| Release As part of the consideration for being allowed to participate in a tennis tournament, the undersigned agrees that neither the Somerset County Park Commission (SCPC) nor the County of Somerset, any director, officer, employee, agent or representative or division of the SCPC, the County of Somerset nor any of their respective successors or assigned (collectively, including the SCPC, the "Representatives") shall be liable for any loss, damage, injury or claim of any kind to person or property arising from or caused by participation by the undersigned in tennis activities including, without limitation, any loss, damage or claim arising from the accident or casualty involving the undersigned whether or not on or off the Representative property. | |||||||||||||||||
| Waiver and Indemnification The undersigned herby waives all claims and demands against the Representatives and each of them for any loss, damage, injury (including death) or claim any kind arising from, related to or caused by participation by the undersigned in the Activity and agrees to indemnity, defend and hold harmless the Representatives from all loss, liability, damages, costs and expenses (including actual attorney's fees) arising from or related to same. | |||||||||||||||||
| This Release and Waiver has been carefully read by the undersigned and the contents of this document are understood by the undersigned.� This Release and Waiver shall be effective for all tennis activities in which I or my dependent participates in throughout the entire calendar year.� The undersigned freely executes this document. | |||||||||||||||||

| Acceptance of my entry in the 2003 Garden State GLBT Tennis Tournament is without assumption of responsibility of any kind by any individuals and/or clubs associated with its organization. I agree to waive any and all rights and claims for bodily and emotional injury, damage to my reputation, or any other harm I might suffer. I also understand that there may be unforeseen hazards, objects, and other matter on the playing surface, and I participate at my own risk and with the assumption of all risks, implied and expressed. I also waive any and all rights to claim against the Tournament, or any individuals and/or clubs associated with its organization, for damages which may arise as a result of references of photographs of me which may appear in publications or any media coverage of the tournament. | |||||||||||||||||
