Sir,
MEMORANDUM
I, on behalf of Balawaristan National Front (BNF), have the honour to draw
your attention towards the world most deprived and enslaved region, to which we
call Balawaristan (Pakistan Occupied Gilgit Baltistan) OGB, while Pakistan calls it
as Northern Areas with the intention of swallowing this golden sparrow on the
pretext of religion. The world knows it as a beautiful place surrounded by China,
Central Asia, Afghanistan, India and Pakistan. But most of the world is unaware
about the in-human treatment by the occupier regime of Pakistan with the 2 million
human beings of this paradise on earth and its political fate, which is still to be
decided along with the other part of Pakistan occupied Jammu and Kashmir (POK).
On the occasion of Pakistan's independence day of 14"* August, BNF
observe it as "BLACK DAY" for the people of Balawaristan being slaved under the
clutches of Pakistan. As a result, the 28000 sq. mile area has become the symbol of a
prison.
Balawaristan National Front (BNF) submits the following demands to UNO, UNSC,
UN Human Rights, Amnesty International, Human Rights Watch, Asia Watch and
all Human Rights Organizations to look into the matter of Balawaristan in
accordance with the Human Rights Charter and United Nations Commission for
India and Pakistan (UNCIP) resolution passed on 13~ Aug. 1948
1) If (Jammu & Kashmir) J & K issue is to be solved according 52 year old
UNCIP resolution, then UN and United Nations Security Council (UNSC)
should also award due punishment to the government of Pakistan for not
complying with the resolution of 13"* Aug. 1948 for withdrawal of its troops
and all civilians from occupied territory of J & K (POK) including
Balawaristan. In spite of the commitment of Pakistan to withdraw its forces
and civilians within a specified period of "7 weeks" which was extended by
UNCIPon the request of Pakistan to "12 WEEKS". But even after lapse of 2711 weeks Pakistan is still occupying Balawaristan and POK by violating UN resolution.
2). The 2 million People of Balawaristan are being treated worst than the animals of civilized world in spite of UNSC guarantees for political and fundamental human rights in the State of Jammu and Kashmir including Balawaristan. While in Balawaristan more than 70 political leaders and workers were severely tortured and put behind the bars on high treason charges by Pakistani occupier regime by applying Pakistani section 124 A, to prohibit them from peaceful political activities despite the fact that the territory of Balawaristan is not part of Pakistan. Right of vote, speech and writing is not allowed. Except pro-Pakistani religious and political parties all nationalist parties and trade union activities are totally banned.
3). UNO should takeover the control of Balawaristan by complying its own resolution to carry out the fair and impartial elections to ascertain the free will of the people, besides Pakistan occupied Sheenaki , Kohistan and Chitral and Indian occupied Ladakh.
4). Pakistan is usurping the resources of Balawaristan approximately 20 billion Rupees annually besides huge gold mines, which needs to be refunded.
5). Pakistan should be compelled to retrieve the 2500 sq.miles area of Shamshaal Hunza ofBalawaristan from China or compensate by providing its own land.
6). J & K problem is still a problem due to the obduracy, religious fundamentalism, greediness, intention of expansionism and dishonouring of UN resolution by Pakistan.
7). If the 52 year old UNCIP resolution is to be revised, which is a need of 21"' century, then the ethnic, cultural, historical and geographical situation and the will of the people of all the five regions of disputed J & K i.e.Jammu, Ladakh, Kashmir, Pakistan occupied Kashmir (POK) and Balawaristan the Pakistan occupied Gilgit Baltistan (OCB) should be considered and asked separately before the final settlement of the whole J & K problem.
8). Before taking over the control of Balawaristan by UNO, all Pakistani forces, ISI, Pakistani agents, Pakistani and Afghani Talibaan, Kashmir!, Pakistani and other terrorists groups and Pakistani citizens who have entered the territory of J & K state including Balawaristan (Occupied Gilgit Baltistan) by violating VNCIP resolution after 1947 and Pakistani administration should be flushed out from POK and Balawaristan in the first phase before settlement of J & K issue peacefully.
