Sue, I
have been contacted by several members of this community
regarding the illegal Board meeting that was held @ the barn on Saturday, 28
July.
First, and foremost, they did not give the
required 10 day notice to
the membership and they are in violation of the Virginia Statute. This is
a
state law and this illegal meeting has been reported to the State Corporation
Commission for investigation.
Second, they did not have a Board Quorum (as
only 3 newly elected
Board members were present) so all decisions that were made are null and
void. Shame on Marcus Thomas as he should have known better!
Third, I understand that these pompus asses
have decided that they
will raise the dues to $550 a year. Are they aware and have you advised
them
that there is a resolution in place that prohibits the Board from raising
dues more than $50 per year without a vote from the membership at large. The
previous Board voted to keep the dues at $350 and the dues are due July 1st.
If you or the newly elected Board think you can delay sending
out the dues
notices until your Board is in place and then raise dues to this outrageous
amount you are sadly mistaken. I have been advised by my attorney that
this
meeting and the actions taken by this Board, if true, are illegal and he
will persue this matter.
Fourth, when they voted to tear down the old
house, there were only 21
members present and while a quorum, unless you get a wide majority of members
to revote this issue, this Board is opening itself up to either a class
action suit or individual suits as to what they were promised when they
bought into Kings Grant. I suggest that the self imposed new King of Kings
Grant slow down and learn the law and what is required of him before his
subjects mutiny! Speaking of mutiny, his new proposal of sending out
registered letters to all of his subjects encouraging them to confess their
covenant violations is hysterical as is his wish to have the membership
either enforce or forgive their violations. With all the in-fighting in
this
community, he will be involved in lawsuits year after his reign of terror is
over. I'm surprised that he hasn't demanded we all kiss the ring.
EEEEEK!
Fifth, while I do not want to personally
attack you, there was a
motion which was seconded at the membership meeting to not renew your
services. Your fees are outrageous and many members feel your services
are
not worth what we are paying. One example is the Newsletter which
stated
that it costs $200 for one edition. Yet this Board voted to retain you.
If
that is their choice, I would like to suggest to them they pay you out of
their own pockets and not ours.
Lastly, Is the Association still retaining
Mr. Levy? if the actions of this illegal meeting and the decisions made
therein are upheld, he will be
extremely busy this year. Please advise because as soon as I get my dues
notice I will turn it over to my attorney for action.
