SCENE 4 Logan's LIVING ROOM

It's a WRECK. Torn paper, a table over-turned, books splayed all over the floor. Logan comes in from the other room.

Logan: Thank God.

Max is so relieved to see him in one piece she almost grabs him. Instead she takes a step back and wraps her arms around herself.

Max: What happened?

Logan: Eyes Only met his match.

Before he can say more, we HEAR a cranky little voice whining from behind them:

Brittany: Uncle Logan...

Max turns to see Brittany, 4, Logan's neice. A greeting card toddler: huge eyes, fluffy hair, bee-stung mouth.

Max: Hi. What's your name?

Brittany: Go away.

Max: Great name. I'm Max.

Logan: Brittany, say hello.

Brittany: No.

Max: I think she already did. (to Brittany) So what's your story? Uncle Logan's no fun? Spends too much time working when you want to finger paint?

Brittany nods yes, warming to Max.

Max: That always makes me mad, too.

Max raises an eyebrow toward Logan.

Logan: I knew you guys would hit it off. (to Brittany) Max is here to help me take care of you.

Brittany: Yipee!

She turns and bounds off.

Max: Okay, find. I like kids, but when did I say I would baby-sit today?

Logan: I'm sorry. My sister got called out of town.

Max: Your sister Bitsy who thinks you associate with street scum? Where's husband Biff? Where's the Nanny?

Logan: I don't know. Husband Biff ran off with the Nanny. Who cares? I'm exhausted. She won't take a nap. She won't eat anything I make.

Max: She isn't into bruschetta with a crisp, pre-Pulse sauterne?

Logan: Max...please?

Off Max, giving in.

SCENE 5 INT. Logan's LIVING ROOM

Logan is straightening up as Max sits on the sofa with Brittany, who eats a Little Debbie from Max's pack.

Brittany: Read me a story.

Max: (to Logan) Got anything for kids?

Logan: (moves to the shelves) This oughta do it. Hans Christian Anderson. (crosses over) It's a folio edition.

Brittany: (to Logan) Kiss?

Logan gives her a kiss: his face so close to Max's, the child's soft cheek just inches from hers.

Max: (opening the book) Okay, here we go.

Logan settles in a chair across, starts reading some printouts as Max points out an elaborate illustration.

Max: Brittany, look. The little mermaid.

Brittany: She's Max!

THE ILLUSTRATION shows a mermaid with long, long, hair.

Max: Yes, but look at her legs.

Brittany: They're fish-legs.

ILLUSTRATIONS: Max leafs through the pictures, speed-reading as she does.

Max: Of course she's not always gonna be part fish...wait a minute. (to Logan) This is kind of...not cool.

Logan: What?

Max gestures with a finger across the thraot: she dies.

Max: Maybe we should pick another book.

Brittany: But I like mermaids.

Max: Really? You do, don't you. Well.

She turns to a picture of the Little Mermaid watching the Prince on shore. She's got to wing it:

Max: Try this: after a long time under water, the Little Mermaid sticks her head up out of the seaweed and meets this Prince, who is insanely cute. But he lives on land.

Brittany: She lives at the swimming pool.

Max: Far away. But she can't get out of the pool. Why?

Brittany: No feet!

Max: Right! So you can see, there's a lot of intense problems.

Brittany: Why?

Max: Because that was the deal a long time ago. People were supposed to be from the same basic element, or at least, both had to have tails.

This makes perfect sense to Brittany.

Max: But the Little Mermaid and the Prince didn't think about all that. They were already in love. So what could they do?

Brittany: Get married and have a baby.

Max: Well, it isn't that easy. They had a lot of stuff to work out first.

Brittany: Why?

Max: Well, because... he would die if he tried to be with her. And since she wasn't where she belonged, since she could never even go back where she belonged...

She hesitates.

Brittany: What happens?

Max: (to Logan) I don't know. What happens?

Logan looks up. He knows she's asking about them.

Logan: They figure it out.

Max manages a smile, turns back to the book.

ON AN ENGRAVING OF THE LITTLE MERMAID, WATCHING THE PRINCE ON THE DECK OF HIS SHIP.

SCENE 6 EXT. WATER-NIGHT

A battered old fishing boad, The Sea Urchin, hauls up a streaming net. It swings high over the rolling deck.

SCENE 7 EXT. FISHING BOAT DECK-NIGHT

We follow the NET as it descends toward a mess of empty beer bottles, tangled line and ill-kept gear. Loser fisherman Ike, Jack, and Mack lumber over to release the catch.

