After the payment of all my just debts I allow my son Elijah Gartin one dollar and no more and at his request I allow to my black man William so much of my estate as will make him equal with my son William Gartin all but one dollar. I also give and bequeath to my black man James five hundred and fifty eight dollars sixty siz cents common currency of the state and if I should be alive I also allow him the half of all he makes to himself after the first July Eighteen hundred and twenty four till my death and no more. I also allow my son John Brown sixty dollars current money of this state and no more. And whatever is left of my estate I allow to be equally divided betwixt my sons Nathaniel, Griffith, and William, and daughters Fanny Shanklin and Elizabeth Duglas, and the heirs of Uriah and Richard Gartin making the heirs of each family equal with one of my sons. I also constitute make and ordain my son, John Brown, the sole executor of this my last will and testament and do dispose renounce and revoke all former wills legacys and bequests by me in any wise made..."

He served as juror in Rockingham County, VA in May 1781. His service was on the case, Cravens, Admr. vs. Ewing. The jurors were: John Brown, Elijah Garten, James Shannon, John Robertson, Peter Hinton, Geo. Hinton, Derby Reagan, Thomas More, John Reeves, James _oling, Brewer Reeves, and Thomas Hicks "who returned papers without agreeing" (note 1). He recieved a Tellico Grant from the Knox County Circuit Court Certificate No. 7 dated October 1, 1810. He got 150 acres in Knox County, Kentucky on Briar creek next to property of Richard Browning.

He and sons would carry meal, apples, and other products of the farm to Knoxville, Tenn. in a pirogue (made by hollowing out a huge tree turnk) from their home in Knox County, Kentucky. Elijah followed his sons to Indiana and settled on a part of the land of son, James, in Lawrence County, Indiana. Elijah was a hunter and not a farmer. The first time he tried his hand at farming he did so by pulling up the dead corn stalks of the year before and dropping the seed where the old plant had been. He never owned agricultural implements. All he needed was his horse pack saddle and his rifle.

Elijah seldom bragged of his hunting exploits. He never hunted with dogs relying on his keen eyesight and woodsman skills to hunt deer, bear, and turkeys. He would take his rifle and white horse and go on hunting trips throughout southern Indiana.

Elijah was near 6 feet tall, rather rawboned with dark hair and grey eyes. Next to hunting his life was devoted to religion. His days were opened with the singing of hymns and prayer. He had been a Presbyterian in Virginia and Kentucky but helped found the Shiloh Methodist Church around Fayetteville, Indiana (note 2). He had a small "corn cracker" as early as 1819 near Fayetteville, Indiana. The power for running it was supplied by an inclined wheel and a small but active steer (note 3). He was in Lawrence County, Indiana from before 1820 until his death (notes 4 & 5).

Notes for NATHANIEL GARTEN:

The month and day of his birth are from a letter dated February 14, 1927 signed by Winfield Scott, Commissioner in the Wars Section (of the War Department?)

His revolutionary was pension papers show that the agent noted he died March 7, 1840.

He had 74 acres on Swopes Knob conveyed to him by survey in 1787. (Monroe County, VA book S-3, page 19) Patents in Greenbrier County, VA show a 1795 patent to Nathaniel for 74 acres south of Swopes Knob. In 1802 Nathaniel obtained 215 acres on Laurel Creek. (Monroe County, Va book S-1, pag 78); 95 acres on Laurel Creek. (Monroe County, VA Book S-1, page 257). In 1811 Nathaniel received 18 acres on Wolf creek. (Monroe County, VA Book S-1, page 300). He filed a petition in Monroe County, VA in 1834 about his Revolutionary War service. It reads as follows:

