Entry for June 23, 2008 ![]() The Supreme Court Rules on Gitmo.... ...and darkness still threatens to engulf our Republic Well, the good news, obviously, is that the Supreme Court issued a "stinging rebuke" to the Bush administration by ruling that Guantanamo Bay detainees can challenge their detention in Federal Court. Well, Duh... As any 4th grade student knows, our constitution guarentees the right of Habeas Corpus to anyone who is incarcerated. While it is certainly a relief that the court has reaffirmed that the constitution applies to the inmates of Gulag Gitmo, a dark and sad spectacle was revealed by the 4-justice minority that denounced the decision. Scalia bitterly complained about this ruling undermining the so-called "war on terror". Thomas, Alito, and Roberts went along in tow and completed the Gang of Four who would subvert the constitution. Perhaps their highway to Hell was paved a bit by Alberto Gonzales' chilling testimony before the senate judiciary committee in 2007, in which he questioned whether the constitution really grants habeus corpus rights. The incredulous senators finally drew out that he was seeking to redifine habeous corpus to be "optional" and subordinate to the president's executive powers. Administration Neocons had previously suggested a Nazi-like "Unitary Executive" principle of virtually unlimed powers during "wartime". Of course, there has been no legal declaration of war. Whether or not one subscribes to the view that the "terrorist threat" has been largely fabricated by rouge elements within or outside of certain governmental agencies (a great deal of plausible evidence suggests that it is), it is still difficult to fathom why our elected leaders would be so eager to discard the Constitution. The Constitution specifies that wars must be declared by Congress, against foreign nations that provoke such action. Not included in the constitutional process is the spectacle of the executive branch declaring "War on Terrorism" and then invading any nation accused of harboring terrorists. If there is no legal war, there can be no "enemy combatants". (Even if the war were legal, Bush clinched infamy by excusing the military from adhering to Geneva protocol for POW treatment.) The administration is therefore guilty of war crimes and high treason. It is difficult to argue how the same standards that resulted in many Nazis being hung at Nurenburg still don't apply today. The threat to our republic is real; witnessing the spectacle of 4 Supreme Court Justices failing to uphold basic constitutional principles should be alarming enough. It is my firm belief that George Lucas meant for the prequel series of Star Wars episodes to serve as a stark warning for what could befall our republic. All the elements are there: Count Dookoo stages a false-flag military operation to frighten the Senate into ceding "emergency" powers to the Chancellor, who then quicky morphs into Evil Emporer. I wouldn't be surprised if it turns out that Alberto Gonsales served as technical consultant when the final episode was filmed.
