Stinging new court docs released show prosecutors still up to their old tricks while the judge looks the other way

While Court TV tries to publicly hang Michael Jackson with lies and speculation before he even steps foot inside a courtroom for a possible trial�doing a hatchet job with reporting the �facts� in the �case� today (Dec 22 2004)--it�s important to note that there have been some incredibly damning court documents (docs) and other evidence that has made its way to the public about the accusing family.

The disgusting �guilty until proven guilty� attitude held by Court TV anchors can�t change the fact that this �case� is full of incredulous allegations which make no sense given the prosecution�s own set of so-called events; not to mention holes in their story the size of the Pacific Ocean.

During the December 20 2004 hearing, the public learned that some 70 names on the prosecution�s defective witness list are identical to names on the defense�s witness list. This slashes the speculation from hack-reporters who want to claim that everyone subpoenaed by prosecutors are going to testify against Jackson.

In a decision that some �case� observers are openly calling �odd�, �surprising�, and �ridiculous�, the current judge in the Michael Jackson �case� has refused to delay the trial date from January 31 2005. Melville recently signed search warrants on Nov 24 2004, which prosecutors didn�t execute until Dec 3 2004; over a year after raiding Neverland on November 18 2003.

Despite those last minute searches�tantamount to invasion of privacy, say the defense�the judge has refused altogether to delay the trial in any way. Most legal analysts had previously said that the defense�s request to delay the trial would be granted because of the prosecution�s last minute scrambling.

This can be viewed two ways: Either prosecutors got what they wanted or the judge has essentially called their bluff in face of their declarations of being �ready� to go forward. But the questions being raised now are whether or not this judge is hell-bent on taking this case to trial regardless of the current circumstances around it.

Some observers have made the point that if prosecutors were really ready, then why are they continuing to search and execute search warrants? And why did they gather a swab of Jackson�s DNA at the very last minute. As reported by Celebrity Justice Dec 6 2004, there may be a 2 faction split between those prosecution team members who want to move forward with a trial on Jan. 31 and those who want more time.

Speaking of turmoil, it also already came out that Larry Feldman is mysteriously absent from current proceedings. The family has a new attorney. It is also important, once again, to understand what the accusing family�s and prosecution�s story is.

Prosecutors are claiming that Jackson conspired to kidnap, then kidnapped a family of 4�after already knowing them for years�and holding them at the wide-open Neverland Ranch. Then, they claim Jackson molested the accuser. Then they claim he conspired some more.

And this was supposedly all done right in the middle of at least 2 independent investigations into these very allegations. Not to mention the media�s white-hot spotlight being focused on this kid and this family, the family being caught on tape numerous times talking about what a wonderful person Jackson is, and signing sworn affidavits in connection with these independent investigations sparked by so-called �concerned citizens�.


__Obstruction?__ In recently released court docs, the defense continues to hammer away at the credibility of the accusing family and their tall tales of conspiracy, alcohol and molestation. Again prosecutors may have violated the court�s order and might be attempting to skirt the law by trying to act as the accusing family�s private attorneys. But, then again, some say the prosecution doesn�t seem to have all that much respect for other Court orders (namely the gag order and Motions to Compel), so why should they care about this one?

This isn�t the first time prosecutors have done this. In a three part MJEOL Bullet #227, a previous declaration from Brian Oxman was discussed. And the prosecution�s affinity for breaking the Court�s order was discussed again.

The prosecution is objecting to the defense�s right to subpoena documents and materials relevant to the accusing family�s credibility, and relevant to allegations that the mother has leveled against Jackson herself.

Some of these records are medical records. The defense makes the point that there isn�t a �physician-patient privilege� in a criminal case; especially when some of the records being sought have already become public knowledge from a previous case.

From the Declaration of Brian Oxman in Opposition to Plaintiff�s Objection to Subpoenas, the defense writes:
Plaintiff�s objections are without foundation because:
(1) There is no physician-patient privilege in criminal proceedings, and the complaining mother�s ________ records from ___________ are relevant because she has placed her mental and physical conditions in issue by claiming injuries as a result of Mr. Jackson�s conduct.

Injuries to her as a result of Jackson�s alleged actions? Yes, it seems that the accuser�s mother gotten into the act by claiming she was somehow injured surrounding these allegations. Therefore, her medical records are in bounds whether prosecutors like it or not.

Despite recent nonsensical articles from the likes of local reporter Steve Corbett and tabloid reporter Diane Dimond, the media did not appear too concerned with covering yesterday�s hearing. Some reports, however, recount the big, bad Tom Sneddon huffing and puffing about being ready for trial, despite the fact that he�s still executing search warrants�some 100+�..looking for �evidence� that doesn�t exist.


__A trial within a trial__ What the prosecution wants to do, now, is bring in the 1993 allegation. Despite no matching description of Jackson�s body, no evidence other than the allegation, no grand jury indictment, no charges filed, no arrest, and no cooperation from the 93 accuser, prosecutors want to use speculation from the likes of Ray Chandler and Larry Feldman to shore up their �case�. But is the 1993 accuser even standing by those allegations from 1993?

For some reason, there�s been a change in tone in tabloid reporter Diane Dimond�s speculation about whether or not the �93 accuser will testify against Jackson. She used to be 99.9% sure he would testify. Now she�s claiming he doesn�t want to. What happened to that 99.9%? For the record, if subpoenaed by either side, he can�t get out of testifying.

At first, during the course of this case followed closely by some �case� observers who have shared their opinions with MJEOL, the prosecution backed away from using the 1993 investigation. One point, prosecutors stood up in court and called the 1993 investigation �irrelevant� after the defense filed a Motion to Compel to force prosecutors to hand-over documents from that investigation.

We also came to find out that prosecutors had heavily relied on speculation from the 1993 investigation to further this current �case�; to get an indictment and to get dozens of search warrants in this �case�.

Most observers have echoed a sentiment that was expressed by NY Daily News reporter Michelle Caruso�s comments. She said if prosecutors have their way, this is going to be a �trial within a trial.� However much they claim this as a benefit, some �case� observers familiar with the 1993 investigation say it may be devastating not for Jackson, but to the prosecution�s current �case�.


__Start with the loons in the mirror__ The prosecution will attempt, however unsuccessfully, to paint Jackson as a perverted and crazed loon�even if they have to act like corrupt and crazed loons in the process. That includes breaking court orders and flouting the law by breaking attorney-client privilege, invading the defense camp (at least twice), breaking the gag order and trying to act like private attorneys for the accusing family.

They also seem to want to go back in time and change history. The defense says certain information was subpoenaed by Jackson�s defense on March 17 2004. The documents arrived in court and were taken by prosecutors who then voluntarily handed it over to the defense. Now, apparently, they�ve changed their minds. Sorry no back-sies! Jeez. From the motion:
As discussed below, the records arrived in court and the prosecutor took custody of them. The plaintiff then voluntarily turned over the records to the defense. The prosecutors claim that it now has standing to complain about follow up subpoenas to get full and complete records such as billing records from hospitals is without merit. (pg 9 of .pdf | pg 4 of Declaration Yeah, this isn�t the only thing prosecutors have done that is without merit. But the prosecution has the gall to claim that the defense is invading the privacy of the accusing family. And the prosecution�s argument for invasion of privacy is ridiculous because the records they claim to want to protect have already been publicly disclosed. These records because public in a previous attempt by the family to get money from department store J.C. Penneys.

�All of the complaining family�s�records were produced in connection with the case of _____________ v J.C. Penney Inc., Los Angeles County Superior Court Case No. KC 027876,� the defense writes. These particular records were reviewed by someone whose name was redacted. And the case law to back up the argument is cited in Klang v Shell Oil Co, Jasimine Networks Inc. v Marvell Semiconductor, Inc., and Roe v. Superior Court.

Since the prosecution already has a copy of certain medical records, why are they trying to keep the defense from getting this information? As a matter of fact, the defense reveals that prosecutors are lying when they claim these medical records were confidential because prosecutors got their hands on them as a result of the J.C. Penneys case too:
13. All of the complaining witness family produced their _________ records in the J.C. Penney case. The prosecution knew this because it got a copy of those records. Plaintiff�s claim that the records are confidential or that no waiver has been established is disingenuous. (pg 10 of .pdf | pg 5 of Declaration) As far back as April and May 2004, these prosecutors already promised to make a copy of said records and provide Jackson�s attorneys with a copy. Now apparently they have changed their minds. Wonder why? Did they make a mistake? Like they mistakenly invaded the defense camp by raiding Mark Geragos�s private investigator�s office? Yeah right.

Back in March 2004, Jackson�s former attorneys subpoenaed certain records that neither of the prosecutors objected to. Now all of the sudden, they have a problem. Further, back then, prosecutors �freely and voluntarily turned all of the records over to Mr. Sanger� (pg 11 | pg 6 of Declaration).


__A history of defrauding people and entities?__
It came to light in previous court docs that the accuser�s mother may have defrauded others as well, including Fritz Coleman, Chris Tucker, and George Lopez. From a Santa Barbara News-Press article dated Dec 2 2004 (Jackson lawyers prepare to attack accuser�s mom):
The attack is expected to include questioning whether the mother appropriately used money that celebrities�including comedians Chris Tucker, George Lopez, and Fritz Colement�raided at the Laugh Factory in the fall of 2000 for her son�s cancer treatments. (see Jackson lawyers prepare to attack accuser's mom - Fritz Coleman (Dec 2 2004) )

The Laugh Factory should sound very familiar. Jamie Masada is the owner. Yes, that Masada who claimed to have introduced the accuser to Jackson (false); the same Masada that made the rounds whining about the accuser needing blood and a kidney (false); the same Masada who claimed the mother and her children were sleeping on the floor with the accuser�s face swollen up (false, too).

Could he too be part of any shady dealings with money raised by this family? Time will tell. But Masada, by the way, reportedly opened a New York venue of The Laugh Factory in June 2004. He�s just rolling in it, isn�t he? But I digress.

If the accuser�s mother didn�t spend the money raised for the medical bills of the accuser, then she has many more problems than the world of trouble she�s already in for making false accusations against Jackson.

A very revealing report was written by Bill Heard, dated December 21 2001, entitled �Chance Encounters with Cops Lead to Merry Christmas for LA Family.� The report details this same family being the recipients of more charity: this time from the Los Angeles Police Department. Keeping in mind, this is Dec 2001. Also note the timeline with the J.C. Penney case and their subsequent $137,000 settlement given to the family.

Wanting to do something special for the accusing family, after learning their �story�, police officers took up a collection of about $200 out of their own pockets to buy gifts and school supplies for the kids. From the article: On Thursday, they dropped by the family�s apartment to find a Christmas tree that had been donated by the LAPD�s Hollenbeck Division officers, but no ornaments. And no gifts.

The officers bought a stock of ornaments with their own money, then talked to their sergeant, Eric Windham, about further help for the family.

So, at roll call this morning, Windham asked his troops to look into their hearts and their pockets for the Arvizos. They did, and out came some $200.

It was enough to buy some gifts for the kids�and a little left over for a holiday dinner. The MTA also contributed school supplies for the youngsters.

Now, apparently they met Jackson in late 2000. So you had Jackson, Fritz Coleman, and who knows who else donating to the family at, around, or closely after that time. And they were the recipients of charity from the LAPD as well. I guess they get around�


__Conspiracy to Falsely Accuse Jackson?__
During her testimony at a previous hearing September 17 2004, the accusing mother confirmed that she met Jackson in August 2000. Courtroom observers comments were highlighted in MJEOL Bullet #204: Accuser�s Mother Hired Numerous Lawyers before Meeting Jackson? . They said the conversation between Jackson attorney Tom Mesereau and the mother was �heated�. One even scribbled down an unofficial transcript of the convo:

TOM MESEREAU: When did you meet Michael?

ACCUSER�S MOTHER: August 2000.

MESEREAU: According to this official statement, sworn declaration that you gave to the Santa Barbara Sheriff�s department and district attorney, you retained an attorney and investigator in January 2000 for the sole purpose of finding out information about Michael Jackson and settling with him. You discussed a settlement concerning Michael Jackson before you even knew him?

ACCUSER�S MOTHER: I�I�well�

PROSECUTORS: Objection! Irrelevant.

JUDGE MELVILLE: Sustained.

It seems as if this woman hired both an attorney and private investigator BEFORE she even met Jackson in an attempt to seek a settlement for child abuse�BEFORE Jackson had even met her kid. It is information like this that will come out during a possible trial.

Besides being incredibly suspicious, it would open the door for Jackson�s attorneys to show their own pattern: a pattern of people seeking contact with Jackson, hooking up with the same attorney and psychologist, leveling allegations and threatening a lawsuit.

Why didn�t they file a lawsuit against Jackson? Because they were stopped by current DA Tom Sneddon. The civil suit cover-up was talking about in a report months ago by the Santa Barbara News Press. They report that Sneddon struck a secret deal with the accusing family�s then-attorney Larry Feldman. Reportedly, he had to �solemnly swear� not to file a civil suit until after criminal proceedings were resolved (see Civil Suit Cover-up?�Bullet #109 ).

For the record, California Penal Code Section 182-185 deals with conspiracy by two or more persons to falsely indict another person:
o California Penal Code
+ PENAL CODE SECTION 182-185

182. (a) If two or more persons conspire:
(1) To commit any crime.
(2) Falsely and maliciously to indict another for any crime, or to procure another to be charged or arrested for any crime.
(3) Falsely to move or maintain any suit, action, or proceeding.

Did they conspire to falsely accuse/indict/arrest Jackson? What else is waiting in the wings to come out about the accusing family? Have any other celebrities and/or people come forward�besides J.C. Penneys--to talk about other scams the family has run on them? Time will tell.

MJ Home Movie Hoax

Hackers are pointing users to a phoney video of Michael Jackson to coax them into downloading a Trojan horse. The movie, which hackers posted links to on newsgroups, supposedly displays Jackson performing "un-natural acts" with a boy, reported antivirus firm Sophos. Instead the link opens a Web site that automatically downloads a Trojan horse called hackarmy, which allows hackers to enter a back door to infected computers.


"There�s no real movie, just a Trojan that allows hackers to access your computer," said Graham Cluley, senior technology consultant for Sophos. "It supposedly gives you pictures of Michael Jackson doing bad things. There�s a real danger that people are getting their news from gossip groups like these and not from proper news sites. Unfortunately, the current news media�s bias has forced people to research their own news."


