I really want to rent this property what do I do now?

 

With this sheet are a set of documents that you must read, be completed and returned to the address below.  As soon as we process and check them you may move in the property.  We will do this as fast as we can and notify you.

 

In order that we can process them as quickly as possible we have supplied a checklist of items to give you an idea of how long it takes us to complete this when we receive them and what you can do to speed up this process. For example the payment of the security deposit and first months payment by cheque would mean that you could have to wait up to seven days for it to clear, payment by bankers draft is immediate.  Please note that we must receive ALL the items below before you can take up residency in the flat.

 

An assured short hold tenancy is a legal document that is enforceable in court and gives you and us rights and obligations, please make certain that you have read it and understand it.

 

q       A Non Refundable Deposit of £250 – payment of this means that we reserve the flat for you for (up to) the next three weeks while you (and we) complete the paperwork and is deductible against the first months rent.  Please note that the reservation only runs from our receipt of the money and not the promise of the money. 

 

q       A security deposit and one months rent in advance – bankers draft / cash – immediate, payment by credit card over the internet / email – about a day, payment by electronic funds transfer (over the internet) about 4 days, cheque – up to seven days, Please note that the security deposit is only refundable when you leave the property against an inspection.

 

q       References – one financial and one personal.  Please make certain that you have supplied telephone numbers and that the people are willing to give the references.  Please note that if the financial one cannot be your current employer you must have a guarantor.  Please note that a guarantor is liable to pay if you do not subsequently pay your rent.  Obviously the speed at which we check these depends on their ability to be contacted.  Minimum time – 2 days Maximum time - ? as long as it takes for us to verify your references.

 

q       Standing order payment details – please note we require all payments after the initial one to be by standing order.  The completed form is sent to us and we send it to your bank.  You will not be allowed to move in until we have this information.  Please note this is not optional.  Cancellation of the standing order at any time after it initiation will be taken as notice to leave the property unless otherwise mutually agreed by both parties. Minimum time – 2 days Maximum time - ?

 

q       Shorthold Assured Tenancy Agreement – This can be signed and witnessed when you move in.  Time – 0 days.  Please note: it is initially for 6 months, if you sign it you are committing yourself to.  At the end of the six months

a)      it can be terminated by either party or

b)      if both parties agree it can be renewed for a further 6 months (or mutually agreed period)

c)      if both parties agree it can be “held over” on a monthly basis.  Each side can give a months notice to terminate.

Terms and Conditions

 

One months deposit and one months payment in advance.  Initial payment by cheque (allow for clearance), bankers draft, credit card (if Paypals member), cash.  Two references.  Further monthly payments by standing order from bank account.  Deposit refundable by cheque at end of let after inspection of furnishings.  One months notice either way.

 

The price is inclusive of council tax, electricity, water, heating, tv licence, building (but not contents) insurance. (Heating note: the flat is part of the central heating system of the main house and it is assumed that this will be adequate for most normal purposes.  Radiators can be turned off using valves.  If this is not the case the tenant will contact K or M Laing.  The tenant will not introduce new heating methods eg electric fires, oil heaters etc without the express permission of the above.)

 

Faults due to “normal ware and tear” will be met by K & M Laing and must be notified as soon as discovered in order that they can be remedied (eg washing machine does not work).  Damage due to misuse will be met by the tenant.

 

The flat will not be structurally altered or have any redecoration done on it without express permission of K & M Laing.

 

The flat is let as “a room in a house” due to the shared heating, electricity, council tax, insurance etc.  As such it cannot have a separate house number or postal deliveries.  However it is envisaged that under normal circumstances the tenant will enjoy complete privacy of the flat and will not in normal circumstances go in the main house.

 

Post will be transferred from the main house to the flat.

Access to flat will be through its own dedicated front door

No subletting

No pets

Access to the garden is only in emergencies eg fire

 

Guests etc. overnight guests: the tenant is allowed overnight guests.  However the flat is a single one and the guest must not be seen to have taken up permanent residence eg more than 3 nights per week on average.

Parties etc. The tenant will not allow parties that cause noise etc to disturb the neighbours.

AN ASSURED SHORTHOLD TENANCY AGREEMENT

 

THIS AGREEMENT is made on ______________

BETWEEN:-

 

Mr  K Laing, 66 Saville Road, Chadwell Heath, Romford, Essex RM6 6DT ( Mr. K Laing called the Landlord) of the one part and

 

1. Names

(Hereinafter called ‘The Tenant’) of the other part.

 

Definition and Interpretation

 

In this agreement:-

1.1 Word importing one gender shall be construed as importing the other gender.

1.2 Word importing the singular shall be construed as importing the plural and vice versa.

1.3 Where any party comprises more than one person the obligations and liabilities of that party under this agreement shall be joint and several obligations and liabilities of those persons.

1.4 The Clause Headings do not form any part of this agreement and shall not be taken into account in its construction or interpretation.

Together with the fixtures, fittings furniture and effects therein (hereinafter called ‘the contents’) which are specified in the attached inventory signed by the Landlord and Tenant for a term of 6 months (hereinafter called ‘the term’) commencing on

TENANTS COVENANTS

The tenants will:

a) Agree to pay a security deposit of £ 500 (five hundred pounds)

upon entering into this Tenancy Agreement. (Which is refundable at the end of the tenancy period subject to clause [g] below).

