Statement delivered by Amir Shah-

Mr. Chairman,

In the short time available, AAPSO would like to bring to the attention of this Commission the grave and systematic violation of the civil and political rights of the I.'. million people of Balawaristan comprising the present-day districts of Gilgit, Baltistan Diamar, Ghizar and Ghanche in Pakistan-occupied Kashmir. Balawaristan or Gilgit-Baltistan.withan area of some 72,000 square kilometer and a rich cultural heritage, was an integral part of the state of Jammu and Kashmi before being forcibly annexed by Pakistan in an arbitrary and unconstitutional manner. In 1993, the High Court of Pakistan-occupied Kashmir ruled that the detachmen of Balawaristan or Gilgit-Baltistan from the rest of Jammu and Kashmir by Pakistai violated the Resolutions passed by the United "Nations Security Council. In 1999, th Supreme Court of Pakistan ruled that that the Northern Areas, as Pakistan now call Gilgit-Baltistan, are a disputed territory and the Government of Pakistan has no clair 'over it." These judgements also call upon Pakistan to ensure that the people c Balawaristan enjoy their fundamental rights, including the right to be governed by thei chosen representatives. Unfortunately, successive governments of Pakistan have ignore these judicial pronouncements. As a result, even the minimal political rights available t the people of the rest of Jammu and Kashmir are not available to the people of Gilgi Baltistan.
The Government of Pakistan has set up a Northern Areas Legislative Council I administer Balawaristan. However, even the Chief Executive of the Council is selecte from the Pakistan Parliament and is-not-answerable to the Council. Thus, as pointed o) by reputed organizations such as the World Bank and the World Conservation Unioi people's participation in political processes, decision making and performance evaluatic of government agencies is wholly lacking. As pointed out by these organizations, "tl concept of representatives of the people approving appropriations does not exist" and tl Council, which could be a "harbour of the aspirations of the people", has bee "debilitated"-and "cannot act as a check on the executive,". -- In Balawaristan, basic political freedoms and the rule of law are non-exister Hundreds of political workers belonging to the Balawaristan National Front, Karakora National Movement, Karakoram Students Organization and the Gilgit-Baltistan Nation Alliance have been subjected to harassment, intimidation, torture and arbitrary detention by Pakistani security forces and intelligence agencies. Torture and continues illegal detention of prominent human rights activists Syed Haider Shah Rezvi and Basharat Shafi for more than one year now on fabricated charges of treason is a shocking example. Religious intolerance has been exported to this hitherto peaceful region from Pakistan and its helpless people made to bear the brunt of violence unleashed bysectarian organizations which resort to wanton killings, abductions and destruction of property. Religious discrimination has been sought to-beinstitutionalized by manipulating the school syllabus and deleting all references to the Shia tradition. Students protesting against the imposition of this biased syllabus have been beaten up and jailed. Pakistan has followed a systematic practice of demographic aggression against Balawaristan. There has been a steady influx into the region of outsiders, including Pathan tribesmen from the North-West Frontier Province and Punjabi settlers, who have taken control of the lands of the indigenous people and monopolized business and employment opportunities. Pakistani drug mafias have converted the ancient and beautiful towns of Gilgit-Baltistan into drugs and weapons markets from where heroin and other narcotics are transported to Europe, America and Central Asia from Afghanistan and Pakistan.
AAPSO, therefore, calls upon the Government of Pakistan to implement the decisions of its own judicial organs and the recommendations of various international agencies so that the people of Balawaristan can exercise their right to self-determination and enjoy the civil and political rights enshrined in various human rights instruments including the Universal Declaration of Human rights and the International Covenant on Civil and Political Rights. On behalf of the 2 million people of Balawaristan i.e. Pakistan Occupied Gilgit Baltistan (OGB), I would like to draw the attention of this forum towards the fast deteriorating human rights situation. Our nation is reeling under the stiffing control of armed forces of Pakistan and its notorious intelligence agency ISI. Our innocent people are being treated as subjugated slaves. They have been deprived of all basic human, cultural, educational, economical, religious and political rights for the last 52 years, due to the worst colonial system imposed by Pakistan in the name of religion. As a result our simple and innocent people are treated worst than the animals of the civilized world even at the dawn of 21st century.
