Thank you for you letter of support sent to the Minister of Citizenship and multicultural affairs, Hon Gary Hardgrave, on behalf  of  JC'S Capoeira Angola School - Community Arts and Culture in Australia.

Our community will be notified of your attitude to this matter, regarding the discrimination that the decision-makers in Brasilia, the DIMIA and the government of the Prime Minister of Australia imposed to the Brazilian artists invited to perform at our community cultural Festival -- denying a Visa to our 2003 International Australian Capoeira Angola Festival. 

It is good to know, however, that Mr. Gary Hardgrave in his letter to the Senator says: [ you may be assured that any future applications lodged by the Capoeira dancers (JC'S School) will be considered on their merits by authorised decision-makers applying Australian immigration law and policy ]. 

Indeed, we will be looking to further festivals to add to the education and evolution of our community in Australia. Particularly, after the good news that the Minister of Culture in Brasil, singer Gilberto Gil, may be present at the 2004 Womad, in Adelaide.

The presence of such artist and a Minister of the Brazilian government may add to help to improve the way such applications are reviewed to artists to entry Australia. Otherwise, it is good to mention that he hear that Mr Gilberto Gil can't entry the USA as a person himself, yet, the honourable Minister of Education is not denied a Visa (?).

We hope that in Australia we can progress better then voting to the attitude that discriminates those that can't 'prove' they are not 'poor' - or else, as Pauline Hanson's situation that was 'reviewed' by the decision-makers granting a Visa out of jail. 

People such as the Brazilian artists and many in detention centre in Australia and other Cuba illegal USA jails sometimes do not have the same 'merit' and opportunity to be considered as a human as some corrupted politicians and millionaire investors that can cross the Australian borders without following the compliance required to protect our community.

Thank you, Hon Minister, for your letter dated from 5 September 2003. 
 

The Hon. Minister Hardgrave is writing to JC'S Capoeira Angola School – Community Arts and Culture in Australia, in behalf of the Hon Phillip Ruddock MP, Minister for immigration and Multicultural and Indigenous Affairs. The Prime Minister government refused a visa to the Brazilian artists invited to contribute to the 1st Australian International Capoeira Angola Festival, sponsored by JC'S in June 2003.

The Hon Minister for Citizenship and Multicultural Affairs is now replying the e-mail they received on 8 July to justify the verdict from the DIMIA, the Australian Consular Service in Brasil. Unfortunately, to the disgust of our Australian community, JC’S non-profit community event was given up for lost, and we had a loss with this mess.

Hon Minister, we are sorry, but to accept such ‘poor excuse’ that the artists do not fit with the ‘criteria’ that this government wants is not correct. Your government is sending the wrong message and DIMIA is not providing the proper work that we need to progress Australia with arts and culture. 

Yet, on his letter to JC’S the Hon Minister justifies DIMIA… 
[ based on the information provided, the decision makers were not satisfied that the applicants had sufficient incentive to return home to Brasil after the finish of their visit to Australia

Hon Minister, which (DIMIA$$) criteria $hould be regarded as Hon arable ???

DIMIA decision-makers received faxes from the Brazilian Minister Luis Fachini Gomes, in behalf of the Brazilian Consulate in Sydney, requesting support to the artists and the cultural relationship of the two countries. One of the letters was sent direct to the Australian Ambassador in Brasil, Mr. John Sullivan. Yet, the BR Minister request was disregarded, or ignored – ??? Not to say that the Australian organizations supporting the event were also dishonoured. 

When the Minister writes… [ It is open to the Capoeira dancers to lodge fresh applications for business visitor visas and to provide any additional information which they consider may provide sufficient evidence to satisfy the decision-makers that they meet criteria for the grant of business visitor visas ] – Thankyou mate, yet… 

Let’s remind the Hon Minister that two visa applications were submitted. As for the $o-called “criteria” that is on your letter, Hon Minister, one of the artists and his spouse have an income by around R$5500 ($Real) a month. Let us remind the Hon Minister that this wage in Brasil can be match up to as someone that in Australia earns by around $1000 weekly. They own cars and houses, and work in Brasil to the public service and two of them to their local Council. Not to mention that they had a weekend workshop with the South Africa Capoeira community in Johannesburg after the Australian event. 

