The congregations are independent. The decisions are made at the local level. It is a matter of conscience. The circumstances would have been considered by the elder body. Any judicial action is a result of unrepentance as percieved by local body, not as an automatic process dictated by the WBTS. The elders are only given guidelines. How they apply them is up to them. We the WBTS did not tell them to DF so and so.
It doessn't matter if this is how it percieved at the publisher level, or even practically applied by the WBTS. It is the wonderful world of literal legal wording... Where what is important is what is said, not what is meant.