This is only part in the world where the highest imposed court (Chief Court) is working on contract basis, where no rights of writ / appeal against human rights violation is allowed. This court can award death sentence to the local people without any chance of further appeal in any High Court or Supreme Court In the past 52 years a number of our countrymen have been brutally killed by the Pakistani forces and intelligence agencies.
I would like to put some glimpses on few human rights violations in this part of the world, where no human rights organization is existing nor the external organization is allowed Mr. Nazir Ahmad a local administrative officer of grade 18 from kashorote Mahala Gilgit city was tortured mentally to death by Pakistani agents i.e. Chief Secretary, Mahmood Khan and Home Secretary, Nasir Ahmad and denied to register a case. An unemployed youth Zakir Hussain, Astore District Diamer, was killed by a Pakistani military officer Lt. Colonel Qazi Najeeb Pathan, Commandant of Chitral Scouts, while another two innocent gujar family members namely Rehmat Wali and Satar, from Gilgit, were murdered by police, but no case could be filed against these human rights violations. Pakistani administration and its defamed intelligence agency the ISI have been forcibly and treacherously sending the innocent unemployed youths across the line of control (LOC) to Indian occupied Kashmir for terrorism and religious cleansing. A list consists of few such civilians who were sent across the LOC by ISI and killed encounter with Indian Army in 1998-1999 is as under.

Instead of registering a case against ISI and Jamat-I-Islami, the kins of the deceased youths were threatened by the Pakistani forces.
Mr. Chairman, civilized world and this august forum have not paid any attention to the neglected people of Pakistani occupied of Kashmir (Balawaristan). Only in 1999 alone Pakistani occupied forces used our innocent youth (soldiers of Northern Light Infantry) as mercenaries against India in the Kargil heights. As a result more than 900 young men lost their lives, approximately 1000 were injured and disabled, a dozen became prisoners of war and 40 are still missing.
Mr. Chairman, I appeal on behalf of 2 million down trodden people of Balawaristan (Occupied Gilgit Baltistan) that Pakistani President Moulvi Rafiq Tarer, The then Prime Minister Nawaz Sharif, Army Chief General Pervaiz Musharraf, General Zia-ud-Din the then ISI Chief and master minded General Mohammad Aziz of Plundry (POK) should be brought to the International Court of Justice as war criminals. Mr. Chairman, We appeal to the world community that 2 million people of Balawaristan should be considered as human beings and given the rights enjoyed by the civilized world being free citizens without any discrimination.

On June 22nd 1996, a Pakistani Military officer Lt.Col. Qazi Najeeb, a Pathan Commandant of Chitral Scouts (CS) fired indiscriminately on the local youths who were trapped on the pretext of recruitment for the falsely newly established Northern Scouts. As a result one unemployed young Zakir Hussain died on the spot, while dozen other sustained injuries. The local political leaders strongly protested against the Pakistan colonel, but instead of taking action against the culprit, the local protesters were arrested, tortured and more than 40 leaders and workers of different political parties were charged under high treason by imposing section 124 A. 2. On 14th August, 1997, more than 20 political leaders and workers of Balawaristan National Front (BNF) and Karakoram National Movement (KNM) were arrested and tortured severely by imposing section 124 A of high state treason in spite of the fact that Balawaristsan is not a part of Pakistan. As a result my left ear drum was damaged, head injuries caused weakness in my eye sight and right ring finger was broken, while the kidneys of Ali Haider Taj and Manzoor Hussain were badly effected.
3. On June 1999, Jalal-ud-din, Jalal Hussain, Qaimat Karim, Jani and other workers of KSO were arrested, tortured and sent to prison by imposing section124 A, when they were protesting against the use of occupied Gilgit Baltistan,s (Balawaristan) territory and the Pakistan Army controlled local para-military force (Northern Light Infantry (NLI) in Kargil war, by treating them as mercenaries, Pakistan did not even honour the dead bodies of NLI soldiers, but accepted it's own Punjabi and Pathan national officer's dead bodies. Moreover Pakistan has not so far accepted the prisoners of Kargil war.
