This is the last Will and Testament of me Thomas Horobin of the Royal Oak Inn, Sparklow in the Township of Hartington Middle Quarter and Parish of Hartington in the County of Derby, farmer and inn keeper.
First I direct that all my debts, funeral and testamentary expences to be paid by my executors herein after named with all convenient speed after my decease and after payment thereof, I give, devise and bequeath, direct, limit and appoint all and singular, my real estate and my household furniture, stock, money and all other of my Personal Estate whatsoever and wheresoever unto my wife Martha Horobin, to Benjamin Horobin of Stiff Close in the Township of Longnor and Parish of Alstonefield and County of Stafford, farmer and to William Kidd of the Street Farm in the Township of Hartington Middle Quarter, Parish of Hartington and County of Derby, farmer, their heirs and assigns upon trust as soon as conveniently may be after my decease.
First I leave to my wife Martha Horobin, the tithe rent charge payable to me of the Farm at Under Whitle in the Parish of Sheen and County of Stafford, now in the occupation of Benjamin Mellor, amounting to the yearly payment of thirteen pounds, eighteen shillings and sixpence, during the course of her natural life, and I also leave to her the whole of the household furniture including beds and bedding that she had when she became my wife, and also the whole or any part of the furniture that is now in my possession for her own use and disposal, and also for her to reside in this house where we now live as long as she may think proper after my decease.
I next leave to my brother William Horobin now residing at Buxton in the County of Derby at my decease, the possession of the house and land situated at Sparklow and Hurdlow now in my occupation with all my stock, hay and corn implements in husbandry and dairy utensils with any article of furniture my wife may leave therein and also at the decease of my wife, I likewise leave to my brother William Horobin the income from the tithe that she did receive from the before named Farm at Under Whitle in the Parish of Sheen and County of Stafford, subject to the payment of one hundred pounds to my nephew Michael Frost, son of my sister Hannah Frost now residing in the Township of Sheldon, Parish of Bakewell and County of Derby and the same to be paid twelve months after the decease of my wife.
I next leave to my sister Hannah Frost the yearly income of seven pounds, ten shillings of the piece of land called the Cheesevat situate in the Township of Longnor, during the term of the life of my wife.
I next leave to my sister Kate Houseley now residing at Newton Heath near Manchester, the yearly income of eight pounds paid of the Nab End Farm in the Township of Longnor during the term of the life of my wife.
Next I leave to my brother Edward Horobin of the Heys Farm in the Parish of Sheen and County of Stafford, my share of the sum of money left by my sister Ann Brindley and now lying in the Buxton Bank.
Next I leave to my nephew Thomas Horobin now residing at Manchester, the son of my brother Edward Horobin before named, the possession of the Nab End Farm now in the the possession of James Brindley as tenant and also the piece of land called the Cheesevat now in the occupation of George Salt, and to have the possession of the same after my decease, after the payment to my wife of the sum of 32 pounds per annum during her life. Also to have the weights, beam and scales, cheese rack and all other articles left by my wife at the Nab End Farm.
I also leave to my nephew John Houseley the sum of one hundred pounds, to my niece Elizabeth Houseley the sum of one hundred pounds, and to my niece Margaret Houseley the like sum, all children of my sister Kate Houseley now residing at Newton Heath near Manchester, and the aforesaid legacies to be paid by my nephew Thomas Horobin out of the Nab End Farm twelve months after the time of his being in possession of the same.
I next leave to Charles Horobin now residing at Oxbatch in the Township of Fawfieldhead, Parish of Alstonefield and County of Stafford, son of my brother Robert Horobin (deceased) the house situate at Crowdicote and three pieces of land called the Fullow Knowle, Crowdicote Bank and the third piece called the Townfield situate in the Township of Longnor, Parish of Alstonefield and County of Stafford, and to have the possession of the same at my decease.
I appoint my wife Martha Horobin of the Royal Oak Inn, Sparklow, Benjamin Horobin of the Stiff Close, in the Township of Longnor, and William Kidd of Street Farm, Executrix and Executors of this my Will and hereby revoking all former Wills by me at any time made heretofore. I declare this to be my last Will in witness whereof I have hereunto set my hand, this ninth day of March, one thousand eight hundred and seventy six. ----- Thomas Horobin --------- Signed, published and declared by the said testator Thomas Horobin as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names.