One of the messages that linked to the file read:


"Subject:
Michael Jackson Home Movie Horror
Message body:
Posted here are the pictures that are going to put Michael Jackson behind bars for a very long time. Disturbing stills taken from the home movies shot by Mr Jackson are now circulating the net. In these pictures here, it can be clearly seen that Mr Jackson is performing un-natural acts with the boy in question."


Earlier this week, hackers tried a similar trick with a photo of David Beckham, which downloaded the same Trojan, distributed by the Hackarmy. Hackers have also used photos of Osama bin Laden and Britney Spears to perform similar tricks.

�My family and I have dedicated our lives to spreading unity and peace to the world through our music. The most recent unauthorized version of my life story, �Man in The Mirror,� in no way shape or form represents who we are as a family. It is unfortunate that for years, we have been targets of completely inaccurate and false portrayals. We have watched, as we have been vilified and humiliated. I personally, have suffered through many hurtful lies and references to me as �Wacko Jacko� as well as the latest untruth about me fathering quadruplets.

�This is intolerable and must stop. The public depiction of us is not who we are, or what we are: we are a loving family. My success on stage can be attributed to the love and support of my family off stage. My brothers and I are �brothers� first, we started out together and will always be together. All I can hope for is that one day, my family will be shown the same kindness and respect that we have, throughout our lives, shown to others.�

Accuser�s Stepfather Asked for Compensation

The stepfather of Michael Jackson�s accuser testified Thursday that he asked for payment for the family�s participation in video interviews intended to restore Jackson�s reputation following the controversy spurred by a British documentary.

"I said, �This family has nothing and you�re making millions from this, and what are you going to do for this little family,�" the man said of a conversation he had with someone he only identified as the "gentleman from Neverland."

Under questioning by the defense, the stepfather said the person offered the family "a college education and [to] buy them a house."

The questioning seemed to help bolster defense contentions that the accusing family is trying to "shakedown" Jackson for financial gain. Jackson�s lawyers claim that the molestation accusations came when the family received no money for the interviews.

The attempt to record the video interviews followed the broadcast of Martin Bashir�s "Living with Michael Jackson" documentary, which had raised a storm of controversy in February 2003. It was during this time, the stepfather testified, that Jackson enlisted an investigator to tape a rebuttal video to attest to the music icon�s good character.

Referred to in court as "Mr. Doe" to withhold his identity, the witness testified that he also asked for compensation from British journalists who came looking to interview the family following the airing of the documentary in the United Kingdom.

"Two British journalists showed up and I talked to them," he said. "They said they wanted to do an interview with (his wife) and the children. I said, �what are you offering?� They said, �what do you want?� And I said I didn�t know."

He went on to say that the journalists eventually offered $15,000 for the interview.

The stepfather refused to confirm much of the content of the rebuttal video, stating that the investigator Bradley Miller had ignored him while he interviewed everyone else associated with the family.

"When (Miller) came in the house, he went around the room and asked each person to identify themselves but he did not identify me," he said.

"You heard Mrs. Doe say very positive things about Michael Jackson, didn�t you?" Jackson attorney Thomas Mesereau asked.

"I don�t know," the witness said. "I assume nice things were said. It wasn�t about me."

Mesereau then said, "You heard Mrs. Doe talk about Mr. Jackson saving her son�s life and being a father figure. Do you recall her saying, �They filmed a beautiful story about Michael and my son?�"

"No," the witness responded. "I don�t recall that."

Like the other witnesses at this week�s proceedings, the stepfather said he did not know Miller was working for Jackson�s former attorney Mark Geragos.

The defense is trying to determine whether Jackson�s attorney-client privilege was violated when Santa Barbara officials broke into Miller�s office and seized the video in question.

The stepfather seemed to be annoyed at being on the stand and repeatedly stated that he did not recall things. He did acknowledge that he was used at one point by Santa Barbara Sheriff�s Department as confidential agent to scope out the location of Miller�s office, but insisted that he was unaware of Miller�s employment by Geragos, and he refused to look at documents presented to him to help enhance his recollection.

"You can show me what you like, but I don�t remember him saying who he worked for ... I didn�t care who he worked for," the witness said.

Mesereau also questioned Mr. Doe about the man�s belief that his wife and the family were being held against their will at Jackson�s Neverland. The man testified that after she and the children had gone to the ranch, he called the Santa Barbara County Sheriff�s Department. This was in April 2003.

"I felt (my wife) and the family might be under duress," the witness stated.

However, following the call to authorities, he said the family returned and he told Santa Barbara authorities that everything was fine. He added that after that incident, his wife returned to Neverland.

"She somehow or another got back there," the man said.

In other testimony Thursday, civil attorney William Dickerman acknowledged having exchanged a number of letters and phone calls with Geragos and Miller, but never asked or was told that the investigator was in the employ of Geragos. Dickerman at one time represented the accuser�s family.

The lawyer also acknowledged that he knew of the taped interviews made by Miller and was concerned with whether his clients had given consent to use the tapes for the rebuttal video.

Also on Thursday, Judge Rodney Melville authorized the release of the Attorney General�s investigation into Jackson�s allegation of manhandling at the hands of deputies. The report concluded that there was not enough evidence to support the claim of mistreatment. The judge ruled that the release of the report did not violate the protective order in the case.

Melville also agreed to "entertain" a response by Jackson in regards to the release of the documents. Jackson�s spokeswoman Raymone K. Bain did not immediately return a call for comment.

Mesereau objected to the report�s release, calling it "a scam and a sham" to get publicity for the prosecution. He argued that although Jackson sustained bruises and received medical treatment, the pop star had never made a formal complaint about the mistreatment or made request for an investigation.

"Karen Faye, Michael Jackson�s loyal, long-time make-up artist... According to confidential sources close to the investigation, informants told the AG�s office it was Faye who had actually applied make-up to create the bruise seen here on Jackson�s arm, and that it was all smoke and mirrors."


In response, Karen Faye issued the following response to MJJForum:

"I just want to make a statement regarding Diane Dimond�s public statement that I used make-up to make a bruise on Michael�s arm. This is totally untrue. I am very angry. Our media representative & TheJusticeSystem.net correspondent Gail (MJDANCER123) has given us the scoop from inside the courtroom.

In describing the atmosphere of the courtroom, Gail conveys to us that the showdown is "tense" and that Sneddon is "under pressure." Gail notes that many media reps that are in the courtroom and in overflow simply "do not believe Sneddon�s testimony." His behavior has been described as "petulant, bratty, abrasive and very uncooperative," Because of this behavior, Judge Melville admonished D.A. Sneddon FOUR SEPARATE TIMES.

According to Gail, Judge Melville stopped the proceedings and said to Sneddon "Look, you are no longer an advocate. You are a WITNESS in these criminal proceedings. Stop being argumentative and evasive and answer the questions! Yes, or No will do."

Sneddon responded with what could be described as a belligerent tone "I do not want the wrong view point to get out ..... I have to explain." Melville then stated "That is up to your counsel. Your counsel will question you about this. Once again, you are not an advocate but a witness. Stop sparring with Mesereau."

From that point, Sneddon barked his answers with an angry "YES" or "NO" to Tom Mesereau�s questions.

Gail had the opportunity to speak with Katherine Jackson, Michael�s beloved mother. Gail conveyed to Katherine that MJJForum, TheJusticeSystem.net, Mark Geragos and Carol Davis are in support of Michael and the family and that our support is unwavering. Gail then proceeded to hug Katherine. Katherine was very moved by this and said "Why oh why are they doing this to my son, my family?" Our prayers go out to the matriarch of The Jackson Family.

Gail mentions that the entire family wore white with gold accents and that they were all very confident.

Jackson Attorneys Ask Judge To Throw Out Grand Jury Indictment

On the basis of what they see as insufficient evidence, lack of "strong suspicion" and improper conduct on the part of the government, Michael Jackson�s lawyers have asked a judge to discard his grand-jury indictment.

In a motion filed on Tuesday and released on Wednesday, Michael Jackson�s lawyer Robert Sanger signed a motion which appealed to Santa Barbara County Judge Rodney Melville to throw out the indictment.

The motion cites what the defense deems unfair proceedings including the conveying of information to the jurors "without regard to the rules of evidence," and the behavior of the prosecutors, including the allegation that they "bullied and argued with witnesses" and "ran the proceedings as if they employed grand jurors."

The motion cites prosecuting attorney Thomas Sneddon�s interaction with one witness � whom The Associated Press believes to be Russell Halpern, the attorney who represented the father of Jackson�s accuser during a custody battle with the teen�s mother � to illustrate a manner in which the prosecution "vouched for his own version of events while not under oath" and accused a witness of lying to the court.

The witness is quoted as saying that when he called Sneddon to inquire if his son was the person making molestation claims, he "found the head D.A. ... to be very uncooperative."

After the witness testified on the content of their phone conversation, Sneddon allegedly snapped at the witness saying, "That is not the way that conversation went and you know it."

Sanger alleges in the motion that this was an example of Sneddon�s attempt to "destroy this witness and establish to the captive jurors that he, Tom Sneddon, was the victor."

The motion also alleges misconduct, "the perfunctory presentation of defense material provided to the prosecution," and that "the admissible evidence is insufficient to establish a strong suspicion of the elements necessary to show Mr. Jackson was part of a conspiracy." It asks that the trial court determines whether or not the grand jury "abused its power in returning the indictment."

"There is no case in the history of the state of California that has condoned anything like the abuse of power demonstrated in this grand-jury proceeding," the motion said.

The matter will be addressed in court on July 27.

Jackson has pleaded not guilty to committing a lewd act upon a child and dispensing alcohol, as well as conspiracy to commit child abduction, false imprisonment and extortion.

Jackson hearing set after lawyers ask for case to be thrown out

Michael Jackson lawyers were set for a battle after the star asked the judge to throw out the child molestation case against him, claiming a lack of evidence and "outrageous" conduct by prosecutors.

The latest pre-trial hearing in the explosive celebrity case was due to get under way in Santa Maria, near Jackson�s Neverland Ranch in California, as Jackson moved aggressively to try to sink the prosecution case.

Earlier this week, the "King of Pop�s" legal team filed a motion to have the 10-count indictment against the thrown out, claiming prosecutors had "bullied" and cajoled witnesses into making groundless allegations in front of a grand jury that handed down the charges.

They accused prosecutor Thomas Sneddon of "flagrant misconduct" and flouting the laws of evidence during the hearings in March and April in an "overzealous" bid to obtain the indictment and prosecute Jackson for allegedly molesting a 12-year-old boy at Neverland last year.

Jackson�s team suggested that Sneddon, who led a 1993 investigation into earlier child abuse charges against Jackson that never reached trial, harboured a grudge against the superstar for escaping prosecution.

Sneddon presented evidence that pointed to Jackson�s innocence in a "perfunctory" manner that undermined the grand jurors� ability to make an independent and objective decision about the evidence, Jackson�s team said.

Notably, they claimed, the prosecutor produced no evidence to show that Jackson, 45, was involved in conspiracies of child abduction, false imprisonment and extortion, as charged in the indictment.

But while the attempt to throw out the case was lodged with the court earlier this week, Jackson�s lawyers asked the judge to postpone on the subject until July 27 to allow them more time to prepare.

On Friday, prosecutors and defence lawyers were expected to thrash out a number of other issues, including a strict gag order that has kept most documents hidden from reporters hungry for more details of the charges.

Media lawyers are fighting to lift the veil of secrecy and win access to the still-secret indictment, while the prosecution, defence and the judge fear the move will prejudice Jackson�s chances of getting a fair trial.

Also on Friday�s menu was a bid by Jackson�s team to persuade Judge Rodney Melville to bar from trial certain evidence seized in a series of searches on Neverland and other on the offices of a private detective working for Jackson�s former lawyer, claiming it was illegally seized.

Jackson has pleaded innocent to the 10 charges against him and is due to stand trial on September 13.

Defense Motion Claims Sneddon Conducted Personal Surveillance

On November 18, 2003, a search of Bradley Miller�s Beverly Hills office was done by police. Private investigator Miller was employed by attorney Mark Geragos. But the steps leading up to the search are particularly troubling.

A defense motion that was unsealed on Thursday stated that the district attorney of Santa Barbara personally conducted surveillance at the private investigator�s office. It also cited a memo drafted by Mr. Sneddon said he had visited the building where Mr. Miller�s office was located, photographed a list of offices there, and climbed the stairs to the second floor in an unsuccessful search for Mr. Miller�s office.

Then Mr. Sneddon took several photographs of the building, went to a phone booth where he looked up Mr. Miller�s number, and went to a meeting where he displayed driver�s license photos of Miller and others. The name of the person who saw the pictures was redacted from the court records released on Thursday.
The defense said law enforcement officers used a sledgehammer to enter Mr. Miller�s office and conference room during their search. The motion, filed on June 22, asked Judge Rodney Melville not to allow the evidence which included videotapes and computer hard drives, to be admitted at trial. The defense said evidence taken from Miller�s office should be returned to Jackson�s attorneys because police had no right to seize it under attorney-client privilege, which bars the prosecution from learning about communication between Jackson and his attorneys.
The prosecution denied knowing that Mr. Miller was working for Mark Geragos. They also said that the office of an attorney or private investigator could be searched if they had reason to believe there was evidence not covered by attorney-client privilege.
Also on Thursday, prosecutors filed a motion asking Judge Melville to clarify whether a statement made by Michael Jackson last month violated the gag order. This statement was in response to the leaking on national television of a confidential and sealed court document dating back to 1993.
Media attorney, Theodore Boutrous Jr. filed an appeal with the California 2nd District Court of Appeals on Thursday challenging the secrecy that has surrounded the case and included a long list of orders issued by Judge Melville that sealed such items as search warrants, grand jury transcripts and key sections of the indictment.

Defense Requests Grand Jury Indictment Thrown Out

Santa Maria Superior Court Judge Rodney Melville released a heavily redacted grand jury indictment on Wednesday. Attorneys for Michael Jackson are asking that the indictment be thrown out, claiming that the prosecutors bullied and argued with witnesses during the hearings and "ran the proceedings as if they employed the grand jurors."

"There is no case in the history of the state of California that has condoned anything like the abuse of power demonstrated in this grand jury proceeding," detailed the 47-page motion signed by Robert Sanger on behalf of the entire defense team.

Prosecutors ran secret grand jury hearings "by innuendo and sarcasm, impugning Mr. Jackson by ridiculing those allegedly associated with him and even those who sought to legally represent him," accused the defense.