4. Nine un-employed youths, of village Hanzel 15 Kilometer north of Gilgit city, were treacherously taken to the line of control (LOC) with India by ISI and it's puppet religious party Jamaat-e-Islami. When they refused to penetrate into Indian Kashmir, they were killed and later the ISI put the blame on the Indian Army, when their parents came to know about it after a period of 6 months. The case against ISI and Jamaat-e-Islami could not be filed even when their kins / parents approached the police and so-called court, the culprits of ISI and Jamaat-e-Islami are threatening the kins and parents of the deceased.
5. Pakistani occupants in this part of J & K are not honouring the right of speech and writing which is a basic right for the last 51 years.
a). A local magazine "Balawaristan Times" was confiscated and ultimately banned due to its Human and Political Rights matter since 1994.
b). Gilgit Digest" confiscated and banned since 1998.
c). Chief Editor "Weekly K2" Raja Hussain Khan Maqpoon was served notice for confiscation of his property and sent to imprisonment by the contract based Chairman of Chief Court, due to his column against the Pakistan's imposed illegal taxes, where human, basic and rights of representation are not yet given.
6. I was threatened alongwith my teenaged children, by Pakistan and it's ISI who desired me and my party to abstain from peaceful struggle for restoration of political and Human Rights. I am presently undergoing much agony by hiding myself far away from my children, otherwise my life would not be spared.
7. Locals are being awarded death penalties and confirmed by the un-constitutional and illegal Chief Court ( equal to any district and session court) , which has been established by the occupants on contract basis without giving the right of further appeal at any High Court or Supreme Court to the local accused. The head of this court is called Chairman of Chief Court and is appointed by Pakistan's corrupt Minister of Kashmir Affair and Northern Areas Affairs (KANA) from his constituency on contract basis to oblige his voters. He (the contractor of the said court) has the powers to award death sentence to the people of disputed area but has no powers to listen to their writ petition , appeal or grievances against the Human Rights violations. It means that this is the only area of the world where Human Rights violations are encouraged and fully allowed.
That is why, no single culprit was given punishment even for a single day, in the state sponsored and engineered sectarian clashes which claimed hundreds of innocent lives of Shia, Sooni and Ismaili sects in Gilgit since 1998. Honourable chairman and members of this august Commission, I appeal to all of you and warn the civilized world, if stern action against the coercion and atrocities committed by Pakistan in its occupied Balawaristan (Gilgit Baltistan) is not taken in the above mentioned matters, the 2 million people of the most important , sensitive and resourceful part of disputed Kashmir will face serious Human Rights violations due to the evil designs of Pakistan and its notorious Intelligence Agency the ISI to genocide the opposite sects and anti-Pakistani political activists through its created and sponsored Taliban in the near future.

I would like to draw the attention of your organization towards the only slaves of the world. This unfortunate and most important (in terms of it's geography and natural resources) part of disputed Jammu & Kashmir State, consists a 28000 sq.mile area with a population 2 million approximately, as we call it Balawaristan i.e. Occupied Gilgit Baltistan (OGB). Government of Pakistan occupied this area in the name of religion, treacherously immediately after 15 days, when it came into being as a sovereign state on 1st november 1947.Pakistan first entered this region on the pretension of discharging it's subsidiary services as a Muslim neighbour country, but later on divided the innocent people sect wise and deprived the whole population even from basic human, economical and political rights by violating United Nation Commission for India and Pakistan (UNCIP) resolutions passed on 13th August, 1948 and 5th Jan. 1949.
This is the only region throughout the world, where Human Rights are not honoured to at all. Here the local people are not allowed to file any writ petition / appeal against Human Rights violation, committed by the occupying Pakistani Military and civil administration. As far as the political and democratic rights are concerned, Pakistan imposes it's own elected member (not elected from this disputed territory where he does his job as an ancient king) as a minister for Kashmir Affairs and Northern Areas Affairs (KANA) Division. He (KANA Minister) imposes any person fron his constituency from Pakistan as a head of contract based apex court (Chief Court).
