Congress should pass a law that says that medical malpractice awards may not be greater than an amount Congress sets because of Amendment Eight of the United States Constitution. The United States Supreme Court has the ability to judge (determine) that medical malpractice awards may not be greater than an amount the United States Supreme Court sets because of Article Three of the United States Constitution and Amendment Eight of the United States Constitution. The May 13, 2002 Forbes has an article with the title "The Tort Mess: It's even worse than you think. Out-of-control lawsuits are shutting down practices, killing businesses, and costing the economy $200 billion a year" written by Michael Freedman. If medical malpractice awards are capped, more insurance companies may decide to sell medical malpractice insurance and they might charge lower prices for the medical malpractice insurance. Many obstetricians and other Doctors have stopped practicing medicine or moved to other locations because of their justified worries about medical malpractice liability. If medical malpractice awards are capped, many Doctors may decide to reduce the fees they charge for their services. Congress should make sure a government agency exists that has the names and locations of Doctors and other health care workers that have been sued for medical malpractice. Congress should make sure this government agency also has the amounts of money Doctors and other care workers have paid out for medical practice. People should be able to view the names and locations of Doctors and other health care workers who have been sued and how much money they have paid out via the Internet. People should not have to pay to view the information on the Internet. If people want the information to be mailed to them, they could be charged for the information. We should not expect Doctors to be gods. Doctors are not perfect. I do not think any human can be perfect. We should expect Doctors to practice the Hippocratic Oath. We should not expect perfection. If pharmaceutical liability awards are capped, pharmaceutical companies might spend more money on AIDS research, contraceptive devices, and vaccines. Congress should make sure a government agency exists that has the names of pharmaceutical companies, their locations, and lawsuits that have been brought against them, and the names of the drugs that the suits are based on. Congress should make sure that this government agency also includes the amount of money that the pharmaceutical companies have paid out for settlements and how much money has been paid out for each drug. People should be able to access the information for free over the Internet. If people want the information to be mailed to them, they could be charged for the information. We should not expect pharmaceutical companies to be perfect. A drug that improves millions of live may kill hundreds of people or make hundreds of people ill. People who take prescription drugs should make sure their Doctors are ordering diagnostic testing for blood work because prescription drugs sometimes kill or severely harm people. HEALTH INSURERS LIABILITY AND HOSPITAL LIABILITY Amendment Eight of the United States Constitution says "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted." Amendment Seven of the United States Constitution says that "In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury shall be otherwise re-examined in any Court of the United States, than according to the rules of common law. Members of health insurance palns including health maintenance plans have the ability to sue health insurers including health maintenace plans because of Amendment Seven. Patients have a right to sue hospitals because of Amendment Seven of the United States Constitution. Congress should pass a law that says that health insurance liability should not be greater than an amount Congress sets because of Amendment Eight. Congress should pass a law that say that hospital liability should not be greater than an amount Congress sets because of Amendment Eight. The United States Supreme Court has the ability to judge (determine) that health insurers liability and hospitals liability are not greater than an amount that the United States Supreme Court sets. If health insurer liability is capped, health insurers may reduce the premiums they charge for health insurance. If hospital liability is capped, hospitals may reduce the fees they charge for the usage of their hospitals and the services that the hospitals provide. Congress should make sure a government agency exists that has the names and locations of health insurers and hospitals that have been sued and the amounts of money they have paid out each time they were sued. People should be able to access the information from the Internet for free. If people want the information to be mailed to them, they could be charged for the information. If product liability awards are capped, automobile manufacturers and other companies may reduce the prices they charge for their products. Congress should make sure a government agency exists which has the names and locations of manufacturers and the amounts of money they have settled for each time they have been sued. People should be able to access the information for free over the internet. If people want information to be mailed to them, they could be charged for the information. AUTOMOBILE ACCIDENT LIABILITY Amendment Eight of the United States Constitution says that "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted." Congress may want to pass a law that says that auto accident liability including pain and suffering awards may not be greater than an amount Congress sets. The United States Supreme Court may want to say that automobile accident liability including pain and suffering awards may not be greater than an amount the United States Supreme Court sets. If automobile accident liability is capped, many more companies may decide to sell automobile insurance and prices of automobile insurance may decrease significantly. One of the most expensive services that many people who drive cars buys is automobile insurance. If people did not have to spend as much money buying automobile insurance, they would have more money to buy other products and services as well as save money.
