  • In November 2002, Kate and friend, Lindsey McKinney, travel to Austin, Texas to audition for the "American Idol" television show. The women sleep outside for 12 hours for an audition. Neither make it to the second round, but McKinney says she feels worse for Kate who sang a rendition of the country song "Forgive" by Rebecca Lynn Howard. "She craves attention like no other. This is the bad kind of attention that she's going to get," McKinney said. After returning from her trip, Kate brags to a college friend of her sexual conquest of sleeping with a Justin Timberlake look-alike. According to reporter Dawn Frantangelo:

    Reporter: ...Scott Hodson, another university freshman, says he briefly dated the young woman.

    Scott Hodson: She was really friendly, kind of a really sociable person. She was--she was fun to talk to quite a bit.

    Hodson: I don't think the singing part went real well. I mean, she waited in line and went through her little turn and everything. But when she came-- came back, her biggest story was about sleeping with the guy who looked like Justin Timberlake.

An officer determines Kate is "a danger to herself" and "It's classified as a mental health issue." Kate is taken into custody and transported by ambulance to North Colorado Medical Center of Greeley.   • According to friends and authorities, Kate suffers two recent personal trials including the end of a relationship with an 18-year old boyfriend and the death of her best friend, Nicole Clements, in a road accident. According to Lindsey McKinney, in May 2003, Kate suffered under such mental anguish that she overdosed on non-prescription pills and was rushed to a hospital.   • Afternoon - Without informing the Lakers, Bryant takes a private flight to Eagle, where he has made arrangements to undergo an arthroscopic surgical procedure on his right knee by Vail Specialist Dr. Richard Steadman of the Steadman Hawkins Clinic.   • 4:00-4:30 p.m. - Kate, a concierge at the Cordillera, receives a telephone call from Bryant's travel agent and Kate confirms Bryant's reservation. Kate is "excited" that the L.A.   • 10:00-10:15 p.m. - Kate meets Bryant and his entourage (including Mike Ortiz and Joe Carlson). Kate assigns Bryant Room Number 35, a first-floor room at the end of a long hall. Kate says, "It's about the farthest room away from the front desk and the lobby."   • 10:15 p.m. - Although the room next to Bryant's is vacant -- indeed, prior to Bryant's arrival, there were only four occupied rooms -- Kate assigns Bryant's three bodyguards to Room Numbers 18 and 20, located on the other end of the hotel.   • 11:13 p.m. - A phone call lasting a few minutes is placed from Bryant's room to his Newport Beach home where his wife, Vanessa, and young daughter, Diamante, are staying. Source: Los Angeles Times.
  • Before midnight: Kate exits the hotel through a service entrance and returns by herself through "the back way" to Bryant's room. Kate "didn't want to create a hassle" with Bryant's bodyguards and did not want them to know she was returning to Bryant's room. Kate takes Bryant on a tour of the public areas of the hotel and they flirt with each other. "She was excited that he was Kobe Bryant and was showing interest in her". While touring the hotel terrace, Kate and Bryant meet the bellman and speak briefly with him and other hotel guests. Bryant invites Kate to his room. Kate expected Bryant "to put a move on her" and she willingly returns to his room. They "chitchat" about tattoos and the jacuzzi. Kate shows Bryant the tattoo on her ankle. Undisclosed to Det. Winters during his interviews & only discovered later in a subsequent interview, Kate also lowers her dress strap to show Bryant the tattoo on her lower back. Bryant invites Kate to sit in a jacuzzi located in one of the hotel's public areas. Kate later claims she feels uncomfortable with the jacuzzi invitation. However, Det. Winters states, "I don't think she told him anything like that, no." When asked to clarify whether Kate told Bryant "she was getting uncomfortable with the situation", Det. Winters responds, "No." On the contrary, Bryant asks Kate for a hug and "she drapes her arms around his neck" and they hug and kiss for about five minutes. The "hugging and kissing is totally consensual".Source: Det.     The events of the sexual encounter that followed remain in dispute. "She says she consented to it," Det. Winters testified. "Then she said Kobe Bryant began touching her in ways that she didn't want." However, signs of a struggle were absent from the scene. Source: Det.   • Noon - Det. Doug Winters, accompanied by Deputy Rich, briefly interviews Kate for approximately 1/2-hour in her home. As part of the interview, Deputy Rich collects the clothing Kate wore on the night she had sex with Bryant, including a one-piece black dress, an overcoat, bra and underwear.     Kate's parents take her to the Sheriff's Department for her videotaped interview. In the interview room, Kate is accompanied by a victim's advocate from the Eagle County Resource Center. Kate claims the assault took place late in the evening in Bryant's hotel room and "never claims anything other than vaginal sex" occurred. Kate files criminal charges against Bryant. Source: Det.     The exam report notes that "no trauma observed" (i.e., no cuts, no abrasions, no bruises, no lacerations) on the labia majora, labia minora, vagina or rectum. Examiners note "bilateral redness" on the labia minora and erythmema (or "redness") in the cervix. During a colposcopic exam (i.e., toluidine blue dye is applied and the stained region is magnified and examined under a colposcope), nurses observe the following: "multiple, small shallow pinpoint lacerations, approximately 1 to 2 millimeters in length, on the posterior fourchette" and "two 1 centimeter lacerations". "Other than those injuries, no other tears, bruisings, abrasions" and Kate was never given "any pain medication, any topical ointment, no treatment whatsoever". Source: Det.     As part of the exam, nurses collect the yellow knit underwear Kate wore to the exam. Forensic testing confirms that the underwear has a spot of her blood and traces of semen, sperm and Caucasion pubic hairs that "do not match the DNA profile of Mr. Bryant". Notwithstanding, the Sheriff's Department has not conducted any tests to determine to whom the semen, sperm and pubic hairs belongs. Source: Det.   • 5:30 p.m. - Sheriff Joseph Hoy obtains an arrest warrant for Bryant from District Judge Russell Granger. Judge Granger bars the release of information about the case and orders the matter sealed. Prior to this day, Hoy has never before gone to a judge to obtain an arrest warrant. Rather, he has always followed local protocal and allowed the District Attorney's office to obtain warrants.   • The Colorado Mountain News Media and Vail Daily petition Judge Richard Hart to order the Eagle Police Department to release three police reports, concerning two 911-dispatch incidents, involving Kate.