This illegal, immoral and un-constitutional contract based chief court is empowered to confirm death sentence to the local peopole, without giving the right for further appeal in any High Court or Supreme Court to the accused. No appeal / writ petition could be entertained against the Human Rights violations by the said Chief Court. The non-elected Chairman (Minister of KANA) mand Chief Executive the same person with different portfolio, does not allow the highest local elected body of Balawaristan (occupied Gilgit Baltistan) which is called Northern Areas Council. This name was introduced by Pakistan to merge this disputed region of J & K state into it's territory without consensus of the people by violating UNCIP resolutions.
The so-called Council has no right to discuss about the coercion and atrocities of occupied civil and military administration in it's meeting. Mrs. Shamim Hamza a lady member of the N.As. Council was punished for her speech in the said show-piece Council against the Pakistan government, by dismissing her husband SSP Amir Hamza from service.
2. Political activists of my party Balawaristan National Front (BNF), including me and more than 70 political persons are facing high treason cases of Pakistani section 124 A, despite the fact that being citizens of disputed part of J & K State. I am in hiding since March 1999, due to threat to my life by Pakistani intelligence agency the ISI due to my letter of 4rth Oct. 1998 to the UN Secretary General Mr. Kofi Annan and heads of UNSC and UN member countries. I was the first man who revealed government of Pakistan's intrigue much before the Kargil war to crush the BNF and other nationalists and non-wahabi sect.
The recent conflict of Kargil was the part of the main design of ISI against the people of Balawaristan (OGB), Pakistan occupied Kashmir (POK) and Indian occupied Kashmir (IOK) besides Northern Light Infantry (NLI) the local para military force which is under the command of Pakistani Army. It should be noted that, ISI was trying to instigate the local population (Shia) of both sides of the LOC for sabotage and terrorist activities against non-muslims by penetrating into J&K via Astire and Baltistan of Balawaristan for the last few years. But the local Shias, Soonies and Ismailies denying to do so by arguing that the people of IOK have have all the fundamental, human, economical, cultural and political rights, while the people of Balawaristan are deprived all of these rights since Pakistan occupied on 16th Nov. 1947. A Kashmiri, like Mufti Sayed and Maqbool Dar, can become minister of India besides the membership in National Assembly and Senate of India, while the people of Balawaristan have no right to vote.
The people of Balawaristan are being treated worst than the animals of civilized world. Due to these obivious differences the people of OGB could not and would not be deceived by the ISI. More over, since 1992 BNF is struggling for freedom from the illegal and immoral occupation of Pakistan. That is why, ISI played a duel role by pushing NLI, the local para-military force as mercenaries against the people of Kargil and Drass across the LOC in May 1999. The use of NLI under the command of Pakistani military, as mercenaries in Kargil is a severe violation of human rights, where more than 900 soldiers were killed, 1000 became disabled and injured, while a dozen became prisoners of war and 40 including a local officer were missing. Instead of that Pakistan disowned all of these sacrifices and losses of the local youths by refusing off their dead bodies in spite of an Indian offer, while accepting it's own nationality holder officers' dead bodies. Government of Pakistan has now amalgamated the NLI soldiers into it's own coward army so these brave soldiers could be discouraged and the last sign of Balawaaristan could be perished ultimately as per plan of ISI. Their inherited (by their previous disbanded predecessor Gilgit Scouts) cantonments and properties can be occupied and possessed by the greedy Pakistan Army and the apprehension of any resistance against ISI sponsored and trained Talibaan, Pakistani religious terrorists and Pakistani occupied forces forces could be prevented in the future.This action of Pakistani Army against NLI, itself reveals the deceitful plan of ISI to use the territory and youths (NLI) against Kargil and Ladakh people and Indian Army.
BNF appeals the organization for intervention to send the dead bodies of NLI soldiers from India to their respective native land of Balawaristan and send the serious injured soldiers abroad for treatment on the expenses of Pakistan. We also request to your organiztion to warn Pakistan and it's ISI against it's plan to genocide the local Shia, Ismailia and Sooni (non-wahabi) communities besides Balawaristan National Front and nother nationalist political parties. I am also attaching two lists of ISI's Kashmir victims besides hundreds in Afghanistan and J & K.