In a transcript of the testimony identifiable as that of Russell Halpern, the attorney who represented the father of the accuser in a custody dispute with the mother, quoted Halpern and District Attorney Tom Sneddon arguing about the attorney�s efforts to get information from the prosecutor�s office.

"I found the D.A.�s office to be hostile when I called," said Halpern. "I found the head D.A., that being yourself, to be very uncooperative."

He said he first inquired whether his client�s son was the boy making molestation claims.

"You initially refused to tell me," he testified. "I asked you if my client�s son was dying. You initially refused to tell me. It was only after I told you that I might have to tell the press of your reaction that you called back and then told me."

Sneddon shot back: "That is not the way that conversation went and you know it."

"You know it too," said Halpern.

The witness said he had a clear recollection of the events because he took notes.

"So did I," said Sneddon.

The testimony was given as an example of the prosecutor testifying rather than asking questions.

"Mr. Sneddon through bullying tactics, inadmissible evidence and his own personal vouching for his version of events, wanted to destroy this witness and establish to the captive grand jurors that he, Tom Sneddon, was the victor," Sanger wrote. "This was an outrageous display of power that would not be allowed before a judge in any open court."

Mr. Halpern was unable to comment on Wednesday because of the gad order. He stated that Sneddon is improperly using the gag order to silence him.

"Mr. Sneddon has misused his powers as district attorney to try to keep me from talking at all. I am not a potential witness, and his description of me as a potential witness is disingenuous. It is a poorly disguised attempt to keep me from exercising my First Amendment rights."

With regard to the charge of conspiracy, the defense details that the prosecution had failed to show this crime. "There is simply no evidence that Mr. Jackson had the specific intent to agree to conspire with anyone about anything," said the motion.

�No action or investigation has been taken to determine who is leaking this information or why they are permitted to violate the law in such a manner. I respectfully request that people see these efforts for what they are.

�These kinds of attacks and leaks seek to try the case in the press, rather than to a jury who will hear all of the evidence that will show that I did not, and would not, ever, harm a child. I have always maintained my innocence and vehemently denied that these events ever took place. I reluctantly chose to settle the false claims only to end the terrible publicity and to continue with my life and career.

Family of Jackson�s Accuser File Claim Against L.A. Department of Children and Family Services;


Jackson�s Defense Fights for Prosecution Material

The family of Michael Jackson�s accuser has filed a claim against the Los Angeles Department of Children and Family Services, seeking damages.

In a document filed on Tuesday on behalf of the alleged victim and his immediate relatives, it is stated that the family seeks damages against the Los Angeles Department of Children and Family Services for allegedly violating their privacy. The family claims that the department disclosed confidential details about the investigation that was conducted by the department before Jackson was first criminally charged in the molestation case last November.

The reason for the claim is due to the fact that a government memo was posted on The Smoking Gun website in December 2003, revealing the fact that the young accuser "denied any form of sexual abuse" and said that he never "slept in the same bed as the entertainer." The boy also denied the allegations when questioned by a social worker assigned to the Sensitive Case Unit of Los Angeles� Department of Children and Family Services back in February 2003.

The family of Jackson�s alleged victim says it is seeking damages from the Los Angeles Department of Children and Family Services because officials did not have the "human decency" to apologize for violating their privacy and allowing the confidential memo to become public knowledge. The Department however has stated that it "continues to conduct an aggressive, ongoing investigation" into the memo�s leak and has promised to hold those responsible accountable.

The family claims not to be seeking money, but merely an apology. However, defense attorney Dana Cole says that "this new claim on their part seems to suggest that maybe there is a financial motive, and that it is about the money".

Meanwhile in Santa Barbara, Jackson�s defense team has filed documents requesting the prosecution to hand over material, which involves more than a hundred witnesses, thousands of pages of documents and more than 300 seized items.

The documents, released late Tuesday, claim that the prosecution has withheld material that should have been turned over to the defense months ago. In a statement the defense says: �The prosecution has found the time and effort necessary to prepare for grand jury proceedings, conduct ongoing witness interviews and monitor forensic examination of seized items at the expense of providing timely (potential evidence) as the law requires�, calling it �inexcusable. However, it is not clear whether the evidence they seek access to would be admissible at the time of trial.

The defense lawyers have stated they need ample time "to conduct follow-up witness interviews, locate and interview rebuttal witnesses and conduct its own forensic examinations. This process will take months." If the material is not handed over promptly, then �Mr. Jackson�s right to a fair trial is jeopardized."

Next Friday, at the next scheduled hearing, Judge Melville will consider defense requests to order District Attorney Tom Sneddon to turn over the material and to lower Mr. Jackson�s bail. The judge will also consider requests by both sides to keep grand jury transcripts sealed and media attorney Theodore Boutrous� argument to make the documents public.

Fox 411: Accuser in the Middle of Custody Fight

Father's lawyer suggests mother keeping her sons away so they don't tell the truth about what really happened at Neverland

The following article comes from Roger Friedman's 19 May column.

The 14-year-old boy at the center of the current Michael Jackson case is right in the center of a family at war.

The boy's parents, who are in and out of family court over custody and visitation issues, recently crossed swords again.

This time the mother, who has been called an opportunist and a manipulator in this column by many who have had dealings with her, really said a mouthful. In court papers she said that not only do her two sons and one daughter not want to see their father, but — and this is only according to her — the two boys sleep with baseball bats because they fear this man. She also said they go through putting up a series of barricades so they can sleep soundly.

But it turns out, according to the father's lawyer, that the daughter has seen and spoken to her father. "The mother doesn't care whether she seems him or not," says H. Russell Halpern. "She's only interested in keeping the boys away from him. She's afraid they'll tell him that the whole Michael Jackson story is made up."

In fact: sources have told me from the beginning that when the 14-year-old underwent chemotherapy treatments a year and a half ago, it was the father who took care of him. When the family first came to Neverland, it was the father, not the mother, who accompanied them.

"When the boy got sick, the father took a leave of absence from his job and slept next to his bed. The boy wanted him there for comfort." The mother's latest court statement, says Halpern, "demonstrates her lack of credibility." And there may be some evidence to back this up. When the mother sued J.C. Penney a couple of years ago, she gave a deposition in which she allegedly testified that her ex-husband — whom she later accused of beating her kids and killing her dog — was a "wonderful man."

Halpern is busy right now trying to get the deposition unsealed. He claims that the Pasadena, California lawyer who handled the case has been pressured by the mother's attorney, Larry Feldman, to keep the papers hidden. But attorney Tom Rothstein told me yesterday, "I've never spoken to Larry Feldman in my life." Feldman, of course, is better known as the lawyer who got a $20 million settlement for another family from Jackson in 1994.

Dr. Sandram is an Indian dentist in Santa Barbara County who in 1995-96 filed and won a lawsuit against the Santa Barbara D.A.�s office (winning over $300,000 in damages to date) for causes including Conspiracy, False Imprisonment, and several other civil rights violations, some of which were related to death threats and attempted homicide on both himself and his wife.

In 1994, Dr. Sandram attended a private fundraiser/dinner with Sneddon and members of his staff. Sneddon, along with Detective Timothy Rooney and Sr. District Attorney Magnacolo (sp.) discussed a plan directed at Michael Jackson to "run that (n-word) out of Santa Ynez". The discussion also involves several racially motivated prosecutions, payoffs, and conspiracy. Our discussion with Dr. Sandram includes Sandram�s contention that Sneddon and his staff "knew" Jackson was innocent of the crimes, and possible motivations as to why they may want to drive him out of the County. Also included in the discussion is info on an original grand juror in the recent case (who ended up not being a juror after the initial selection), and the use of cocaine (the illegal drug) by Sneddon�s Sr. D.A. (Magnacolo) during the same meeting.

Does District Attorney Thomas Sneddon Have A Vendetta Against Michael Jackson?

In a report this morning, ABCNEWS has viewed documents that could spell trouble for the prosecution of the child molestation allegations against Michael Jackson.

During the entire investigation, Michael and his defense team have said that Santa Barbara County District Attorney Tom Sneddon has a vendetta against him and is determined to convict Michael at any cost. Mr. Sneddon denies this.

However, a memo signed by Thomas Sneddon dated last November says that Sneddon personally investigated aspects of the case. As was told to ABCNEWS by defense sources, these parts of the investigation are almost always handled by police investigators or junior prosecutors.

According to the memo, Sneddon drove to Los Angeles and met alone with the mother of the alleged victim in a parking lot behind a federal building. The memo goes on to say that Sneddon took pictures of the office of a private investigator who worked for Mr. Jackson. The memo claims that Mr. Sneddon handled all these matters by himself, without the presence of a law enforcement officer or an investigator. Sources close to Mr. Jackson told ABCNEWS that Sneddon also executed his own stakeouts.

In addition, a Santa Barbara County police report says that Sneddon met alone with the alleged victim�s mother on another occasion.

Linda Fairstein, a leading sex crimes prosecutor, said this alleged personal sleuthing by Mr. Sneddon was unusual. "It�s way too personal. It�s way out of line," Fairstein told Good Morning America. "If he does any substantive parts of an investigation, he may become a witness in the case."

In addition, Ms. Fairstein indicated that Sneddon�s close involvement in aspects of the investigation could be grounds for a mistrial and gives the defense team ammunition to attack the prosecution.

"It lets these very talented defense attorneys take him apart before the jury and explain that it�s not his place to do that," she said. "He creates trouble in and out of the courtroom for himself by taking on that role."

Mr. Sneddon cited the gag order and declined to comment on the memo and charges of a personal grudge against Mr. Jackson.

Legal experts believe jurors may question the case if they sense it is motivated by a personal grudge from the district attorney.

MJ Accuser's Testimony 'Shaky'

The grand jury testimony of the 14-year-old boy accusing Michael Jackson of child molestation was not a success, I am told.

Much was made recently of the boy's appearance before a grand jury convened by District Attorney Tom Sneddon in Santa Barbara. As was the case 10 years ago, Sneddon's case against Jackson depends on the grand jury believing the veracity of a teenager. But two grand juries in 1994, you may recall, did not conclude that Jackson had molested anyone.

Now I hear from sources involved with the case that the 14-year-old, who testified recently, did not make a good witness. In fact, I'm told that his own lawyer cut off the questioning when he saw things were getting rough.

This comes at a time when, I am told, the boy's mother -- who in 1998, according to statements made by her ex-husband in court papers, spent time in a mental hospital -- is again having similar problems. "She was hospitalized again," a source tells me.

So far the grand jury in the Jackson case has heard from several observers, but it has not been able to question a number of key people Sneddon hoped to bring in. They include the three Jackson employees -- Frank Tyson, Vinnie Amen and Marc Schaffel -- who actually dealt with the boy, his mother and her other children. Sneddon had also sent warnings out that he wanted to bring in the now 23-year-old man from the decade-old case. But that never came to fruition, either.

If the testimony of the current accuser was indeed as "shaky" as it was described to me, it will be interesting to see where the case goes next. If the grand jury does not hand down an indictment, the lack of a case would abrogate any chance the family had for a civil suit or cash settlement, as in the 1994 case.

Jackson, by the way, has spent the last couple of weeks in Orlando, Fla., renting a swell small mansion from local time-share king David Siegal and hanging out at Disney World. Besides his children, he is also being attended to by Nation of Islam leader Leonard Mohammed.

Meanwhile, Dr. Carole Lieberman -- the Beverly Hills psychiatrist who filed a complaint against Jackson after his baby-dangling incident in early November 2002 -- says she wonders if Sneddon has a case at all.

Lieberman has a history of sorts concerning Jackson. She told me last week that she was the psychiatric consultant years ago on Randy Taraborelli's unauthorized biography of Jackson, which was published in 1991. A dozen years later it was she who called Child Protective Services when she saw Jackson dangling his youngest child, baby "Blanket," from a German hotel window. She wrote again to Child Protective Services on Feb. 11, 2003, a week after Jackson was seen on the TV special "Living with Michael Jackson" holding hands with the boy who would later accuse him of child molestation.

"He's not fit to be a parent," Lieberman observed in our conversation. She would not confirm, as my sources insist, that she is partnered in her endeavors to have Jackson's kids removed from him with zealous attorney Gloria Allred. Both Lieberman and Allred turn up constantly on TV to comment on Jackson.

But Lieberman, for all her criticisms of Jackson and assertions that he's guilty, told me, "The dates in the case will be its downfall." Like this reporter, Lieberman questions the viability of the window of opportunity in which Sneddon claims Jackson abused his accuser -- Feb. 7 to March 10, 2003. This was right after the TV special aired and the world condemned Jackson for his closeness to the child. However, the child had been in Jackson's presence many times for nearly a year prior to the special's broadcast, and there is no allegation of impropriety then.

"I told Tom Sneddon, things don't add up," Lieberman said. "There's some kind of disingenuousness about the way he's handling the case, some of kind of ambivalence."

Santa Barbara authorities concluded story was hoax

As previously reported, the LAPD are currently investigating into new claims of child abuse against Michael Jackson. However, it has become apparent that the Santa Barbara Police Department were the first to hear of these new claims and in fact deemed them not credible, according to News-Press.

Almost falling into routine surrounding rumours that circulate about the King of Pop, these allegations have apparently been pushed forward from two women who are no strangers to the world of Michael Jackson.

According to Reuters, this new Accuser "recovered" memories from psychiatric sessions with Carole Lieberman, a Beverly Hills Psychiatrist who has been outspoken in the media, as well as filing official complaints to the Santa Barbara authorities against Michael following what she had seen in the Bashir documentary, Living With Michael Jackson, which in fact led an investigation by Police.

The attorney who is rumoured to have brought this complaint to the LAPD is no other than Gloria Allred. As well as being involved in the case against Michael in 1993, Allred has been trying to have authorities seize the King of Pop�s three children since late 2002 after the now infamous incident with his youngest, Blanket, in Berlin.

Michael Jackson�s Defence team have previously issued a press release on these new claims, in which they stated, "We believe that this smear campaign is driven by money hungry lawyers, seeking to capitalize on Mr. Jackson�s current legal situation."

Psychologist�s words to the Accuser.

Yesterday, March 19th, NBC�s Mike Taibbi shared breaking news with a report on the Today show.

Taibbi announced that NBC News had examined documents from the Santa Barbara Sheriff�s Department investigation of the case, and they had seen �major potential problems� that could face Michael Jackson�s prosecutors.

