The Pacific American Foundation (PAF), formed in November 1993, is the only national organization dedicated to improving the lives of Pacific Americans by helping them to help themselves. Opposing View to OHA

The case brought by fifth-generation Hawaii resident Harold "Freddy" Rice challenged the state of Hawaii's process of electing OHA trustees. Rice asserted this procedure violated the 14th and 15th Amendments which established the "one-person, one-vote" principle barring the government from denying the right to vote "on account of race, color or previous condition of servitude." In 1996, a Federal District Court ruled against Rice and this decision was upheld by the Ninth Circuit Court of Appeals. It found OHA's voting restriction was "not primarily racial, but legal and political." Mr. Rice, with the support of "Campaign for a Color-Blind America," has appealed the Ninth Circuit's decision to the U.S. Supreme Court. The case was heard by the Supreme Court on October 6, 1999. The adverse decision in the Rice vs. Cayetano case is having far-reaching effects on all Native Hawaiian programs -- from sovereignty initiatives to ceded land revenues. It is imperative that Native Hawaiians understand what is at stake...and the ramifications of this decision to the future of the Hawaiian people.

Hawaiian Sovereignty Elections Council was formally deactivated in December 1996 as a result of the Rice-Cayetano decision. It was created to facilitate aprocess for the Hawaiian people to determine whether a sovereignHawaiian government will be created and what form it might take. The "Native Hawaiian Vote" held in 1996 asked the question by mail out ballot: "Shall the Hawaiian people elect delegates to propose a native Hawaiian Government?" 73% of returned ballots voted "Yes."
