Will of Samuel H. McClintock, Jr.
(June 20th, 1818)
BE IT REMEMBERED . . . That I Samuel McClintock Junior of Brandywine Hundred County of New Castle and State of Delaware, Carpenter, being weak in body but of a sound disposing mind memory blessed be the Lord for his mercies and calling to mind the uncertainty of this life and knowing that it is appointed for men once to die, and being desirous of settling my termperal Estate have thought proper to make and publish this my Last Will & Testament in manner as is hereafter mentioned to wit: IMPRIMIS -� It is my mind and will that all my just debts and funeral expenses be paid out of my Estate by my executor herein after named Item I give and bequeath to my brother John all my plantation and tract of land and premises situated on the hundred and county aforesaid it being the same which my Uncle Samuel now lives on be/by the contents thereof more or less - To hold to my said brother John his heirs and assigns forever after the decease of my said uncle - under and subject to certain other legacies hereinafter mentioned to be paid hereout. � ITEM - I give and bequeath to my sister Eliza the sum of $300 current lawful money of the United States of America which sum I desire and order that my said brother John shall pay herein the following manner - to wit - $100 at the� end of 1 year and $100 at the end of 3 years immediately after he shall arrive to the age of 21 years providing the said John has possession of said land otherwise so years after the decease of my Uncle Samuel. �� ITEM - I give and bequeath to my sister Jane the sum of $200 like money after which sum I order that one said brother John shall pay her as follows - to wit - $100 at the end of the first year, $100 at the end of 5 years immediately after he shall arrive at the age of 21 years. ITEM - It is my mind and will that in case my Uncle Samuel should happen to die before his wife my Aunt Mary that then and in such case I do devise and bequeath unto her the Easterly end of my house with the privilege of the yard, well, oven, and a sufficient quantity of fire wood ready cut and bought to the door also the keeping of one cow summer and winter on the place one half of the garden, and privilege of apples and cherries for her own use. All which privileges I devise to my said Aunt Mary for and during her natural life and to be at her own disposal for her to personally enjoy the same herself or otherwise to let it to any other person.� And for the full accomplishment of this my last will and testament . I do hereby nominate, consititute and appoint my aforesaid Uncle Samuel my whole and sole executor of this my Last Will and Testament and I do hereby make null and void all and every other will or wills by me at any time heretofore made and declare this and no other to be my Last Will and Testament and I do hereby make null and void.� In witness whereof I Samuel McClintock Junior the testator have here unto set my hand and seal the this eleventh day of June in the year of our Lord one thousand eight hundred and eighteen. � Signed sealed published pronounced and declared by the said Samuel McClintock the Testator as and for his Last Will and Testament in the presence of us who subscribed our names hereunto as evidences at his request in his presence and in the presence of each other. William Talley New Castle County - Personally appeared William Talley and Joseph W. Day the two subscribing witnesses to the above and forregoing will who being solemnly sworn on the Holy Evangelists of Almighty God did _____ say that they saw Samuel H. McClintock Junior the Testator (by way of making his mark) sign and seal the above and foregoing instrument of writing and heard him publish and decalre the same it having been first distinctly read to him to be his Last Will and Testament � That at the time of his so doing he was (to the best of their belief) of sound disposing mind and memory. That it was at the request of the Testator in the presence and in the presence of each other they severally subscribed their names thereto as wintess.
