In other court battle news, Bronx Criminal Court Judge Eduardo Padro threw out the rape charges filed against 27-year old rapper Dmx back in June. The rape charges were filed by a 29-year old stripper who claimed she met the raspper at the Harlem Heat club, and that she returned to a South Bronx apartment for a requested private dance and once inside the apartment was raped by the rapper
Dmx (real name Earl Simmons) maintained his innocence (I' don't even know her. That didn't happen. I didn't do it. My fans know that, anyway,"he told reporters) In July he volunteered to take DNA test to compare genetic material from his blood with the evidence.
Bronx prosecutor Bruce Birns moved to dismiss the charges, noting that DNA results "make it legally impossible to prove the defendent's guilt beyond a reasonalbe doubt." Dmx' attorney, Murray Richman, told the Daily News that the rapper was in a local recording studio and later at home in New Jersey at the time of the alleged attack. "We knew from the beginnning and we asserted from the beginnning that it wasn't him," he said. "He had no contact with her. It wasn't even a consensual act. It was nonact."
Dmx' debut album on Def Jam, It's Dark and Hell is hot, went platinum two months after it's release. In midst of court battle, he was on lacation in Jamaica, filiming Belly, which will be his first motion picture starring role.
