to answer questions) Bob Schulz moved forward with pushing this issue forward. On April 15, 2002 every member of Congress (Except 5 or 6 who wished these items USPS delivered) had hand delivered the following items.
As of October 11, 2003 congress has still refused to hold the hearings promised to us as their response to our 1st amendment petition. |
