COURT SAYS BOY SCOUT'S BAN ON GAYS ILLEGAL TRENTON, NJ - Equating the Boy
Scouts of America with public accommodations such as
restaurants, libraries, schools and theatres, the New
Jersey Supreme Court on August 8, 1999 ruled that the
organization's 1990 expulsion of a gay assistant
scoutmaster violated the state's anti-discrimination law.
The
scoutmaster, James Dale, 29 had in the past earned 30
merit badges, seven achievement honors and other awards.
He had been expelled by the Monmout Council in 1990 after
the group learned from a newspaper article that he was
gay.
When
asked to comment, "Big Jim" as he is
affectionately called by his troupe members, started
crying tears of joy while jumping up and down, clapping
his hands and yelling "I am soooo happy! We can
finally play our Barry Manilow albums at the scout
meetings." The news comes right before the scout
troupe is scheduled to leave for Greenwich village where they will
be staying at the YMCA and catching several Broadway
musicals.