    Town of Eagle Attorney Ed Sands argues that the records are part of the criminal investigation, and that releasing them would damage the investigation and Kate. According to Sands, "They're sealed because they have nothing to do with the investigation, but it would do irreparable harm if the documents were revealed. They are of a highly sensitive nature. You would understand if the documents were revealed."

    Sands says the Eagle Police Department is not attempting to cover anything up. He says acting Police Chief Gary Ward acted properly in not providing the records.

    Sands says Bryant and his attorney will have access to the records in due process, "Defense attorneys may get everything; the public and press might not."

    Town Manager William Powell admits that the police twice visited the Faber residence and that the police visits could have a bearing on the Bryant case. "There is some indirect connection," he says. Judge Hart takes the matter under submission and is slated to issue an order on July 25, 2003. Source: Vail Daily.

  • Kate retains an attorney in Avon, Colorado. Kate is less visible these days, her friends say, staying home most of the time, unless she drives to meetings at her attorney's office in nearby Avon.   • Kate attends a local party, appears to be in a good mood and is reportedly "bragging" about the incident. According to NBC reporter Michelle Hofland:

    Reporter: One report that we were able to track down and get five people to confirm is that NBC has learned that Bryant's accuser was at a party one week ago and she said something that surprised everyone at the party. The party host was even surprised that she showed up.

    Steve Evancho: I was just surprised that that one person in the whole world would be there because of the whole incident.

    Reporter: What was her mood like?

    Evancho: Happy. She was having fun.

    Reporter: Then sometime late Tuesday night, Evancho said that he asked the alleged victim to describe Kobe Bryant's anatomy. We can't say exactly what was said because it is inappropriate for t.v., but the five teens do confirm that she answered with a gesture and a description. They couldn't believe it.

    Evancho: That she was bragging about it kind of. About the whole thing.

    Reporter: I'm sorry what'd you say?

    Evancho: Bragging about it.

    Reporter: Evancho says he tried to get the 19-year old to tell him what happened that night in Kobe Bryant's hotel room, but she said she couldn't say.

    Reporter: Also, we have been trying all day to get the District Attorney's office to tell us if to give us a comment. They finally called us back to tell us they won't comment.

    Nothing that happened June 30th was against the will of the woman who now falsely accuses me.

    These false allegations have hurt my family. I will fight against these allegations with all my strength.

    My wife is the strongest person I know. She is willing to stand by me despite my mistake. That means everything to me.

    I have so much to live for. And by that I do not mean the contracts, or the money, or the fame. I mean my family. I will fight for them.

    I appreciate all those who have supported me. Thank you for believing in me. My family and I are going to need your support and prayers now more than ever.

    Vanessa Bryant's Written Statement:

    I know that my husband has made a mistake � the mistake of adultery.

    He and I will have to deal with that within our marriage, and we will do so. He is not a criminal. I know that he did not commit a crime, he did not assault anyone.

    He is a loving and kind husband and father. I believe in his innocence.

    Because I know him to be innocent, I will stand by him and we will face this together. I will give him all the strength and support he needs to face these false accusations. I will not let him face these accusations alone.

    I know Kobe better than anyone. The great person you see on the court and in the public is a far greater person off the court.

    As with all allegations of a criminal nature, the NBA's policy is to await the outcome of a judicial proceeding before taking any action. We do not anticipate making further comments during the pendency of the judicial process.

  • The Eagle County Sheriff's Office Press Statement:

    The Eagle County Sheriff's Office issued a warrant for Kobe Bryant, a 24 year-old California man.

    Deputies received a report on July 1, 2003 from an adult woman who made allegations of sexual misconduct by Bryant. The incident occurred in a hotel in the Edwards area of Eagle County, Colorado on the evening of June 30, 2003.

    Upon review of interviews and physical evidence, Investigators met with the District Attorney's office and concluded they had enough evidence to charge Kobe Bryant with felony sexual assault. During the investigation, Bryant was cooperative with authorities.

    Bryant voluntarily complied with the arrest warrant by turning himself in to the Eagle County Sheriff's Detention Facility, in Eagle, Colorado and posted a $25,000 bond on July 4, 2003.

    The case information was sealed to the public by order of Judge Russell Granger.

And you know if I could go through the feeling of � if I could just turn back the hands of time � and I love my wife so much. She's so special to me. But I'm innocent. And together, my wife and I and my family, we're going to fight these false accusations.

    We have a lot at stake, I have a lot at stake, and it has nothing to do with the game of basketball; it has nothing to do with endorsements. Nothing at all. This is about us. This is about our family. And I've been falsely accused of something and I'm innocent. Shoulder to shoulder we're going to fight this all the way to the end.
