Legal Justification for New Legislation
-The current State of Ohio program that covers 100% of only Ohio National Guard Member's tuition to any state college or university is discriminating against Ohio's Active duty service members and Veterans because according to United States Code: Title 10: Section 3062 supports that said Ohio Army National Guard is a member of the United States Department of the Army. Given that Active, Reserve, and National Guard are all protecting the United States of America. Then it's clear that treating the Ohio National Guard members differently than Active duty Ohio Soldiers and Veterans is reasonable under the law to say that this unlawfully discriminating against Ohio's Armed Forces members. Since regardless if you're active or national guard you're still an Ohioan part of the US Armed Forces so any program or special treatment to the National Guard is unfair, unequal, discrimination, and a violation of civil rights in singling out a certian group in this case the state is singling out Ohio's Active Duty Service Members and Veterans with educational benefits funded by the state. United States Code: Title 42: Section 1981 Equal rights under the law. This USC, justifies the legal right for Ohio Active Duty Veterans to recieve or at least have an equal opportunity to educational assistance just like or similar to that offered to the Ohio National Guard. (Reference K)

-The State of Ohio is in violation of federal discrimination law:
United States Code: Title 42: Section 2000a-1 Prohibition against discrimination or segregation by any law, statue, ordinance, regulation, rule or order of a State or State agency. This state funded program giving 100% free tuition to the Ohio National Guard is discrimination by the state of Ohio regardless if it is unintentional or not under the law. (Reference I)

-Ohio National Guard Members recieving 100% tuition from the State of Ohio's program and they are also disabled and recieving this benefit is in confilict and violation of the
Americans with Disabilities Act Title II: State and Local Government Activities: "Requires the State and local governments give people with disabilities an equal opporunity to benefit from all their programs, services, and activities (e.g. public education, employment, transportation, recreation, health care, social services, courts, voting, and town meetings)." This is a violation of a disabled Active Duty Ohio Veteran who has just as every right as the Ohio National Guard Member to benefit from this state funded program according to ADA. (Reference G)
