PARTICIPANT RELEASE OF LIABILITY – READ BEFORE SIGNING

Please right click on document, select print, fill out and mail along with a deposit of $250.00.  Balance due before or upon arrival September 1^st.  Checks accepted before, but not upon arrival.  Participant is guaranteed one active bait or does not pay.  Night bears count as an active bait.  Participant agrees to obey all Minnesota State hunting rules and regulations described in the 2009 Minnesota Black Bear Handbook as well as the 2009 Minnesota hunting regulations handbook. Anyone born on or after January 1, 1980 must have a Firearms Safety Certificate (or equivalent), or other evidence of successfully completing a hunter safety course.   Participant has read and agrees to the Safety Procedures and Guidelines given at the time of the program or has read online. Participant accepts any monetary burden their program may carry (trespass, fines, property damage, etc).  Any food purchased from, provided by, or served by Castle Creek Outfitters is consumed at participants own risk.  Any equipment used by participant provided by Castle Creek Outfitters is used at own risk. Participants are required to use safety harness provided with stand. Participant agrees that photos taken of bear(s) and / or participant(s) may be used freely by Castle Creek Outfitters.

 

In consideration of being allowed to participate in any way in the 2009 Castle Creek Outfitters Black Bear program-related events and activities, I, __________________________________, the undersigned, acknowledge, appreciate, and agree that:

 

1.                    The risk of injury from the activities involved in the program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk, of serious injury does exist; and,

2.                    I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees (as hereafter defined) or others, and assume full responsibility for my participation; and,

3.                    I willingly agree to comply with the stated and customary terms and conditions for participation.  If however I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

4.                    I, for myself and on the behalf of my heirs, assigns, person representatives, and next of kin, hereby release, indemnify, and hold harmless Castle Creek Outfitters, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, spouse, heirs, and, if applicable, owners and lessors of premises used to conduct the event (“Releasees”) with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from negligence of the Releasees or otherwise, to the fullest extent permitted by law.

5.                    Governing Law and Jurisdiction.  The laws of the state of Minnesota shall govern the validity, construction and enforceability of this Agreement, without giving effect to its conflict of laws principles.  All suits, actions, claims and causes of action relating to the construction, validity, performance and enforcement of this Agreement shall be in the courts of the State of Minnesota.

 

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
