Article 13 Penalties

ADDITIONAL FINES EVERY THIRTY (30) DAYS IN THE SAME AMOUNT WILL BE LEVIED FOR ANY VIOLATION THAT HAS NOT BEEN CORRECTED. 13.3 Regarding commercial vehicles: For failing to remove a commercial vehicle placed, parked or permitted to remain on any property, driveway, road or road easement in the development overnight or for any extended length of time, in violation of Article 7.9, within thirty (30) days of receipt of the Rules & Regulations warning to do so, the member shall be subject to a fine of $100. A member who fails to remove the vehicle within fifteen (15) days after the issuance of the initial fine shall be subject to an additional fine of $250; and if not removed within fifteen (15) days after the issuance of the second fine, an additional fine of $500 will be imposed. If the member shall fail to remove the vehicle within fifteen (15) days after the issuance of the third fine, he or she shall be subjected to an additional fine of $500 and the Board shall commence legal proceedings to compel removal and enjoin further violation of Article 7.9 of these Rules & Regulations. In such case, the member shall reimburse the Association for all reasonable costs incurred in prosecuting such action, including all costs of appeal, if applicable.
