GENERAL ADVERTISEMENT OF ASSIGNMENTS
The GENERAL CHANGE OF ASSIGNMENTS takes effect
Sunday, October 29,
2000 AT 0200, and accordingly, Bid Sheets will be received in
the
office of the Montreal Crew Management Centre, with a copy to
the
Local Chairman, up until 2359 Saturday October 14, 2000.
Employees are advised to read the Bulletin
carefully before compiling
their Bid Sheets. Only Bid Sheets received in the above office
prior
to the above time will be considered.
As per the attached appendix, applicants MUST
use and correctly
complete the Bid Sheets available at terminals. Employees are
requested to indicate their Master Seniority number on the prescribed
Bid Sheets, print and sign name, as well as insure their employee
number is on both sides of the Bid Sheets. Once completed Bid
Sheets
are to be faxed to the Crew Management Centre at fax #
Employees MUST indicate clearly whether their
bid is for a
LOCOMOTIVE ENGINEER'S position, a CONDUCTOR/YARD FOREMAN'S position
or a TRAINMAN/YARDMAN'S position
Employees who may move between positions covered
by the UTU and
positions covered by the BLE Collective Agreements MUST submit
a
separate Bid Card for each of the two types of positions.
All employees must man their assignments according
to results of
General Ad taking effect at 0200, October 29, 2000 unless on sick
leave or annual vacation.
Conductors and Trainmen awarded at change of
assignment must advise
the NMC Montreal in regards to protecting their assignments.
All blind bids must be dated and resubmitted
each change of time.
APPLICATION OF MAINTENANCE OF BASIC
RATE PROVISIONS
Please note, at this and all future General
Advertisement of
Assignments, in the awarding of positions, both required and
non-required, Article 9A 3, and all other applicable provisions
of
Article 9A with respect to the placement of protected employees
will
be strictly adhered to. For your information, Article 9A 3(b)
reads
as follows:
"All positions, whether required or
non-required, will be
advertised at the general advertisement of assignments; upon
the
setting up of new assignments; and/or upon the creation of
a
permanent vacancy in assigned road or yard service. Only those
required positions will be filled unless circumstances are
such
that the other provisions of this Clause 3 pertaining to the
placement of protected employees in non-required positions
can be
applied. Adjustments to pools or spareboards will continue
to be
handled as at present subject to the parameters contained in
this
clause 3."
(emphasis added)
In other words, protected employees will be
placed on non-required
positions only in the event that there are more protected employees
than required positions. Non-required positions can be bid; however
they will be awarded only when the provisions of the collective
agreement permit, and there are more protected employees than
there
are available required positions.