One major development was how much the Accuser knew about the previous case in 1993. In a report from June 14th 2003, Dr. Katz, (the psychologist who spoke to the Accuser) was quoted by a Santa Barbara investigator as saying, �You know, you don�t want Jackson to do these things to kids again, do you?� He says the (Accuser) answered, �Well (he) didn�t stop him�� giving the rarely reported full name of the first Accuser. Katz answered, �I actually do know about that case� I worked on that one too.�

Within the report it was also mentioned how the key players in this case, District Attorney Tom Sneddon, attorney Larry Feldman and psychologist Dr. Stan Katz, were all key players in the 1993 case. Taibbi mentioned that Michael�s �defenders say the names common to both cases suggest an agenda, even a vendetta.�

Another development was that despite previous statements from both Sneddon and Feldman claiming this case was not about money, Dr. Katz was quoted as saying last June, �Mr. Feldman actually referred these kids (the Accuser and his siblings) to me, because they had come to him in this lawsuit Feldman�s going to file � Whether the Mother�s motive is to do it for money, I can�t tell you� I mean, certainly they�re kind of a poor family.� This of course suggests that the family were planning on filing a civil lawsuit in the hope of getting money.

The most outstanding piece of news taken from NBC�s report was a quote from Dr. Katz addressing the Accuser, �Look, if you go ahead with this civil lawsuit, your family will get money if they win.�

Michael's Security Guard Says He is Innocent
Mike LaPerruque talks with Fox' Roger Friedman

Michael Jackson's private security guard and assistant, the one who traveled with him exclusively during the time Jackson knew his current accuser and family, says the singer will be proven innocent of all charges.

Yesterday I talked to Mike LaPerruque, a retired sergeant in the Los Angeles County Sheriff's Department who remains on reserve after a 22-year active career.

LaPerruque says he worked for Jackson from August 2001 until June 2003, was with him in New York for the 30th anniversary solo concerts, Jackson's escape from New York following September 11, and on several occasions met the boy who's accusing Jackson of child molestation, as well as the boy's mother and siblings.

If he's called before a jury, LaPerruque � who signed a confidentiality agreement with Jackson during his employment � will testify that the singer can only be innocent of all charges.

"I was with him 24/7," LaPerruque was able to tell me. "I had a key to his room at all times, and I was never told not to use it."

Did he ever walk into Michael Jackson's bedroom and see him in bed with a child other than one of his own?

"No! Of course not," said LaPerruque.

He called the mother of Jackson's 13-year-old accuser "the type of woman who knew how to manipulate people."

When LaPerruque heard the newsbreak last November 17 about the Neverland raid and Jackson's latest problems, he says his first thought was, "Poor guy. He can't catch a break. He had a new album coming out and a lot of stuff happening."

LaPerruque said his immediate thought was that "it was a shakedown."

LaPerruque told me that he's been offered all kinds of things in exchange for an interview, even a trip to Paris. His agreement with Jackson prohibits him from talking about certain aspects of his employment, but he is not completely biased in favor of Jackson. He told me one story about what happened in the Berlin hotel the day after the baby-dangling incident.

"There were a bunch of friends there, and they said to give a real F.U. to the press and to these lawyers who were saying there should be an investigation, they would do something funny," he explained. "They would buy a life-sized baby doll from a toy store, cover its head with a blanket, and then throw it over the side. Michael thought they were kidding around, and so he said, 'Great idea.'"

Soon after, LaPerruque spotted one of Jackson's pals returning from a toy store with the doll.

"I had to stop it from happening," he said. "I physically took it away from the guy. I said, 'It's not funny, and you don't know what's happening in the States.'"

He added: "I got into a little hot water on that one. But Michael does things impulsively."

LaPerruque left Jackson's employ last June, he said, because of the crazy schedule.

"They would call me and say 'Michael's going to Las Vegas, he's already left for the airport, you have an hour to meet him,'" LaPerruque explained.

He said that he spent 10 weeks with Jackson in Las Vegas, during the whole Martin Bashir shoot, and was with him in Germany and in Florida. On the road, LaPerruque would act as Jackson's traveling secretary, making schedules and slipping them under his door for the morning.

"Michael Jackson is one of the most down-to-earth guys I've met in my life," LaPerruque said.

He told me a story about hanging out with Jackson in a Chevy Astro van, eating chicken wings from Jerry's Deli on Ventura Boulevard, talking about Egyptian history.

Under oath he will testify that he's had experience with child molesters in his 22 years as a cop, and that Jackson does not fit the profile. He said he has two kids, and he would feel comfortable with either one of them � a boy and a girl � spending time with Jackson.

Clearly, LaPerruque is a fan. But he is also a potential nightmare for Santa Barbara County District Attorney Tom Sneddon, who will be put in the position of cross-examining a member of the Los Angeles County Sheriff's Department and questioning his veracity.

For example, LaPerruque said, "[Jackson] would never offer a child liquor." He said the "Jesus Juice" that Jackson jokes about � liquor hidden in soda cans � is designed so the child-friendly singer is not photographed doing something adult, like holding a drink. He is not the first member of Jackson's entourage to use this explanation with me.

So we'll have to add Mike LaPerruque to the list of impressive defense witnesses for Michael Jackson, which already includes director Brett Ratner, actor Chris Tucker and a dozen or more eyewitnesses ready to take the stand.

Attorney from J.C. Penny Shoplifting Case Says "this is a shakedown, shakedown, part 2."

In an explosive interview today, Tom Griffin, the attorney who represented J.C. Penny in the alleged shoplifting case that began in August of 1998, revealed detailed information about the family of the boy accuser in the Michael Jackson case.

In the Penny�s case, the boy, his brother and mother accused security guards of viciously beating them without provocation. "It became readily apparent that this was an incident, in my opinion, a scam to extract money from J.C. Penny," says Mr. Griffin.

The shoplifting charges were dropped and Penny�s ultimately paid a $137,000 settlement to the family days before the scheduled trial in 2001. The family had sued for $3 million.

"If it was a cooked-up scam ... why pay anything? The worst case scenario is that a jury�s going to believe what she said and that they�re going to tee off on you," says Griffin.

Public records of the case only describe the stories told by the opposing sides. J.C. Penny�s claims that the boy was sent out of the store by his father with an armful of shoplifted clothes and that the whole family was quickly detained with the mother starting that brief scuffle.

The family claims that both boys were modeling clothes for J.C. Penny�s, not stealing them and that they�d been brutally beaten by store security guards for no reason.

However 100 pages of documents not in the public record, including defense deposition excerpts and psychiatric reports were obtained by NBC. These documents give a very detailed version of J.C. Penny�s case.

The psychiatrist hired by Penny�s found the mother to be schizophrenic, delusional and severely depressed, "sad over being a nobody," she�d said, "a sad housewife getting fat."

Her own therapist found her to be anxious and depressed after the incident, but not delusional.

Oddly enough, 2 years after the incident the mother added on the charge that one security guard had also sexually fondled her breasts and pelvic area for up to 7 minutes says Penny�s.

The Penny�s psychiatrist says she "rehearsed" her two sons to back up her "farfetched" story -- in what "sounded like scripted copies of (her) testimony" -- that they and she had all suffered broken bones, in addition to her sexual assault.

Mr. Griffin says, "She just came up with this fairy tale, not a fairy tale, a horror story, and ran with it."

Because of the gag order, none of those involved in the Michael Jackson case would comment on this story.

What is the connection between this story and the charges against Michael Jackson? Mr. Griffin, J.C. Penny�s lawyer, says that based on his experience with this family he can guess about a possible connection.

"They�re going for a home run this time, this is a shakedown, shakedown, part 2."

Brett Ratner Had Doubts Over Accuser�s Mother
Chris Tucker To Play Major Role In The Case?

"I always had a weird feeling that the mother would set Michael up," were the words of Brett Ratner, according to FOX�s Roger Friedman.

Director of the Rush Hour movies and Red Dragon (also a good friend of Michael�s) Ratner told Friedman, �I always liked the father. But the mother was an opportunist�.

Ratner described how the Accuser was allowed to visit the set of Rush Hour 2, however he didn�t always show gratitude, "[The boy] would sit in my director's chair. When I told him to get up, he'd tell me to go to hell." Ratner said, "He used to tell me, 'Brett, I don't like the last shot' while he was watching us make the movie. He's telling me how to make my movie! He's more street smart than I was at that age. If someone tried to fondle him, he'd punch them in the face. He's an adult. I think the jury will see that."

Friedman also portrayed a picture of neglect from the mother, �a picture is coming clearer of a mother who often deposited her children with anyone who'd take them - grandparents, friends, acquaintances - so she could spend time with her boyfriend. The mother is also said to have been inattentive during her son's bout with cancer.�

Two people who have been said to have looked after the Accuser, as well as his brother and sister, were star of the Rush Hour movies (and another good friend of Michael�s) Chris Tucker and his girlfriend.

�What will come out in testimony, if there is ever a trial in this case, will be the story of how Tucker and his girlfriend/fianc� flew with the boy and his family from Miami back to California on Feb. 7, 2003, after the boy and his brother appeared on the Martin Bashir TV special, Living With Michael Jackson. Both Tucker and his fianc� will testify, I am told, about the family, in particular about a mother who often dumped her star struck kids with Tucker so she could be with her boyfriend�, Friedman stated.

Videographer Christian Robinson Speaks Out

An exclusive interview between ABCNEWS� Cynthia McFadden and private videographer Christian Robinson was shown on ABC Good Morning America. Mr. Robinson was employeed to record Michael Jackson on tape for two years.

Most compelling is that he conducted his own taped interview with the accuser and his family soon after �Living With Michael Jackson�, the documentary made by Martin Bashir, was aired on TV in February 2003. He asked them on the tape if there had ever been any inappropriate sexual behavior between Michael and the accuser. "Yeah. I asked. And they answered and they were very up front and they, of course, said absolutely not." "All of the them, every single one," he said.

"And just to clarify that even a little bit more, during this interview I told them to speak truthfully probably more than 30 times. I kept on reminding them, I�m like I want you guys to tell the truth. You know, I know how passionate you guys are about this. I just want, I want you guys to tell your story. And they told it," Robinson said.

It has been reported that the boy�s family didn�t know about the alleged abused when this interview was conducted. They said the mother didn�t know anything about claims of abuse until months after the interview was recorded.

"In my mind, you know, I was doing an interview to show the accurate side of Michael Jackson," said Robinson. He says his hour and a half interview with the boy and his family convinced him that Michael is innocent.

"I will tell you this, the family was not coached. The family was incredibly passionate, not just the accuser and his family, but the other two siblings. There were tears, they were holding hands, they were talking about Jesus and God and Michael as the ultimate father figure." He does not know if this tape still exists or if it does, it has probably been subpoenaed by the Santa Barbara District Attorney�s Office.

He says that he thinks he also asked about sleepovers. "Yes, I think I did...I guess they both slept in the bed, and Michael slept on the floor." He recalls that the younger boy elaborated by saying they watched movies and played games before they and Jackson would fall asleep. "You know, they, the families, were very close at this point. You know? So i saw nothing wrong with it," Robinson said.

He said that the family told him that they credited Jackson with helping to save the boy who suffererd with cancer. "He�d felt, they all felt like a miracle had taken place."

He also spoke about viewing intimate moments between Michael and his own children. "They operate much like any other family. People look at the kids and think they must be so screwed up, having those things (scarves) on their faces. But when you�re in a room with them and they take their things off and they�re playing with all the other kids and running around tipping things over and they�re just like any other kids."

Ian Buckley, a still photographer who was also employed by Michael Jackson, said he and Robinson were with Michael in Las Vegas the day before the Neverland Ranch had been raided by authorities. He said they were instructed to "get shots of the fans" that day. That was the last day they had contact with Michael.

Accuser's family declared Michael's innocence on tape

Videographer Christian Robinson told ABCNEWS, in an interview sources say happened before a gag order was issued, that Michael Jackson's accuser, and his family, said the King of Pop did nothing wrong in an interview last year.

Robinson says he taped his own interview with Michael's accuser and his family soon after Martin Bashir's documentary Living With Michael Jackson aired in Feb. 2003.

Asked by ABCNEWS' Good Morning America whether he had inquired with the family about the possibility of inappropriate behavior on Michael's part and he responded: "Yeah. I asked. And they answered, and they were very up front and they, of course, said absolutely not. All of them, every single one."

Robinson claims the alleged victim, his brother, his sister and his mother all said Michael did nothing wrong.

"And just to clarify that even a little bit more, during this interview I told them to speak truthfully probably more than 30 times. I kept on reminding them, I'm like I want you guys to tell the truth. You know, I know how passionate you guys are about this. I just want, I want you guys to tell your story. And they told it," Robinson told ABC.

Robinson said he felt he was doing the right thing when he shot the interview for Michael after the Bashir documentary aired.

You know, I'd ask them one thing and it's almost like they were getting mad at me, 'why are you asking us this, this is Michael is innocent,'" Robinson said. The videographer says he doesn't believe the family was coached to give him answers or that they felt scared or intimidated.

"I will tell you this, the family was not coached. The family was incredibly passionate, not just the accuser and his family, but the other two siblings. There were tears, they were holding hands, they were talking about Jesus and God and Michael as the ultimate father figure,"

Meanwhile, Robinson says he doesn't know if the tape still exists. If the tape does exist, it's likely now been subpoenaed by the Santa Barbara District Attorney's Office.

...the nine charges levelled against him (Michael) this afternoon by the Santa Barbara District Attorney Tom Sneddon do not look strong enough to convict him of child molestation. Poor judgment is more like it.

At worst, Sneddon may have Jackson on the two charges of "administering an intoxicating agent." I told you first, back on Nov. 19, that Jackson would be accused of giving the 12-year-old boy wine and sleeping pills. That would apply to the two last charges in the felony complaint against him.

But the boy in question, his brother and mother appeared with Jackson in an ABC special that aired on Feb. 6, 2003. Subsequently, an investigation by the Los Angeles County Child Protective Services took place between Feb. 14 and 28 that concluded no abuse had taken place.

Sneddon is now asking us to believe that beginning on the day after the special aired, and while the investigation was taking place, Jackson decided to commit seven lewd acts upon the boy. It's possible, but it seems implausible.

Mark Geragos, Jackson's attorney, will offer dozens of witnesses who passed through Neverland between the dates on Sneddon's complaint -- Feb. 7 through March 10 -- and saw nothing of consequence. He will also have testimony from Neverland staffers who will claim that Jackson was never alone with the boy, and certainly not enough to commit lewd acts on seven separate occasions.

I will tell you stories in the weeks to come of children who Jackson befriended, as well as their families. (I've no doubt others will, too.) They may seem very strange. But do they make him a paedophile?

