____This puppy is sold on Limited Registration. It is understood that the puppy will be Spayed/Neutered and NOT to be used for breeding. Puppy is to be spayed/neutered upon six months of age. Buyer is to furnish the breeder with a copy of the spay/neutered receipt. If this is not done it will be breach of the contract. This dog is suited to be a companion only.
____This puppy is sold on Full Registration in which will be eligible for all AKC events and offsprings will be eligible for registration by AKC or other registry. This dog is suited to be shown and used for breeding. Puppy is guraranteed to be a purebred. Breeder will either give Registration Papers or Transfer Papers immediately upon their receipt from AKC or other Registry and full payment is received from purchaser.
BUYER'S RESPONSIBILITIES:
The buyer agrees to permanently register the above metioned animal with AKC and to provide good care, both physically and emotionally, to the dog as follows:
1. To provide the care of a qualified veterinarian in case of illness or injury and for preventative health care.
2. To provide proper nutrition as advised by breeder or the veterinarian.
3. To provide shelter from the weather both in winter and in summer.
4. To sexually spay/neuter this pet; By 6 months of age unless advised by veterinarian otherwise due to health conditions; if pup is not spayed/neutered by 6 months breeder will at this time repossess above mentioned dog and you will lose all rights to it unless advised of medical reason said pet must wait to be altered, this medical statement must be given to breeder prior of pups 6 month birth date. (If you are purchasing said pup at full registration this does not apply to you NO. 4.)
5. To in general, care for this dog physically and emotionally as the loving, totally dependent living that the dog is.
6. To contact the seller for advice and/or assistance if, for reasons beyond the buyers control, the buyer finds the above conditions cannot be adequately met.
7. To contact the seller in writing and offer the seller the right of first refusal should the buyer decide to transfer possession or ownership of the dog for the amount described below:
Full Registration: 75% of purchase price up to one year of age.
Limited Registration: 60% of purchase price up to one year of age.
8. To provide seller with any and all change of address during the dogs life.
9. To contact seller when and if dogs life expires at any time and what happened, old age, etc....
SELLER'S RESPONSIBILITY:
1. To warrant that said dog will be genetically capable of fulfilling his/her purpose as described above.
2. To warrantee that said dog will be generally healthy for a period of 72 hours from the time of possession of the dog is transferred to buyer.
3. To warrant said dog from genetical defects for up to but not over one year from date of whelping.
BUYER AND SELLER'S RESPONSIBILITIES:
If the sellers are satisfied that the above described dog is unsuitable for the purpose sold because of conditions outlined in the warranty section of this agreement, the sellers will, at their discretion, replace said dog with one comparable value and qualities at their earliest convenience, the unsuitable animal will, at the discretion of the seller, be returned to seller at the expense of the buyer.
The buyer understands that he/she is purchasing a fine breed that responsible breeders of this breed do all in their power to protect the breed from degradation and harm; and that he/she is purchasing a dog from a breeder whose reputation could be tarnished from irresponsible actions of buyers. The buyer further understands and agrees that any willful or substantial violations of the above sale conditions will result, at the sole and absolute discretion of the sellers, in the forfeiture of ownership and possession rights of the dog without refund of monies paid; and that transfer or disposal of the dog without adhering to the terms of the agreement will result in liability of three times the purchase price of said dog. Also, the buyer understands that any court cost and/or expenses incurred by the seller, due to breach of this contract is the sole responsibility of the buyer.
SCOPE AND AMENDMENTS:
This agreement embodies the entire agreement between parties hereto, and supersedes any and all other agreements between the parties in connection with the sale of the dog described herein. This agreement may be amended at any time by the consent and signature of both parties in writing, provided that a written document so states that the purpose of the document is to amend this agreement. This agreement is entered into and wholly excuted by the state of Minnesota and litigation arising from any possible breach of this agreement shall be adjudicated in the county of Chippewa, in the state of Minnesota, under Minnesota law. All parties here by submit themselves to the jurisdiction of said courts. Should any provision of this agreement be held invalid, illegal or unenforceable, the remaining provisions shall not be affected.
ACCEPTANCE:
By Signature below, the buyer(s) and sellers affirm that they have read and understood this agreement and will abide by the articles of this agreement. (Agreement Pages 1 through 3, Two Contracts will be signed: 1 for Buyer and 1 for Seller)