9). The UNCIP resolution of 5'h Jan. 1949 in which the free will of the human-being for self-determination has been checked limiting their choice on greedy and selfish Pakistan's proposal, should be declared null and void by terming it against human rights charter.
10). To meet the expenses of UN forces and the people of Balawaristan, 20 billion Rupees per year since 16'h Nov.l947 should be refunded by Pakistan.
11). Baltistan and Astore, the areas of Balawaristan, were used for hostile activities against Ladakh and Kargil in May, 1999 and our youth, the soldiers of Northern Light Infantry (NLI), were used as mercenaries. As a result more than 900 youth were killed, 1000 became disabled and injured, a dozen became prisoner of war while 40 soldiers including an officer from Astore are missing in Kargil war. At last the whole NLI units were disbanded and mixed with the Pakistan Army, which is violation of UNCIP resolution.
12). Pakistan should be forced to compensate the deceased disabled, injured and missing soldiers of NLI in Kargil war, according to international standards.
13). The fraudulent and self styled advocate or guardian Pakistan should not be considered an advocate of Balawaristan (OGB), POK and J & K any more.
14). Jammu and Kashmir including Balawaristan issue should not be dealt as religious or sectarian. Otherwise it will cause severe damage to the human lives in the hands of Pakistani non-tolerant fundamentalists, who are the master of Talibaan. It should be tackled on humanitarian bases.
15). BNF and United Kashmir Peoples National Party (UKPNP) appeal to the UNO, UNSC and civilized world to take action against President of Pakistan Moulvi Rafiq Tarar, Army Chief General Pervez Musharaf, Chief planner of Kargil war General Mohammad Aziz plundry (POK) and Ex Chief of ISI General Zia-ud- Din as war criminals of Kargil, by producing the then Prime Minister of Pakistan Nawaz Sharif, NLI prisons of Kargil war, NLI martyrs kin and war veterans for testimony in International Court of war crime.

Sub:- PROTECT THE RIGHTS OF GILGIT BALTISTAN
I, on behalf of the 2 million downtrodden people of Balawaristan (Pakistan occupied
Gilgit Baltistan), have the honour to draw your kind attention towards the world's
most deprived and enslaved region of disputed Jammu & Kashmir. We, the people
of this disputed land occupied by Pakistan treacherously, are treated worst than the
animals of civilized world. Though we love peace and tranquility in the region, we
fear, outcome of the summit meeting of Pakistani President, Gen. Pervez
Musharraf, and Indian Prime Minister, Atal Behari Vajpayee, because of the long
discriminatory and inhuman attitude of successive Governments of Pakistan usually
and Army of Pakistan particularly. The head of Military regime of Pakistan Gen.
Pervez Musharraf invited each and every religious and political personality of a
smallest part of its occupied Jammu & Kashmir (PoK), consists of 6400 Sq. Km, but
did not bother to talk to any person of Balawaristan (Pakistan occupied Gilgit
Baltistan) having a huge area of 44800 sq. kms. This is the most important part of
disputed J & K, though people are not Kashmiri in race. Government of Pakistan
prefers its sponsored mouthpiece like All Parties Hurriyat Conference (APHC) and
other puppet parties of PoK, which defend the right of Pakistan instead of the
people of J & K for their vested interests. Moreover, Gen. Musharraf has no
sympathy towards the people, neither legacy nor any mandate of the people of
Balawaristan. That is why our people don't trust on Gen. Musharraf or any
Pakistani leader or PoK or APHC. Our rights are being usurped by Pakistan from
the very beginning by using the name of religion and did and will never protect our
right of freedom or self-determination. Instead of giving right of self-determination
and freedom, Pakistan has the designs to gulp this huge region by terrorism, which
is bigger than 71 independent countries area wise and bigger than 43 countries
population wise. Ever since Pakistan occupied this beautiful land on 16 Nov. 1947,
the people of this region are being deprived from all basic human, political,
economical, cultural, educational and indigenous and all other rights by violating
UNCIP and UNSC resolution in this regard.
