    Mr. Meehan's response to my letter deserves a reply.  He basically dismisses my entire argument by saying "Yes, but it's a private business, and therefore shouldn't be regulated."  However, he admits that the act of smoking in someone's face constitutes assault.  Since it is illegal to assault someone under any circumstances, and smoking in someone's face (against his will) constitutes assault, then smoking is just as regulable as fisticuffs.
     Additionally, Mr. Meehan tries arguing that other towns than Tempe (the town which will be voting on it's smoking ban, Proposition 200, on May 21, 2002) already have smoking bans, and thus the option of dining in a smoke-free environment remains available to non-smokers who desire a non-smoking restaurant environment.  However, according to Mr. Meehan, this option should not exist; thus it is with irony (and a degree of chutzpah) that Mr. Meehan offers as an alternative something he argues against anyway.
