That's the question the Miami Beach Planning Board is grappling to answer. Since 2000, Miami Beach has banned single-family home rentals lasting less than six months and one day. ''With the housing crisis, we have not been able to sell or rent out one of our houses,'' she said. ``And yet, we continue to pay taxes and insurance on it. We should be able to make money on it with a seasonal rental.'' But some residents told the board they support the current rules. First assistant City Attorney Gary Held said the case is on hold, ``pending a possible settlement through mediation, which contemplate the adoption of an ordinance.'' Since January, the city has issued 35 code violations to single-family homeowners for violating its rules on short-term rentals, said Nannette Rodriguez, a city spokeswoman. In 2007, Miami Beach issued 23 violations, she said. William McClain, a real estate agent who works for Villazzo, said his firm manages five homes that are short-term rentals. ''Each of our properties is carefully supervised,'' he said. ``We don't simply hand over a set of keys and collect a commission check at the end.''
