Good acting and wide social network of course are advantages in award competitions. After performing for many years they remain passionate and respectful for the business, which is even more commendable. Strictly speaking, two television veterans do not make too many movies. Lo Hoi Pang's award acceptable golden phrase did not disappoint with his true humorous nature. Sister Shuen whose family life has always been low key does not mention her relationship much either. Despite the troubles from diabetes, Sister Shuen rarely complains. TA KUNG PAO, MAY 6 2012, LIGHT SHADOW PATH COPYRIGHT CONCEPTS AWAIT CLARIFICATIONS The Copyright Ordinance amendment now is in a sticky situation. The government has decided to postpone its second reading for three to four weeks. This ordinance has a few points that require discussion and are worthy of attention. First, Secretary Gregory So Kam Leung says that the bill has no provision that targets "secondary creation". Some feels that is not the whole truth, as this is an issue of expression and understanding. The acts of copyright violation that the draft refers to do not target "secondary creation", but they do not exempt it either. In other words it can be said that it may cover "secondary creation". Now netizens hope to exempt "secondary creation", the issue is how to define "secondary creation"? How can this type of "creation" be guaranteed not to harm copyright owners' interest? Composers and Authors Society of Hong Kong Limited (CASH) earlier issued a statement about suggestions that the regulation stifling secondary creation to express the Society's "neutral" stance. It hoped to discuss secondary creation even more in depth and rationally. The Society actually understand fully that secondary creations of old songs with new lyrics often appear, yet publishers have to pay royalties to the original copyright owners. This is the usual rule. If someone online puts new lyrics to an old song and publicly play it, it is the same in principle. Thus the Society in the discussion should mention similar justification to protect the copyrighter owners' interest. On the other hand, International Federation of the Phonographic Industry (IFPI) holds a firmer attitude, feeling that Hong Kong copyright laws are behind the times in targeting internet. The industry six years ago has already fought for an amendment, which now is being "used" by political parties. In case the bill does not pass, the industry will have to spend several years to negotiate with the government. IFPI's stance is for copyright owner interest and is criticized for "neglecting" creator's complaints. Original creators' complaints are to protect their own copyright interest. If "Secondary creators" harm the original creators' interests then accuse original creators for "neglecting" their complaints, that does not make sense. Earlier Hong Kong Motion Picture Industry Association again points out that 11 film companies complained about over 800 pirated videos that appeared on the video sharing site youtube with over 5,000 views that cost Hong Kong film an estimated loss of 300,000, the total tally of Hong Kong film's box office of ten years so it is rather severe. If the draft cannot be passed, film copyright owners can only seek reparation through civil means. According to past experience, the cost of a civil lawsuit is higher than the reparation and does not serve as a deterrent against copyright violators. If "secondary creation" exemption is used as an excuse for the third reading of the bill to be postponed or even cancelled, who would protect original creators' interests? This is actually how the creative industry is stifled. The definitions of "Parody" and "Satire" are very hard to be standardized. Pang Ho Cheung revealed that for one scene since he was able to land a hospital location he immediately came up with the Chapman To Man Jat hospitalization scene. On the way to the hospital Ah Jat asked the director what this scene was telling, Pang Ho Cheung only coldly said, "Just shoot it first, think about it later!"
