This includes taping sections at our concerts, and our music via our website....We are in the business of art....On the artistic side, Metallica create music for ourselves first and our audience second. With each profect, we go through a grueling creative process to achieve music that we feel is representative of Metallica at that very moment in our lives. We take our craft--whether it be the music, the lyrics, or the photos and artwork--very seriously, as do most artists. It is therefore sickening to know that our art is being traded, sometimes with an audio quality that has been severely compromised, like a commodity rather than the art that it is. | Who is Metallica? Metallica is a heavy metal band that first formed in the early 80s. When did Napster first file suit against Napster? April 13, 2000 Who else filed suit? Metallica, their publishing company Creeping Death Music, and their record label Elektra Records Why did they sue Napster? They allege Napster has been unlawfully using a digital audio interface device and violated the Racketeering Influenced & Corrupt Organizations Act. They also sued three universities: Univ. of Southern CA, Yale Univ., and Indiana Univ. They blame these universites for not banning the file-sharing program on their servers. How did Metallica present their case? To prove their point, Metallica drummer Lars Ulrich and the band's attorney, Howard King, produced a list of more than 335,000 user names of people that were illegally sharing Metallica's copyrighted songs using Napster. Napster then barred those people from its service two weeks later. Did it work? Not really. Nearly 30,000 of those whom were banned appealed the ban, saying Metallica misidentified them and asked to be reinstated to the service. |

| Who is Dr. Dre? Dr. Dre is one of the hip-hop community's most popular and influential artists. When did Napster first file suit against Napster? April 27, 2000 Why did Dre sue Napster? According to CNET news, Dre sued Napster for the same reasons that Metallica had done two weeks prior. Dre sites that Napster has allowed the illegal trading of his songs which are copyrighted. How did Dre present his case? Dre handed the Napster company a list of 239,612 usernames of people he claimed were illegally trading his music. He also gave a list of songs he wished Napster to block from their service, instead of kicking fans off the Napster service (CNET.com). Did it work? Not really. Just as in the case of Metallica, all the people who may have been banned from Napster wrongfully were given the chance to be reinstated to the service. |
