Reservations in Private Educational Institutes

The present hue and cry raised by the Government and the Parliament over the issue of reservations in private educational institutions is unwarranted for. Judiciary has merely expressed the meaning of present laws. The mistake must be accepted and every politician must beg for forgiveness from the nation. They or their predecessors have made mistake. Present politicians have failed to correct it.

It is good sign that politicians do wish that reservations must be continued. Reservations are needed based on social and economical considerations while ensuring fairness to those who were denied basic rights in the past. The way they are trying to shade their responsibility and the way they are criticising judiciary is unpardonable.

It is a fact that education is key for development of any nation. It is established that every person needs education to take active part in development. It is accepted that education needs resources and it is beyond the capabilities of the Government alone to undertake responsibility. Private educational institutes are need of the day. such institutes have to generate resources and the only way is to charge suitable fees to students. The Government has a role to play to the extent to watch and correct these institutes while students are admitted and trained. Government should not get involved in avoidable responsibilities. In my opinion the Government should decide on their activities of governance as under:-

  1. The Government should decide on policy and method of test to prepare merit list.
  2. The Government should decide on percentage of students admitted purely on merit basis. This should be termed as the Government quota. The rest of the admissions should be treated as Administration quota.
  3. The Government should decide on percentage for students to be admitted from various categories (open and reserved) within the Government quota.
  4. The Government should decide on the fees to be paid by the students admitted within the Government quota.
  5. Institutions be allowed to admit students from the merit list but need not be as per the serial number. There is no necessity to fix quota for children of NRIs or foreigners. This should be left to the administration of the individual institution.
  6. Institutions be given free hand to charge fees to students admitted witin their quota. The Government should not accept responsibilities for finding fair amount of fees to be charged.
  7. The Government should supervise working of the institute to ensure qualitative education and fairness in various examinations and tests.

If Parliament makes such rules judiciary cannot question issues of reservations or fees.
