I am writing/faxing you re my telephone conversation yesterday (Mon March 1st 1999) with Scott from the Criminal Listings Dept.
Regarding the hearing of my Appeal at the Crown Court this Friday (March 5th 1999), can I ask for an adjournment due to my current ill health?
While I do seek to have my appeal heard in the Crown Court, and have been working towards the hearing of March 5th, I have unfortunately encountered my second bout of flu, the first one already hindering me in preparing my case.
I would like to have resolved the issues on March 5th as it is to my benefit to do so. However I would be prejudicing myself by appearing this Friday. I have already felt unwell for 10 days but felt it was something that would pass in the course of time. I decided though that if I still felt unwell on the Monday, to reluctantly seek an adjournment to try and cause least inconvenience to all those involved.
This evening I managed to arrange an emergency appointment with my GP Dr. Alan Young, who had prescribed me penicillin for my first bout of flu in early February.
His opinion is that I am obviously suffering from fatigue, while there are none of the physical symptoms of flu, that I was probably suffering a similar viral illness for which I am arranging a further appointment for tests and treatment.
What we also agreed on, is that the hearing does bring with it to me a certain amount of stress. This has worsened as the ban on my busking has severely affected my income from entertainment bringing with it further stresses and problems. What I need is a short period to recharge my batteries and get rid of any viral infection that could be running me down and be able to put my case in better health.
In asking for this adjournment I am only looking for a temporary relief. I feel I would be able to attend any hearing date from March 15th, though a date in early April would be the preferable latest, as I am seeking to resolve the matter to allow me to earn my income, and already have financial arrears I am seeking to resolve.
Please notify me of the decision so that I can inform my witnesses of the adjournment, and my apologies to all involved of any inconvenience.
