This Memorandum for the TeVelde Construction permit by Renee Hancock of the
NDEQ.
It reads:
Please Draft a Construction permit for the above operation. Complete a LWCF
tracking
sheet to date. We have 60 days from August 18, 1999 to issue the
permit.
(Added in pen is "Please draft a permit w/in 2 days."
and
"Class I = no public notice required.")
While the NDEQ asserts that this is normal procedure, the fact that there was a hurry to allow the TeVelde's to expand the existing farm before the deadline under LB 822.
The purpose of allowing expansion for existing dairies was to allow operating farmers the opportunity to grow their operations without undue penalty. The Cattleman's Association lobbied hard during the drafting of LB 822 that it would restrict family farms from being able to compete and grow.
