The Will of James McClintock

(Nov 24, 1787)

MEMO; that letters of administrattion on the Estate of James McClintock Junior late of New Castle County deceased were granted unto William McClintock next of kin upon the inuntiation of Samuel McClintock Administrator and inventory to be exhibited on or before the twenty fourth day of May next and vender an account on or before the twenty fourth day of November AD 1788(9) given under the seal of the registor this twenty fourth day of November AD 1787.

BE IT REMEMBERED . . .

That I James McClintock of Brandywine Hundred in the County of New Castle and State of Delaware, Labourer, being sick and weak in body but of sound mind memory and understanding thanks be to God for all his mercies do make and publish this my last will and testament in manner and form following to wit.

IMPRIMIS - I do hereby ordain and direct and it is my mind and will that all my just debts and funeral charges be well and truly paid by my Executors out of any Estate within convenient time after my decease.

ITEM - I give and bequeath all my wearing appearel to my cousin James McClintock - to wit.

ITEM - I give and bequeath to my brother John McClintock my silver shoe buckles - ITEM - It is my mind and will and I do hereby order and direct that if upon paying my just debts and funeral charges what shall be of any personall estate left I give and bequeath to my loving father James McClintock, my brother John McClintock and my sister Elizabeth McClintock wife of H. Galbraith to be equally divided between them part and share alike.� And lastly for the full accomplishment of this my last will and testament I do hereby consititute nominate and appoint my trusty and well beloved Uncle Samuel McClintock and my trusty and well beloved cousin James McClintock Junior whole and sole Executors of this my last will and testament.� In witness whereof have hereunto set my handand seal this twenty� day of October one thousand seven hundred and eighty seven.

Signed, sealed publish pronounce and declared by the above named James McClintock and for his last will and testament in presence of us who have hereunto subscribed our names as witness thereto in the presence of the said testator and in the presence of each other.� Tho. Personally appeared William McClintock one of the subscribing evidence to the above and foregoing will who being sworn saith that he did see ______ James McClintock sign seal publish pronounce and declare the above and foregoing instrument of writing as his last will and testament that at the time of so doing and saying he was to the best of his belief of sound and disposing mind and memory that he did sign his name as evidence thereunto at his request in his presence and in the presence of Thomas McClintock whom he see signed as one other evidence at the same time. � In tetimony whereof I have here unto set my hand at New Castle this 24th day of November AD 1787.

BE IT REMEMBERED that on the twenty fourth day of November AD 1787 the Last Will and Testament of James McClintock deceased in due form of law and _____ and letters testamentary therefore are granted unto Samuel McClintock surviving Executor in the same will named he being sworn well and truly to ____ the same and exhibitan inventory into the Registor's office at New Castle on or before the twenty fourth day of May ___ and render a true and just account of the administration at or before the twenty fourth day of November next ____ thereunto required given under the seat of said office.

Know all Men by these presents, That we Samuel McClintock and Robert Hamilton of the County of New Castle are held and firmly bound unto the Delaware State, in the Sum of one hundred and fifty pounds current money of the said State, unto which payment well and truly to be made, we bind ourselves, our heirs, executors and administrators, firmly by these presents. Sealed with our Seals, and dated at New Castle in New Castle County aforesaid, this twenty fourth day November in the Year of our Lord, One Thousand Seven Hundred and Eighty Seven.

The condition of this Obligation is such, that if the within bounden, Samuel McClintock, surviving Executor of the last Will and Testament of James McClintock, the elder, late of New Castle County, deceased, do make or cause to make a true and perfect inventory of all and singular the Goods, Chattels and Credits of the said deceased, which have or shall come to the Hands, Possession or Knowledge of the said Samuel or unto the Hands or Possession of any other Person or Persons for him and the same so made, do exhibit, or cause to be exhibited, into the Registers Office of New Castle County aforesaid, at or before the twenty fourth day of May next ensuing and the same Goods, Chattels and Credits, and all other Goods, Chattels and Credits of the said deceased, at the time of his death which at any time after shall come to the Hands or Possession of the said Samuel or into the Hands or Possession of any other person or persons for his do well and truly administer according to Law, viz. Shall pay the debts of the said deceased, so far forth as the said Goods, Chattels and Credits will extend and the Law will charge, and do make or cause to be made a true and just account of his Administration, at or before the twenty fourth day of November next and all the rest and residue of the said Goods, Chattels and Credits which shall be found remaining upon the said Executor account, the same being first examined, adjusted and allowed of by the Orphans Court of the County of New Castle aforesaid, do distribute or dispose of according to Law and the true intent and meaning of the last Will and Testament of the said deceased, then this obligation to be void and of none effect, else to remain in full force and virtue.