Sneddon has promised in the past that more children would start coming forward to tell their stories. So far, none have done that. Only this one boy, from a family that has spent a good deal of time wresting large cash settlements and making accusations based on race and sex against companies. Sneddon is going to have a hard time proving that none of that matters, or that Michael Jackson is guilty of more than making fun of the district attorney in a song.

No one has come forward to make additional allegations against embattled pop star Michael Jackson after a tip-off phone line was set up by police, it emerged today.

The news came amid fresh doubts about the strength of the child sex abuse allegations made against Jackson by a 13-year-old cancer survivor. Jackson has called claims that he abused the boy at his Neverland ranch in Santa Barbara, California, a "big lie".

Sergeant Chris Pappas of the Santa Barbara County Sheriff's Department said today that about 70 calls had been received by police about the case in the last two weeks.

Only a handful had provided information which could be followed up and no further accusations had been made against the 45-year-old singer, he said. "At this point in time none have clearly identified new cases for independent investigation," he said.

Meanwhile, the New York Times reported that the Santa Barbara District Attorney, Thomas Sneddon, has twice delayed filing formal charges against Jackson.

Jackson's lawyer Mark Geragos has questioned whether the star will be charged at all.

"I'm not so sure there's even going to be a charging document," he said. But in previous comments Mr Sneddon has defended the case saying: "It just doesn't make any sense that the Sheriff and I would do something that is doomed in the long run to fail."

The credibility of the accuser has already been called into doubt following a claim that he and his mother recently signed legal papers saying the pop star "never acted inappropriately".

It has also been revealed that the boy's family has launched two other abuse-related lawsuits in the past, winning a $90,000 settlement in one case.

Does No Charges Mean Weakening Of The Case?

Does the Santa Barbara County district attorney, Thomas W. Sneddon Jr. have a problem? He has twice delayed filing formal charges against Michael Jackson even though Mr. Jackson has been arrested and booked and was set free on $3 million bail on November 20th. Some veteran prosecutors say this delay is not unusual. But does it indicate problems with the case?

A tip line was set up to sift through anonymous calls from anyone with information on the current case against Mr. Jackson, but Sgt. Chris Papas states that no one has come forward to tell of separate acts of molesting by Mr. Jackson. Sgt.Papas said "At this point in time, none have clearly identified new cases for independent investigation".

Mark Geragos, Mr. Jackson�s lead attorney, said he would not comment on the case "unless and until there is a charging document." Mr. Garagos said, based on his fragmentary knowledge of the identity of Mr. Jackson�s accuser and the accuser�s account, "I�m not so sure there�s even going to be a charging document." This has been characterized as a "big lie" by Mr. Geragos.

Mr. Sneddon will not speak to the public until he makes the charges against Mr. Jackson public. In an interview with CNN last week, Mr. Sneddon admitted that he had mishandled his announcement of the arrest warrant for Mr. Jackson by appearing to make light of the charges. He denied that he was pursuing a vendetta.

John D. Barnett, a prominent defense lawyer in Southern California stated that "advertising for witnesses" could be taken as a sign of weakness in the prosecution�s case.

Michael R. Oxman, attorney who has represented several members of the Jackson family, stated that Mr. Sneddon was "out to get Michael Jackson." Mr. Oxman said that "at the press conference, the district attorney paraded before the world a bunch of uncharged and unsubstantiated claims to poison a jury." "He conducted a jocular press conference as if it�s a Broadway opening. That is just unprofessional conduct."

He also said that he suspected that the victim�s family was seeking money, not the conviction and imprisonment of Mr. Jackson. Mr. Oxman said, "Whenever anyone says it�s not about money, it�s about money."

Mary A. Fisher Speaks �On the Record� With Greta Van Susteren

Author of the October 1994 GQ Magazine article "Was Michael Jackson Framed?" appeared in an interview with Greta Van Susteren on December 1st. Below is a transcript from that interview:

Mary, first the question, do you think he was framed in 93, and if so, the follow up question, is why you think that?

Mary Fisher: I definately think he was the target of a plan to extract money from him. And I base that on a five month investigation that I did for GQ...that looked at the accusers, the adults that were surrounding the boy who made the accusation. And I looked at who they were as people and to look at their motivations. And what I came up with was that three of them had questionable backgrounds and also the boy had been giving a powerful, psychiatric drug, before he ever made any allegations against Jackson. And, uh, there was alot of evidence that had not come out before that strongly suggest that Jackson was the target of extortion.

Greta: Mary was there any evidence at all that other than the boy and his family had ever seen anything to suggest a criminal activity about Michael Jackson. If you strip away the accusations from the one family settled civily. Is there anyone else that back them up?

Mary Fisher: There was no other corroborating evidence as there often is in these cases of alleged child molestation. It�s easy for someone to make an accusation, but it�s very hard to defend against it. And that�s because often there is no other evidence. There�s the say so of the child surround by adults who encourage the child to, uh, to make these statements for their own motivations and there is no other evidence. That was the case in 93, and so far that seems to be the case now.

Greta: In the 93 case, did the family first go to a lawyer for civil damages for money before they went to the prosecuter?

Mary Fisher: That�s exactly right. The interesting thing is if the parents of the first boy had genuinely believed that there son had been sexually molested by Jackson. You would think that the first thing they would think to do is go to the police, but they didn�t do that. They went to an attorney, and the attorney then helpled them with some sort of plan to extract money from Jackson. And then they brought in a psychiatrist, who by the way had no experience with children and met with the boy several times, and it was only after that and being given the drug, that the boy then said yes Jackson did inappropriate things to me.

Greta: In terms of the drug, do you know what the drug was?

Mary Fisher: Yes, it�s sodium ametal (sp?) and it�s a powerful psychiatric drug when under the influence, a person is highly suggestible. And that drug was given to the boy by the father of the boy and the father�s friend who was a dental anesthielogist, and the anesthielogist gave the boy the drug in the dentist office.

Greta: Was there any accusation by the boy before this drug that Michael Jackson had been inappropriate with him?

Mary Fisher: No. In fact he had been asked several times if anything inappropriate happened and he would always said no, and then again this is what happens in some of these cases and incidents, that a series of adults, whether it is police, the parents, psychiatrists surround the child and the child becomes influenced by these adults and often they are false accusations that come out of this.

Greta: Alright this family, the mother and father not married, right? That adds the results to that element to it that the family was falling apart.

Mary Fisher: Exactly right. In the first case, the parents were involved in a bitter custody and divorce battle. The what also happened is that Jackson had befriended the father and the boy and got busy and moved on and the father was disgruntled by the fact that Jackson was no longer as close to him as he once been. That seems to be a parallel in this frequent, in this new case. Uhm, and in this new case that fact that parents did not take the boy or call the police, but they took him to a lawyer(s), civil lawyer.

Greta: And the lawyer, is there any parody or similarities. Are there any lawyers from the 93 case hovering around this new case?

Mary Fisher: Well, the lawyer, the civil lawyer from the boy in the first case is also the attorney who the parents, uh, the mother of this current boy took him too. That�s whats in common.

Greta: Aright, and what has happened to the family. Any quick update where, he�s now a young man, was a boy back then in 93. What�s he up to?

Mary Fisher: You know, I haven�t really kept on top of it. I understand he�s living in the east coast. I guess he�s 22 years old in college but I don�t know where. And to me there is so many similarities with the old case and this current case that it is really important to reserve judgement before anyone comes to a conclusion about guilt or innocence here.

If they thought it was an open-and-shut case, prosecutors investigating child abuse allegations against Michael Jackson got it badly wrong. Just 10 days after the heavily publicised police raid on the singer's Neverland ranch, the inquiry has hit several embarrassing snags.

While the lurid story still dominates tabloid headlines, Jackson's camp has scored notable victories in a public relations offensive. As both sides gear up for a long battle, it seems the star may even have won round one.

Tom Sneddon, the Santa Barbara district attorney in charge of the case, had to apologise for referring to Jackson publicly as 'Wacko Jacko' and welcoming reporters covering the case for the money they will bring to the Californian economy.

'I knew as soon as I said it, it was inappropriate. It was unprofessional,' he said.

The Jackson camp accuses him of mounting a decade-long vendetta against the singer after the collapse of a 1993 child abuse case following a multi-million dollar payoff to the alleged victim.

Sneddon denies any personal spite, but his climbdown was humiliating. 'If my mom was still alive she would take me to task for not being a good person,' the DA said. The apology was only the beginning. It has emerged that the alleged victim went to see a therapist - whom he told that he had been abused - only after his family had already contacted a lawyer linked to the 1993 case. The lawyer helped put them in touch with police.

Perhaps most damaging of all are reports of an audio tape on which the child and his relatives praise Jackson and say he never 'acted inappropriately' towards the boy.

Jackson's side has played a skilful media game, letting only Kimberly Guilfoyle Newsom, a CNN legal pundit, hear the tape.

Newsom said that on the tape the alleged victim, his brother and their mother all praise the singer effusively as a father figure, saying they were blessed to have him in their lives. The tape was recorded last February after the alleged abuse.

Newsom said the Jackson source who played it to her said the boy's mother and the alleged victim had signed an affidavit that Jackson had never abused the child.

Ugly details have emerged of the home life of the boy, a 12-year-old cancer sufferer. His family pursued two abuse-related lawsuits in the past, once winning more than $137,000 in damages.

That case occurred after the family said they were assaulted by security guards at a department store after the child left with clothes he had not paid for. His mother told a court then that one guard had sexually assaulted her. Charges were dropped and a settlement paid.

The boy's father has previously admitted domestic abuse. The couple had a bitter divorce in which the mother claimed her husband harmed her and was guilty of spousal abuse and child cruelty. The father accused her in turn of making the children lie.

Amid all the leaks, accusations and dirt digging, a sophisticated game is being played, as each side tries to control the flow of information to an insatiable media.

The press are playing dirty too. The FBI has launched an investigation into how Jackson and his flamboyant lawyer Mark Geragos were secretly videotaped on board a private jet as Jackson flew from Santa Barbara to Las Vegas after his arrest.

Geragos said he had sued the plane's owners, XtraJet, for placing cameras on board. The incident prompted one of the few comments nearly everyone agrees on. 'New lows are being hit daily in the case,' said Jackson's spokesman, Stuart Backerman.

Jackson's robust defence and his hounding by the tabloids have won him the support of celebrities, many of whom see a racial element in the case, including rappers P. Diddy and LL Cool J and rhythm and blues diva Alicia Keys. Civil rights leader Jesse Jackson has attacked Jackson's treatment by the media.

If Jackson's camp operating from a hotel in Las Vegas, has come out with guns blazing, the prosecution remains convinced it has a firm case. After saying they would charge Jackson this week, the prosecutors now signal this will not happen until at least mid- December, giving Sneddon more time to examine evidence from Neverland. Experts say the charge sheet should be far more detailed as a result of the extra time.

Following are 3 more positive articles questioning the charges and stating, as I have said all along, that Gavin is not the one doing the complaining.

In that article, Celebrity Justice claims that the word is Gavin was not willing to tell what happened to him and that it was "finally pulled out of him." I don't even have to be a Psychologist to know that "pulling" information out is cause for reasonable doubt. It is a very common occurance that information that is forced from younger people is not true. What happens is they feel guilty for not being able to say what they are expected to say and finally make up a story to appease the adults who are pressuring them to say something that is untrue. If this is true, that he was unwilling and finally told something under pressure, this whole case has not a leg to stand on.

Los Angeles -- Ten days after the arrest of Michael Jackson on charges that the 45- year-old pop singer sexually molested a 12-year-old boy at his Neverland ranch in Santa Barbara, gallons of ink and hours of airtime have been devoted to his reported accuser, a previous reported accuser, Jackson's supposed sexual predilections and sleeping habits, and a private jet ride that was surreptitiously videotaped.

But so far, not a shred of hard evidence has been produced to substantiate the charges (or refute them), and, say experienced criminal attorneys, most of the speculation, which could be seen to be damaging to both sides, will have little impact on the outcome of Jackson's trial -- if there is a trial.

"A lot of this stuff you're hearing about, it's good for optics but it doesn't mean a jury will hear about it," said Brian Sun, a respected criminal attorney in Los Angeles currently representing a former FBI agent charged with helping a Chinese double-agent in an espionage case.

At first, the district attorney in Santa Barbara, Thomas Sneddon, seemed almost giddy with self-confidence when he announced the allegations at a televised news conference on Nov. 19, the day after the lavish Neverland estate was raided by dozens of Santa Barbara County sheriff's officers, and hinted he had an air-tight case against Jackson on multiple counts of child molestation.

Since then, reports have leaked that the boy's mother has alleged several times before that she was abused, with some suggesting darkly that she may have coached the boy, a cancer patient, to make the charges that Jackson molested him while the two slept together.

Last week, in the face of rising criticism, Sneddon apologized for his lighthearted banter at the news conference where he announced the accusations, which Jackson has vehemently denied. Prosecutors said they are delaying the filing of the formal charges against Jackson until mid-December, an unusually long delay, say some courtroom observers, who also note that the D.A. also issued a plea for other alleged victims to come forward -- suggesting, they say, that the case may be weak.

Jackson's defenders were further heartened when a young Australian entertainer said he spent nights in Jackson's bed at Neverland without experiencing any sexual advances. But to veteran criminal lawyers, the claims and counterclaims have little, if any, legal relevance. Their sole impact may be on the minds of potential jurors, but even that is uncertain.

"Both sides feel they need to do some PR, but there are reasons to doubt any of this stuff will be admissible," Sun said.

Mark Holscher, a former prosecutor, said that the celebrity character of the case all but guarantees weeks, if not months, of leaks and accusations that ultimately may have little bearing on the outcome of a trial.

"With famous defendants, there are all sorts of wild cards,'' Holscher said. "With a celebrity, there are really a different set of rules. Everything is magnified, but the trial could be a very different matter."

It has been widely reported, though never officially confirmed, that 10 years ago Jackson paid the family of a 14-year-old boy some $15 million to $25 million to settle a civil suit involving allegations that Jackson had sexually molested the boy. After the civil case was settled, documents were sealed and the boy refused to cooperate with the district attorney, and criminal charges were not filed.

That case reportedly rested on a four-page declaration by the boy, who was 13 years old when the affidavit was prepared in December, 1993. That document was recently exhibited on a Web site known for disclosing sensitive court documents, thesmokinggun.com.

In the affidavit, the boy claims he was hugged, kissed and then fondled by Jackson when he spent the night with the singer at the Neverland ranch and in hotels.