Hon Minister, the unfruitful verdict by the DIMIA let our Australian kids very sad. They were inspired, educated to record their own Capoeira songs composed to the event. JC’S offspring keep asking why can’t they have this cultural gift. Our country had a loss with the mess provoked by the DIMIA and our reputation as a nation of immigrants is going to be put down if the Prime Minister government continues to deny education that may disembark in the form of artists visiting Australia. 

Hon Minister, if  your Liberal government continues to ‘play’ with this attitude, denying education and arts to our community, such anti-family attitude could be ‘clas$ified’ (voted) as nepotism, or racial discrimination. Please, review ASAP this attitude and get the DIMIA staff to work fittingly to our social (cultural) progress. 

We need support to our events in Australia, support to cultural and family matters. If that ‘game’ is part of the Liberal agenda a handclap (vote?) from our community will turn up. Otherwise, a public Capoeira Angola message of disgust to this government will “dance” in public events, at Universities and Schools, Radio, Internet, Media, etc. 

By the way, the Festival of the Winds in Bondi Beach on September 14 is going to be rewarded with JC’S Capoeira Angola performance and public workshops. The Hon Minister is welcomed to support the festival and join us – the community. 

Hon Minister, I like my vote and my work (Capoeira) to those that aim to support education and arts and do not discriminate against the human race.

This public letter contains reference to the Prime Minister of Australia and his government, the DIMIA Consular Service; family matters; Capoeira; business and chaos with diplomatic cultural relationship.
 

July 2003, the beginning of a new financial year in Australia, we want to add credit to Australia. Australia requests a cultural ‘GREEN’ card to arts, educational projects, to evolve. Please join us, and say YES to Education and Arts, YES to Culture, YES to Family development project. Australia must progress. Our offspring deserve it. 

The Australian community needs arts, educators, and of course, politicians to support and commit to cultural and family matters. In fact, we have Australian artists and celebrities from the Hollywood movie world supporting cultural artistic community programs to evolve our children. JC'S Capoeira Angola School too aims education and works hard to achieve this goal. Yet… not all Australians fit to this picture. Regrettably! 

Instead of having a cultural profit to claim, the AU community has more lo$$ to deal with. Who’s the irresponsible accountable? Let’s have a Capoeira game, mate! 

The Prime Minister must first support arts and education in AU. Yet, the Prime Minister is wasting taxpayers’ money supporting the lies of the Bush government to invade, bomb and destroy families in Iraqi and elsewhere. This Prime Minister and his government discriminate families in immigration detention centres. This Prime Minister can’t (yet) say… ‘SORRY’ – included, sorry to the AU native. To add loss to AU the DIMIA follows the disgusting attitude of this Prime Minister.

Let’s protest against racial discrimination and those opposed to grant our families art and culture. 

The 2SER - 107.3 FM "Bambu Hut" show http://www.2ser.com/streaminglink.html is a community Radio service in Sydney. During a recent live show at 2SER, JC'S Capoeira Angola School offered a very special Thank You to people that add up to the cultural development of Australia. People such those that supported the 1st International Australian Capoeira Angola Festival, performed in June 2003. 

Unfortunately, our non-profit community cultural event was not fully accomplished. The DIMIA refused visa to artists and educators invited to perform the Festival. DIMIA is denying culture and education to progress Australia. DIMIA discriminate artists that intend to visit and share their art and culture to add to progress Australia. Therefore, a special “drop” (vote call) to protest against the non-tuned “eyes & ears” of the Prime Minister of Australia and his racist government is now at the Capoeira Roda – voting Capoeira. 

Thanks goes to Minister Luis A. Fachini Gomes and the BR Consulate in AU supporting the cultural relationship of Brasil and Australia. The Brazilian Consul wrote a letter to DIMIA and sent a fax to the Australian Ambassador J. Sullivan in Brasil. Requesting support to JC’S Capoeira Festival and commercial and cultural exchange in between Australia and Brasil. These affairs now can be jeopardised due to the diplomatic embarrassing situation caused by the government of the Prime Minister.