"On this 17th day of February 1834 personally appeared in open court before the justice of the County Court of Monroe, Nathaniel Garten aged 74 years who being first duly sworn according to law, doth on his oath make the following declaration in order to obtain the benefit of the act of congress passed June 7, 1832. That he entered the service of the United States under the following named officers and served as herein stated. That he was born in Orange County State of Virginia in the year 1759 as he has always been informed, but that he has no record of his age; that he engaged as an Indian spy in the year 1777 from the first of January to the first of March by Capt. Robert Cravens of the militia in the county of Rockingham State of Virginia and Lieut. Trout; that he was marched to Tygart's Valley the in the county of Augusta VA where he remained 3 months at Warwicks Fort for the purpose of protecting the inhabitants from the barbarities of the Indians as they had previously committed many depridations during which time he was constantly examining the ways by which the Indians came to the settlement in order that he might give intelligence to the Company stationed at the Fort. He was not in any engagement with the Indians as they (hacing ascertained that the Fort was guarded) did not attack.; That he with several others pursued the Indians for some days, marching from 40 to 50 miles a day; they suffered extremely for the want of provisions. At the expiration of three months he returned home to the county of Rockingham from which place he had started, and remained there about one year; Afterward hearing that the Indians were doing much injury to the people and their property in Tygart's Valley, he was marched back under the command of Lieut John Rice as an Indian Spy, where he remained 3 months again in active service as before stated. He returned home a second time and remained another year, from whence he was sent to Nutter's Fort at the west Fork of Monongahala River, a distance of 200 miles under the command of Capt. William Kincaid where he remained three months to guard the Farmers while at work in their fields. He returned home and moved to the county of Greenbrier (now Monroe) where he has since resided and does now reside. In the spring of 1781 being informed that James Mack's family were taken prisoners by the Indians, on Indian Creek, he volunteered and went to Laferty's Fort on Indian Creek where he staid three weeks reconnoitering the country between the mouth of Blue Stone Creek and the mouth of Indian Creek to protect the farmers during the time they were planting their corn; for which services he received no pay. He has no documentary evidence & knows of no person who can testify to his services. He is known in his present neighborhood to Col. Richard Shanklin, Capt. William McDaniel & Capt. John H. Vawter & others who can testify as to his veracity and their belief of his services as an Indian Spy. He hereby relinquishes every claim whatever to a pension or annuity except the present, and declares that his name is not on the pension roll of the agency of our state."

He was also known as Nathaniel Girton Jr. He and family were in the 1820 and 1830 Monroe county, VA censuses. In the 1840 and 1860 Census they were in Putnam county, Indiana. They have not been located in 1850. When they moved to Indiana they located in the same viscinity of William Girton who was from Pennsylvania via Brown Co, Ohio. Nathaniel's records at the courthouse soon began to appear as Girton instead of Garten. The proximity to the Girtons and the inability to write one's name may be the reasons the spelling of the name was changed. He appeared on the census of 1840 in Putnam county, Indiana. He and family have not been located in the 1850 census. He appeared on the census of 1860 in Putnam county, Indiana.

Notes for ZACHARIAH GARTEN:

Zachariah moved to Boone and Gallitan counties, Kentucky about the time his father drowned in the Ohio River in 1801. It is presumed he met Polly Miller there. From Gallitan they moved to Iowa and to Indiana. From Switzerland County, Indiana they moved to Decatur county, Indiana. In 1828 Zachariah was made an Associate Judge of Decatur County, serving a full six year term. In 1839, his son John Bunyan lost his wife and was left with 3 small children. This same year the Garton's moved to Missouri.

Judge Zachariah Garton, with his wife Polly Miller Garten, came to Bloomington Township, Dekalb County, in 1839. Zachariah was the son of Uriah and Sarah Cuddon Jones, who was a widow with 4 grown sons when she married Uriah.

In Missouri Zachariah and Polly chose a hilltop on which to build their new home. In 1845, Zachariah was County Assessor of Buchanan County. Not all of Zachariah and Polly's children followed them to Missouri, but we know that Uriah, John Bunyan, William Cuddon, James Stephen and Lewis came with the family.

Zachariah and Polly had ten known children and possibly an eleventh. Polly would have been 53 at the birth of the last child. Polly being born in 1753 and died june 14, 1855.

Zachariah and Polly Garton chose Buchanan County as their home and last resting place. They watched their children and gradchildren grow and establish roots in Missouri. Today their descendants still live in Buchanan County as well as California, Oregon, Washington, Kansas, West Virginia, and other states and countries of the world.

Zachariah was buried in Holland Jones Cemetery, DeKalb County, Missouri.