To Jackson's accusers, the document proves he has a habit of such immoral and criminal behavior. But some legal observers doubt whether it could be used against Jackson in court now. Holscher said prosecutors would probably have to prove first that the previous molestation actually occurred and that it involved a similar pattern of behavior to that alleged now, both of which could be extremely difficult without the other boy's testimony and cooperation.

"Normally, it is hard to get claims like that in a trial," Holscher said.

He added that it was unusual, though not surprising, that the Santa Barbara district attorney would issue a plea for other alleged victims to come forward.

If the boy involved in the current case is the lone witness at Jackson's trial, his testimony may not be enough to persuade a jury. The boy would be likely to face a difficult cross examination in which all his assertions would be challenged.

"Anytime you have to rely on one witness it's a tough case," Holscher said. "This may depend more on whatever documentation is out there and what they got in the searches."

Added Sun, "At this point, everyone is trying to get as much leverage as possible, but the truth is, this is not a trial, and so you don't know anything really. A prosecutor asking for other victims to come forward could be considered unusual, but it doesn't necessarily mean the case isn't strong."

Yes, he is a baby-dangling, crotch-grabbing, plastic-surgery-overhauled celebrity. Yes, he has said he enjoys sleeping next to children at a place called Neverland.

But don't call the King of Pop a criminal. It's too early for that.

With each passing day, the child-molestation case against Michael Jackson appears to grow weaker, though that could be because his lawyers have been trumpeting his innocence on the Internet and through the same mass media that have labeled their client a freak.

Jackson's lead counsel, Mark Geragos, says his accuser's family is gold-digging. He's piggybacking off news reports that this is the third time the boy's mother has raised allegations of physical or sexual abuse in court.

Also, a lawyer for the boy's father in his parents' divorce case said last week that the woman had a "Svengali-like" ability to make her children repeat her lies.

The boy's family has filed no civil suit against Jackson, but "if anybody doesn't think based upon what's happened so far that the true motivation of these charges and these allegations is anything but money . . . then they're living in their own Neverland," Geragos said. "Michael Jackson is not going to be slammed."

"His lawyer is coming on very, very strong. As a result, it leads me to think he's got something," said Leonard L. Cavise, a DePaul College of Law professor who specializes in criminal procedure and evidence. "He's not just sitting back. He's saying this guy's a victim."

"What we don't know is what, if anything, that the prosecution and the sheriff's office recovered from Michael Jackson's home," said Richard Kling, a Chicago-Kent College of Law professor and practicing criminal-defense attorney. "If there's no additional evidence, the prosecutor is in a lot of trouble."

A bizarre case so far Jackson, 45, celebrated Thanksgiving at an undisclosed location after posting $3 million bail Nov. 20 for his arrest for engaging in lewd or lascivious conduct with a child younger than 14. Since then, the Santa Barbara County district attorney's office has declined to comment, saying it will do so only after it files formal charges against the Gary, Ind., native. Those charges are expected before Christmas.

The prosecution's silence has let a swirl of reports about Jackson's accuser's family surface in newspapers and on television. The boy reportedly has cancer, which sparked Jackson to befriend him.

In November 2001, J.C. Penney Co. paid the boy's family $137,500 to settle a lawsuit that accused company security guards of beating the boy, his mother and his brother in a parking lot after a boy left a J.C. Penney store with clothes that hadn't been paid for, the Associated Press reported. The mother also accused a security guard of sexually assaulting her during the incident, which happened in 1998.

A month before the settlement, the boy's mother filed for divorce and accused his father of child abuse. Russell Halpern, the father's attorney, told the AP that the mother lied and that the father once showed him a script she allegedly had written for her children to use in a deposition.

That information -- combined with the background that Jackson paid a reported multimillion-dollar settlement in a 1993 case involving similar sex-abuse allegations -- could help the star in court.

"This cuts to the credibility of the accuser and the accuser's family," said DePaul's Cavise. "In most sexual abuse cases -- absent physical evidence, DNA or injury to sexual organs -- it's usually the case where it's the word of the victim and whatever the victim has told his or her parents or his crisis counselors."

A judge would need to decide that the information about the boy's mother is relevant for it to be presented in court, which could prove challenging -- but not impossible -- for Jackson's lawyers.

"If there's a pattern to their fabrication of claims, then that pattern could easily be admissible," Cavise said.

Kling, the Kent professor, acknowledges that the information raises more questions about the accusations, but he isn't sure it's Jackson's silver bullet.

Also, the boy's father could pose credibility problems if Jackson opts to use him to discredit his wife. He was sentenced to domestic-violence counseling after pleading no contest to charges that he beat her. He also has pleaded guilty to a misdemeanor charge of willful cruelty to a child in an incident involving his daughter, Newsweek reported.

"I don't see a pattern of frivolous lawsuits; I see a dysfunctional family," Kling said. "Certainly there's a lot of potential fodder for cross-examination, but the two suits have nothing to do with sexual abuse [involving the boy]. They show a lack of normal functioning on the part of his mom."

Kling said "he would be smiling a lot" right now if he were Jackson's attorney, but "until such time that we see what the evidence is," you just don't know.

It only gets weirder

Jackson's accuser, according to Newsweek and People magazines, appeared in a British documentary with Jackson in which the singer admitted sleeping in his bed at Neverland with children in a nonsexual manner.

The boy met Jackson a few years ago with the help of Jamie Masada, a Los Angeles comedy club owner who runs a camp to teach needy kids about comedy. At that point, Masada said doctors were giving the boy, now believed to be 13, only a few weeks to live. Meeting Jackson was one of his dreams.

The allegations against Jackson were related by the boy to a therapist, who was required by law to notify authorities.

Masada said last week that the cancer-stricken teen is seriously ill again. He has only one kidney and is awaiting a transplant because his remaining kidney is failing.

The boy's poor health adds yet another level of bizarreness to the case. If it goes to trial, Kling predicts a three-ring circus that could make the murder trial of O.J. Simpson "look like a Sunday school kindergarten class."

Jackson's Web site, both Cavise and Kling said, is an indicator that Jackson's defense team is trying to sway a potential jury that undoubtedly will bring preconceived notions about him into court.

"If this case went to trial tomorrow, I don't think you could possibly find a fair jury," Cavise said. "If the guy's public profile is killing him right now, it's part of his lawyer's job to change that."

Jackson says on mjnews.us that he's trying to avoid the spotlight.

"We will not engage in speculation," he writes. "We will not provide running commentary on every new development or allegation dujour. We intend to try our case in the courtroom, not in the public or the media."

A gag order could go out soon, temporarily ending all chatter by key players. But until it's all over, "there's nothing that's going to be usual about this case because it's Michael Jackson," Kling said.

NEW YORK: Here's some more good news for Michael Jackson. As the pop superstar prepares to battle child molestation charges in court - his >12-year-old accuser is a reluctant witness.

According to rate the music.com, Harvey Levin, the producer of American TV's Celebrity Justice who broke the latest scandal in America, claims young Gavin Arvizo is not the willing witness, the prosecution first thought he was.

"This boy told a therapist that Michael Jackson fondled him in his private parts, but he's a very reluctant witness. He did not come out and spill his guts about what allegedly happened between him and Michael Jackson," Levin said.

"We're told it literally had to be pulled out of him, first by attorney Larry Feldman and then by a therapist, who ultimately got the story from the boy," he added.

I had to laugh yesterday while reading "breaking news" reports from the Los Angeles Times and other sources about Michael Jackson (search).

Almost all of this news was reported here first Nov. 19 -- that the family of Jackson's accuser hired Larry Feldman (search), the same lawyer who wrested a $20 million settlement from Jackson 10 years ago in a similar case, to work with their own attorney.

Also on Nov. 19, we told you that the 12-year-old boy in question confessed to his psychiatrist that Jackson had plied him with wine and sleeping pills -- not exactly the prescribed medicine for a kid recovering from cancer.

We also told you in that same column that Jackson, feeling unable to re-court the family once they had hired these lawyers, attempted to get them out of the country by buying them passports. At the time, we were told that South America was the destination. I can now tell you that Brazil was the specific idea the Jackson people had in mind.

I also told you that the medical condition of the boy was still in jeopardy, although I was asked by my source to not give specifics.

Yes, that was all nine days ago. So it's not exactly "news" to read it again this weekend.

But what is interesting is that in that time, my source -- who I protected and will continue not to name -- has decided to come forward. And I mean, in a big way. He's been all over the media in the last two days. I guess a week of anonymity was too much for him. Now, not only is his name everywhere, but so is the name of the boy involved. So much for protecting a minor who, as far as anyone knows, is an innocent.

But at least one mystery can be solved by this source. Because he contacted Jackson about the boy in the first place, Jackson wound up meeting comedian Chris Tucker (search) and director Brett Ratner (search).

The source was the conduit for the Jackson-Tucker introduction, then Tucker introduced Michael to Ratner, who directed Tucker in Rush Hour. Ratner went on to direct Michael's "You Rock My World" video in the summer of 2001. That gives us a timeline for how far back these relationships existed. File that in your trivia book for future use.

On Nov. 20, the very next day, we also told you that Jackson had hired Mark Geragos, the famed defense attorney, last winter when all this started. This would be at the end of February 2003. So this would make reports -- filed elsewhere this week -- that Michael panicked on the plane ride from Las Vegas to Santa Barbara completely ridiculous.

Jackson had known for a long time that this trouble was brewing. And, whether it's misguided or not, he believes in his innocence and will fight the case out. You can bet on that. Looking back through 2003, Jackson's much-publicized house hunting trips to Florida can now be explained. Florida is a "homestead state." You can't lose your home if there's a civil judgment filed against you, which >is why, for example, O.J. Simpson lives there.

Jackson feared, and rightly so, that this new case -- with Feldman advising -- could have as devastating a financial result as the one from 10 years ago. And this time he does not have the same resources.

Also in that Nov. 20 column: we reported that the mother of the alleged victim would be portrayed as a "scorned woman" and that her life would be held up to great scrutiny. This has already come true.

The biggest news of the last few days was that the mother has filed other lawsuits, including one in which she won $163,000 against J.C. Penney (search). Also, all of her videotaped comments from last winter extolling Jackson's virtues have been dragged out to undermine her claims. I told you that would happen in the column of Nov. 19.

Will there actually be "new" news this weekend? Probably not. But here's a prognostication: early next week some dots may get connected that haven't been before.

A lot of the great bites of information will simply be gossip and have nothing to do with the criminal charges D.A. Tom Sneddon wants to file on Dec. 15. And some may explain exactly what's at the root of this story. >

Here are some cases making the news that are known to have been false allegations, which destroyed the life of the accused.

Many times, victims will recant thier testimony just to make things "back to normal" because usually their family will, ironically, tell them it was thier fault and make statements such as, "Look what you did to our family."

But more often, children -- especially teens going through troubling divorce proceedings as mentioned below -- accuse an adult of inappropriate behavior in order to get attention or get revenge for feelings of neglect or rejection.

Also extrememly common is one parent accusing the other of inappropriate or violent behavior in order to shed doubt on that spouse during a custody battle.

Dimond Uses Jackson for Financial Gain�Again

Court TV's Diane Dimond has once again used Michael Jackson to procure gains in her financial and career status. It was announced on the Business Wire (Nov 24) that she will now host Court TV's Hollywood at Large. Dimond's obvious reward for reporting various Jackson information, confirmed or not, has been examined by some who see her as little more than a gossip-monger with an unjustly elevated platform. The press release announcing her supposed triumph specifically points to her work with breaking the recent Jackson story as a way to convince people of her alleged worthiness for the new position. However, upon closer inspection, one could wonder what the COO of Court TV, Art Bell, is thinking by making her their new star.

Dimond rode to fame working for the now defunct tabloid TV show Hard Copy. She got into hot water with Jackson, and the law, when she was spreading a damaging lie about the 1993 case from one of her "sources." Jackson subsequently won a defamation of character lawsuit against her main source, Victor Gutierrez. Dimond herself escaped responsibility by wrapping herself around the "journalist" mantra.

Dimond recently spread the apparently false story that the District Attorney, Tom Sneddon, found "love letters" at Michael Jackson's home. She even appeared on Larry King Live (Nov 24) proclaiming as much:

At the time, the boy, the mother, the family was up at Neverland. She goes on to avow that there was an absolute certainty these "love letters" existed in conversation with Larry King and other panelists who appeared on the show that night:

However, Nola Foulston, Kansas City District Attorney, said on Fox News show On the Record that she has spoke with DA Sneddon recently, and he "categorically" denied the existence of any such "love letters". It appears the story was first reported by a London tabloid (see 'Love Letters' Story a Fake?).

There is a rising level of suspicion surrounding Dimond's ability to get her hands on information that no other news source is able to independently verify at that time. There are questions concerning whether or not she was being fed direct information from Sneddon. Also suspicious was the timing surrounding her involvement in this case. Dimond was reportedly one of the first reporters, if not the first reporter, at Neverland when Jackson's home was searched by police. She was also the first to know of the existence of an arrest warrant against Jackson. Either she was alerted directly by someone in the DA's or Sheriff's office BEFORE Jackson's home was search, or she's just extremely lucky. Most think the former is a more accurate description.

The obvious closeness to Sneddon could cause problems if any in the media start to publicly question why she was able to get her hands on that kind of information so soon in the case (see Dimond & Sneddon: Too Close for Confort?). Thus, her current information�the "love letters" story�may have been a damaging misstep among many she's had throughout her career. Whether Sneddon was illegally leaking information from the case directly to Dimond or not can only be answered by either of those two parties. Thus far, some have yet to understand Dimond's sudden increase in stature for essentially doing nothing more than any other tabloid reporter with "good connections" could do.

Accusations Motivated By Money

Michael Jackson's attorney has said that the accusations made against Mr. Jackson are motivated by money.

The family of the boy had already been involved in two abuse allegation cases previously. One being a lawsuit in which the family alleged that they were battered by mall security guards and the other a divorce conflict, where the father pleaded no contest to child cruelty and spousal abuse.

Court records show that the boy's family were paid $137,500 to settle a lawsuit in November 2001 in which they claimed that security guards beat the mother, the boy and his brother in a parking lot for the boy carrying out clothes that they hadn't paid for.

In the 1998 confrontation the boys mother also alleged that one of the guards had sexually assaulted her.