Sub : SAVE THE LIVES OF INNOCENT PEOPLE
Madam,
I have the honour to elucidate you about the deteriorating Human Rights situation in BALAWARISTAN (Pakistan Occupied Gilgit Baltistan). As a result the lives of 2 million population of this disputed land including nationalists, different sects, writers and journalists are in danger, particularly in the hands of Pakistan Army and its notorious intelligence agency ISI. The mosques of Shia Muslims are dynamited and faith is attacked. I would like to mention a brief geopolitical background of this most important disputed region. Balawaristan is situated between Pakistan, India, Jammu & Kashmir, China, Afghanistan and Central Asia. The area is consisting of 28000 Sq. Miles and population is 2 million approximately. The world knows it in terms of tourist heaven. Its fate is also to be decided with that of Jammu & Kashmir (J & K) but unlike both parts of J & K Balawaristan (Pakistan occupied Gilgit Baltistan) has been deprived it of all Human, fundamental, economical, culture, historical and religious rights, since Pakistan occupied it illegally. According to UNCIP resolution of 13 Aug. 1948, local authority should have been established under the surveillance of UN after the complete withdrawal of Pakistani forces and civilians from Balawaristan and Pakistan occupied J & K. UN Security Council had guaranteed the political and Human Rights and also assured the integrity and sovereignty of Balawaristan.
Instead of all that local authority was not established nor the Fundamental Human and political Rights given. By sending more and more troops, ISI agents, Pakistani and Afghan terrorists, 2 million people of Balawaristan were being deprived of all their rights for the last 53 years by violating UN resolutions. The occupier military Militry regime of Pakistan and its ISI has made the life of the indigenous people difficult by checking on their free movement, speech and writing. As a resul this disputed area became like a prison of 28000 Sq. Miles. As your honour are well aware that the Fundamental Human Rights are much concern with that of political rights. Instead of establishing local authority under the surveillance of UN Pakistan has established a puppet Council which is called Northern Areas (Balawaristan) Legislative Council. But it is just opposite of its name "Council" and "legislative".
It does not have the right to make any kind of law even like local body of any small Pakistani city nor it performs as council. No single person of 2 million people of Balawaristan is consulted in law or legislative matter by the occupier regime of Pakistan. In spite of all this Pakistan has been propagating about the dumb, rightless and powerless Council. As far as the UNSC guarantees of Human Rights are concern, this is the only land on this planet, where Human Rights are 100 % violated. Indigenous people have no right to file a writ petition or appeal in any court of Balawaristan against Human Rights violation. Free movement, right of writing and speech except pro-Pakistani political and religious parties all other indigenous people is disallowed.
The life of the indigenous people became much agony due to the hatred checks and questions of foreign intruders, the ISI everywhere within the territory of Balawaristan. More than 80 political activists including me are facing sedition charges of Pakistani section 124 A in imposed and contract base Court, since 1996. This trend is increasing every year despite the fact that Balawaristan is not a part of Pakistan and it's laws cannot be imposed any way. Instead of terrorism and militancy in Indian Jammu & Kashmir no single person is facing sedition case. This contract base court of Balawaristan is called Chief Court, which has the powers to award death sentence to the local people, while the indigenous people has no right to appeal further against the death penalty and Human Rights violation. This is the unique court of the world where the head of the court is directly appointed by the corrupt Pakistani Minister of Kashmir Affairs and Northern Areas Affairs (KANA) division. The duty of this court is to protect the interest of KANA minister and Pakistani occupier forces by depriving the indigenous people. This court is a slap on the face of the civilized world and justice.
Your honour imagine the evil designs of this so-called Muslim champion country Pakistan where it's army dynamited a Shia Muslims mosque in Dewasai near Skardu to keep away the people from their rador system on this disputed area. In 1988 25 Shia mosques were torched and hundreds of innocent Shia Muslims were genocide by Pakistan Army with the help of Afghans and Pakistani nationals. In may 1999 local youth (Northern Light Infantry soldiers) were killed by sending them as mercenaries across the line of control towards Indian occupied J & K intentionally. As a result 900 youth were killed more than 1000 became disable and 40 are missing.