The net splays open. Twitching fish fall away to reveal

A BEAUTIFUL YOUNG WOMAN (GILL GIRL)

In a skin tight suit, thin and unrestricting, cut out at the sides. Her long, soaked hair spills down her breathless body. Her flesh is opaque, dead blue-White. Through the cut-outs in her suit we can see crescent shaped gashes.

Jack: Jeez. Too bad.

Mack presses his ear to her chest: does he hear something?

Mack: I hear a heart beat!

Jack: Come on man, she's not breathing. She's dead.

Mack: (to Ike) Get us in, fast.

Ike runs for the wheel and cranks up the engine. Mack opens her mouth, trying to clear an air passage. CLOSE on Gill Girl's upper body as Mack places his mouth over hers. In this tense moment the action SLOWS down. SILENCE.

Mack breathing into her mouth. Her chest is still, not rising up and down as it should when lungs inflate. But on her side, what looked to be a gash begins to rise, a thin half-moon shaped layer of skin. Below it, another half-moon. And another. We're seeing GILLS-- scalloped, delicate, edged with deep red.

Mack: What the--

Ike: Look like some kinda gills...

Mack: Gills? What the hell is she-- a mermaid?

SCENE 8

EXT. DOCK-FISHING BOAT DECK- DAY (DAY TWO)

The fisherman stand around the open fish holding tank on deck, passing a flask among themselves. There's a small crowd on deck.

THE FISH HOLDING TANK

Gill Girl's sleek head breaks the surface. She looks at them, then slides back under, her legs splashing water in fisherman's faces.

Ike: There she blows.

Murmurs of amazement among the group.

Dock Worker: What do you call a thing like that?

Mack: That, my friends, is what we call in this trade a Mermaid.

Man in a Suit: She's got a tank on her back, right?

Ike: What she's got is gills. Here she comes now. Look at her sides under water.

Gill Girl surfaces and regards them. Several people lean over the tank to look down into the water at the gills, which are working just fine. They're a conversation stopper. Gill Girl flips over and dives again.

Man in a Suit: How much for a picture with her?

The fisherman look at each other. How much?

Mack: Five bucks?

The man in the suit hands Mack the money. Pulls a camera out of his jacket pocket--

Jack: That'll be five for each of us.

His eye on the tank surface, the guy digs in his pocket and hands Jack a wad of bills. Gill Girl pops up. FLASH. FLASH. FLASH. She dives, fast. From the crowd, voices as lib: "I want a picture." "Me, too" "Lemme see that thing." The fishermen are realizing they've got something here.

Mack: Okay, okay, show's over.

Dock Worker: I just saw the top of her head.

Mack: So tomorrow's another day. Let's go. Clear the deck.

As he hustles them away Jack turns to Ike:

Jack: We got a potential gold mine here.

Ike: Yeah, but she didn't like the camera. She could just stay down there and then what? Can't see the bottom of the tank. What do we do?

Tough one. Then:

Jack: I got a brother-in-law...

The fisherman gather around to listen as--

SCENE 9 EXT. DOCK- DAY

The crowd disperses on the dock. One figure, however, remains. A tall man in a black duster, standing to the side near a bait shack, his eyes never leaving the Sea Urchin. We'll call him STALKER.

SCENE 10 INT. Logan:'S APARTMENT FOYER-DAY

Logan's sister, Bitsy, 30s, very uptown. Brittany is in Max's arms. Logan looks done in.

Bitsy: (to Max) Thanks so much. Do I owe you anything?

Max: Me? No, it was fun.

Logan: Max is a friend, Bits.

Bitsy: Oh, I'm sorry. You're just so...young. I mean...

Max: I get what you mean, that's okay. (to Brittany) Bye-bye, good girl.

Brittany: Kiss Max.

She reaches out and hugs Max around the neck, plants a big smacker on her cheek. Max nuzzles her nose.

Bitsy: Kiss for Uncle Logan?

She brings the child over and Brittany kisses Logan, too.

Bitsy: Can't thank you enough, Itsy. Can I come back and pick up her stuff tomorrow?

Logan: No problem.

Bitsy: Nice meeting you, Max.

She goes out the door.

Max: Itsy?

Logan: Childhood nickname. If I weren't so tired, I'd have to kill you for knowing that.

Max runs to help Logan, but she can't touch him.