The boys mother had filed for divorce a month before the settlement, starting a fight, which included abuse charges. Russell Halpern, the fathers attorney said that the boys mother had lied about the abuse saying that she had a "Svengali-like'' power of making her children repeat her lies. He also said that the boys father once showed him a script that the mother had written out for the children to use for when they were questioned in a civil desposition.

"She wrote out all their testimony. I actually saw the script," said Halpern. "I remember my client showing me, bringing the paperwork to me."

Defence attorney Leonard Levine, who specialises sexual assault cases said that if Jackson attorneys can show the mother or the accuser lacks credibility, the familys past legal cases could be crucial in the current molestation case.

Referring to the claims of physical abuse Levine said, "It sounds like music to a defense attorney's ears - that there have been other cases where they have sued and there is at least an argument that the allegations are similar to the ones here."

The boys father was charged on four counts of child cruelty in 2002 along with one count of each of the following: injuring a child, false imprisonment, and making a threat. He pleaded no contest to one count of child cruelty but court records were uncertain as to which of his children this referred to and other charges were dismissed. The boys father pleaded no contest to spousal abuse in 2001.

On Tuesday Michael Jackson's attorney Mark Geragos, promised to come down hard on anyone who attacks Mr Jackson and stated that molestation allegations against Mr. Jackson were motivated by money, saying, "If anybody doesn't think based upon what's happened so far that the true motivation of these charges and these allegations is anything but money and the seeking of money, then they're living in their own Neverland."

ABCNEWS legal contributor Kimberly Guilfoyle Newsom heard the tape, which was made in February, and said there was no indication from the sound of the voices that the statements were coerced or had been rehearsed.

The boy and his mother said that Jackson never acted inappropriately with the child, and the accuser stated that when he slept in the singer's bedroom he slept in the bed and Jackson slept on the floor, Guilfoyle Newsom said. They praised Jackson for providing support, love, guidance and advice, and the boy's mother said that God had blessed them by bringing Jackson into their lives, Guilfoyle Newsom said today on ABCNEWS' Good Morning America. In the tape, the mother described Jackson as a "father figure" to her children. The tape and affidavit could be extremely damaging to the prosecution, said Guilfoyle Newsom, who is herself a prosecutor. If the boy testifies, the tape could be introduced by the defense to raise questions about his credibility, and he could be forced to say that he lied in the tape and affidavit, she said. All I'have been hearing this morning is ''GOOD NEWS" about Michael Jackson.

They are saying that Michael has evidence and affidavits confirming that the boy and his Mom where "in fact" lying about the "supposed" molestation, at the neverland ranch.

I'm happy to hear his legal team, speaking so positive... and even a Lawyer in Detroit Michigan, says, that what hurts the prosecuting team is this evidence that the defense team has in regards to proving Gavin and his Mother wrong. Michael apparently had them sign affidavits, confirming that they were never treated in any harsh way, and if they go against this sworn affidavit, they may be sued or face charges.

I love that....

Michael is going after everyone involved in wrongful allegations of himself, he's doing it.... he's fighting.... like I knew he could, he was very smart this time, even though, he still allowed the children there, he was smart by covering his gestures of kindness.

He knew that at anytime this could happen, and that is why the prosecutors raided his home, in hopes to get all the evidence Michael had to prove 'NOTHING' went wrong in the home.

Jermaine Jackson Clarifies Bed-Sharing

Jermaine Jackson appeared on 20/20 tonight (Nov 21) defending his brother. The elder Jackson has confirmed what many Jackson supporters have believed for a long time: Michael Jackson has never actually gone to sleep in the same bed with any child. To explain this further, when Jackson admits that he "shares his bed" with children, he is not referring to actually laying down next to any child, turning the lights off and going to sleep next to them. When Jackson uses that phrase, he means that he's sharing his personal property with anyone who wishes to sleep in his bed while he will sleep on the floor or on a cot. Thus, he never physically sleeps in the same bed with any child. This information was also confirmed by Corey Feldman on Larry King Live (aired Nov 21, 2003) when he said that Jackson slept on a cot while he was there. Oddly, this was also confirmed by the alleged victim during the Living with Michael Jackson "documentary" when he admits that Jackson slept on the floor while he and his siblings slept in Jackson's bed.

The media does not shy away from random speculations-the more wild and untrue, the better-where Michael Jackson is concerned. Could misinterpretations of Jackson's words be coming back to bite the media in their proverbial asses? Looks like it.

I've been reading that this is the same kid who was holding his hand on the documentary "Living With Michael Jackson". If so, then this kid is contradicting himself. Dick Gregory's Comments On Michael Jackson

Dick Gregory, activist, health guru, ex-comedian as well as advisor to many influential people is a man who has been a mainstay in American culture for decades. As a friend of Michael Jackson for many years he recently offered insight to the current situation involving Mr. Jackson and provided a perspective that has not been evident in many media outlets.

On a radio show entitled, Make it Plain, hosted by WOL's Mark Thompson in Washington, D.C., Dick Gregory stated in response to the mad media frenzy and tilt toward guilt coverage, that those who believe in Michael Jackson's guilt or innocence should first ask for truth to be exposed. Whether it is damaging for Michael Jackson or not, he insisted that truth is the most important aspect of this issue.

However, Mr. Gregory does not believe that Mr. Jackson is guilty of the charges and raised many questions concerning the events leading up to the actions of law enforcement and consequent media coverage.

He asked why was it necessary for 40 police officers and 20 FBI agents to raid Michael Jackson's property? More specifically, why were FBI agents present, especially since the allegations against Mr. Jackson are not a federal offense? He also questioned the legitimacy of the claim of law enforcement that they did not know of Mr. Jackson's whereabouts and the timing of the raid.

According to Mr. Gregory, there is a monetary element to this entire situation. He states that Michael Jackson purchased the Beatles catalog for nearly $48 million and it is now worth $1.5 billion. He also owns the rights to the Elvis catalog and found out after his purchase of the Beatles collection that these rights also included ownership of Little Richard's catalog of which, Michael Jackson promptly called Mr. Richard and returned it to him.

His suspicions arise from the fact that Michael Jackson has taken out loans and his lenders wanted collateral, which was none other than his Beatles catalog. Mr. Gregory stated that Michael Jackson did not mind offering that up as collateral because every time he would come out with a record he would make around $500 million from his efforts. For those who doubt those claims, he explained that there is a mischaracterization that occurs when people think about what is success for Michael Jackson. Although he may not achieve the outrageous sales of his more youthful days a majority of successful artists sales would pale by comparison.

Mr. Gregory found it odd that every time Michael Jackson is about to come out with an album or moneymaking venture he is hit with a scandal and that this situation is no different. He also admonished the audience not to forget that Michael Jackson embarrassed SONY and music mogul Tommy Mottola when he claimed that they were racist and that they took advantage of and mistreated Black artists.

Not holding anything back, Mr. Gregory stated that Rev. Al Sharpton, who came to the defense of Michael Jackson during this time was soon overwhelmed by media coverage of a video tape which showed individuals attempting to frame him in a drug deal. He went even further stating that this type of behavior could be traced to Bill Cosby and the suspicious murder of his son Ennis, who was gunned down while changing the tire of his Mercedes on a California highway. He claims that this happened after Mr. Cosby hinted that he wanted to purchase NBC when it was up for sale.

Dick Gregory also alleged that when they showed Michael Jackson in handcuffs, it was symbolic and when they handcuffed him, they handcuffed us all (Black communities). He stated that they allowed Mr. Jackson to board his private plane in Las Vegas, fly back to California and then handcuffed him and immediately took them off when inside the police station. According to Mr. Gregory, law enforcement had not judged him an extreme flight risk if they let him fly in and obviously not a danger if they immediately uncuffed him once inside, so why the posturing?

Mr. Gregory further intensified his discourse by reiterating that the value of Michael Jackson's Beatles catalog cannot be underestimated and asserted that Mr. Jackson could easily be killed, have it consequently ruled a suicide and thus his collection will be forfeited in lieu of his debt.

He further commented that people such as Liz Taylor, whom he knows Michael Jackson would rush to their aid in times of need, have not come to his defense or spoke out on his behalf. He also talked about how many people take "Michael" for a joke, yet he is very intelligent and that he knows what is going on.

Yet for all his concerns, Dick Gregory stated that Michael Jackson will "come out clean" in this dilemma and he called for people to say a daily prayer for the "truth to come out" about this situation concerning Mr. Jackson at 12:00 P.M., no matter what the time zone. He believes, ultimately, people will be shocked at what that truth is.

In the final analysis, many may balk at the comments and observations of Mr. Gregory, believing that governmental officials, media organizations and corporations in the music business may be beyond collusion or conspiracies (when two or more make a conscious effort to bring about a certain reality), which is fine. Yet, free and independent thought that Mr. Gregory exhibits is absolutely necessary, especially in an era where fact and fiction has taken an equal seat in mainstream media and thought.

Hopefully, people will not jump on the bandwagon of mainstream reactionary thought and will judge this situation objectively and think about how the constant stream of Black men being vilified as sexual and violent deviants will affect Black communities and Black individuals in general. I will not even address how these events also help serve as a smokescreen to other national and international events, but if we do not become more vigilant of our surroundings, it maybe a mistake we may all regret.

The strongest evidence I've seen in the last couple of days that shows me MJ is innocent is this: He never went home. MJ came from Vagas to the courtroom, was booked, and went back to Vagas. i'll tell you why i think so.

1. Tom Sneddon and the Sheriff were acting entirely too silly during the press conference. If this is supposed to be a serious matter involving multiple counts, as they said it is, why were they joking around and laughing during the press conference?

2. If Michael Jackson is supposed to be a criminal, why did they allow him to surrender at his leisure? That does not make since.You would think they would give him a solid time to turn himself in like 24 hours or something. Why was the surrender open-ended?

3. When the 70 officers descended on Michael's estate yesterday, why was the press there to film it ahead of time? If this was supposed to be an ongoing investigation, a private investigation mind you, and they wanted to catch their suspect, they would not have the media there filming while they're rolling up to the front gate.

4. If you are going to roll up on somebody with 70 officers, you can't be acting on a hunch, you act on a fact. Sneddon clearly said they are still searching for evidence. What?! Also, if this is an ongoing investigation, you don't roll up when they are not at home. If you feel you've got to get your man, do it! Don't make it look like you're doing it! This is not supposed to be for show only. If it is supposed to be a criminal investigation (an ongoing one at that), it is supposed to be for real. Why mess around?!

5. Last night on Larry King Live, Diane Dimond lied. Last night she said an arrest warrant had already by issued. Yet, Sneddon said it wasn't issued until today. Also, during the press conference today, Sneddon pointed out Diane in the crowd, mentioned her by first name and said she knows him well. Why are they so close? I'm very suspicious of this case as well as their friendship, because Diane is clearly a MJ hater.

6. If this was supposed to be an ongoing investigation that has been going on for some weeks or months, don't give the public some lame excuse about Halloween being the reason for not searching Michael's home before November 18th. Sneddon mentioned Halloween during the press conference and something about the fans. Helloooooo!!! Effective 11/18/03, Halloween had been over for a whole 18 days. Why the delay? Why the excuses? Why put off a child molestation case for Halloween if the charges are so serious?!

7. If Michael Jackson was being sought for some serious charges, that stemmed from a so-called ongoing investigation, why wasn't he placed under surveillance back then so they could stay abreast of his whereabouts? This way they wouldn't have to look for him when they're ready to scoop him up? Is it because Sneddon and his crew are acting on a hunch (again)?

8. Once they heard Michael was in Las Vegas, why were they reluctant to go and get him? During the press conference, one of the journalist asked Sneddon if they were going to go to Las Vegas and arrest Michael. Sneddon said no. Now what since does that make?! If Michael is supposed to be a criminal, why don't you want to go and arrest him?

9. During the press conference, Sneddon said they went to Neverland to arrest MJ yesterday and would have if he was there. Well, if they only had a search warrant yesterday, they would not have been able to do it anyway. Why did Sneddon forget just that fast that the arrest warrant was only issued today? He said it himself that the arrest warrant was issued today. Why is Sneddon flip-flopping?

Dimond & Sneddon: Too Close for Comfort?

Many observers have noticed a very close "relationship" between the media and the District Attorney's office during this latest Jackson scandal. One reporter, in particular, has a highly peculiar rapport with DA Tom Sneddon. She, Diane Dimond, has taken the credit for breaking both Jackson stories; the first being in 1993 when Jackson was accused of molestation. No charges were ever brought against him. It is alleged that Dimond was on her way to Neverland before or around the same time as police raided Jackson's home. She was the first who knew about a search warrant. She was also the first to know about an arrest warrant. This obvious "insider information" can only come from one place. It appears rather odd in retrospect that she had such information, which no other media outlet could independently confirm at that time, before the news of the story actually broke. Just `good reporting'? I don't think so.

During the now infamous press conference given by DA Sneddon and the sheriff, the following exchange occurred: Quote:

SNEDDON: Are you aware of other civil cases that have been handled outside of the media since 1993 that were kept quiet?
ANDERSON: Not to my knowledge.
QUESTION: Really?
ANDERSON: Yes.
SNEDDON: Well, I am.
QUESTION: How many?
SNEDDON: Ask Diane, she knows everything about Michael Jackson.

If it seems ridiculously odd that Sneddon would refer a question of that magnitude to a reporter-the same reporter once sued by Jackson, the same reporter `breaking' stories, and the same reporter scorned from 1993-then you are not alone. He is evidently friendly enough to call her by her first name. While using her first name in itself isn't suspicious, it's just a part of so many other factors that help to throw suspicion on their "relationship" (see Press Conference Transcript

Sneddon also said, during that press conference, he would not do any interviews with the media and instructed them to stop calling his office. Yet, he recently gave a sit-down interview to Diane Dimond for Court TV. In that interview, he even refers to Jackson as "Jacko- Wacko" when talking about what people have to say about Jackson. Dimond appeared on CNN's Larry King Live recently (Nov 21), and King raised the question as to why a District Attorney would even give an interview to anyone, given the fact that Jackson still has yet to be charged with any crime. Dimond's response was to look down, to stall, and then finally say "Well, I -- I just asked him. And he and I have stayed in touch over the years, as I stay in touch with all the sources..." This close relationship, whatever it is, is highly problematic because it calls into question the motives of both the DA's office and certain media outlets. Are they deliberately trying to convict Jackson in the court of public opinion? Only those two people know the real answer to that question.