 

b) Pay the rent at the times and the manner specified to K Laing by standing order.

 

c) The property is let inclusive of electricity, water, heating, council tax costs but the tenant agrees not to introduce new means of heating eg fan heaters oil heaters etc into the property.

 

d) Not to damage of injure the property or make alterations in or addition to it.

 

e) Preserve the fixtures, furniture and effects from being destroyed or damaged and not to remove any of them from the property.

 

f) Keep the interior of the premises clean and tidy and in as good tenantable state of repair and decorative condition as at the beginning of the term, reasonable wear and tear is acceptable.

 

g) To give the Landlord vacant possession and return the keys of the Property at the end of the Tenancy and remove all Furniture belonging to the Tenant and his/ her personal possessions and rubbish and leave the property and the Landlord’s fixture and fittings in good lettable and tenantable condition and repair and to pay the Landlord the cost of repairing or replacing and damaged or missing parts of the Property or any of the Landlord’s fittings.

 

h) Not to remove any contents from the premises and to leave the furniture and effects at the end of the tenancy in the rooms or places in which they were at the beginning of the Tenancy.

 

i) Not carry on any trade, business or profession or Let or receive paying guests on the property or place or exhibit any notice board or notice on the property for any use other than that of strict residence.

 

j) Not permit or allow to be done on the premises anything which may become a nuisance or annoyance to the Landlord or the occupiers of any adjoining premises or which may render the Landlord’s insurance of the premises void or voidable or increase the rate of premium for such insurance.

 

k) Not to use or allow the premises to be used for any illegal or immoral purpose.

m) Not to assign, transfer, sub-let or otherwise part with possessions of the property may part thereof to any other person.

 

l) Permit the Landlord or the Landlord’s agents at reasonable times in the day to enter the premises to view the state and the condition thereof and of the fixtures, fittings and effects. Permit the Landlord and the Landlord’s agents at reasonable time to enter the premises during the last 26 weeks on the fixed term with prospective tenants and during any part of the term with prospective purchasers of the Landlord’s interest in the property.

 

m) Notify the Landlord forthwith in writing of any defects in the Property as soon as practicable after such defects come to the notice of the Tenant.

 

n) Permit the Landlord to make alterations to any part of the Property following the service of a two clear week’s notice by the Landlord to carry out such alterations. (Emergency repair work will be carried out immediately and will not qualify for any notice period).

 

o) To pay the Landlord a fee of £50.00 for any of the Tenant’s cheque which are either dishonored or countermanded by his / her bank.

 

p) Not to smoke

 

q) Not to allow overnight guests to take up permanent residence.

 

r) To unblock drains during the term of this Agreement.

 

s) Not to keep any living animals, bird, reptile, fish or insect in or on the premises.

 

t) During the Tenancy the Landlord will inspect the property after giving prior notice.

 

LANDLORD COVENANTS:-

 

a) The Landlord will pay and indemnify the Tenants against all outgoings in respect of the Property (except the charges for the supply of Gas, Electricity or the use of any telephone and Council tax or its replacement) If not caused by the Tenants negligence or its has been agreed with the Landlord.

 

b) Permit the Tenant, so long as he / she pays the rent and performs his / her obligations under this agreement, quietly to use and enjoy the premises during the term without any interruption from the Landlord or any person rightfully claiming under or in trust for the Landlord.

 

c) Return to the Tenant any rent payable for any period during which the premises may have been rendered uninhabitable by fire or for any risk, which the Landlord has insured.

 

d) The Landlord will accept no responsibility of any kind for any proprety of the Tenant(s) being lost, damaged or destroyed in the property from whatever cause.

 

IF

1) Any part of the rent is in arrears for more than 14 days whether formally demanded or not:

OR

2) If there is any breach of any of the Tenants obligation under this Agreement.

OR

3) If the premises are without the agreement of the Landlord left Unoccupied for the continuous period in excess of four weeks.

 

The Landlord may re-enter and take possession of the premises and thereupon the Tenancy created by this Agreement will determine, but without prejudice to any other rights and remedied of the Landlord.

 

THIS AGREEMENT is intended to create an Assured Shorthold Tenancy as defined in Section 20 of the Housing Act 1988 and the provisions for the recovery of possession by the Landlord in Section 21 thereof shall apply accordingly.

 

THIS AGREEMENT shall take effect to the provision of Section 11 of the Landlord and Tenant Act 1985 if applicable to the Tenancy.

 

ANY Notice to be given hereunder shall be deemed to be properly given if sent by registered post or recorded delivery addressed if given by the Landlord to them by name at the address stated onto be their address at the date hereof of if given to the Tenant to him / her by name at the address of the premises and if so sent shall be deemed to have been served no later than the first working day following the day on which it was posted.

THE Tenant hereby acknowledges that he / she has received prior to the date hereof a valid notice from the Landlord stating that his / her Tenancy is to be an Assured Shorthold Tenancy.