Max: Logan! Logan!

She's circling him. He smiles up to her.

Logan: It's not your fault.

She can't touch him, help him. She runs to the phone.

Max: I'll call Sam Carr. He can meet us at the hospital. But we've gotta get there. You can't get downstairs, I can't help you downstairs...

Logan's starting to go under.

Max: Logan, how do I get you downstairs? Who do I call?

Logan: Speed dial 6

She hits the speed dial. Max hears someone answer.

Max: Hey, it's Max, who's this? Asha. Asha, we need your help. I think Logan's got the virus again.

On Logan, covered with sweat, new welts on his arms.

SCENE 11 INT. E.R. HALLWAY- CONTINUOUS

Logan's on a gurney. Nurse Betty is calling out his vital signs to DR. SAM Carr, pulling on his lab coat and running beside. In the background, Max and Asha stay close.

Nurse Betty: BP (?) and falling.

Carr: What's his temperature?

Nurse Betty: Came in at 105.

Carr: Start IV Naprosin. A hundred ccs of Methacillin.

They swing into--

SCENE 12 INT. EXAMINATION ROOM- CONTINUOUS

Asha has hung back, Max is in the room. The Nurse starts an IV. NURSE 2 is waiting.

Carr: (to Nurse 2) Get me a chem 7, stat. Fever?

Nurse Betty takes his temperature with a digital thermometer.

Nurse Betty: Temperature's 105 point 5.

Carr: Get him on ice.

NURSE #2 runs into a fridge across the room for ice packs. Carr's looking into Logan's eyes.

Carr: (to Max) What else do you know about this virus?

Max: (quiet voice) Manticore planted it in me. Any intimate contact between us...

Carr: Did you have intimate contact?

Max: I was careless.

Carr: But you're not sure?

Max: We don't know how much contact it takes. There's no way to know.

Carr: And no antidote? No drug therapy?

Max shakes her head: no.

Carr: Okay, look, Max. Whatever it is? There's nothing you can do to help right now. Go outside with your friend and wait.

Max: But...

Carr: Please.

He goes back to Logan. Max watches the nurses piling on ice packs, watches Logan's face, pale and covered with welts. For once in her life, she's helpless.

Asha: (gently) Max?

Asha's behind her. She puts her hand on Max's shoulder. Max is glad for the touch. Her eyes well up. She looks at Asha. Asha starts to cry, too.

Asha: I don't want him to... he can't die.

Max: Asha, he might.

Asha: It's not your fault.

Nurse Betty comes over to walk them out. They go, their arms around each other.

SCENE 13 INT. POWER PLANT- DAY

Following spoilers provided by R.A.M.S.

WHITE dressed in military sweatshirt and jogging shorts, is jumping rope with a fast, compulsive rythm that makes it look utterly fun free. The Man in the suit, who took Gill Girl's picture, finds him.

Man in a Suit:' Sir? Got a minute?

WHITE: What is the rule on fitness time?

Man in a Suit: No interruption except under emergency conditions.

WHITE: And are these emergency conditions?

White stops jumping. The Man gives him the photo he took of Gill Girl.

WHITE: What the hell is this thing?

Man in a Suit: I believe it's a transgenic.

White turns and moves off. The Man in the Suit follows. As they pass workers manning the steam pipes, they're joined by his usual operative, whom we shall henceforth call Otto.

WHITE: You see this?

Otto: A second before you did. She won't be hard to find. There's a complication, though.

WHITE: There always is.

Otto: We've got intelligence about the South Africans. They know transgenics got out of Manticore alive and they're back on the case.

They've reached an icon door. White pushes a code into a security box and it opens. The men enter and we are--

SCENE 16 EXT. MAKO'S TAVERNA-NIGHT

Unsavory. Rundown. Packed. At the door, Jack collects a five dollar cover charge as Ike hands out a flier to passers-by. "Come See the Mermaid: 100% Real! 100% Ligitimit!" In line to do just that, Normal and Alec.

Normal: You'll love it. Flawless, brilliant, you absolutely cannot see the trick.

Alec: She better be hot.

Normal: (smiles) you'll see. They're at the door.

Normal shows Jack his hand stamp and starts inside.

Jack: Sorry. Pay every time.

Normal: Excuse me. That's why you stamp.

Alec: (to Jack) Here. For two.

Alec pays, gets stamped and they enter.

SCENE 17 INT. MAKO'S TAVERNA-NIGHT

It ain't Crash. Lots of scary guys and the scary women who make a living off them.

