
This is the last Will and
Testament of me Henry Smitherman
of Carshalton in the County of Surrey, Paper Maker. I give and
devise to my wife Mary Ann Smitherman
my freehold property No.1 Sunningdale Villas, Sutton in the County
of Surrey. I appoint my said wife and my daughter Julia Frances
Smitherman and my friend Henry
Horton of Bute Road, Wallington in the County of Surrey,
House agent (hereinafter called my trustees) to be the Executors
and Trustees of this my will. And I declare that all trusts and
powers hereinafter reposed and vested in my trustees shall be
exercised by the survivor of them or the heirs executors or administrators
of such survivor or other the trustees or trustee for the time
being of this my will. I give my plate and plated articles, linen,
china, glass, books, pictures, furniture and other household
effects to my said wife absolutely. I devise and bequeath all
my real and personal estate not hereby otherwise disposed of
unto my trustees upon trust that my trustees shall call in and
convert into money my personal estate and shall with and out
of the moneys produced by such calling in and conversion and
with and out of such part of my personal estate as shall consist
of money pay my funeral and testamentary expenses and debts and
shall invest the residue of the said moneys and shall stand possessed
of the said residuary trust monies and the investments for the
time being representing the same (hereinafter called my residuary
personal estate) and shall stand seized of my said real estate
In trust to pay the rents, profits and income of my said real
and residuary personal estate to my said wife during her life.
And upon her decease upon trust to sell my said real estate and
to stand possessed of the proceeds thereof and also of the said
residuary personal estate in trust for all my children in equal
shares provided always that if any child of mine shall die in
my lifetime leaving a child or children who shall survive me
and shall attain the age of twenty one years then and in such
case the last mentioned child or children shall take (and if
more than one equally between them) the share which his, her
or their parent would have taken of and in the proceeds of the
sale of my real estate and my residuary personal estate if such
parent had survived me. And I declare that all moneys liable
to be invested under this my will may be invested in or upon
any stocks, funds or securities of or guaranteed by the Government
of the United Kingdom or of any British Colony or Dependency
or in the bonds or debenture stock or guaranteed or preference
stock or shares of any Railway or other Company in Great Britain
or India incorporated by Royal Charter and paying a dividend
on its ordinary stock or shares or upon real or leasehold securities
in England or Wales. In witness whereof I have hereunto set my
hand this sixteenth day of June one thousand eight hundred and
eighty three - Henry Smitherman - signed by the said testator
as and for his last will and testament in the presence of us
present together at the same time who at his request in his presence
and in the presence of each other have hereunto subscribed our

On the 29th April 1884 Probate of this will was granted to Mary
Ann Smitherman widow Julia Frances Smitherman, spinster
and Henry Horton, the Executors.
PROBATE
The Will of Henry Smitherman late of Carshalton in the
County of Surrey, Papermaker, who died 21st December 1883 at
Sutton in the said County was proved 29th April, at the Principal
Registry by Mary Ann Smitherman of 1 Sunningdale Villas,
Sutton, widow, the Relict. Julia Frances Smitherman of
1 Sunningdale Villas, spinster, the daughter and Henry Horton
of Bute Road, Wallington in the County, House Agent, The Executors.