We would also like to draw your kind attention towards the discriminatory attitude
of UN observers for India and Pakistan stationed at Jutiyal, Gilgit, towards the
people of this region. In the first week July, 2001, Gilgit Baltistan National Alliance
(GBNA) consisting of 14 political, religious, nationalist and even pro-Pakistani
parties had brought in to the notice of UN observers a week ago that it has to
observe a peaceful protest rally against Gen. Musharrafs attitude for neglecting 2
million people of disputed part ofJ & K before leaving for New Delhi summit. But
UN observers remained absent at the specified time of handing over memorandum
to your honour, the UN Secretary General. This unexpected attitude of UN
observers may help the occupier regime of Pakistan and its atrocities, instead of
providing protection to the deprived people. We, like other deprived people of the
world, expect that UN audits employees must behave like sympathizers and
guardians of the deprived people and they should not support the aggressors.
Government of Pakistan and its Military particularly, is settling its own armed
citizens and Afghan and other terrorists besides increasing its notorious intelligence
agencies in Balawaristan to turn the indigenous people in to minority by neglecting
J & K "State Subject Rule" and UN resolution in this regard. Both General Zia and
General Musharraf military governments of Pakistan had played heinous role in
1988 and 1999 genocide campaign against the innocent indigenous people. In 1988
liundreds of Shias and Sunnis were killed, thousands displaced forcefully by Zia and
in 1999 our youth (soldiers ofNLI) were sent against the people ofKargil and
Ladakh during "KARGIL WAR" to punish both sides of Line of Control for not
taking part in terrorist activities against India. As a result, more than 900 NLI
youth were killed 1000 became disabled and wounded, while 40 are still missing.
Viore than 400 civilians of Baltistan and Astore border areas were destroyed due to
Pakistan sponsored terrorist activities across the borders by using our peaceful soil.
Political and human rights are completely denied by Pakistan that is why more than
LOO political persons are facing sedition cases and no impartial judicial system
'xisted in Balawaristan. A retired Pakistani national is appointed as head of judicial
�ourt by Pakistani Minister of Kashmir Affairs and Northern Areas Affairs
KANA) on contract basis to punish the indigenous people of this disputed region on
he direction of imposed minister of Pakistan. That is why these political persons,
igainst whom false sedition charges have been framed by torturing them in tortures Cell, do not expect any fair trial in this contract base court. There is also a legal
law, being citizens of disputed land, the people of this area are not citizens of
akistan and thus Pakistani legal system is not valid.
We appeal your honour, UNSC and UN to protect the lives, faith, and culture, right
of freedom and self-determination and territorial integrity and sovereignty of our
egion as per UN and UNSC resolutions. Pakistani rulers and APHC and the
eaders of PoK should be barred from deciding the fate of our region and the people
of Balawaristan should be given the right to decide their own fate, whether they
yant to live with Pakistan, India or Kashmir or choose their own independence.
ien. Musharraf should be asked to withdraw Pakistani forces, armed Pakistan
lationals, Afghans and other terrorists from Balawaristan by complying with
JNCIP resolutions. Construction of bunkers for terrorists under the pretext of
nosques along the borders with Afghanistan and India should be stopped, to avoid
ny further human destruction in the hands of these terrorists.
We appeal your honour, UN, UNSC, European Union, International Court of
Justice and Human Rights Organizations to book general Pervez Musharraf and
other Pakistani generals and political and religious leaders as war criminals, who
are involved in genocide campaign against our youth since 1988.

Sub: JUSTICE ON CONTRACT and TERRORISM
Pakistan is the only country in the world, which has introduced a
ustice System in it's occupied part of disputed Janimn & Kashmir,
lalawaristan (Pakistan Occupied Gilgit Baltistan), by which the highest
ourt is sold on contract basis.
This court is called Chairman of Chief Court and is appointed by
Pakistan's corrupt Minister of Kashmir Affair and Northern Areas
affairs (KANA) from his constituency on contract basis to oblige his
oters, one side and to collect huge money from this part through the
ead of Judiciary on another. He (the contractor of the said court) has the
owers to award death sentence to the local indigenous people without
iving them the right of appeal in any High Court or Supreme Court.