In the nooks and crannies of the room, lap dances, couples making out. Behind the bar, a huge tropical fish tank. Floating inside, gills slowly pumping water already fetid and stale, is poor Gill Girl.

Alec looks at her. He's struck by... a feeling. Kismet. He moves toward her, ignoring stares from the big bozos as he elbows aside. Normal riding his wake.

Normal: See? Gorgeous. Maybe it's the water. Magnifies everything...

Alec can't take his eyes off her.

Normal: These guys are amatuers. Where's the production value. Maybe that's part of the trick. Those cheesy-looking gills, they're fake, okay, but the rest? How does she breathe?

They're at the bar. Gill Girl tries to face away from the crowd. A DRUNK climbs onto the bottle shelf behind the bar and shakes the tank before the BARTENDER can drag him down.

Normal: You can walk right around the back of the tank. Nothing. Mind spotting me a drink? I forgot to get cash.

The agitation in the water makes Gill Girl's hair float up, revealing, just for a second, her barcode. Alec reacts, realizes what she is. Quickly, he reaches into his pocket and hands Normal a few dollars.

Alec: Get us both a drink, okay?

Normal: Where are you going?

Alec: No place. I'll be right back.

BEHIND THE AQUARIUM

Alec knocks on the glass. Gill Girl slowly turns. He smiles. She starts to face the other way. He holds up his hand: stop. She does. He turns and points to his barcode. She smiles with relief. He gestures: wait, I'll be back.

THROUGH THE TANK Alec sees something that gets his attention.

WHITE AND Otto settling down at the bar. Alec slips into a shadow as Normal, carrying two beers, finds him.

Normal: Outstanding vantage point, I hope you like ale.

SCENE 17 CONTINUED

Alec: See that guy on the other side of the tank? Red tie?

Normal SEES White, who's having a word with Otto.

Normal: Italian suit. Friend of yours?

Alec: Vice cop. See how he's looking around. It's a set up for a raid. Maybe tonight.

Normal hands Alec both beers.

Normal: I just remembered. It's Pat Nixon's birthday. I promised Mother I'd be there for the service.

As he goes, Alec grabs a passing dancer--

Alec: Hey, doll-- how 'bout a dance?

Dancer: Sure.

He sits down so she can straddle him and hide him from view. As she starts to do her thing, Alec watches White through the tank-- staring so intently that he attracts Jack's attention.

Jack: For another twenty, you can get in there with her. No oxygen pack. No air hose. On her sides? Real gills. That's how she breathes. Half woman, half fish.

WHITE: Excellent. I'm impressed. How much do you want for her?

Jack: Miss Fishy? She ain't for sale.

Max: Okay. If we can get her out and into the ocean fast enough, White won't be able to find her. I'll borrow a car.

Alec: Then do it fast. This place will empty out in about twenty minutes.

She's on her way.

SCENE 18 EXT. SECTOR SIX FLOP HOUSE-NIGHT

A run down S.R.O. We come in on a window.

SCENE 19 INT. STALKER'S ROOM IN FLOP HOUSE-NIGHT

ON THE BED

The flier: COME SEE THE MERMAID! 100% REAL: 100% LEGITIMIT!

Newly shined, set up on top of the flier by a black gloved hand.

A man we'll call STALKER. He wears a black combat suit and face mask made out of some dense, opaque protective material. With expert care, he cleans and assembles a high powered rifle.

SCENE 20 INT. Logan's APARTMENT-NIGHT

Logan's on the sofa, eating soup. Asha beside him.

Logan: This is great. I didn't know you could cook.

Asha: Boil water. Drop in dehydreated Miso cube.

The buzzer rings. Asha goes to

SCENE 28 EXT. MAKO'S TAVERNA

The street's deserted. The Stalker's there. Tries the front door: locked. He pulls out his rifle and BLASTS the lock.

SCENE 29 INT. MAKO'S TAVERNA

Alec and Max hustling Gill Girl out the kitchen door as they hear the blast.

The Stalker enters and sees the dazed men, the empty tank. Runs for the kitchen.

SCENE 30 INT. KITCHEN-CONTINUOUS

Following spoilers provided by R.A.M.S.

Gill Girl, Max and Alec out the door.

Stalker right behind them.

SCENE 31 EXT. ALLEY BEHIND MAKO'S TAVERNA

The car's still running. They pile in. Take off.