Discourteously, DIMIA staff, Tatiane Rick, AU Visa Officer PN 9809 and Norman Kersting, Temporary Entry Decision Maker PN 5360 disregarded the Brazilian Minister diplomatic request. DIMIA stated that the BR artists’ personal attributes and professional backgrounds, Capoeira, are in no need to Australia –?? Also, DIMIA imply that the Brazilian Masters are from the “3rd world” and don’ have enough money to $atisfy the Minister demand$ – (??). Indeed, the artists don’t have a “special” account illicitly held in the Swiss Land bank ally of thieves, dictators, terrorists, corrupted politicians and investors, etc. To DIMIA, the Prime Minister, the artists’ intentions of coming to visit AU and share education is not genuine –?? 

DIMIA attitude is an embarrassment to AU, a country made by immigrants. DIMIA denies Culture and Education to evolve Australia. Revolting the DIMIA non-cultural and anti-family attitude!

The Labour Party received JC’S community acknowledgments at SER. The Waverley Council supported the event and donated money. Thanks to Mayor Paul Pearce letter supporting the event. Yet, the Waverley Council Mayor request to the AU community was disregarded and taxpayers’ money wasted. 

Thanks to ANU Capoeira, Canberra’s Australian National University Student Association that endorsed JC’S Festival and donated money. 

Thankyou to the Bondi Pavilion Community Cultural Centre staff that supports cultural initiatives aimed to evolve our community. 

Thanks to SBS Radio/Sydney, Special Broadcasting Service, Portuguese Language Program. SBS was going to make journalistic coverage of the 1st International Capoeira Angola Festival to our community. SBS donated the Multi Track Studio to the recording of the master tape of the new JC’S Capoeira Angola CD. The artistic skills of JC'S kids, from the age of 7, would be highlighted at JC’S CD. JC’S kids are inspired to compose and perform their Capoeira songs at JC’S. The event was very special to our AU children. Yet, due to the discrimination of DIMIA our Australian family was denied of the Capoeira Festival. 

Mr Prime Minister, our artistic community is not happy at all with your government. Therefore, your Liberal Party program against arts and culture, family gathering, etc, will be denounced and protested in public and other events. Our artists, martial artists, dancers, educators, families, etc, living in Australia and overseas will ‘drop’ a special NO vote to your government in any coming election. Be aware with the Capoeira vote! 
 

 SAY NO TO RACISM! GRANT YOUR VOTE TO EVOLVE THE HUMAN RACE!

Thank you for your email. Obviously for privacy reasons I cannot disclose any information about individual applications or reasons for grants or refusals of visa applications to Australia. However, full details of visa application decisions are provided to applicants and they are aware of the reasons for particular decisions.

Please note though that allapplicants must meet the criteria for the grant of a visa. The criteria are different depending on the kind of visa the applicant is applying and are legislated. You might like to consult our website www.immi.gov.au for more details.

You can rest assured that the Australian Government take their responsibilities in visa issue very seriously and that, at no stage, does any form of discrimination feature in our decision making whatsoever.

Working for a Human Rights Association in France, I am particularly sensitive to discrimination for visa attributions and would very much like to know the reasons of this refusal. Had there been any specific problems with the first edition of the festival or is it discrimination against Brazilian citizens in general?

    Tatiana Rick, after the refusal of the application that we had, We would like to know if there's a problem with the request to obtain the Visa to our guests. The Festival is scheduled to start next week, and we are now just waiting (and worried) to have them here in time. Our program already promoted to the Community will be a mess. 

    Without the presence of the artists, Master of Capoeira, in Australia, the event is a failure. And we are going to be wasting our Australian money, time, and disturbing people lives here, and also in Brasil.

    We want to promote more education and arts to evolve our country. We have the support of local Waverley Council, Bondi Pavilion Community Cultural Centre, SBS Radio, Canberra University, our local community, etc. People and institutions that are happy to help and add to Australian arts and cultural matters to be developed and promoted. 

