RESOLUTION AUTHORIZING THE HONORABLE MAYOR

“Honorable Mayor”) IN BEHALF OF THE MUNICIPALITY OF
_____________________________________ (hereafter referred to as the
“Municipality”), TO PARTICIPATE IN THE “MOBILE FOR PEACE AND DEVELOPMENT
PROGRAM”, TO ORDER AND PURCHASE THE MOTORCYCLES, AND TO AUTHORIZE THE USE OF A
PORTION OF THE CALAMITY FUND FOR THE MUNICIPALITY’S PARTICIPATION IN THE
PROGRAM.

WHEREAS, the League of Municipalities of the Philippines
(LMP), in consonance with Republic Act No.7160, otherwise known as the Local
Government Code of 1991, mandates every Local Government Unit (LGU) to exercise
its general powers and attributes essential to the promotion of the general
welfare, including the efficient and effective delivery of basic services
devolved to them, has launched the “Mobile for Peace and Development Program”
to ensure immediate response by LGU in the performance of their duties and
responsibilities, including the efficient and effective delivery of services to
constituents;
WHEREAS, the LMP authorized supplier for the MPDP, the
exclusive territorial licensee of its brand in the Philippines, manufacturer
and distributor of reliable and affordable motorcycles, and ONL Consultants
Inc. (“ONL”), a seasoned consultancy company which today is the only one with
known experience in successfully structuring and implementing programs that
benefit LGUs en masse; realizing the need for the availability of affordable
motorcycles to enhance the delivery of basic services, address peace and order
problem and promote general welfare of the constituents of the LGUs, proposed
to work together with the LMP, for the successful implementation of the “Mobile
for Peace and Development Program”;
WHEREAS,
pursuant to Section 50 of Republic Act No.9148, otherwise known as the
Government Procurement Reform Act, (amending Book II, Title 6, Property &
Supply Management in the LGU, Section 366 of the Code), procurement of supplies
and equipment, which are sold by an exclusive dealer or manufacturer which does
not have sub-dealers selling at lower prices and for which no suitable
substitute can be obtained at more advantageous terms, may be made without
public bidding;
WHEREAS, a Joint Memorandum Circular (MC) was issued by the
DBM and the DILG on March 20, 2003 regarding the use of Local Calamity Fund
appropriation for man-made disaster relief and mitigation. The MC informed LGUs that the appropriation
may be used for works or services in connection with man-made disasters
resulting from unlawful acts of insurgents, terrorists and other criminals as
well as for disaster preparedness and other pre-disaster activities.
WHEREAS, the MPDP complies with the Section 50 of RA9148,
known as the Government Procurement Reform Act and the Joint MC, issued by the
DBM and DILG calling for preparedness against man-made disasters in consonance
with the Program’s focus on Peace and Order and Economic Development as key
concerns of Municipalities across the Nation.
WHEREAS, the MPDP answers this call
for preparedness against man-made disasters, terrorists, criminals and disease
epidemics while also empowering Municipalities to improve the livelihood of its
constituents through
increased police mobility and presence to deter terrorist activities that
endanger Municipalities, through quicker response time to criminal and medical
emergencies with roving patrols and mini-ambulances, through improved and more
efficient the health inspections against disease epidemics such as SARS,
through entrepreneurial opportunities to constituents by the MPDP’s Independent Service Mechanics Certification Program
and the Mobile Canteens or Rolling Stores.
NOW, THEREFORE BE IT RESOLVED, that the Sanggunian Bayan endorse, as it
hereby endorses, the “Mobile for Peace and Development Program” and all its
components and hereby confirms its support through this Resolution.

FURTHER that
the Sanggunian Bayan
authorize, as it hereby authorizes the Honorable Mayor to order for purchase
units of motorcycles under the “Mobile for Peace and Development Program” for
and in behalf of the Municipality as identified in the attached Purchase Order
Form (Annex A) which forms part of the Resolution;
RESOLVED FURTHER that the Sanggunian
Bayan authorize, as it hereby authorizes, the
appropriation and release of Pesos

from the Calamity Fund for the purchase of motorcycles under the “Mobile for
Peace and Development” Program in accordance to the Joint Memorandum Circular
2003-01 dated March 20, 2003 issued by the DBM and the DILG regarding the use
of Local Calamity Fund appropriation for mad-made disaster relief and
mitigation.
RESOLVED FINALLY that copies of this Resolution be furnished the Office of the Mayor, the League of
Municipalities of the Philippines (LMP) National Office and other concerned
offices.
