I just spoke with L. Hughes and she said the
SEC has requested the perm inj
on 6/29/01. That was the last entry
the PACER has logged. They are still
waiting for the court to grant that request.
That should be no problem. He
defaulted on all hearings.
I asked her if Roy was now allowed to keep
all the money he has acquired and
she said they know how much money he used
to have in the stateside accounts
and they will now ask the judge to force Roy
to disgorge those monies. This
is still a civil case. If Roy fails
to cooperate with any court orders,
then he can be held in contempt of court.
And her implication was that if
he doesn't cooperate with the SEC, then this
case could turn criminal.

25th of June 2001
I just spoke to Leslie Hughes, the litigating
attorney for the SEC. Roy was
served his notice of the TRO
(Temporary Restrain Order)and is given 20 days in which to respond. He
was
served 6/7 making it 6/27 to
respond. After that, if he fails to do so, the SEC can
go into court and ask for the
permenant injunction. After that, Roy cannot
appeal and it is all over for
Roy.
The only money the SEC can find
are the frozen monies in Luxumberg. BTW, the
Lux bank froze his monies there
due to their own investigation. The SEC said
they didn't have anything to
do with them freezing his account. She
said as of late 2000 Roy had cleaned out his
state side bank accounts. They
found them but there was no money in them.
That means the SEC never did
freeze his accounts, only the monies in the
Lux bank. The rest of the money
Roy has. He has cleaned out the state side
bank accounts and the SEC can't find that money.
That means after he has lost the
case, then he will have all that other money
that he has hidden from the SEC.
I asked if there was an attorney yet for Roy.
She said there was one at the
beginning, but he has not filed any pleadings
and there is currently not one.
That also means that the legal defense fund is
totally bogus and a rip off because
they failed to make timely filings
and now they have run out of time.

Just spoke to L. Hughes and she said the latest
entry, 12/17/01-The Status
report, is just that, to appraise the judge
of the latest events re: the
case. There is money in Greneda and
Lux and they will have to file lawsuits
in those jurisdictions to get those monies
back. That could take years.
During these proceedings, the case will remain
open and the final judgement
will not be filed.
