The Will of

THIS IS THE LAST WILL AND TESTAMENT of me
JOHN ROBERT RICHARDSON
carrying on the business of a Timber Merchant
at the City and County of Kingston upon Hull
in Co-partnership with
Harrie Percival Heigham under the style or firm of
"Richardson & Company"
I bequeath to
The London City and Midland Executor and Trustee Company Limited
(hereinafter called" the Company")
All my share and interest in my said business,
including all money employed by me in the said business whether as capital
or by way of loan at the time of my decease, together with all profits and
interest due to me up to the day of my decease
(but not securities for money kept at my office for safe custody
only and which are in no way connected with my said business)
Upon trust to realise the same in accordance with the
provisions of the Article of Partnership of the said firm and to
stand possessed of the proceeds of each realisation Upon trust to
pay there out all costs charges and expertise-of realising and
administering the trust hereby created
(including the remuneration of the Company)
And subject as afore said I direct the Company to stand possessed of
the net proceeds of such realisation and the investments for the time
being representing the same
(hereinafter called my Trust Fund)
Upon trust to invest the same In such securities as they in their
discretion may think proper with power from time to time to vary each
investment provided that any of the securities selected by them other
than Statutory Trustee investment shall have no uncalled or unlimited
liability upon them shall have paid a dividend on the Ordinary Stock or
share each year during the five years preceding investment by the Company
or if a security with a fixed dividend shall have always paid the full
dividend and shall have a quotation on The London Stock Exchange.
And to pay the income thereof
(including all interest on unpaid instalments of purchase money
in the event of my partner exercising his option to purchase under
the said Articles of Partnership)
to my dear wife Louisa Ellen Richardson during her life.
And after her decease Upon trust to stand posseseed of the capital
and future income of my Trust Fund In trust for all my children who
being sons shall attain the age of twenty one years or being daughters
shall attain that age or marry under that age in equal shares and if
there shall be only one such child the whole to be in trust for
that one child And l declare that the Company with the consent
in writing of my said wife during her life and after her decease at
their own discretion may raise any part or parts not exceeding together
one moiety of the vested or presumptive share of any child of mine under
this my WILL, and apply the same for his or her edvancement preferment
or benefit as my Trustees shall think fit And I also declare that the
company may in the capacity either of Trustee or Executor employ and
pay a Solicitor Broker or any other agent to transact all or
any business required to be done
(including the receipt and payment of money)
And the Company shall also be entitled to remuneration
free from duties in accordance with the scale of fees being in force
at the date of this my WILL or such other scale (if any) as may be
arranged by written agreement between the Company and me.
And I further declare that if at the time of my death the business of
the Company shall have been transferred to or incorporated with that
of any other Company this my WILL shall be read and construed as if
the name of such other Company were substituted for that of the Company
throughout.
I appoint that my share of income whether original or accrued or which
may accrue after my decease under the WILL of my late father
Joseph Richardson deceased shall from and after
my decease be paid to my said wife
Louisa Ellen Richardson for her separate use and
without power of anticipation until the youngest child shall attain
the age of twenty one years but in case I shall leave no child or
children who shall survive me or leaving such in case he she or
they shall all die under the age of twenty one years then I appoint
the, said income shall be paid to my said wife during her life.
I give to my brother Joseph
our late Mothers diamond ring and
to my esteemed friend and partner the said
Harrie Percival Heigham my diamond pin.
I devise and bequeath all the rest residue and remainder of my real
and personal estate to my said wife for her own use and benefit
absolutely, she paying there out my funeral expenses and debts
(except business debts ) all costs and expenses in respect of
the proving of this my WILL and winding up of my estate other
than my share and interest in my business herein before bequeathed
to the Company.
And all death duties payable on my death And I appoint my said wife
Sole EXECUTRIX of this my WILL, and to be the Guardian of my infant children
And lastly I revoke all former testamentary dispositions by me made
IN WITNESS whereof I have hereunto set my hand this
first day of November One thousand nine hundred and twelve