Violations. It means that this is the only area of the world where Human
Rights violations are encouraged and fully allowed. That is why, no single
culprit was given punishment even for a single day, in the state sponsored
and engineered sectarian dashes which claimed hundreds of innocent

Five lawyers of a Young Lawyers Forum. Gilgit, Balawaristan
ive been arrested by occupier regime of Pakistan on June 4th 2002,
hen they demonstrated a sit-in program in Gilgit Town.
The lawyers were protesting against the contempt of court notices to them
by the Chief Court as well as cancellation of their practicing licenses.
The lawyers voicing their concern for the independence of the Judiciary
in Balawaristan and the victimization of the young lawyersby the head of
the said court, which is called Chairman unlike of any Judiciary term.
Some nationalist political activists of Balawaristan National Front (BNF)
and Karakorum National Movement (KNM) also joined the protesting
lawyers to express their sympathy with them. The lawyers contended that
the NACC chairman had been Victimizing them through the issuance of
the contempt of the court notices and cancellation of their practicing
licenses because they had opposed his service extension for two years as
chairman of the NACC. This is the unique Judiciary of the world; KANA
Division of Pakistan gives the rein of this court to any one on contract
basis. They alleged that they also adopted resolutions voicing their
concerns regarding the independence of the judiciary in the region from
time to time that ended up in their victimization. The lawyers passed a
resolution on 2-3-2002 that was full of scandalous matter tending to
obstruct the working of the apex court in the region and undermined its
so-called prestige. Pakistan occupier regime used police headed by DSP
Ali Sher laid the siege of protesting venue and arrested advocates
Asadullah Khan, Amjad Hussain, Manzoor Ahmed, Muhammad Farooq
and Mnzaffar-ud-Din all belonging to the Young Lawyers' Forum and
later an FIR was lodged against them and shifted to the Gilgit CIA center
Gilgit and tortured them on the pretext of investigations.
After torturing in CIA Center, 5 Lawyers of Young Lawyers'
Forum along with Ghazi Anwar a leader ofKarakorum National
Movement (KNM) were sent to Gilgit Jail under 147,341 CrPc. The
lawyers refused to apply for bails. The Jailed lawyers expressed their
determination for struggle till the complete independence of judiciary in
Balawaristan (Pakistan Occupied Gilgit Baltistan).
The Young Lawyers Forum on Thursday demanded of the
government of Pakistan to initiate an impartial inquiry into the
controversy between the chairman of Balawaristan Chief Court and the
lawyers. The young lawyers allied that the chairman of the Northern
Areas Chief Court Muzafar Malik has been using third degree tactics to
bring the lawyers to knees and not allow to file petitions against the
government heads of department Mr. Muzaffar Malik was accused of
bribing Kashmir Affairs Northern Areas Affairs (KANA) Division to
obtain extension in his tenure even though his retirement age was over.
We appeal the, (JN, UNSC, Human Rights Organizations and
civilized world to take action against Pakistan's illegal, immoral and
inhuman actions against the 2 million indigenous people ofBalawaristan.
Pakistan should be forced to abide by international Human Rights
declaration and laws.
We also appeal the ITN, VNSC and civilized world to impose
independent administration (Local Authority till decision ofJ& K
dispute) and Judiciary in Balawaristan according to the 1JNCIP and
VNSC resolutions of 13 August 1948 and 5th Jan. 1949. Pakistan should
be forced to withdraw its forces and civilians from the area as per the UN
resolutions, before arising any Human tragedy in the hands of Pakistan
and its terrorists.
Pakistan is again gathering Talibaan and other terrorists in Darel,
Tangir, Astore and Ghowadi Skardu, vallies of Balawaristan and
providing training facilities by its Pakistan Army and ISI experts.
Pakistani Force Commander for Balawaristan (FCNA) based in Cilgit
visits regularly to these terrorist camps on weekly basis.
This is the moral duty of the civilized world to eliminate terrorists
from this disputed part ofJammn & Kashmir to avoid any fresh terrorist
threat to this region particularly and rest of the world usually.