Stalker bursts out the door. Raises his rifle.

THE RIFLE SITE

The back of Gill Girl's head, right in the sight through the back window. Stalker lowers his weapon.

SCENE 32 INT. Logan's CAR-NIGHT

Alec and Max in front. Gill Girl in back. She's very ill.

Alec: How long do you think she'll last?

Max: We can hold our breath under water for five minutes. I hope she's better at it than that.

Alec reaches around and takes Gill Girl's hadn. She looks at him with her big, grateful eyes. Alec digs it. Max, driving, sees a problem ahead.

As if in answer...

SCENE 49 INT. Max's CRIB-DAY

ON THE WINDOW as CRASH, it shatters, Stalker crashing through GUNS BLAZING at...

Max blurs out, charges at him. BAM! Another shot misses then his gun SKITTERS AWAY as Max hits him hard by the window, carrying them both back out onto...

SCENE 50 EXT. Max's-FIRE ESCAPE-DAY

As Stalker struggles to his feet, Max SWINGS through the window outbound, kicking him tumbling backward over the fire escape railing and...

HER HAND

shoots through the railing, grabbing Stalker by the coat just before he drops out of sight.

Max: Give me one reason not to let you drop.

Stalker looks up, wordless. Max weirded out as his odd dark clothes do something strange...they stretch, then slowly RIP, WATER POURING from the gash that's elongating now. She tries to find a solid piece of his clothing to grab onto. Nothing.

Max: Alec!

But he's already there, hauling Stalker by the arms onto...

SCENE 51 THE FIRE ESCAPE

Max and Alec watch the rest of the water drain from Stalker's suit. From now on we'll call him MERMAN. Max and Alec look at each other-- this is too weird.

GILL GIRL underwater. Her eyes pop open as MERMAN steps into the tub, WATER SLOSHING on the floor as he submerges in an embrace next to her. They look up now, at the EGGS FLOATING over their SMILING FACES. We're...

SCENE 52 INT. Max's CRIB-DAY

Max, Alec, and OC watch the odd family reunion from the bathroom doorway. Max touched.

Alec: Please. Don't pretend this is a beautiful thing here.

Max: It is. He risked his life to find her.

Original Cindy:I'm with you, boo, but beautiful or no...

O.C. pulls the door closed, giving them some privacy.

Original Cindy:They start kicking boots, Original Cindy don't want to be scarred for life.

Leaving them all...

SCENE 53 IN THE LIVING ROOM

Alec gets them back to business.

Alec: Whatever that suit was that kept him going, it's shredded now. I'm betting he'll be in as bad shape as her soon enough.

Max: We have to get them to the ocean, that's what Logan says.

Alec: From what I heard of that conversation he was saying more like give it up.

Max thinks a second, then...

Max: Call Logan. Tell him I need transport papers.

She starts off.

Alec: Where you going?

Max: There's a construction site four blocks away. They've got a water truck.

Alec: A water truck. You think White won't seet that one coming?

Max: Ok, then. Tell me a better plan.

Off Alec, thinking. He shakes his head. Nothing.

A PADLOCK

snapped by BOLT CUTTERS. We're...

SCENE 54 EXT. CONTSTRUCTION YARD- NIGHT

Max opens the barbed wire gate, enters the site where some HEAVY EQUIPMENT sits idle. She sidles up to...

A BEAT OUT WATER TRUCK

used for dust abatement. Max opens its dented door with a metallic CRUNCH. REVEAL...

IN THE SHADOWS- A FIGURE- SCOUT

is watching as Max bends down in the cab, hotwiring the truck. He talks quietly into a CELLPHONE

SCOUT: (into phone) I've got action sir. Water truck at a construction yard. He's talking to...

SCENE 55 INT. WHITE'S COMMAND POST- NIGHT- INTERCUT

White: talks to his guy in the field.

WHITE: Good.

SCOUT: It's not some mutant, though.

AT THE CONTSTRUCTION YARD: The STARTER GRINDS. The ancient engine RUMBLES to live.

SCOUT: Chick in leather, long dark hair. Serviceable. In fact, very.

WHITE: (realizing) X5-452

SCOUT: Should I apprehend?

WHITE: She'd eat you alive. (then) We'll get her at the checkpoint with her friends. Don't mess this up, I want them all.

AT THE COMMAND POST: White hangs up, leaving...

AT THE CONSTRUCTION YARD: As Max drives off, unsuspecting