During Neil Cavuto's Your World program (Nov 24 2003), correspondent Trace Galliger (sp?) appeared on the show with some startling information. He reports that the company from where Jackson chartered the plane to fly back to Santa Barbara is now brokering a video of Jackson from inside the plane. He says that he has actually watched 45-50 minutes of that video. Galliger did not hear the audio because the company would not allow him to. He says that on the video, one can clearly see Jackson being very calm and talking to different people on the plane. He says that clearly Jackson was not panicky at all.

This information is in direct contradiction to the tabloid story saying Jackson was "panicky", "rocking back and forth", "people had to drag him off the plane", and that he "wanted to flee the country." Yet another rumor has been slapped down, as it appears to be a total fabrication. Remember, this is no second- or third-hand information, as Galliger says he actually saw the video footage with his own eyes.

The current information comes on the heels of Roger Friedman admitting to not being sure if any `explicit letters' even exist. Members at one Jackson website say that Friedman reported to Fox news that the "love letters" story could be an imported rumor from the UK.

The father of the boy in the center of the Michael Jackson controversy announced through his attorney Russel Halper that Gavin's mother, with whom he is in a divorce fight about custody, is unfit. The father does not believe that the pop superstar victimized his son. It is not Mr. Arvizo's aim to defend Michael, but to reproach his (former) wife in this custody fight. He also said: "Either she places a child in a home in which he's in danger of being molested, or the alternative, she is encouraging a child to make false accusations. Either way, it makes her unfit." The interesting thing about this story is that a father, who really seems to care about his son, does not belive that the allegations are true. Stuart Backerman released another statement, saying: "The big lie against Michael Jackson is anchored in the most vicious allegation imaginable, one that resonates across every culture: the spectacle of harming a child. While everybody is already discussing the case, it is notable that all of Michael's celebrity friends, who used to stand up for him, especially Liz Taylor, have this time remained silent (so far) and don't want to comment the case. But Michaels goddaughter Nicole Richie, the daughter of Lionel Richie, defended him. She said at Access Hollywood she had spend a good part of her childhood at the Neverland Ranch and never had anything illegal happened there. She and her friends had often slept in one room with Michael without anything sexual or inappropriate happening. "It wasn't more but an adult who would like to be a child again, you know. He just feels comfortable spending time with kids", the 22-year-old explained. If she had ever noticed anything illegal, she would have told her parents about it immediately, she said.

Several people already expressed their concern about the treatment of Michael Jackson by the authorities and the media. US civil rights activist Jesse Jackson said the authorities' serach of of the Neverland Ranch with dozens of policemen had been immoderate: "That was an overkill. We have severe reservations on how the district attorneys of Santa Barbara handle this case."

Mark Allen, another civil rights activist, wrote the following in an article: "The two biggest stories when it comes to adults allegedly taking advantage of youth of course have to be Michael Jackson and Priests of the Catholic church. But I am compelled to ask if "one set of rules" are being applied in the manner of investigation an the media response? I am trying to recall if during the many challenges to the Catholic church, did in fact 70 police cars with forensic officers swarm around the churches or homes of the priests facing the allegations? Was there an hourly update by the national press as to the wherabouts of the priests facing allegations? Were the priests forced to surrender any passports or pay any multi-million dollar bonds to authorities in order to remain free? Did the media force the priests or church or related groups to cancel any of their planned activities that had already been assigned? Did the announcement of the allegations against priests coincide with any major church actvitity? [...] Why would we allow CBS to cancel Jackson's TV show, at a time when the public is making his latest record sales at number one? That same public would certainley watch his TV special when it aired. [...] So why treat Jackson any different when his guilt or innocense won't be known for some time? "District Attorney Tom Sneddon's cheerful smile at Wednesday's press conference announcing the latest child-molestation accusations against Michael Jackson said it all. This case is personal. With 33 years of experience as a district attorney behind him, Sneddon is certainly a professional, but he showed unusual satisfaction in issuing an arrest warrant for the pop star. The apparent vendetta most likely stems from two events. Sneddon was the prosecutor on the child-molestation case against Jackson 10 years ago, only to find himself without a victim willing to testify when Jackson reached a multimillion-dollar settlement with the alleged victim's family (that case led California to change its laws so that child-molestation victims could be compelled to testify). Secondly, Jackson later attacked the district attorney in his music. Jackson's 1995 double album, HIStory: Past, Present and Future, Book 1, includes a song called D.S. featuring the chorus, "Dom Sheldon is a cold man," according to official lyrics. His pronunciation of the title character, however, sounds much closer to "Tom Sneddon is a cold man." In the opening verse, Jackson sings, "They wanna get my ass/ Dead or alive/ You know he really tried to take me/ Down by surprise." Other verses includes the lyrics, "He out shock in every single way/ He'll stop at nothing to get his political way," and "You think he brother with the KKK?/ I know his mother never taught him right anyway/ He want your vote just to remain DA." The district attorney, a father of nine, is known for his take-no-prisoners courtroom demeanor, which earned him the nickname "Mad Dog" early in his career, according to the NDAA. Sneddon served in the Vietnam War and worked at the Los Angeles district attorney's office but has been with Santa Barbara County since 1969. He was elected district attorney in 1982 and has been re-elected ever since, prompting the local newspaper to call him "arguably the single most powerful person in all of Santa Barbara County." Please note, the raid on Neverland may simply be due to the prior investigation being held in "open" status (as announced by Sneddon a few years ago), which would allow any future allegations to be immediately investigated with little or no evidence. So, it may be that no "probable cause" existed in this incident (needed in most issuance of search warrants).

Michael is innocent. The outrage that prompts this continued persecution is from not being able to control Michael. His fame and "defiance" (not needing to comply even to appease his critics) frightens them. Sneddon and Diamond are now back in the spotlight after 10 long years. They woke up every morning looking for something to damage Michael with and now they are surely in heaven. But in reality, their souls are bound in hell. Of all the articles we found, one by Michael's long-time foe may be one of the most enlightening and supportive. Though he claims that the original allegation was settle "before it reached the arrest stage" (incorrect since a settlement cannot halt an "arrest stage," I thought it was worth sharing. We have seen Friedman go from vicious attacker to almost a closet supporter.

But he is correct, Michael has footage of almost every moment of his life, and according to his attorney Oxman, he has had someone present at all times just to prevent this type of charge ever coming to anything in the future. The controversial Martin Bashir documentary about Michael Jackson that aired last February on ABC may now come back to haunt him.

The whole world knows by now that the Santa Barbara sheriff�s department and other arms of the law have been combing over Jackson�s Neverland Ranch since early Tuesday morning. The Santa Barbara district attorney, I am told, �is determined to make a case stick.� He is even said to have sequestered the family of a 12-year-old boy who may have made a complaint against Jackson.

Rumors of an arrest warrant for Jackson, who has been in Las Vegas for three weeks filming a new video, began to swirl by Tuesday evening. Calls to Jackson�s lawyer and the Santa Barbara sheriff�s office were not returned.

But the real irony here is that Jackson may have filmed evidence that will either save him or hurt him if such a case proceeds through the courts. Unlike the story a decade ago when he was branded a child molester and settled a case out of court, this story may have been documented. First, Jackson let Bashir follow him with cameras for months before selling his documentary around the world. Then it turned out Jackson was filming the filming, with miles of film shot by all parties. Police will be examining everything from those films, including all the interviews and Jackson�s interactions with others, to search for clues about these latest allegations.

In a statement issued Tuesday evening, Jackson decried all the self-appointed friends and spokesmen who took to the airwaves today in his defense. Some of those friends, as with most celebrity cases, are turning into paid consultants to various TV shows. Among those who�ve suddenly bobbed up on the air: Shmuley Boteach, the shamed rabbi who ran a shady charity with Jackson for a short time. The two have actually not been on any terms for more than a year. A Jackson insider, hearing that Boteach had started giving interviews, literally shrieked with horror: �I hate that guy. He�s not Michael�s friend. Someone should tell him to shut up, already.�

Earlier Tuesday afternoon, there was some speculation that Jackson�s new problems stemmed from the infamous 10-year charges brought by the son of a Los Angeles dentist-screenwriter. That case was settled before it got to the arrest stage, with Jackson paying the boy�s family a reported $20 million. Last spring I reported that the boy�s story had been questioned in a detailed 1994 GQ magazine article. Both the boy and his father have since purchased multimillion-dollar homes.

Another theory about the Jackson case is that it may have something to do with jailed Hollywood private eye Anthony Pellicano. Only a couple days into his 27-month sentence for wire tapping, Pellicano is thought to be negotiating with federal authorities for an early release. His leverage may be files on celebrities he investigated or worked for, implicating them while freeing himself.

�There may be a long line outside the D.A.�s door of people who want immunity,� a source said last night. Already, several high-profile figures, including attorney Bert Fields, have admitted that they�ve been questioned about the work Pellicano did for them.

But Jackson�s case may not be so complicated in the long run. By simply ignoring criticism and openly entertaining children in his house - and in his bedroom - he may have set himself up for this investigation. The fact that so much of the last two years is on film may have seemed normal to him as a person who lives in the public eye. But to the police, all that publicity may very well seem like nothing so much as evidence.

But as I wrote in this space yesterday, a lot of the evidence in the Jackson case will come down to videotape. There is lots of it, too, some of which may show the boy and his family singing the praises of Jackson, defending and explaining his odd lifestyle. If so, they will be hard-pressed to explain their own behavior now. For example: In one interview last winter, the mother of the boy told a reporter: "Michael has pet names for all of my children, and [one of them] even calls him Daddy. He is the father they never had." She said all her children were "hoping to spend a lot more time with him in the future." Here's one big P.S. for all you Jackson watchers: Steer clear of on-camera commentators who are hustling their own gig on Jacko's back. I am talking about folks like Shmuley Boteach, Uri Geller and Brian Oxman, all of whom are quick to quip when the red light goes on, but know nothing about the case, Jackson or his alleged victim." Positive Media Coverage For The King Of Pop

Hunting Season Open: Ducks, Rabbits, Deer, Michael Jackson...

Some things in the media are very predictable, almost laughably so. Take the results of any reality TV dating program. Viewers know, long before the final rose is given out, who the Bachelor is going to choose. But because network bigwigs know how boring our own little lives are, they give us something to live for in the form of a "multinude" of bodies romancing via a hot tub. How considerate, how thoughtful, how ratings oriented.

How about the predictability of celebrities popping up in ads for everything from telephone service to Twix bars? Take Old Navy ads for example. I had still not figured out the whole Morgan Fairchild connection from last season, when what to my wondering eyes should appear? A Lil Kim rapper dressed up in ski gear. Lil Kim? Sweaters? Cargo pants? A bra? Yeah, I'm believing that this icon of "you are what you don't wear" is out clubbing in snow boots and a fleece hoodie.

OK, maybe I didn't see that coming, but there is one recent occurrence that simply has not surprised me at all. It was only a matter of time. A cyclical event, akin to full moons and celestial bodies. Only what is blinding me is not a solar eclipse, but the burning in effigy, once again, of a superstar.

Michael Jackson, accused of child molestation. And while the word accused should imply the pointing of a finger and what should be an "innocent until proven guilty" mentality, the media has done what they do best. They have displayed a willingness to forgo even a modicum of neutrality or objectivity, in favor of ratings. Sell the sizzle, not the steak guys, because when all is said and done, just like last time, that's all there is going to be.

As predictable as "Open Season" on Mr. Jackson has become, what is most notable is the fact that it has taken this long for another unscrupulous set of adults to emerge, willing to use a child for monetary gain. I mean what's a little pimping of your own child if you can grab millions of dollars? What it is, complete lack of evidence aside, is a very telling sign that some people are unscrupulous, unfeeling and undeserving to parent the children they exploit.

I said it last time, if I truly believed that someone had abused my child in any way, the only thing I would want are their eyeballs on a stick. No amount of money would ever make me "go away".

I don't think people realize how easy it is to level an allegation of this type and destroy a person's life. Anyone, at any time can go to authorities and accuse another person of molestation of a child. It is a serious, no tolerance crime, as well it should be, and one that must be taken seriously by prosecutors. And even in those instances when all investigations are exhausted and a person is proven innocent, the damage is irreversible.

But the dividends for the accuser can be just as life altering.

Millions of dollars are an appealing prospect to anyone, but personally I'd rather take my chances on a lottery ticket, not a person's life. Unfortunately for the people behind these current accusations, and I say people, because it is not the child spearheading this assault, they may have to settle for lottery tickets too. Michael Jackson will not throw money again to make people go away and regain some peace in his life. Once blackmailed, twice shy, you know. That's not to say he won't be found guilty of certain things. They will dig and find he is a serial humanitarian. They will investigate and come up with evidence to prove he is the 20th century's leading champion of children around the world. And they will run every forensic test possible and come up with the irrefutable proof that he is human, just like you and me. And in the end, they will once again discover, much to their embarrassment, that he is not guilty. So even though they have declared open season on Michael Jackson, they'd better watch how they take aim. Misloaded weapons have a way of backfiring.

In fact, Jackson's side will likely argue that when he tried to break off his involvement with helping the boy and his family financially, the mother became, and I am quoting a Jackson insider, "a scorned woman."

"She's very screwed up," said one source. "There's videotape of her acting weird, too. And Michael was very kind to her, even getting an apartment for her boyfriend."

But the argument will be that when this woman, who is financially so dependent that she claimed to have lived in a barn, was told by Jackson's people that the party was over, she ran to a lawyer to see what she could get out of it.

Remember, everyone in this country is guaranteed a defense, even if you don' t agree with it.

But as I wrote in this space yesterday, a lot of the evidence in the Jackson case will come down to videotape. There is lots of it, too, some of which may show the boy and his family singing the praises of Jackson, defending and explaining his odd lifestyle. If so, they will be hard-pressed to explain their own behavior now. For example: In one interview last winter, the mother of the boy told a reporter: "Michael has pet names for all of my children, and [one of them] even calls him Daddy. He is the father they never had." She said all her children were "hoping to spend a lot more time with him in the future."

The sudden change in Jackson's schedule, by the way, throws a monkey wrench into his promotional plans for his new greatest hits album. Michael and his entourage were three days away from leaving for Paris and Berlin, where enthusiastic fans would have greeted him. Here in the U.S., the album has so far not made any of the early top 10 of the week lists at major retailers like Tower, Virgin or HMV.

And here's one big P.S. for all you Jackson watchers: Steer clear of on-camera commentators who are hustling their own gig on Jacko's back. I am talking about folks like Shmuley Boteach, Uri Geller and Brian Oxman, all of whom are quick to quip when the red light goes on, but know nothing about the case, Jackson or his alleged victim.