    We  would like to ask you or the new Australian Visa officer in charge of this matter, if there is any particular problem to our request to have these artists here. Please, let us know ASAP. Are they, are we, missing anything to achieve our goal, regarding this matter, culture, education, etc, with your office in Brasil? 

    Dear Tatiana, We would like to do the right thing, to have the artists and educators according to our immigration laws. As well, we do not want to waste AU money, paying again to a new Visa application. And waste the money donated by Australians, used to pay Air tickets from Brasil, and in Australia, accommodation, etc, to have our guests here. They are not going to be paid a salary to come here, rather, they agreed with our offer to pay for the expensive during their stay in our country, during their contribution sharing their skills, arts and culture. 

    We would like to use our money to evolve Australia. 

    Please, We appreciate your consideration and guidance to this important matter. Many people, Australians, reacted angry after that we learnt about this political situation of refusing Visa to artists and educators invited to share their skills, arts and culture in Australia with our community.

After ringing Brasil, We learnt that some of the documents sent on the first application requiring the Visa to travel to Australia, one month ago, did not return to the owners in the refusal letter that your office sent them with  their personal documents.

It seems that one of them is now getting problems to get ASAP the original that was sent to your office to include this in the new application Visa that you required. Is this going to be a problem, if this original document is sent later? Since we are running out of time, and we don't hear from your office.

Please let's know what's going on, 'cause as you know, we are already disrupted here in Australia and in Brasil due to this situation.

We are now including some of the letters of support to the event sent by the Waverley Council Paul Pearce Mayor, the Bondi Pavilion Community Centre, and we believe that your office received a direct letter from the Brazilian Consulate in Sydney, also the Itamarati (BR Cabinet) in BR was told about this matter, and as they already did to others, in recent time, they are also looking after this matter, since it involves Brazilian artists going overseas representing Brasil in Cultural events.

Dear Tatiana, or the officer in charge of this matter, could you please let us know what's going on.

The departure of the guests is due on June 8, and we must learn here in Australia what's going on in order to put Order to the Festival that we are offering to our community.

It's with sadness that we learn in AU that the application Visa to the BR artists was refused. 

Its not the case that they wish to come here. We Australians need to have them here, as guests to have the Capoeira Festival promoted to our community, to add education and to evolve Australia.

WE told them to send again a new Visa application. 

In the name of the Australian community, AU taxpayers, we ask you, or the new Visa officer that is looking after this matter, to consider the fact that the money that is paying to these Visa applications is not theirs, but our Australian money.

We, students, Australian institutions supporting the event such as, SBS, Waverley Council, Canberra University, Bondi Pavilion Community Cultural Centre, and others are paying for everything related to this Festival. Let's not waste our money, please. 

We would like to also have your support to add to the success of the event. To add to the Australian society to educate and evolve. Culture and Education are the priority matters to this event. This is an authentic Australian community based project, a non-profit based event. 

Please, would you let us know ASAP, in proper time all that we need to prove to your bureau that they are eligibly to receive the Visa that we are requesting to have them here in Australia. The event is now scheduled and promoted to the media, etc, Air Tickets paid, accommodations paid, multi track SBS Studio booked, to record the commemorative CD from the Festival, SBS Radio, and  SBSI - for a possible documentary on this unique event, etc. 

The event will start on June 11, after their arrival in Sydney on June 10. 

Australian community, others supporting this project, would like to thank you for your time and consideration to this matter.

Could you please let us know ASAP how long is this going take this time this "game" after that you receive by next Monday/Tuesday the new application.

The reasons for the refusal of their business visa applications is stated
at the letter sent to them with their passports.
This information can only be disclosed and discussed with the applicants or
the authorised persons, as per form 956 (attached to the application form).

If they wish,  new visa applications can be lodged at any time (new
application form, fee and supporting documentation).  If they  choose to do
so, the applications will be decided by another case officer.  However, we
can not guarantee that these applications will be approved.