Even the dead bodies of these local youths were disowned by Pakistan Army only excepting their own nationals Now I would like to write about a particular case, so that your honour will be able to judge the whole system imposed on the 2 million people of Balawaristan (Occupied Gilgit Baltistan). Except few local agents who do perform for ISI and Pakistani occupier regime against their motherland, the general masses are facing severe situation in Balawaristan (Pakistan Occupied Gilgit Baltistan) as well as in Pakistan, due to threat of Pakistani forces and agencies.
Raja Hussain Khan Maqpoon a publisher and Chief Editor of a local newspaper "WEEKLY K2". This young man had sold out his land property to high light the burning issue of Balawaristan by publishing his own newspaper. This weekly K2 was providing almost 99 % coverage to Pakistani Occupier regime and pro Pakistan political and religious parties, while 1% for the local nationalists, who are demanding for freedom from the worst clutches of Pakistan. In spite of that this publisher is facing almost 2 dozen fake cases in the imposed courts in Balawaristan. All these cases have been registered by the agents of occupier regime of Pakistan to make the WEEKLY K2 publisher financially cripple by running in between Rawalpindi Pakistan to Balawaristan once or twice in a week.
Chief Editor of K2 has also awarded punishment by sending him behind the bars on contempt of court (by the Chairman of the Contract base Chief Court) charges. His fault was to write against the illegal and impugn verdict of chief court allowing Pakistan to levy taxes from this disputed land, which is not legally, and constitutionally part of Pakistan. In the editorial 'Weekly K2' had urged Chief court for "not kill the people of Balawaristan financially for God sake", as a result the Chief editor of K2 was sent to prison and issued orders to confiscate his immoveable property by the contract base chairman of Chief Court. And he was threatened of dire consequences if he repeats to highlight the issues of Balawaristan in future.
On 14 Aug. 2000 "Weekly K2" had published almost 90 % pro Pakistan coverage and 100% advertisement free of cast in favour of Pakistan on the occasion of Pakistan's independent day while 10% coverage was given to the nationalist parties which demand for freedom. In spite of that General Musharraf the Military ruler of Pakistan ordered his commander Maj. General Safdar based at Gilgit Balawaristan to cancel K2 declaration and eliminate the nationalists who demand for freedom as a result ISI has planned to eliminate the nationalists by false blames and accidents. And orders to cancel the declaration of "WEEKLY K2" has been issued by the Deputy Commissioner of Skardu on the instigation of Pakistan Army.
I appeal your honour to take premeditated action to save the lives of Raja Hussain Khan Maqpoon and Manzoor Hussain Parwana the Editor of "Monthly Kargil" besides Balawaristan National Front (BNF) and Karakorum National Movement (KNM) activists who are facing treason cases and abstain Pakistan Military authority and its intelligence agencies and forces from harassing by registering false cases and allegations against nationalists, writers, publishers and social activists.

I would like to draw your kind attention towards the deteriorating Human Rights situation in Balawaristan (pakistan Occupied Gilgit Baltistan), where Human Rights are not recognised. This is the part of the world where the indeginous people are not allowed BY Pakistani occupier regime to file any case against Human rights violation. Besides the following political prisoners more than 80 political leaders and worker are facing state treason cases SECTION 124 A, since 1996. A copy of the latter to UN Secretary general is also attached for Your honour's observation and kind information.
THE FOLLOWING LEADERS AND WORKERS OF BALAWARISTAN NATIONAL FRONT (BNF) AND KARAKORUM NATIONAL MOVEMENT (KNM) WERE ARRESTED BY THE OCCUPIER REGIME OF PAKISTAN ON 12TH, 14TH , 15TH AND 18TH AUGUST 2000 BY DEPRIVING THEM FROM PEACEFUL PROTEST AGAINST THE 53 YEARS OF SLAVERY.
