| Puppy Purchase Agreement/Guarantee The following agreement is between JoAnna Rouse hereafter referred to as "Seller" and ________________hereafter referred to as "Buyer" for the sale and purchase of one purebred dog of the "Pug" breed, litter number ______________on this date of____________. Sire: Dam: Purchase price: $ Seller certifies that this puppy is a purebred Pug of sound mind and body, good health, and free of communicable diseases as far as appears to the eye. This puppy has been checked by a veterinarian and was found to be healthy and has received 1 sets of puppy shots and been treated for worms. Contagious Disease If, within 5 days of purchase, your veterinarian positively diagnoses the puppy as having a contagious disease that was definitely incubating at the time of purchase, Seller will accept immediate return of the puppy and refund the purchase price, plus the cost of testing and emergency treatment done by your veterinarian, not to exceed the purchase price of the puppy. If you choose to keep the puppy, and have it treated by your own vet, Seller will pay for the reasonable cost of treatment, not to exceed the purchase price of the puppy. If the puppy dies under a veterinarian's care (in hospital, not at home), as a result of a contagious disease (i.e. parvo), that was definitely incubating at the time of purchase, and timely veterinary care was obtained to no avail, Seller will refund the purchase price and applicable vet bills not to exceed the purchase price of the puppy. "Timely" means the puppy was taken to the vet for treatment at the first sign of illness or lethargy, not when the puppy was so debilitated it couldn't be saved. Seller must be notified of the illness by phone within two business days of diagnosis, and receive (by fax or mail) a copy of the vet bill, including testing, diagnosis, treatment, and itemized cost of treatment, within three business days to qualify for reimbursement. Transportation cost to or from the Seller is the responsibility of the buyer. Please note: because of their solid foundation of good health, good food, prior vaccinations, and lack of exposure, it is highly unlikely that an "Indigo" Pug puppy will contract a contagious disease if you follow the recommended vaccination schedule by your vet. It is recommended that the Buyer use common sense and not expose the new puppy to other puppies, take it to places a sick puppy has been within the past six months, or take it to public places until the puppy series of vaccinations has been completed. Congenital Defects: Congenital: Of or relating to a condition that is present at birth, as a result of either heredity or environmental influences. Example: a congenital heart defect. (American Heritage Dictionary) In the event that the puppy is diagnosed as having a serious congenital defect within one year of purchase, Buyer may return the puppy for a refund of the purchase price, return the puppy for a replacement of similar value, or retain the puppy and receive reimbursement for corrective surgery (if applicable), not to exceed the purchase price of the puppy. This does not apply to minor imperfections, which does not affect the health and/or well being of the puppy. This also does not apply to defects that are related to Brachycephalic breeds such as eye and respiratory problems. Some of these problems include, but are not limited too: stenotic nares, elongated soft pallets, collapsed trachia, trichiasis, entropion, distichia, pigmentary keratitis, etc.� In the event the puppy has a congenital defect that causes its premature death or warrants euthanasia within one year of purchase Buyer may receive a refund of purchase price or elect to accept a replacement puppy. Buyer must notify Seller by phone within two days of a serious congenital defect being detected by a licensed veterinarian. Seller must receive a written notice from Buyer's veterinarian, detailing the nature of the defect and cost of corrective surgery (if applicable), within three business days of examination. Seller retains the right to a second opinion by a veterinarian of her choice. Seller must be provided with the name and phone number of Buyer's current veterinarian. Under NO circumstances may the puppy be euthanized within the first year without prior written consent from the Seller. Doing so will negate any obligation Seller may have to reimburse Buyer for any veterinary costs. (Consent by e-mail would be considered "written"). Please be advised there are allot of defects that are considered or assumed to be congenital but are not proven to be. If your puppy acquires a defect that is questionable I will try and work out a fair solution for all concerned. Although a concentrated effort is made by Seller to breed sound, healthy puppies, buyer(s) should understand that, due to the nature of the breed, Pugs are predisposed to certain medical anomalies, and that a "normal" Pug may have one or more of these conditions during its lifetime. The Buyer(s) is urged to research the breed and be familiar with all the health issues that could affect their Pug and be ready, willing, and able to deal with any such issues before entering into this or any agreement to purchase a Pug. Spay/Neuter Agreement: This puppy is being sold and warranted for the purpose of being a pet and companion only. No warranty is given to the Buyer(s) for any special purpose or function of this dog other than being a companion dog. Spaying or neutering is required by the age of 6 months old. This will help eliminate certain health issues that could be deadly to your Pug such as Testicle cancer in males and Ovarian cancer in females. It will help avoid undesirable traits such as marking territory in males and heat cycles in females. This will also eliminate the possibility of an accidental breeding and an unwanted litter of puppies. It is further understood and agreed that the AKC papers will be withheld until proof of spay or neuter has been provided. Upon when such proof is provided, AKC papers will be promptly mailed to buyer or AKC registration may be applied for online through the AKC website. If this puppy is not spayed or neutered by 6 months of age, buyer agrees to return the puppy to the breeder. No refund will be given and buyer agrees to be responsible for transporting the puppy back to the breeder. In the event legal action is required for the breeder to re-obtain possession of the puppy, buyer agrees to pay for all court cost and related expenses. Buyer agrees to provide good care and a loving environment for this puppy and agrees to house the puppy primarily indoors as part of the family. Buyer, please be aware that due to the facial structure (brachycephalism) of a Pug they can overheat quickly and easily and may die as a result of heatstroke. Seller will gladly accept return of the puppy, at any age, if Buyer is ever unable to keep it. This warranty is nontransferable and is void if the puppy is sold and/or full or partial ownership is transferred to another person. Registration Requirements Registration papers will be furnished to Buyer when complete payment is made for the puppy and upon the fulfillment of any agreements stated above. If payment is made by personal check or money order, the registration papers will be held until the check/money-order has cleared. Buyer agrees to register this dog in accordance with the time limits specified by the AKC. The Buyer has the right to name their new puppy. I do request, and would very much appreciate, that you use my kennel name (Indigo) at the front of the name you choose. I have read, understand, and agree to the terms in this agreement:.
